1 Humberside International Airport Byelaws 1999 Byelaws made by Humberside International Airport Limited in pursuance of Section 63 Airports Act 1986 in respect of the Airport for regulating the use and operation of the Airport and the conduct of all persons whilst within the Airport. Part I INTERPRETATION 1. These Byelaws may be cited as the Humberside International Airport Byelaws In these Byelaws:- the Airport means the area of land for the time being constituting the Humberside International Airport; the Managing Director means the Managing Director of the Company or any person acting with the authority of the Managing Director; Authorised Person means any person authorised by the company or the Managing Director; Authorised Standing means an area of ground appointed by the Company as a waiting place for taxis and indicated by a sign saying Taxis ; The Company means Humberside International Airport Limited. The Air Navigation Order shall mean the Air Navigation (No2) Order 1995 S11995/1970 and all other Orders or Regulation made by Statute, Statutory Instrument or powers thereunder. the Road Traffic enactments mean the enactments relating to road traffic including the lighting and parking of vehicles and any Order or other instrument having effect by virtue of any such enactment; Taxi means any vehicle used to carry passengers for hire or reward, which is not a public service vehicle within the meaning of the Public Passenger Vehicles Act 1981 or any statutory re-enactment thereof; PART II ACTS PROHIBITED WITHIN THE AIRPORT 3. No person shall without lawful authority or seasonable excuse;- (i) Obstruct or interfere with the proposer use of the Airport including without prejudice to the foregoing operating or attempting to operate, tampering or interfering or misusing any machinery or equipment at the Airport. 2 (ii) (iii) (iv) (v) (vi) Fail to comply with any notice prohibiting or restricting access to any building road or any part of the Airport or any notice restricting or prohibiting any activity including without prejudice to the foregoing smoking or bringing any naked light into any place where such an act is prohibited. Fail to comply with any instruction or command given by any Authorised Person. Fail to properly place and/or secure an aircraft in the place and position appointed for that purpose by an Authorised Person. Drive or place a vehicle carelessly or recklessly or without due consideration for persons using the Airport. Be in a state of intoxication in any part of the Airport and/or behave in an indecent or disorderly manner likely to cause offence or annoyance to other users of the Airport. (vii) Affix bills posters or stickers upon any wall structure floor or pavement or any surface forming part or used in relation to the airport or display any flag banner or emblem likely to cause a breach of the peace. PART III ACTS FOR WHICH THE PERMISSION OF THE MANAGING DIRECTOR IS REQUIRED 4. No person shall, without the permission of the Managing Director:- (1) Knowingly enter or leave the Airport, otherwise than through a gate or entrance for the time being provided for that purpose. (2) Knowingly enter any part of the airport to which members of the public are not for the time being admitted. (3) Drive a vehicle on the Airport unless he has the necessary driving licence and insurance required under the Road Traffic enactments to entitle him to drive that vehicle on a public highway; (4) Drive a vehicle elsewhere than in a place provided for the passage or accommodation of such a vehicle; (5) Run an aircraft engine in a hangar, save in the presence of a licensed aircraft engineer; (6) Fill any container (including any part of a vehicle) with liquid fuel or discharge liquid fuel from any container elsewhere than in a place provided for that purpose by the Managing Director; Page 2 of 6
3 (7) Beg or solicit funds or contributions of any kind; (8) Sell or distribute anything, offer anything for sale or hire or make an offer of service; (9) Sing, dance, shout, play musical instrument in such a way as to give reasonable cause for annoyance to another person or erect or use any apparatus for transmission, receipt, recording, reproduction or amplification of sound, speech or images. PART IV TAXIS AT THE AIRPORT 5. Within the Airport the following provisions shall apply to taxis:- (1) No person shall stand or park a Taxi on the Airport for the purpose of plying for hire unless he has been authorised to do so by the Company. (2) No personal shall ply for hire with a Taxi except on an Authorised Standing and subject to any conditions imposed by the Company attached to the authorisation granted by the Company. (3) Breach of the provisions of the authorisation shall be deemed and shall constitute a breach of these Byelaws. PART V LOST PROPERTY 7. The following provisions shall apply in relation to the safe custody, re-delivery and disposal of any property, vehicle, animal or thing which while not in proper custody, is found on any part of the Airport, or in any aircraft or vehicle at the Airport:- (1) Subject to the provisions of the Customs and Excise Acts, any person who finds property to which these Byelaws apply shall, as soon as possible, and in any case within 24 hours, deliver such property for safe custody in the state in which it comes into his possession to the Airport Information Desk and inform a member of staff of the Airport at the Information Desk of the circumstances in which it was found. (2) Any lost property delivered to the Information Desk shall be retained in safe custody by the Company until claimed by the owner thereof or disposed of in accordance with these Byelaws and the Company shall keep for a period of not less than twelve months a record showing particulars of the lost property, the circumstances in which it was found and the ultimate disposal of the lost property; Page 3 of 6
4 (a) (b) Official documents, including licences, passports and aliens identity books shall wherever practicable be returned forthwith to the appropriate Government Department local authority or other body or person responsible for issuing them or for controlling or dealing with them; Where the name and address of the owner of any lost property other than the documents referred to in the preceding provision are readily ascertainable, the company shall forthwith notify him that the lost property is in its possession and may be claimed in accordance with these Byelaws; (3) If any lost property, while it is retained by the Company in safe custody, be claimed and the claimant proves to the satisfaction of the company that it belongs to him and he gives his name and address to a member of staff of the Airport at the Information Desk, upon payment of such charge as the Company may from time to time fix for the return of any lost property delivered to the Information Desk then the lost property will be returned to that person; (4) (a) If any lost property retained by the Company for safe custody in accordance with these Byelaws is not, within three months of the date when it was delivered to the Information Desk, re-delivered to a person pursuant to Byelaw 7(3) hereof, the Company shall be entitled to sell if for the best price that can reasonably be obtained; (b) (c) (d) Notwithstanding the foregoing provisions of these Byelaws, if any lost property retained by the Company pursuant to these Byelaws is of a perishable nature and if, within 48 hours form the time when it was found, it has not been re-delivered to a person pursuant to Byelaw 7(3) hereof the Company shall be entitled to sell it at the best price that can reasonably be obtained; Notwithstanding the foregoing provisions of these Byelaws, any lost property which is or which becomes objectionable may forthwith be destroyed or otherwise disposed of in a reasonably manner; A sale under this Byelaw shall not prejudice the right of any person which rights have been divested by sale to be paid the proportion due to him of the residue of the proceeds of sale after deduction of any charge by the Company for the safe custody of the lost property and the Company s reasonable costs in connection with the sale; (5) Where any lost property is contained in a package, bag or other receptacle the company may cause such receptacle to be opened and the contents examined, or require the claimant to open it and submit it and its contents for examination, for the purpose either:- Page 4 of 6
5 (a) Of identifying and tracing the owner of the lost property; Or (b) Of ascertaining the nature of the contents. PART VI ROAD TRAFFIC 8. No person shall without lawful authority, or the permission of the Authorised person; (1) Park a vehicle elsewhere other than in a place provided for that purpose; (2) Park a vehicle in the car park without paying the fee from time to time prescribed and displayed at the Airport; (3) Fail to comply with any direction for the regulation of traffic given by an Authorised Person or traffic sign erected and displayed by the Company. (4) In any case where an accident occurs within the Airport, the driver of any vehicle involved shall stop, give his name and address, that of the owner and the identification marks of the vehicle and details of the accident to a member of the Airport staff as soon as reasonably practicable and in any event before leaving the Airport; PART VII GENERAL PROVISIONS 9. (1) Where an Authorised Person reasonably suspects that a breach of any of the foregoing Byelaws has been committed by a person, that person shall upon being requested to do so by an Authorised Person correctly state his/her name and address and the purpose of his/her being on the Airport; (2) No Authorised Person shall exercise any power under any of these Byelaws without the production of written evidence of his/her authority if required to do so. PART VII PENALTY 10. (1) Any person contravening any of the above Byelaws shall be liable on summary conviction to a fine of not exceeding 2, (2) In respect of a contravention of Byelaws 8(1), (2) and (3) which occurs in a place within the Airport to which the Road Traffic enactments do not apply, the Authorised Person may fix an immobilisation device to the vehicle while it Page 5 of 6
6 remains in the place in which the Authorised Person finds it or move it from that place to another place and fix an immobilisation device to it. (3) On any occasion when an immobilisation device is fixed to a vehicle the Authorised Person shall also affix to the vehicle a notice indicating that such a device has been fixed to the vehicle and warning that no attempt should be made to drive it until it has been released from that device; specifying the steps to be taken in order to secure its release. (4) An immobilisation device shall not be removed from a vehicle except by or with the permission of an Authorised Person. The Authorised Person shall remove the immobilisation device upon payment in any manner specified in the notice affixed to the vehicle of such charge in respect of the release as may be prescribed.
