2 The plaintiffs hereby disclose the following supplemental information as required by Rule 26.1, Arizona Rules of Civil Procedure. The numbered paragraphs are the same as those in Rule The factual basis of the claim is set out in the complaint. 2. There are two legal theories of the complaint. First, that the Commission violated Article IV, Part 2, Section 1 by adopting a Congressional districting plan having only one competitive district and rejecting plans with more than one competitive district which met all the criteria of Article IV, Part 2, Section 1, Paragraph (14), including competitiveness. Second, the Commission violated Article II, Sections 4 and 13, and Article XX, Section 7, by adopting a Congressional districting plan which discriminated on the basis of race and ethnic origin by concentrating Hispanic voters into Congressional District 4 far beyond the numbers necessary for Hispanic voters to be able to elect candidates of their choice and thereby preventing them from having a reasonable opportunity to influence elections in other districts. 3. The plaintiffs now plan to call the following fact witnesses: a. Dr. Alan Heslop, c/o Jose de Jesus Rivera, Esq., Haralson Miller Pitt & McAnally PC, 3003 North Central, Suite 1400, Phoenix AZ 85012, phone: , will be called to testify regarding the work of the Commission and its consultants, particularly with regard to the outreach work of the Commission, and public input to the Commission, instructions from the Commission to the consultants regarding modifications to and tests 2

3 of Congressional maps, the data used by the consultants and the Commission, and related matters. b. Mr. Douglas Johnson, c/o Jose de Jesus Rivera, Esq., Haralson Miller Pitt & McAnally PC, 3003 North Central, Suite 1400, Phoenix AZ 85012, phone: , will be called to testify regarding the work of the Commission and its consultants, particularly with regard to the outreach work of the Commission, and public input to the Commission, instructions from the Commission to the consultants regarding modifications to and tests of Congressional maps, the data used by the consultants and the Commission, and related matters. c. No statements have been given to these plaintiffs. 6. The plaintiffs expect to call the following expert witnesses: a. Joseph Stewart, PhD, Department of Political Science, University of New Mexico, 2072 Social Sciences, Albuquerque NM , phone: , fax: Dr. Stewart s vita (Joseph Stewart.doc) has been provided to all parties. Dr. Stewart s report was provided to all parties on April 18, Dr. Stewart s supplemental report is in an electronic file (Stewart Report pdf) with supporting documentation (other than that provided by Mr. Sissons) in electronic files (AZCong02_DTC-master.xls and DTC02_T2.xls). Earlier drafts of Dr. Stewart s report are found in electronic files (Jan03_AZ_draft1.pdf, Jan03_AZ_draft2.pdf, and Jan03_AZ_draft3.pdf). b. Mr. R. Anthony Sissons, Research Advisory Services, Inc., 5631 North 6th Street, Phoenix AZ 85012; telephone ; fax Mr. Sissons resume (Sissons CV.doc) has been provided to all parties. Mr. Sissons assisted Dr. Joseph Stewart in the preparation of Dr. Stewart s report by gathering data and performing calculations under the direction of Dr. Stewart. Mr. Sissons may be called to testify regarding the 4

5 source of the data and the work that he did for Dr. Stewart. His initial report has been provided as two electronic files (IRC_SOSdata.doc and IRC_SOSdata.xls). His testimony at trial will include an explanation of how he prepared the report s analysis, and that the analysis is equally applicable to Congressional district plans. He will further testify that any calculations based on the voter data obtained from Election Data Services are skewed. His letter outlining the problems with the IRC s data was submitted to all parties in April 2002 (Sissons letter doc and LEGIS94.zip). Mr. Sissons has analyzed and prepared additional data for Dr. Stewart regarding the 2002 elections. The transmission letters for the data from Mr. Sissons to Dr. Stewart are in an electronic file (Sissons .pdf). His supporting data is in the files AZCongress02G.zip, AZCongress02P.zip, POPREG401.zip, Yav&MohTotal.xls, and AZCongress02P_DTC.zip. Mr. Sissons also provided Mohave County election data to Dr. Stewart (Mohave Co election data.pdf). Mr. Sissons also provided a further explanation of his data sources in two electronic files (Sissons Letter pdf and ExplainSources.zip). Mr. Sissons provided additional explanation in an of 18 February 2003 (Rivera and Sissons s Feb 2003.pdf) and in a letter to counsel for the Legislative plaintiffs with accompanying files (Sissons files.zip). c.
