Upon roll call the following were found to be present: MAYOR: Pete Muldoon COUNCIL: Hailey Morton Levinson, Bob Lenz, Don Frank, and Jim Stanford. A compliant pedestrian walkway shall be provided that safely connects the north wing of the building to the West Broadway sidewalk. Option 1. The applicant shall work with the Town Attorney to dedicate the 6-foot bike path as a public pathway. Additionally, applicant shall work with Planning Staff and the Teton Conservation District to provide a public amenity at the bike path s terminus such as a bench and viewing platform. 2. Prior to approval of the Sketch Plan, the applicant shall provide a site plan that shows a pedestrian connection (e.g., stairs from the upper parking tier to the lower tier and front door of the building. Option 1. Stairway connection. Prior to approval of the Development Option, the applicant shall modify the site plan to show a stairway connection from the upper parking tier to the lower tier and front door of the building similar to the site plan presented to Council on June 27, The applicant shall provide two screening walls on the West Broadway frontage that vary between 4 and 2 tall to screen the main parking area. Each wall shall be 4 tall for the first 50% of the wall (starting from the project entrance and then taper to a minimum of 2 tall at the north and south ends. Each wall shall be made of stone veneer or other similar decorative material. 4. The applicant shall obtain an encroachment permit for any proposed landscaping in the WYDOT Right of Way. 5. On-site management is required with 24-hour contact information prominently posted in the building and distributed to all tenants. A primary responsibility of on-site management is to enforce internal policies of the project and to address any conflicts with or complaints from surrounding property owners about impacts from the project. 6. The applicant shall revise the proposed elevations for review and recommendation by the DRC prior to Development Option Plan approval to incorporate the overall massing including roof overhangs and bracing elements shown on the October 3, 2016 renderings to address the Design Guidelines related to Massing, Composition and Texture. 7. The applicant shall be required to present final materials and color palette to the DRC for review and recommendation prior to approval of a Development Option Plan for the project. The proposed materials shall include synthetic materials and metal or natural wood to achieve better texture and contrasting composition. 8. Prior to approval of the Development Option Plan, the applicant shall provide a revised landscape plan that deletes all non-native sod areas from the 25 creek buffer area. In addition, prior to approval for the Development Option Plan, the applicant shall consult with the Teton Conservation District (TCD to ensure that the proposed hardscape creek access areas are consistent with TCD best practices. Furthermore, in the future event that the Town sewer line located in the creek buffer is replaced, the applicant shall cooperate with the Town, the TCD, and other relevant parties to ensure that the creek buffer is restored for the purpose of enhancing wildlife habitat and improving water quality. 9. The applicant shall delineate the 25 creek buffer with temporary fencing during the construction period of the project to ensure that no apartment building related construction activities encroach into the creek buffer, except that this fencing is not required if the Town sewer line on the property is replaced at the same time as the apartment building is under construction. 10. Prior to approval of the Development Option Plan, the applicant shall identify which 32 units will be deed-restricted as required workforce housing. 11. If the Town becomes aware, either through neighbor complaint or its own investigation, that parking for the site is inadequate and causing significant neighborhood conflicts, the Town Council shall review the parking plan and may require the applicant to implement operational changes (e.g., increased parking fees, formal shared parking agreements, additional guest parking, etc. to reduce parking conflicts to acceptable levels. 12. Snow shall be managed on the site to ensure that adequate parking is maintained throughout the season and no snow shall be stored in the 25 creek buffer. 13. Prior to approval of the Development Option Plan, the applicant shall revise the site plan to provide a continuous sidewalk on the entire front of the building, unless it can be demonstrated that this sidewalk would cause a significant operational problem with the project. 14. Prior to approval of the Development Option Plan, the applicant shall revise the site plan to provide some type of physical barrier (curb stops, fence, wall, etc. to prevent encroachment from car overhangs into the 8 pathway and this shall be done in consultation with the Pathways Director. 15. The applicant shall obtain approval from the Town Engineer and State of Wyoming to change the point of diversion of the Lime Kiln Ditch prior to approval of the final Development Option. Failure to obtain either approval shall result in the submittal of a revised site plan for review by the Town Council. 16. Prior to approval of the Development Option Plan, the applicant shall provide a detailed lighting plan that is consistent with the LDRs and designed to minimize negative impacts on mule deer movement and habitat consistent with the TCD s comments. In particular, the overhead street lamps should be minimized as they are unnecessary, especially with the reasonable use of wall lighting and light bollards. 17. The Development may not be converted to condominiums. Mayor Muldoon called for the vote. The vote showed all in favor and Item P17-025: Fee waiver request for 550 W. Broadway. Paul Anthony and Tyler Sinclair made staff comment. A motion was made by Hailey Morton Levinson and seconded by Bob Lenz to request to waive the $7,000 fee for Joe Rice/Goal LLC for the development review fees associated with an upcoming application for Sketch Plan/ Development/PUD for a 90-unit apartment building per Ordinance 939. Mayor Muldoon called for the vote. The vote showed all opposed and the motion failed. Town Zoning Update: Character Districts 3-6 Neighborhoods & Corridors. Tyler Sinclair, Alex Norton, and Paul Anthony made staff comment. Public comment was given by Jim Wallace and Arne Jorgensen.
