2 Part A SEASONAL MEMBERSHIP Including complimentary parking in Merkanti Prices: Adults (per person) Children (when accompanied by two paying adult members of the same family & a maximum of two, aged 10 or less) - Free of charge Children Aged FREE Children Aged Seasonal Membership is strictly non-transferable and may only be used by the respective registered holder, to the exclusion of the Club Pool. (Members are welcome to dine at The Club restaurant area for lunch) 2 A holder of a Seasonal Membership (hereinafter referred to as Seasonal Member ) is entitled to complimentary parking in the Merkanti area. Parking within the Merkanti area is strictly on a first come, first served basis, and is restricted to Club Operation Hours and subject to availability. 3 Seasonal members are entitled to a 20% discount on the sun bed menu. A membership card needs to be presented. 4 The Seasonal Membership is also subject to the General Terms & Conditions under Part C hereof. 5 With every two paying Seasonal Members of the same family, two children under the age of 10 are entitled to a complimentary membership. 6 members are entitled to a complimentary Starwood Preferred Guest membership. This entitles the card holder to various benefits all over the world. SPG points can be earned in all of the Resort s outlets. Not in conjunction with any other discount and or offer.

3 30-DAY PASS Adults (Anytime, including weekends and public holidays): 450 These 30-Day Passes entitle Members to 30 individual uses of The Club, to the exclusion of the Club Pool area. (Members are welcome to dine at The Club restaurant area for lunch) Children: Not Available 1. Passes that are not used within the season of issue will not be carried over to the next season. 2. The 30-Day Pass is also subject to the General Terms & Conditions under Part D hereof.

5 Part C GENERAL TERMS & CONDITIONS 1. These General Terms & Conditions, together with Parts A and B respectively, shall be valid from May 27th 2016 until October 2nd 2016, and regulate the conditions under which access to the Facilities (as described hereunder) will be provided by Dragonara Resort Limited. 2. Membership entitles holders of a Seasonal Membership or Day Membership (collectively referred to hereinafter as Members ) to the use and enjoyment of the facilities of the Club (except the Club Pool and lower deck. Members are welcome to dine at The Club restaurant area for lunch -hereinafter referred to as Facilities ). 3. Access to the Facilities shall only be granted to the Members upon the production of a valid Membership at the entrance of the said Facilities, and only when such Membership is presented at any time during the Club Operation Hours under paragraph 4 hereunder. 4. Club Operation Hours: Dates :00-18:00 09:30-19:00 09:00-19:00 10:00-18:00 Half-Day Membership applies from hours onwards and only on Monday to Friday. 5. Only food & drinks purchased from The Westin Dragonara Resort Food and Beverage Outlets may be consumed at The Club. All food & beverage will be available from Palio s Restaurant. Members will be asked to remove and refrain from consuming food not from the hotel. 6. Beverage service to the sun beds shall be available on request and against payment.

6 8. Except as otherwise specified in these terms and conditions, no part of the Membership may be used in conjunction with any other offer. Discounts are not cumulative. 9. Dragonara Resort Limited shall not be liable for any loss or theft to property that may occur in Facilities, except when any such loss or theft arises as a direct result of the gross negligence or fraud of Dragonara Resort Limited or that of its employees or agents. 10. Management Reservations 10.1 The Management reserves the right to use any part of the Facilities and deny access to Members to the Facilities or any part thereof, at all times, should there be any private functions, or at any time at the discretion of the Management. Without prejudice to the generality of foregoing paragraph, the Management hereby reserves the right to use the Facilities and deny access to the Members on the following dates or any other dates; TO BE ANNOUNCED 10.2 The Management reserves the right to alter any prices without prior notice The Management reserves the right to restrict or forbid any Member from using the Facilities where such Member has caused, or is causing a nuisance or has disturbed, or is disturbing the other Members enjoyment of the Facilities The Management reserves the right to terminate and revoke any Membership in the event of a breach of any one or more of the Terms & Conditions listed. 11. Members may order food or drinks from the sun bed menu available on the decks.

Work on dismantling of the Facilities area will commence as of the first week of September 2016 and Dragonara Resort Limited shall not be held liable for any inconvenience caused to Members as a result of any such dismantling works. 13. All prices indicated above are inclusive of VAT. 14. Dragonara Resort Limited collects the personal data of members in order to permit members, inter alia, to access The Club. By signing this agreement you consent to Dragonara Resort Limited processing your personal details in accordance with the Data Protection Act (Cap 440 of the Laws of Malta). Dragonara Resort Limited will disclose your personal details if and when it is required to do so under any applicable law, as well as to any bona fide third parties who may wish to send you promotional information. You have the right to access data which the Dragonara Resort Limited holds about you, and, where applicable, the right to ask for a rectification or erasure of such data. Dragonara Resort Limited may also use your personal data for the purposes of sending you promotional information about any other products or services it may offer. 15. Members shall be required to follow any reasonable directions which may be given to them by Dragonara Resort Limited and failure by any Member to do so may result in termination of that Member s membership. In the event of any such termination, the Member shall not be entitled to receive any compensation from Dragonara Resort Limited. 16. All Terms and Conditions shall be governed and construed in accordance with Laws of Malta. The Maltese Courts shall be competent to interpret these Terms & Conditions.
