1 1 Article I. NAME AND AUTHORITY Section 1 NAME Let it be known that the name of this club shall be the Kansas State University Parachute Club (KSUPC). Section 2 AUTHORITY (a) The KSUPC is a UNIVERSITY COMMUNITY organization formed for the benefit of Kansas State University students, faculty, staff, and community persons living in the surrounding area. The KSUPC is registered with, and operates under the authority of the University Activities Board. KSUPC officers and members are obliged to adhere to the requirements and provisions of the University Activities Board Constitution and By-Laws (current edition). (b) The KSUPC is a United States Parachute Association (USPA) Group Member. The KSUPC is committed to ensuring safe and enjoyable parachuting activities for all members through strict compliance with the provisions of the USPA safety and training publication: The Skydivers Information Manual. The KSUPC will maintain its association with the USPA and its status as a USPA Group Member on a continuing basis. Article II. OBJECTIVE The KSUPC is a non-profit University Community organization established to foster and encourage sport parachuting (known colloquially as skydiving) at Kansas State University and within the surrounding community. It is the objective of the club to provide training, equipment, and supervision to those students and community persons interested in sport parachuting and/or participation in local, regional, and national sport parachuting competition. 28 Article III. MEMBERSHIP Section 1 MEMBERSHIP REQUIREMENTS Any Kansas State University student, staff, or faculty member, or community person is eligible for membership in the KSUPC providing the following requirements are met: 1 of 10

2 (a) Administration. Prospective members must provide detailed personal information, sign required forms or complete other administrative actions as may be stipulated by the club. Administrative actions will include, but not be limited to, the execution of a waiver releasing the KSUPC and all club officers, members, instructors, jumpmasters, pilots, aircraft owners, property owners, or others as may be deemed appropriate, from any and all legal liability (b) Age. Members of the KSUPC who wish to participate in sport parachuting activities must be 18 years of age. (c) USPA Membership. Members must belong to the USPA or agree to become a USPA member within 30 days of reaching freefall status. (d) Fees. The KSUPC is a non-profit organization. Dues, training, and other fees will be established, however to defray costs associated with instruction, equipment maintenance, USPA Group Membership and other operating expenses as deemed essential to safe and efficient operations. (e) Inexperienced Members. Inexperienced/untrained prospective members must agree to pay established training fees and undergo instruction in a first jump course before engaging in skydiving activities with the club. (f) Experienced Members. Persons with previous skydiving experience who desire to become KSUPC members or engage in skydiving activities with the KSUPC must present proof of experience level to designated KSUPC officials in the form of a USPA log book, USPA membership card and USPA class A, B, C or D license prior to being authorized membership or parachuting activities. (g) Community Person Membership Ratio. At no time shall the total membership of university persons be less than 80%. Section 2 CLASSES OF MEMBERSHIP The membership shall be divided into the following classes. 2 of 10

3 (a) Active Members. Those members who have paid dues and meet skydiving currency requirements as stipulated by the club shall be recognized as active members. (b) Associate Members. The semester a person trains he or she is considered an associate member. Upon returning to the KSUPC and paying dues a following semester, to include gaining membership in USPA, he or she will be recognized as an active member. (c) Honorary Members. Those persons whom by majority vote of the active members are determined to be worthy, based on support, position, or outstanding acts, may be extended honorary membership. (d) Non-Jumping Members. Dues paid members who do not maintain skydiving currency standards as stipulated by the club will be considered non-jumping members. Section 3 PRIVLEDGES (a) Voting. Active members shall be entitled to vote in club elections and on club business. Associate, Honorary, and Non-Jumping members will not have voting privileges. (b) Equipment Usage. All classes of membership shall have equal rights to use club equipment, subject to applicable equipment usage fees established by the KSUPC. Article IV. ADMINISTRATION The KSUPC will establish a written procedures manual to ensure safe and efficient club operations. The procedures manual will be reviewed and approved by the Executive Committee of the KSUPC annually. The provisions of the procedures manual shall be binding on all members or persons involved in skydiving operations under KSUPC control. The procedures manual may be amended at any regular or special meeting by a two-thirds vote of the active membership. The proposed amendment must be introduced in writing prior to voting. The procedures manual will include, but not be limited to, the following essential areas: 3 of 10

4 (a) Administration (b) Financial Management (c) Safety (d) Operations & Training (e) Equipment Maintenance & Accountability (f) Aircraft Operations Article V. GOVERNING BODIES The KSUPC shall be governed by club officers, an executive committee, and the membership. Section 1 OFFICERS The KSUPC shall establish the following elected club officer positions: President, Vice President, Secretary, Treasurer, and Club Safety Officer (CSO). Officers shall be elected on an annual basis. At least 50% of the officers must be university persons. Section 2 EXECUTIVE COMMITTEE The Executive Committee shall consist of the President, Vice President, Secretary, Treasurer, Club Safety Officer (CSO) and two (2) members-at-large. Club officers shall serve on the executive committee during their term in office. Two members-at-large will be elected to the executive committee on an annual basis at the same time club officers are elected. KSUPC Officers and elected members-at-large duties will include, but not be limited to, the following: (a) President Shall be responsible for, and supervise, KSUPC activities and operations. Shall be an active member, preside over meetings and represent the club to the public. Shall be elected for a 12 month term by vote of the membership 118 (b) Vice-President Shall be responsible for KSUPC administration. Shall be responsible for maintenance and accountability of KSUPC equipment 4 of 10

5 Shall be an active member of the club, and assume the duties of the president in the president s absence. Shall be elected for a 12-month term by vote of the membership. 125 (c) Secretary (v) Shall maintain minutes of all KSUPC activities and club meetings Shall maintain records and detailed information on club membership, personal data, safety or other areas of administration as may be necessary. Shall prepare correspondence as required for smooth functioning of KSUPC affairs. Shall be an active member of the club. Shall be elected for a 12-month term by vote of the membership. 134 (d) Treasurer (v) (vi) Shall server as the KSUPC financial officer, ensuring a ledger is kept of all financial transactions of the club. Signatures of both the president and treasurer shall be required on checks for expenditures in excess of $ Shall collect, record, deposit and inform the secretary of dues paid. Shall provide oversight of skydiving manifest procedures, ensuring all monies due are collected, recorded and deposited. Shall pay club bills, separate money into established funds or carry out other specific financial actions as stipulated by the membership. Shall be an active member of the club. Shall be elected for a 12-month term by vote of the membership. 146 (e) Club Safety Officer (CSO) Shall serve as the final authority on safety in skydiving for the KSUPC. Shall supervise KSUPC skydiving training, operations, member proficiency, and adherence to basic safety requirements and established procedures. Shall have the authority to stop individual or club jump operations in the interests of safety. Such decisions may not be overruled without majority vote by the Executive Committee. 5 of 10

6 (v) Shall hold a valid USPA Class C or higher license, be and active member, and be approved by the local USPA Safety and Training Advisor (S&TA). If necessary, and qualified, the President, Vice-President, Secretary, or Treasurer may fill the position concurrently with his or her elected position. Shall be elected for a 12-month term by vote of the membership. 159 (f) Elected Executive Committee Member-at-Large The number of elected executive members-at-large shall be established at two (2). Shall be active members. Shall be elected for a 12-month term by the membership. Shall serve as equal members of the Executive Committee to carry out KSUPC business Section 3 MEMBERS (a) Members will obey all safety or other rules or procedures established for safe and efficient operations. (b) Members will be responsible for all club property or equipment in their possession. (c) Members shall ensure that the Executive Committee executes club business in a professional manner. Club officers and/or members of the executive committee may be impeached. Section 4 COMMITTEES A Public Affairs Committee and a Training Committee will be established as standing committees. Other committees may be formed as required. (a) Public Affairs Committee The Public Affairs Committee shall consist of five (5) members: the President (chairman), Vice-President, Secretary, Treasures and one member appointed by the general membership. The Public Affairs Committee will carry out the recruiting and publicity programs of the club and conduct business with Kansas State University or other entities as required in furtherance of club business. 6 of 10

7 186 (b) Training Committee The Training Committee will consist of a minimum of five (5) members: the President, Vice-President, Club Safety Officer (chairman) and two members appointed from the membership at large. Certified jumpmasters and instructors will be assigned to this standing committee. The Training Committee will coordinate and supervise all aspects of safety and training related to skydiving activities in accordance with applicable safety requirements Section 5 VACANCIES OF OFFICE The membership will be advised in writing of vacancies in any elected office. Elections to replace vacant offices must be announced on meeting prior to actual elections. Officers so elected will serve until the expiration of the present term. The KSUPC President may assign a member temporarily to a vacant office until elections are held. Article VI. FACULTY ADVISOR The KSUPC will have a faculty advisor to help maintain continuity within the club from year to year, to assist in administrative and procedural matters as required, and to serve as a contact between Kansas State University and the club. Additionally, the faculty advisor is required by the University Activities Board to be cognizant of all organizational activities, be aware of the financial status of the organization, and periodically affirm that the organization meets specified membership and other requirements. Article VII. FEES Section 1 PURPOSE Members will be required to pay certain fees established at the discretion of the club to pay for equipment maintenance and club activities. The following standing fees will be charged. Other fees may be assessed as required. 7 of 10

8 (a) Dues. Semester dues shall be charged to all active, associate, and non-jumping members. Dues ensure membership and authorized use of club equipment. Payment of dues for the spring semester shall be considered payment of dues for the summer. If a person pays dues during the summer term, this payment shall be considered payment for dues during the fall term as well. Failure to pay dues will cause an individual s name to be stricken from the membership rolls. (b) First Jump Course Fee. Before training to make a first jump, a person may pay a training fee established by the Training Committee and approved by the membership. (c) Re-Training Fee. Individuals on student status who have taken the first jump course and made one or more jumps, but have lapsed in currency, will be required to pay a fee established at the discretion of the club to cover refresher training and supervision. (d) Equipment Rental. Members wishing to use club equipment will be required to pay fees established at the discretion of the club to defray costs of equipment maintenance and replacement. Section 2 REFUND POLICY (a) No Fault. Fifty percent (50%) of the first jump-training fee will be refunded to persons who undergo the classroom phase of instruction but fail for any reason to make their first jump. If a refund is granted for any reason, yet the individual still desires to make a first jump, he or she may do so within 90 days of the first jump course by paying back the balance of the training fee and undergoing refresher training. (b) KSUPC Fault. A 100% refund will be granted in those cases it is determined that the club s action or inaction resulted in an individual not being able to make a first jump. Article VIII. FINANCIAL MANAGEMENT KSUPC funds will be deposited in an account(s) at a local Manhattan, Kansas bank. The Treasurer shall manage club funds under the supervision of the President. The Treasurer will carry out his or her duties in accordance with the provisions of the constitution and those written policies and procedures established and approved by the club. Article IX. MEETINGS Section 1 QUORUM Two-thirds of active membership constitutes a quorum. 8 of 10

9 Section 2 STANDING MEETINGS (a) Regular Meetings. Regular meetings will be established at the discretion of the membership. Written notice listing the location and time of meetings will be provided to all members in order to ensure maximum participation. (b) Elections (v) Elected office nominations will be announced in writing not less than on meeting prior to the meeting in which nominations are forwarded and recorded. Elected office elections will be announced in writing not less than one meeting prior to the annual elections. Annual elections for elected office or positions will be scheduled for the first full week in April. With a quorum present, only a simple majority vote will be required to elect an officer. The Secretary will call the roll of the active membership to establish and duly record that a quorum is present at the election meeting. 270 (c) Special Meetings Article X. Special meetings may be called by the Executive Committee for the purpose of amending the constitution, conducting interim elections based on special circumstances, administering discipline, instigating impeachment proceedings, or any other critical purpose deemed necessary. Not less than two weeks written notice will be provided the membership of the club noting the time and location of special meetings. Action directing that which may reasonably be considered to be significant modification of existing policies and procedures, or action against any individual may not be taken at any special meeting unless a quorum is present. DISCIPLINE Section 1 PURPOSE The KSUPC may administer discipline, up to and including denial of membership. Discipline will conform to procedures established and published by the membership. 9 of 10

10 Section 2 REASONS FOR DISCIPLINE Discipline may be administered for, but not limited to, the following reasons. (a) Failure to Obey Safety Requirements. An individual may be disciplined in accordance with established procedures for failure to obey applicable safety procedures. (b) Malfeasance. A club officer or other elected individual maybe impeached as deemed necessary by the membership. Article XI. DISSOLUTION In the event of dissolution of the club, all monies and assets shall be disposed of in accordance with the desires of the club. Article XII. RULES The rules contained in Robert s Rules of Order Revised shall govern the KSUPC in all cases to which they are applicable and in which they are not inconsistent with the club constitution or published procedures. Article XIII. AMENDMENTS This constitution may be amended only by special or regular meetings where a quorum is present. Not less than two weeks written notice will be provided the membership of the club noting proposed changes to the constitution. REVIEWED AND APPROVED BY THE MEMBERSHIP OF THE KSUPC THIS DATE.
