BC Hydro s Refrigerator Relics Contest PURPOSE: The purpose of the Refrigerator Relics Contest is to identify the oldest, most unique operating refrigerator owned by a BC Hydro customer in the Province of British Columbia and to raise awareness about cost and environmental impact of operating an old and/or second refrigerator. 2. OVERVIEW: This contest is open to any BC Hydro (or City of New Westminster) utility customer as at October 1, 2008 with a current BC Hydro or City of New Westminster utility residential account number in their name, who owns the refrigerator entered into the contest, is willing to assign ownership of the refrigerator to BC Hydro and meets all the conditions of these rules. See Rule 7 for additional eligibility requirements. LIMIT one (1) contest entry per BC Hydro or City of New Westminster utility account, per person and per refrigerator. Maximum one grand prize per BC Hydro or City of New Westminster utility account. 3. DATES AND CONTEST ENTRY: The contest begins on October 1, 2008 at 6:01am PDT and ends October 31, 2008 at 5:59pm PDT (the Contest Period ). Postmarked mail entries dated no later than October 31, 2008 will be accepted until November 15, BC Hydro is not responsible for entries delayed by the post or for any other failure to receive the entries by the contest deadline. Participants may enter by submitting a completed contest entry form (available at along with a picture of their old refrigerator. Refrigerator must be in working condition and must be owned by the entrant/registered BC Hydro account holder). All entries must include a picture of the refrigerator and the serial number and make and model of the refrigerator. Entries may be submitted online at or by mail (addressed to BC Hydro Refrigerator Relics Contest, BC Hydro Power Smart Residential Operations, 4555 Kingsway, 9 th Floor, Burnaby BC, V5H4T8). All entries are subject to verification and validation and will be declared invalid if they are illegible, incomplete or falsified. Submission Requirements for photographs: Format: Photographs must be submitted in colour, black and white photographs will not be accepted. Prints must be at least 5" x 7", not more than 8" x 12", and unmounted. All 35mm colour slides and transparencies must be mounted.

2 Digital entries may be submitted electronically as jpeg files or jpeg files burned to CD. Files should be at least 1600 pixels wide for a horizontal image or 1600 pixels tall for a vertical image, and no larger than 2MB (2,000 KB), and must be accompanied by a colour printout of the image. Content alteration of digital files is not acceptable; cropping of photos is permitted, tonal or colour corrections are acceptable. For digital images, please include your surname as the first word in each digital file name; e.g. Smith_refrigerator.jpg All photographic submissions must be original and owned exclusively by the entrant(s). By submitting a photograph, a contestant represents that their photograph(s) are original and owned exclusively by such contestant and do not infringe the rights of any third party. Previously published photographs will be disqualified. Photographs cannot have been previously or simultaneously entered in any other contest. Contestants are solely responsible for complying with any applicable copyright and trademark laws, and BC Hydro and its agents assume no obligation or liability for any breach or alleged breach of any third party rights. By submitting an entry, entrants acknowledge that they have read, understood and agreed to abide by these official contest rules. 4. PRIZES: There are two prizes available to be won (one for each contest category described below). Each prize consists of the winner s choice of an Energy Star qualified product from Whirlpool Home Appliances with an Manufacturer s Suggested Retail Price (at the time of selection) not to exceed $1500 (Cdn.). Prize selection is subject availability of stock. Prize selection will be coordinated by BC Hydro and prize must be selected by December 31, 2008 or be forfeited. Any costs or expenses associated with the Whirlpool prize including but not limited to installation will be the responsibility of the winner. Prizes include delivery to one location in Canada. Any installation or removal of old appliances or any costs for expenses associated with the prize will be the responsibility of the winner. Each declared winner will have their selected prize appliance delivered and their old refrigerator (subject of the photo submitted with contest entry) will be removed on the same visit. At such time BC Hydro will arrange for a photo opportunity with some or all of the retailer, pick-up contractor, contestant, and a BC Hydro representative. 5. SELECTION OF WINNER: Two contest entries will be selected from all eligible entries received during the Contest Period. The chances of winning either prize are dependent upon the extent to which an entry meets the stated criteria for that prize as described below, the number of eligible entries received and the decisions of the official judging panel. Judging will be completed by a team of Power Smart staff along with external reviewers selected at BC Hydro s discretion, to select a winner in

3 each of two categories: oldest and outstanding relic. Refrigerators must be in working condition to be eligible for either category. The winner for the oldest category will be determined by confirming the model number and verifying the age of the unit (as determined by its make, model, and serial number) and its operating condition. If more than one unit is found dating from the same year and there is not other way to verify which unit is technically the oldest, then a random draw will be held among the finalists in a given year to determine the winner. The winner for the outstanding relic category will be judged based on a number of criteria (selected, weighed, and scored at the sole discretion of BC Hydro s judging panel) including (but not limited to) refrigerator age, operating condition, historical interest/uniqueness, and overall story/appeal. Each entry will be eligible for prize both categories, but no one entry can win in more than one category. In addition to the winner in each category, two or more finalists in each category (as determined by the judging panel in its discretion) will be selected and profiled in BC Hydro publications (e.g. Get Connected, For Generations, website). Prior to being declared a finalist and being profiled, all such entrants will be required to sign declaration and release forms equal or similar to those required to be signed by winners as contemplated by Rule NOTIFICATION: The selected entrant winners will be notified by telephone or . To be declared a winner, BC Hydro will confirm the ownership, age and authenticity of the refrigerator prior to declaring any person a winner. At least five attempts over the five business days following the draw will be made to contact the selected entrant. If a selected entrant cannot be contacted in this manner, that entrant will be disqualified and another entrant will be selected (in the manner described above) from the remaining eligible entrants. BC Hydro is not responsible for the failure for any reason whatsoever, including its own negligence, of a selected entrant to receive notification or for BC Hydro to receive a selected entrant's response. Before being declared a winner, each selected entrant must correctly answer, without mechanical or other assistance, a mathematical skilltesting question and sign BC Hydro's declaration and release form agreeing to: (a) accept the prize as awarded and confirm compliance with these contest rules; (b) release, waive and forever discharge all right, in contract or tort, to damages against BC Hydro or its affiliates for any loss or injury sustained as a result of accepting the prize, (c) consent to the use of his/her name, address, photograph or likeness for any publicity purpose

4 connected with this contest, without any further compensation, other than the prize offered, including participation in the above-referenced photo opportunity; d) confirming the originality and ownership of rights associated with their submitted photograph and granting rights to BC Hydro for the use of their photograph; and e) confirming, and assigning ownership of, the refrigerator. The signed declaration and release forms must be received by BC Hydro within fifteen (15) days of delivery thereof to the selected entrant, failing which that entrant will be disqualified and BC Hydro may, in its sole and exclusive discretion, select another entry from remaining eligible entries or, alternatively, may elect not to award that prize. 7. ELIGIBILITY: No purchase necessary. Contest is open to BC Hydro and City of New Westminster utility account holders as of October 1, LIMIT one entry per account. Entrants must be 19 years of age or older. Employees of BC Hydro and City of New Westminster, except those involved in the planning and administration of this contest, are eligible to enter. BC Hydro shall have exclusive discretion to deem which entries are valid and meet all the conditions of these rules. 8. MISCELLANEOUS: Entrants who have not complied with these Official Contest Rules are subject to disqualification at the exclusive discretion of BC Hydro. Prizes are not transferable and must be accepted as awarded with no substitutions in cash or otherwise, except at BC Hydro's sole and exclusive discretion. BC Hydro reserves the right to substitute a prize of equivalent value if any component of the prize cannot be awarded as described. All decisions of BC Hydro are final in all matters relating to this contest. No correspondence will be entered into by BC Hydro with respect to this contest, except with the selected entrants. BC Hydro reserves the right to terminate or amend this contest at any time without prior notice, if it considers that any factor may potentially interfere with its proper conduct as contemplated by these Official Contest Rules. This contest is subject to all applicable federal, provincial and municipal laws. 9. INTERNET DISCLAIMER: BC Hydro and its agents are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any or entry to be received by BC Hydro on account of technical problems or traffic congestion on the Internet or at any website, or delay in mail service or any combination thereof, including any injury or damage to an entrant's or any other person's computer, related to or resulting from downloading any materials in this promotion. BC Hydro reserves the right, in its sole discretion, to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of BC Hydro or its agents corrupt the security or proper administration of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a

5 violation of criminal and civil laws, and should such an attempt be made, BC Hydro reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 10. INTELLECTUAL PROPERTY: All intellectual property related to this contest and all of the associated promotional materials, web pages and source code are owned by BC Hydro or their respective owners. All rights are reserved. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited. 11. PRIVACY: The personal information you provide to be eligible for the contest will only be used to administer this contest. BC Hydro collects and uses this information under the authority of the Hydro and Power Authority Act and related subordinate legislation and handled in accordance with the provisions of the Freedom of Information and Protection of Privacy Act.
