6 What offices are on the ballot for this election? In the November Statewide General Election, all voters receive the same ballot, no matter what political party you are registered with (or if you have no party preference). The address where you are registered to vote determines which local contests are on your ballot. In the November Statewide General Election all Californians can vote on the top two candidates, those with the most votes from each voter nominated office in June s Primary Election, and on local nonpartisan offices. The text below describes what offices are part of the top two primaries and what are local nonpartisan contests. The top two candidates the ones with the most votes in the June Primary Election moved to the General Election. There are no write-in candidates for these offices. The candidates' party preference (or "None") always appears on the ballot. The candidates may have the same party preference. In the event, there are no nominees or an insufficient number of nominees for a local office, appointment is made as prescribed by EC 10515, You can write-in a qualified candidate for these offices. The candidates' party preference never appears on the ballot On June 8, 2010, California voters approved the Top-Two Open Primary Act (Proposition 14). 8 About the candidates Proposition 34 - Expenditure Limitations: State Legislative Candidates Voters passed Proposition 34 in November This law says we must tell voters the names of candidates who agree to campaign spending limits. This law only applies to candidates for State Legislative offices like State Senate and State Assembly. NATALIA MOLINA Occupation: Non-Profit Administrator I humbly request your vote in representing you as a Trustee Member for Monterey Peninsula College. I have both board and commission experience and strong listening skills key qualities essential for this dynamic role. Raised by Guatemalan immigrant working-class parents, they inspired in me the value of higher education. The call to public service came at the tender age of 10 when my father asked, "How will you help others who have less than you?" A quality education experience produces positive ripple effects in the health and economics of a community: students educated with training in demand are gainfully employed; well-compensated faculty and staff live and spend in the community they work; opportunity for life-long learners addresses unique senior needs, and so on. FELIX BACHOFNER Occupation: Small Business Owner, Former Seaside Age: 50 Mayor and Former Chair, Seaside Planning Commission Georgetown University: International Security Studies Massachusetts Institute of Technology (MIT Sloan): investments, negotiations, technology, planning MPC and its Board of Trustees is about to face a number of serious tests. The formula California applies to funding the College has changed and will lead to lower revenues if operations are not conducted in a fiscally responsible and innovative way. The president is slated to retire, an accreditation challenge has just been weathered and there is ever increasing competition for students and demand for resources. These are the same types of challenges my Mayoral administration handled with poise during the worst days of the most recent recession. The MPC Community deserves Trustees with significant, proven leadership and management experience like this. I also bring significant domain-specific experience in education to the position. I am a former Professor of Practice in Information Technology and Chairman of a tri-county interviewing team for a highly selective University. JASON CAMPBELL Occupation: Landscape Contractor Age: 54 With the enthusiastic support of Seaside residents and the endorsements of prominent elected representatives like County Supervisor Jane Parker and State Assemblyman Mark Stone, I respectfully ask for your vote to re-elect me to the Seaside City Council. During the last four years, I am proud to have championed many positive changes for Seaside. DENNIS VOLK Occupation: Business Owner Age: 63 A lot of you know me just from coming into Mals Market, but for those of you that don t know me, my name is Dennis Volk. I am a local business man who has lived and participated in Seaside activities for more than 40 years. I have chosen to put my time and effort in being an active volunteer in many community events as well as being a foster parent along with owning a grocery store, which can be tough to handle, especially time wise, but I have always been passionate about doing things to help others, especially if more than one person can benefit from it. Now I want to take action, and go one step further which would be to help better the city that I have lived in all my life. As for the direction of development, I want to focus on the areas of housing and economical growth. I believe in my heart that I have Seasides best interest, and I truly think I can make a difference on the Seaside City Council. It would not only be our wants that we would work on, but what this city needs in order to become a place that everyone could be comfortable in. I would appreciate your vote in this years election, so we can work together on the issues that are of concern, and I hope that you will put your trust in me to represent this city in the best way I can. We are a melting pot of cultures from many parts of the globe. I was born in the military hospital on Fort Ord. I am a descendent of a military father. SAM GASKINS Occupation: Pastor Age: 81 I ve been a Seaside resident since First stationed at Fort Ord, then returning in 1977 following my retirement as a Chief Warrant Officer from the Army. I ve been involved with serving this city ever since. Appointed Pastor of Christian Memorial Tabernacle in 1979, I was taken with the neglect of the needy and homeless in our city. To address those needs I founded Peninsula Outreach; the Little Buddy Program; Violent Prevention Program; the Building Bridges Community Services program and Stepping Stone Outreach Inc. If you elect me to sit on your Council I will continue to be an advocate for those in need. I hold a degree in communications from Monterey Peninsula College and a doctorate in Counseling and Communications from the Spirit of Truth Institute in Richmond, Virginia. I ve earned 2 Bronze Stars and numerous awards for my leadership including the NAACP Meritorious Service and Contributions Award, the Congressional Award for Outstanding Humanitarians, the California Legislative Assembly Certificate of Recognition, the Seaside, Chamber of Commerce Humanitarian Award and many other awards and certificates of recognition from business and government at all levels. To achieve this, we must put public service before politics. Water is a basic necessity, not a political football. Our water supply future is at a crossroad. How we move forward will forever impact our community. The Monterey Peninsula Water Management District is facing big issues that will require tough decisions. I am a longtime businessman and resident of Seaside who has followed, been involved with and understand what it takes to achieve a sustainable water supply. The District is now looking at recycled/groundwater replenishment, desalination and Aquifer Storage and Recovery as components of water supply projects. I will address each decision with a fresh perspective, an open mind, and no preconceived agenda. I will listen to the community and ensure that your voices are heard. Cal Am's record shows it lacks the capacity to manage the Peninsula's water system to ensure provision of reliable, efficient, cost effective water service to ratepayers, now and in the future. 11. Approximately 85 percent of water consumers in the United States receive their service from public agencies. Public ownership of water system assets also carries the benefit of lower interest costs of financing infrastructure improvements, while eliminating perverse, investor-driven incentives associated with a for-profit monopoly. 12. Public ownership of the Monterey Peninsula's water system will benefit residential and business customers and ratepayers by lowering water service costs, guaranteeing transparency in meetings and actions by governing bodies, assuring public access to records, and full accountability of local elected officials in water system management and water service delivery. Section IV-- An Ordinance of the Monterey Peninsula Water Management District. The following Rule 19.8 shall be added to the Monterey Peninsula Water Management District, Rules and Regulations, Regulation I, General Provisions: Rule Policy of Pursuing Public Ownership of Monterey Peninsula Water System A. It shall be the policy of the District, if and when feasible, to secure and maintain public ownership of all water production, storage and delivery system assets and infrastructure providing services within its territory. B. The District shall acquire through negotiation, or through eminent domain if necessary, all assets of California American Water, or any successor in interest to California American Water, for the benefit of the District as a whole. C. The General Manager shall, within nine (9) months of the effective date of this Rule 19.8, complete and submit to the Board of Directors a written plan as to the means to adopt and implement the policy set forth in paragraph A, above. The plan shall address acquisition, ownership, and management of all water facilities and services within and outside the District, including water purchase agreements as appropriate. The plan may differentiate treatment of non-potable water services. Section V-- Modification Only By Vote of the People No provision of this Measure shall be changed, amended, or repealed except by a vote of the People. Section VI -- Effective Date; Application. The provisions of this Measure shall take effect immediately upon certification of its passage by the appropriate Election Official. Pending actions or proposals otherwise governed by this Initiative that have been initiated by the Board of Directors of the District, but that are not yet final as of the effective date, or that are the subject of pending legal challenge, shall be subject to the provisions of this Measure. Section VII -- Severability This Measure shall be broadly construed in order to achieve the purposes stated in this Measure. If any section, sub-section, sentence, clause, phrase, part, or portion of this Measure is held to be invalid or unconstitutional by a final judgment of a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Measure. The voters of the Monterey Peninsula Water Management District hereby declare that this Measure, and each section, subsection, sentence, clause, phrase, part, or portion thereof would have been adopted or passed even if one or more sections, sub-sections, sentences, clauses, phrases, parts, or portions are declared invalid or unconstitutional. If any provision of this Measure is held invalid as applied to any person or circumstance, such invalidity shall not affect any application of this Measure that can be given effect without the invalid application. Section VIII -- Conflicting Ballot Measures In the event that this Measure and another measure or measures relating to the same or similar subject matter shall appear on the same election ballot, the provisions of the other measures shall be deemed in conflict with this measure. 54 Iniciativa de ley local en la boleta: J Texto completo de la Iniciativa de Ley J La ciudadanía del Distrito de Administración del Agua de la Península de Monterey resuelve lo siguiente: Título: Iniciativa de estudio para la viabilidad de titularidad local del sistema de abastecimiento de agua de la península de Monterey (Monterey Peninsula Water System Local Ownership Feasibility Study Initiative) Artículo I -- Nombre Se denominará esta iniciativa de ley la Iniciativa de estudio para la viabilidad de titularidad local del sistema de abastecimiento de agua de la península de Monterey (Monterey Peninsula Water System Local Ownership Feasibility Study Initiative). Artículo II -- Propósito El objetivo de esta iniciativa de ley es garantizar a largo plazo la sostenibilidad, idoneidad, fiabilidad, rentabilidad y calidad del servicio de abastecimiento de agua en la zona del Distrito de Administración del Agua de la Península de Monterey, reducir el costo de las tarifas a los abonados, fomentar y poner en práctica medidas sensatas de administración del agua, y establecer la titularidad pública de los activos del sistema de abastecimiento de agua, al imponer normas que dispongan que el Distrito actúe de manera resuelta, en la medida que sea económicamente viable, a fin de adquirir los activos del sistema de abastecimiento de agua, cuya titularidad y operación corresponden a California American Water Company, compañía que en la actualidad presta el servicio de abastecimiento de agua al Distrito y sus abonados. Artículo III -- Conclusiones 1. California American Water Company ( Cal Am ) está en la actualidad a cargo del abastecimiento de agua en la península de Monterey. Esta es una empresa privada de servicios públicos, propiedad de inversionistas, que adquirió el sistema actual de abastecimiento de agua en Bajo la titularidad y gestión de Cal Am, el servicio de abastecimiento de agua de la península de Monterey se ha convertido en el servicio de agua más caro de todos los Estados Unidos, según un informe de Food and Water Watch publicado en junio de En 1995, la Junta Estatal de Control de Recursos Hídricos ("Junta Estatal") ordenó a Cal Am que cesara el bombeo ilegal del río Carmel y planificara para un nuevo suministro de agua. En 2007, un tribunal superior del condado de Monterey ordenó a Cal Am que cesara el exceso de bombeo en la cuenca de agua subterránea de Seaside, que amenazaba la sostenibilidad a largo plazo de la cuenca. 5. Después de que los clientes de Cal Am ahorraran considerables cantidades de agua en respuesta a las condiciones de sequía, Cal Am solicitó la aprobación de la Comisión de Servicios Públicos de California (CPUC-California Public Utilities Commission) para añadir un recargo a las facturas de los abonados con el fin de compensar por los ingresos perdidos. La Comisión aprobó la solicitud y los abonados pagan ahora un recargo de $8 millones anuales hasta 2021 por agua que Cal Am no distribuyó. 6. Desde 2007, el importe total facturado por agua a los abonados de Cal Am, incluidos los recargos, aumentó de $2,501 a $6,484 por acre-pie, lo que representa un aumento del 159 por ciento. Durante el mismo periodo, el índice de precios al consumidor aumentó sólo un 12.5 por ciento. 7. El Distrito de Administración del Agua de la Península de Monterey ("Distrito)" fue establecido en 1977 mediante una ley estatal, que le atribuye al Distrito la administración integrada de los recursos hídricos subterráneos y superficiales de la región de la península de Monterey. El Distrito conserva plenas facultades conforme a la ley estatal para efectuar todo esfuerzo legítimo y necesario con el fin de que se pueda disponer de suficiente agua para el beneficio actual o futuro de los habitantes o las tierras del Distrito. Esto incluye la titularidad y operación de activos del sistema de abastecimiento de agua dentro y fuera de sus fronteras. 8. Cualquiera que sea la entidad con titularidad y autoridad administrativa del sistema de abastecimiento de agua de la península en el futuro, bien sea Cal Am o el Distrito, se enfrentará a importantes retos para satisfacer las necesidades de abastecimiento de agua de los residentes y las empresas de la península y al mismo tiempo cumplir con los requisitos de la orden de 1995 de la Junta Estatal. Para ello será necesario el más alto nivel de capacidad, competencia e integridad gerencial. 9. Desde que se dictó la orden de la Junta Estatal en 1995, el Distrito ha brindado firme liderazgo mediante la ejecución de cinco nuevos proyectos de abastecimiento de agua: la recarga artificial del acuífero utilizando las aguas de escorrentía invernales del río Carmel; los pozos Peralta en Seaside; el proyecto de reclamación de Pebble Beach; Pure Water Monterey en asociación con la Autoridad Regional de Control de la Contaminación del Agua de Monterey (ahora Monterey One Water); y la recuperación de aguas pluviales con Pacific Grove. Este expediente demuestra que el Distrito tiene la capacidad y competencia para la titularidad y administración de los activos del sistema de abastecimiento de agua de la península de Monterey a fin de proporcionar un servicio de agua fiable, eficiente y rentable a los abonados en el futuro a largo plazo. 10.
