1 OPEN TENDER NOTICE Dated: Sealed quotations in single cover consisting of two inner sealed covers (containing Technical cover as Part I and price cover as Part II) super scribing the Name of work, Part Number and Tender reference will be received up to date and time as mentioned below by the office of Chief Executive Officer, NTPL, Harbour Estate, Tuticorin Necessary Schedule may be obtained on payment of the cost of the Tender Document by DD drawn in favour of NLC Tamilnadu Power Ltd, payable at Tuticorin on any Nationalized Banks or Scheduled Banks. Tender schedule will be issued only up to PM on the date as indicated for sale of tender documents. The tender documents are also available in the Web Site of NLC who wish to download the same may do so. While submitting the tender documents, a demand draft towards cost of tender document should be enclosed.the tender documents downloaded from the website and received without demand draft for the specific value will be summarily rejected. The tender schedule can be obtained from the office of the CEO/NTPL on any working day during normal working hours as detailed below on payment of the cost of tender documents in the form of Crossed Demand Draft drawn in favour of NLC Tamilnadu Power limited - TUTICORIN Payable at TUTICORIN.The tenderers in their own interest shall watch the website of NLC for any amendment / corrigendum and shall take note of such amendments / corrigendum in their bid. Corrigendum if any shall be duly signed and enclosed in part I cover while submitting the tender documents. Any failure on this part shall be attributable only to the tenderer and NTPL is not responsible in this regard. 2 The bidder should have satisfactorily completed any two Civil works for a value not less than Rs. 6,81,000/- each in single agreement in any Govt/Quasi-Govt/ PSU/PSE/Public Ltd company during the last seven years preceding the original scheduled date of Tender opening. OR The bidder should have satisfactorily completed any three Civil work for a value not less than Rs.5,45,000.0/- each in single agreement in any Govt/Quasi-Govt/ PSU/PSE/Public Ltd company during the last seven years preceding the original scheduled date of Tender opening. Note: Documentary evidence, for the above should be submitted along with tender documents. Other Requirements: Part: II i) The bidder should have independent Provident fund code number allotted in favour of his establishment under EPF &Misc provisions Act 1952.The PF code number so allotted shall be furnished along with Tender documents. ii) The bidder should have registered (its establishment) under ESI Act 1948, and have the Employers code allotted in favour of his establishment. The ESI code number so allotted shall be furnished along with the Tender documents. iii) The personnel / Workmen engaged by the bidder for execution of works in NTPL under the contract shall be borne on the rolls of bidder agency and shall have to be given appointment letter / employment card under CL(R & A) act issued by the bidder to that effect. The bidder has to furnish a certificate of undertaking to that effect, along with the tender documents. (iv)the bidder shall also possess a valid certificate of registration under service tax Act / Rules, he should have discharged his liability, under the service tax and not a defaulter in payment of service Tax to the effect of which a certificate of undertakings is to be furnished along with Tender documents. (v) The bidder should have obtained the permanent Account Number (PAN) under the Indian Income Tax Act and he should also produce acknowledgement receipt evidencing the filing of IT returns for the period of four years prior to the date of tender or such other period, the bidder / firm / company has been carrying on its business continuously after its registration/incorporation whichever is lesser. Documentary evidence in the form of copy of Agreement and work completion certificates shall be submitted along with the Bid Other Conditions: I. The tenderer should enclose along with his / their tender the work completion certificate with value and period of work issued by the organization with whom the contract has been entered for having met the qualifying requirements mentioned along with necessary documentary evidence like copy of contract agreement / work order. The tenderer should enclose along with his / their tender, necessary documentary evidence for firm / company. It is the responsibility of the Bidder to prove that they are qualified for the work and no further details will be received after opening the Tender. II. Notwithstanding anything stated above the owner reserves the right to assess the capacity and capability of the tenderer to perform the contract, if the circumstances warrant such an assessment in overall interest of the owner/purchaser. III. All the PQR Works should have been carried out within India in Government / Quasi- Government / Public Sector Undertakings / Public Limited Companies in India in bidder s own name. 3 IV. Tender submitted without proper documentary evidence to substantiate the fulfillment of the qualifying requirements as specified are likely to be rejected without assigning any reasons. V. The performance certificates and other documents related to pre- qualification furnished by the bidder along with the bid are liable for verification on authenticity. If any of the above certificates / documents are found to be forged / bogus, his / their offer will be summarily rejected. If the certificates submitted by any Tenderer is found to be forged or bogus, the Tenderer shall not only be disqualified for the tender but also shall be blacklisted by NTPL in taking part in any tender for a period of 3 (Three) years including forfeiture of EMD. If on a later date, the certificates are found to be bogus, the contract will be terminated at the cost and risk of the bidder and the bidder shall be black listed. VI. If the tenderer is a partnership firm and if there is any reconstitution of the partnership, the same should be intimated to NTPL immediately; otherwise, the contract will be liable for termination at the risk and cost of the tenderers. The partner on whose pre-qualification, the work was awarded should not withdraw from the partnership till the completion of the work, in case they happened to be the successful bidder VII. The bidders should enclose a declaration regarding relatives employed in the Corporation along with the tender and tenders not accompanied by this declaration are liable to be rejected. 3.0 Time schedule: 5 months from the date of handing over of site. 4.0 PRESCRIBED TENDER FORMAT: 4.1 Sealed Tender shall be submitted in the prescribed format which can be collected from the office of the Chief Executive Officer, NLC Tamil Nadu Power Ltd, Harbour Estate, Tuticorin during office hours on payment of the cost of Tender Documents of Rs.5,000/- by Demand Draft drawn in favour of NLC Tamil Nadu Power Ltd payable at Tuticorin. No other mode of payment will be accepted. 4.2 Tenders shall be kept valid for 90 days from the date set for Tender opening. However if any extension of validity is called for, the Tenderer shall extend the same. 5.0 NON-TRANSFERABILITY: The Tender documents so purchased shall not be transferable and the amount remitted towards cost of tender documents shall not, on any account, be refunded. 6.0 EARNEST MONEY DEPOSIT (EMD): 6.1The Earnest Money Deposit is to be submitted along with the tender and it shall be either in the form of Demand Draft drawn in favour of NLC Tamil Nadu Power Ltd, payable on par at Tuticorin or in the form of Bank Guarantee obtained from any scheduled commercial Bank other than UCO bank, valid for 120 days from the date set for Tender opening and the same shall be enclosed with the Tender. In the case of BG furnished towards EMD, the same shall be executed by the banker on a non-judicial stamp paper of value not less than Rs 80/- which shall be purchased in the name of the Banker. 6.2The Tenders submitted without the Earnest Money Deposit in the aforesaid manner or in any other manner or short in amount or any adjustment with any pending payment shall be summarily rejected. 6.3 No interest shall be allowed on the EMD. 4 6.4 The firms registered with NSIC / covered under MSMED Act 2006 / MSME are exempted from furnishing bid guarantee / cost of tender documents & EMD provided that such small scale units are registered under single point registration scheme of NSIC / covered under MSMED Act 2006 / MSME and the same is valid on the scheduled date of tender opening and the product range mentioned in the certificate is the same or similar to the tender requirement. The NSIC / covered under MSMED Act 2006 / MSME certificate duly attested by any Notary Public (or) Gazetted Officers (or) practicing Chartered Accountant with seal and date shall only be accepted. However, the firms with valid NSIC / MSME, if they happen to be a successful tenderer, the EMD amount mentioned in the tender enquiry has to be submitted towards initial security deposit before issue of the Letter Of Intent / Award (LOI/LOA) within 15 days from the date of intimation. Otherwise our earlier intimation is liable for cancellation and non-issue of LOI / LOA. The EMD amount towards initial security shall be either in the form of demand draft / Pay Order / Banker s Cheque drawn in favour of NLC Tamilnadu Power limited - TUTICORIN payable at par at TUTICORIN. The security deposit will be released after successful completion of contract. 7.0 SUBMISSION OF TENDER AND OPENING: a) Tenders duly signed in all pages are to be submitted in TWO PARTS IN SEPARATE SEALED COVERS as follows: Part I consists of EMD, Technical and commercial aspects, Qualifying documents and Part II consists of prices (price schedule) only. All other terms and conditions along with technical details, time schedule, EMD, validity of Tender and instruction to tenderers, etc. are contained in Tender documents. The outer cover shall also be superscribed with Tender No. Date of opening and name of the tenderer with postal address. The sealed tenders shall be deposited in the Tender Box at the Office of the Chief Executive Officer, NLC Tamil Nadu Power Ltd, Harbour Estate Tuticorin within the stipulated date & time. b) The Tenders so submitted shall be opened in the presence of the Tenderer and or his authorized representatives, not exceeding one person from each tenderer. The Part I cover only will be opened on due date and time and Date and time of opening of Part II cover shall be intimated only to the bidders qualified for the work. c) NTPL shall not be responsible for any delay/loss in receipt of the submitted Tender which is sent through post/courier. d) Issuance of tender documents need not be construed to mean that such tenderer would be automatically considered. e) The Tenders submitted beyond the date & time mentioned in the tender notice will not be accepted. f) The Tenderers shall submit full credentials / experience, performance certificate of work executed. g) The rates should be free from correction and overwriting and should be neat and legible and written in words and figures otherwise liable for rejection. The special and General Conditions and specifications should be signed at places indicated as token of acceptance. h) The Tenderer should visit the place of work and satisfy himself about the plant and scope of work before submitting the bid. i) If the prescribed date of submission of Tender is later declared as a holiday, Tender can be submitted on the next working day and the Tender shall be opened on the next working day. 5 j) NTPL reserves the right to reject all tenders and cancel the Tender without assigning any reason. k) NTPL shall not entertain any claim on account of preparation of tenders. l) In case the tender document is downloaded from the website the cost of tender document should be remitted in the form of a separate DD (The DD shall be drawn in favour of NLC Tamilnadu Power limited - TUTICORIN Payable at TUTICORIN, and enclosed in Part- I cover failing which the tender shall be summarily rejected. On the top of the cover, the Tender Number, and opening date should be superscribed and addressed to the Chief Executive Officer, NTPL, Harbour Estate Tuticorin , Tamil Nadu and the Tenderer s address, failing which the tender shall be summarily rejected. The tenderer shall also see the Press/website regularly for any amendments/clarifications issued on the tender and shall submit a signed copy of the amendments/clarifications issued in acceptance of the same. Any failure on this part shall be attributable only to the tenderer and NTPL is not responsible in this regard. m) Tender submitted by telex / telefax, or telegram and tender received after the expiry of the time specified for receiving the tender will be summarily rejected. n) No deviations from the draft contract, general, commercial and technical Conditions / Specifications are allowed.
