2 SUBJECT: Events on Wichita Airport Authority Property PURPOSE: and Colonel James Jabara Airports (ICT and AAO, respectively) are transportation facilities operated for the efficient movement of passengers between ground transportation and aircraft, and for efficient handling of cargo to and from aircraft and ground transportation. It is a non-public forum that is not intended for Events of public expression by individuals or groups, except to the extent as required by law. Event shall be defined as any peaceful and lawful protest, demonstration, assembly, political activity, informational leafleting, or other First Amendment expression. In order to protect public health, welfare and safety, and ensure the orderly and efficient flow of persons, goods and services, it is necessary to establish reasonable procedures and guidelines for such Events. RESPONSIBILITY: It shall be the responsibility of the organizing and/or responsible person, party or agency to apply for an Event Permit in writing to the WAA at least three (3) business days prior to any proposed Event to obtain Permit approval. Business days do not include Saturdays, Sundays or national holidays, even if the airport is operating on those days. All Permit applications shall meet the requirements of this Standard Operating Procedure (SOP), Title 9 of the Code of the City of Wichita, and applicable federal and/or state laws. The WAA will either approve, approve with conditions, or deny the Permit application within one (1) business day after the date of receipt of the application. PROCEDURES: A. Location(s) of Events 1. The following locations may be approved for Events: a. The area located on or along sidewalks and generally northeast of the commercial vehicle lanes, southeast of the Close-In Automated Parking Lot, and northwest of the parking garage. b. The cargo parking lot east of the Air Cargo Terminal Building and west of Air Cargo Road. The Air Cargo Terminal Building is a multi-tenant facility. Therefore, an Event activity shall be limited to the area in front of the offices or operations areas of the company which is the subject of the Event. Events shall be limited to the exterior of the Air Cargo Terminal Building Page 2 of 7

3 only. c. The interior area of the Commercial Passenger Terminal Building located in the northwest end of the ticketing area, and/or the southeast end of the baggage-claim area. The Commercial Passenger Terminal Building contains both public (non-leased) areas, as well as multi-tenant leased premises. Therefore, an Event shall be limited to public areas. d. The non-secured leasehold of the tenant/lessee (other than passenger or air cargo terminals) which is the subject of the Event subject to tenant/lessee written permission, and compliance with applicable federal and/or state laws. If necessary, the Airport Authority may work in cooperation with the tenant and Event organizing party to establish a reasonable location so as to not interfere with tenant business activities, pedestrian or vehicle traffic. e. In the case of a general Event not directed towards or for the benefit of a specific Airport tenant/lessee, the Airport Authority may designate an appropriate location on airport property where such Event may lawfully occur. f. Events on/within secured air operations areas, security identification display areas (SIDA), secure-sida, and sterile areas are expressly prohibited. B. Policies and Restrictions 1. The following restrictions shall be observed and complied with at all times during Events: a. Event participants shall not knowingly cause an obstruction to or interference with the free and uninterrupted use of property for business purposes by any employee, patron, or other invitee on such premises, or which prevents the free and uninterrupted entry into or exit from that business. b. Event participants shall not knowingly refuse or fail to leave any such property operated or controlled by a private individual or business entity upon being requested to do so by the person in charge of that property at the time thereof, upon such request by any law enforcement officer, or other authorized individual. c. At no time shall an Event participant physically block, impair, hinder, or Page 3 of 7

4 preclude any employee, tenant, airport user or business invitee from the free and uninterrupted use of the subject property, including the conduct of business on the Airport(s). d. At no time shall an Event participant engage in an illegal assault or physical behavior toward any employee, tenant, airport user or business invitee. e. All Events shall be conducted in a lawful, peaceful, non-obstructive, safe, and non-threatening manner in accordance with this SOP, laws of the federal or state government, and Code of the City of Wichita. Failure to display the Event Permit for examination by law enforcement officials or Airport Authority employees shall be grounds for removal from Airport property of Event participants. f. At no time shall an Event participant utilize an amplified sound system or device. g. The organizing person, party, or agency responsible for the Event shall be responsible for removal and disposal of any litter created by or as a result of the Event, including hand-out leaflet literature. h. The sale or offering for sale of goods and/or services on Wichita Airport Authority property is expressly prohibited unless specifically authorized under a tenant leasehold agreement or with the specific written authorization by the Director of Airports. i. Requests to the WAA for courtesy/complimentary parking or other free services associated with an Event will not be approved. 2. Informational leafleting may be authorized within designated areas of the Commercial Passenger Terminal building noted above at section A. 1. c. of this SOP # 22. However, leafleting on/within secured air operations areas, security identification display areas (SIDA), secure SIDA, and sterile areas is expressly prohibited. In addition to those provisions in Section B.1 above, the following procedures shall specifically apply for informational leafleting. Informational leafleting shall: a. Not be authorized for the purpose of selling or offering for sale any commercial for profit goods and/or services. b. Not contain obscene material. Page 4 of 7

5 c. Be conducted only outside of pedestrian and vehicle traffic flows and patterns. d. Not block, impair or obstruct access to/from the TSA passenger security screening checkpoint. e. Not block, impair or obstruct access to/from any airport tenant place of business. f. Not block, impair or obstruct the access to/from the Commercial Passenger Terminal building entrances/exits. g. Be made available, but not verbally or physically imposed on passers-by. C. Rights Reserved by the Wichita Airport Authority 1. The Wichita Airport Authority reserves the following rights at all times: a. To cancel an Event Permit previously issued for failure to comply with this SOP. b. Remove or cause the removal from airport property some or all Event participants not complying with the requirements of this SOP, Title 9 of the Code of the City of Wichita, or other applicable laws of the state, federal or local government. c. Remove or cause the removal from airport property of some or all Event participants who cause or create the interruption of business or commerce on the Airport(s), or disrupt or interfere with the orderly flow of passenger, pedestrian, or vehicle ingress or egress. PERMIT APPLICATION: 1. All Permit applications requesting an Event on Wichita Airport Authority property shall be submitted in writing at least three (3) business days in advance of the intended date of an Event to: ATTN: Assistant Director of Airports Wichita Airport Authority 2173 Air Cargo Road Page 5 of 7

6 Wichita, KS or 2. All applications for Event permits shall include at least the following information: Name of organizing and/or responsible person, party or agency making application. Name and contact information of individual point-of-contact. Nature and description of Event. Requested location of Event. Estimated number of persons expected to participate in the Event. Special accommodations; i.e. portable restrooms, etc. Requested time, date, and duration of the Event. Statement acknowledging that this SOP has been read and understood and the applicant s agreement to comply with the conditions contained herein. As applicable (if the Event is proposed to be held on the leasehold of an airport tenant), provide evidence of airport tenant approval. PERMIT: 1. Applications for permits shall be denied, approved, or approved with restrictions one (1) business day after the date of receipt of the Application. If the Airport Authority does not act on the Application within this time, the Event Permit is deemed granted as requested in the Application, but subject to the restrictions of this SOP # An organizing or responsible person for the Event shall maintain the written Permit (or copy thereof) in his or her possession when on Airport property throughout the Event duration. Representatives of the Wichita Airport Authority or City of Wichita may at any time request to examine the Permit; and, the organizing or responsible party for the Event must comply with all such reasonable requests. 3. The written permit, if granted, will list the following: Name and brief description of Event Responsible party and point-of-contact Location of Event Permission for signs of approved size and for literature Page 6 of 7

7 Special conditions or restrictions Dates and times of Event Permit expiration APPEAL OF PERMIT DENIAL OR RESTRICTIONS: Appeal of denial of a Permit, or restrictions on an approval may be made by requesting a hearing with the Director of Airports or his designee, which hearing will be conducted within two (2) business days from receipt of the appeal.
