1 NATIONAL INTERSTATE COUNCIL OF STATE BOARDS OF COSMETOLOGY 2014 ANNUAL CONFERENCE AUGUST 23-25, 2014 CHARLESTON, SOUTH CAROLINA CONFERENCE MINUTES SATURDAY AUGUST 23, :00 a.m. 10: 15 a.m. Opening Ceremony Breakfast Sponsored by Super Cuts The General Session was called to order by President Melanie Thompson at 10:30 AM. Leisa Stuart McElreath took the roll, and determined that there were 27 States present including the District of Columbia. Debra Norton presented the Conference Credentials report and advised that 26 states including the District of Columbia have voting privileges with the Associate Members from Arkansas, Kansas, Maine, Minnesota, Nevada, North Carolina, Virginia and Washington authorized to vote by proxy by their respective States. Leisa Stuart McElreath presented the Conference Rules. South Carolina moved to approve, seconded by the District of Columbia. Motion carried. Oklahoma moved, District of Columbia seconded, to approve the Conference Agenda authorizing the President to deviate from the agenda as warranted. Motion carried. South Carolina moved to approve the 2013 Conference Minutes, Oklahoma seconded. Motion carried. President Thompson appointed the Nominating Committee, Angie Printz (MT-Region 3), Chair; Anwar Saleem (DC Region 1), Kelli Kersey (AR-Region 2), LaFaye Austin (OK-Region 3) and Susan Colard (WA Region 4). Leisa Stuart McElreath presented the Election Procedures. District of Columbia moved to approve the Election Procedures. Oklahoma seconded. Motion carried. Mr. Corley explained the privileges extended to the Associate and Honorary members advising that neither class of membership is allowed to nominate a candidate or vote for a candidate for office but they may give nominating and seconding speeches (since the candidate has already been nominated) or speak against a candidate. President Thompson delivered her President s Report to the delegates. President Thompson introduced Rosanne Kinley, Chairman of the Education Committee. Rosanne Kinley introduced her Committee as follows: Robyn Barineau (FL), Becky Brockmann (IA), Fran Brown (UT), Mary Finnegan (MN), Kay Kendrick (GA), Pam Martin (OK), Dennis Schildhauer (WY), and Sharon Young (DC). Rosanne Kinley provided an overview of the education program and requested that all delegates complete the evaluation forms contained in the conference program and turn the evaluation forms in before leaving the conference. Christopher Venesky, Low Country Stylist Communication Success The rise and fall of most businesses is the lack of communication. Communication with peers and staff has to be very clear in order for growth to happen. 2 General Session reconvened at 2:30 p.m. Infection Control Procedures Proposed Changes Leslie Roste RN, Barbicide This presentation provided a review of the proposed changes to the NIC Wet Disinfection Standard as well as the Blood Exposure Procedure. In addition, there was an update on what states are doing in terms of Infection Control Rules. Are You An Effective Leader? Gerard McAvey, Milady We ve previously had discussions about effective communications and how best to incorporate these skills depending on various styles. So, what about your leadership skills? Just like an effective communicator, an effective leader needs to assess their own abilities along with their teams abilities, and your team in general. Regulatory Reform Lynda Elliott, Executive Director/NC Board of Cosmetic Arts Examiners Occupational licensing and deregulation has top billing with legislators. The legislators are calling for broad scale reform indicating it can strengthen competitive advantages. Ms. Elliott addressed the concepts of the need to work together and establish uniform infection control procedures and minimal education to ensure the health, safety, and welfare of the client and the professional. This session focused on the benefits of NABBA and NIC working together. The talking points covered were Standardize Barber, Cosmetology, Specialty requirements; Standardize CEUs throughout the U. S. or members States; Strengthen the overall Industry; Oppose deregulation (strength in numbers); Assist all state members with legislative regulation issues. Policy Decisions that affect our Industry Anthony Fragomeni, AACS A report and update on how policy decisions being made in Washington, DC are affecting our Industry was presented. Legislative Updates Leisa McElreath, NIC Legislative Committee Chairman This session focused on states legislation changes during the past year. Attendees were given an opportunity to discuss legislative changes/experiences in their state. "Development of the NIC Examinations: Planned Change Following the Profession Dana Pancoe, SMT This presentation provided an overview of the rigorous process employed to assure that the NIC licensing examinations are valid and reliable measures of professional practice. Topics covered included the importance of NIC NATIONAL CONFERENCE AUGUST 23-25, 2014 CHARLESTON, SOUTH CAROLINA Page 2
3 using subject matter experts, ongoing performance of job analysis studies, quality control steps used in test construction and production, and how the passing score is established. 11:15 a.m. 12:30 p.m. - CONCURRENT SESSIONS WERE REPEATED. Office of President The Nominating Committee nominated President Thompson for the office of President. Mr. Corley called for nominations from the floor three times; hearing none the State of South Carolina called for the question and President Thompson was elected President by acclamation. Office of Vice President The Nominating Committee nominated Bill Helton for the office of Vice President. Mr. Corley called for nominations from the floor three times; hearing none the State of Oklahoma called for the question and Bill Helton was elected Vice President by acclamation. Office of Secretary/Treasurer The Nominating Committee nominated Leisa Stuart McElreath for the office of Secretary/Treasurer. Mr. Corley called for nominations from the floor three times; hearing none the State of Mississippi called for the question and Leisa Stuart McElreath was elected Secretary/Treasurer by acclamation. Office of Region 1 Director The Nominating Committee nominated Sharon Young for the office of Region 1 Director. Mr. Corley called for nominations from the floor three times; hearing none the District of Columbia called for the question and Sharon Young was elected Region I Director by acclamation. Office of Region 2 Director The Nominating Committee nominated Tracy Smith for the office of Region 2 Director. Mr. Corley called for nominations from the floor three times; hearing none the State of Alabama called for the question and Tracy Smith was elected Region 2 Director by acclamation. Office of Region 3 Director The Nominating Committee nominated Dennis Schildhauer for the office of Region 3 Director. Mr. Corley called for nominations from the floor three times; hearing none the State of Wyoming called for the question and Dennis Schildhauer was elected Region 3 Director by acclamation. Office of Region 4 Director The Nominating Committee nominated Glenda Ledford for the office of Region 4 Director. Mr. Corley called for nominations from the floor three times; hearing none the State of Alaska called for the question and Glenda Ledford was elected Region 4 Director by acclamation. 4 Office of Board Administrator The Board Administrators selected Robyn Barineau as the Board Administrator and the Nominating Committee nominated Robyn Barineau for the office of Board Administrator. Robin Barineau was elected to the office of Board Administrator by acclamation. President Thompson called for the Bylaws Committee Report. Leisa Stuart McElreath, Chairman of the Bylaws Committee, reported that the Committee received no proposed amendments to the Bylaws. President Thompson called for the Honorary Membership Committee Report. LaFaye Austin, Chairman of the Honorary Membership Committee, advised that the committee received one nomination, specifically Myra Jowers from Florida. LaFaye Austin made a motion to elect Myra Jowers as an Honorary Member. Twenty-four written ballots were distributed and collected. Twenty-Three states voted yes; one state abstained. Myra Jowers was elected as an honorary member. President Thompson called for the Conference Site Committee Report. Richard DeCarlo, Chairman of the Conference Site Committee, advised that there were 2 states that applied to host the 2016 conference, specifically Nevada (Las Vegas), and Florida (Atlantic Beach). Each state gave a brief presentation. A vote by the delegates to select the site for the 2016 conference was conducted with the 2 states receiving the following number of votes: Nevada received 9 votes; Florida received 15. Based on the votes by the delegates, the 2016 conference will be held in Atlantic Beach, Florida. Cramp, Esquire Duane Morris LLP Everyone (or nearly everyone!) agrees state regulation of our sector is a good thing. But defending frivolous lawsuits distracts schools and educators from their primary focus of delivering the best possible education to students. Is it possible for state regulations to lead to these frivolous claims? Mr. Cramp, one of the top lawyers representing beauty schools, presented the unintended consequences of state regulations currently unfolding around the country. Marketing Against Deregulation it s Time to be Aggressive Gary Landry, Executive Director Nevada Board of Cosmetology Boards of Cosmetology are continually being evaluated by legislators, attorneys, private interest groups, and the public as to what value they bring to the Cosmetology Profession. If you fail to market your value proposition to all stakeholders, you run the risk of living in a constant defensive posture fending off one challenge after another. Mr. Landry presented a marketing framework, and specific real world examples, on how to execute a proactive marketing campaign to educate all stakeholders on the vital functions that Boards of Cosmetology perform. Included in the presentation was information on the Institute for Justice s views on regulation, how to streamline operations to remove detractor s main arguments for deregulation, how to market to legislators, and how to energize licensees to get the public to support Boards positions. Gosnell 2014 Scholarship candidates: Region 1 Ameca Williams, Georgia Region 2 Dominque Collins, OH Region 3 Maria Patino, Nebraska Region 4 Kelsey Bradbury, Idaho c) Proposed policies amendment: NIC Infection Control and Safety Standards A markup of the proposed amendments to the NIC Infection Control & Safety Standards was distributed to the delegates. The District of Columbia made a motion, seconded by Alabama, to approve the proposed amendments to the NIC Infection Control & Safety Standards. Motion carried. Unanimously. A resolution was read into the record by Leisa Stuart McElreath and was adopted by the delegates. President Thompson adjourned the meeting at 12:30 p.m. 6:30 p.m. Installation Banquet The 2014/15 Officers were installed. Debra Norton received the Aurie J. Gosnell Award.
