16 Argentina s Supreme Court of Justice of Argentina August 25, 2009, unanimously declared to be unconstitutional the second paragraph of Article 14 of the drug control legislation (Law 23,737), which punishes the possession of drugs for personal consumption with prison sentences ranging from one month to two years. According to the Court, the unconstitutionality of the article is applicable to cases of drug possession for personal consumption that does not affect others.

17 The Court s new ruling, known as Arriola, represents a return to the Bazterrica framework of 1986, although with some limits. The Court noted: the second paragraph of Article 14 of Law Nº should be invalidated, since it violates Article 19 of the National Constitution as invades the sphere of personal liberty, which is excluded from the authority of state organs.

20 Even if the unconstitutionality of this legal disposition is declared, it has been not established the limit of the circumstances that do not bring any concrete danger or harm to the rights and welfare of others or about the actions that do not offend public morals or the rights of others, leaving a gray area between intimicy and privacy.

21 On the negative consequences of criminal approaches to drug consumers, Supreme Court Judge Zaffaroni noted: the criminal sanctioning of drug users [ ] has become an obstacle for the recovery of those few who are drug dependent, since it only serves to stigmatize them and reinforce their identification with drug use

22 Some of the risks to face for the next decade will be the consecquences of having this sentence but not a new drug control law. So drug users still need to face :. police arrests. the application of these criteria by other courts (ex. how they interprete the term affect others ) and. the possibility of being incriminated

23 As the Court has said, the penal repressive response for drug users is ineffective and inhumane. Today the lack of a drug control law that depenalize drug use and drug possession is not only still a harm for drug users, (as it is the survival of Law 23737) but also a risk for all those that could have misunderstand that the Supreme Court has depenalised.
