3 CITY OF HUNTLEIGH ST. LOUIS COUNTY, MISSOURI PROPOSED BUDGET FOR 2013 TO THE MAYOR AND MEMBERS OF THE BOARD OF ALDERPERSONS OF THE CITY OF HUNTLEIGH, ST. LOUIS COUNTY, MISSOURI Gentlemen: For your consideration I hereby submit this budget message and the proposed balanced budget for the calendar year This presents a complete financial plan for the ensuing budget year and includes the information required by Chapter 67 of the Revised Statutes of Missouri. Important features of the budget are as follows: I. A Schedule of estimated revenues to be received from all sources for the year 2013 with a comparative statement of actual revenues for the years 2011 and 2012, itemized by year, fund and source; II. A Schedule of proposed expenditures for all classifications for the year 2013 together with a comparative statement of actual expenditures for the years 2011 and 2012, itemized by year, fund, activity and object with a statement that no amount is required for the payment of interest, amortization and redemption charges since the City is not in debt; III. A General Tax rate calculation for the year 2013; IV. A general Budget Summary; V. A proposed Entry of Record for the general Appropriation of Funds for All amounts concerning actual revenues and expenditures for the years 2011 and 2012 were obtained by reference to the records of the City Treasurer, and City Clerk. Proposed expenditures represent an appraisal as to the City's maximum requirements. According to the St. Louis County Assessor's Office, the 2013, total of assessed valuation of all property located within the City of Huntleigh subject to taxation by it for municipal purposes during the year 2013 are as follows: Residential Property Agricultural Properties Commercial/Utility Property Personal Property TOTAL $37, 169, $5, $408, $3,720, $41,303,

4 The total represents a change in the total assessed valuation from the preceding year as follows: Residential Property valuation decreased $775,750.00; Agricultural Property valuation decreased $410.00; Commercial/Utility Property valuation increased $22,128.00; and Personal Property valuation increased $401, In order that present assets can be conserved as much as possible and to be able to provide for the payment of expenses essential to the efficient operation of the City, it is recommended that there be a levy on all property subject to taxation in the City of Huntleigh for the year 2013, taxes for municipal purposes of: $0.201 per each $ of the assessed valuation of Residential Property; $0.310 per each $ of the assessed valuation of Agricultural Property; $0.265 per each $ of the assessed valuation of Commercial/Utility Property; and $0.209 per each $ of the assessed valuation of Personal Property. Based on the latest available information, this would provide total tax revenue of $83, The proposed budget presents a sincere effort to balance the City's finances rather than to make a profit or to create a deficit. Every effort has been put forth in order to hold both proposed expenditures and the suggested property tax rate at minimum amounts. 15 AGREEMENT RELATING TO THE PROVISION OF POLICE SERVICES, FIRE PROTECTION SERVICES, PARAMEDIC AND EMERGENCY AMBULANCE SERVICES This Agreement made and entered into by and between the City of Frontenac, Missouri ("Frontenac"), a City of the 4th Class in St. Louis County, Missouri, and the City of Huntleigh, Missouri ("Huntleigh"), a City of the 4th Class in St. Louis County, Missouri. WITNESS ETH: WHEREAS, Huntleigh is desirous of receiving police, fire, emergency medical service, (EMS) and ambulance services ("Services") to be provided by Frontenac; and WHEREAS, Frontenac is willing to provide such Services to Huntleigh; and WHEREAS, Article VI, Section 16, of the Missouri Constitution, and R.S.Mo and authorize Frontenac to provide these Services to Huntleigh; and WHEREAS, Huntleigh has duly enacted and approved its Ordinance No. 208 authorizing its Mayor to execute this Agreement; and WHEREAS, Frontenac has duly enacted and approved its Ordinance No../lo /!-/ft, 73 authorizing its Mayor to execute this Agreement. NOW, THEREFORE, it is agreed by and between the parties as follows: Section 1. Contract for Services. Frontenac shall provide Huntleigh with said Services and within the municipal limits of Huntleigh on the terms and conditions hereinafter stated. Section 2. Services Provided. Said Services provided or arranged for by Frontenac to Huntleigh shall be the same general Services now provided within the municipal limits of Frontenac for itself. A. Police related Services hereunder shall include but not be limited to: 1. Regular motorized police patrols at such times as, in the sole determination of Frontenac, shall provide reasonable protection and safety to the City and residents of Huntleigh; 2. Police checks of homes of residents of Huntleigh who are on vacation and who request such checks; \1

16 3. General traffic control on the public roads within Huntleigh; 4. Appropriate police response upon view or call from any officer, official, employee, resident or person in Huntleigh; and 5. Property and personal safety advisory services to the officials and residents of Huntleigh. B. Fire related Services hereunder shall include but not be limited to: 1. The dispatch by West Central Dispatch Center (WCDC) and response of available and appropriate fire personnel and equipment upon call from any officer, official, employee, resident or person in Huntleigh; and 2. The dispatch by WCDC of available and appropriate paramedic and emergency ambulance services. 3. Fire prevention advisory Services for the residents of Huntleigh. Section 3. Command and Control of Personnel and Equipment. All Frontenac employees, without detracting from their power and authority as employees of Frontenac and while serving within Huntleigh pursuant to the terms of this Agreement, shall serve as official personnel of Huntleigh; but the authorized command officers of Frontenac shall have exclusive control and command of all such personnel and all equipment provided by Frontenac, while such personnel and equipment are within the municipal limits of Huntleigh serving said City or its residents. Section 4. Powers of Employees. All employees of Frontenac while performing services to Huntleigh and its residents shall have all of the authority authorized by Missouri statutes and Huntleigh ordinances for employees performing such Services, including but not limited to in the case of police Services, including but not limited to in the case of police Services, the power to make arrests otherwise authorized to police employees of a City of the 4th Class. Section 5. Non-Liability of Frontenac. Frontenac shall not be liable to Huntleigh for delay, negligence or mistake in receiving, responding to or the performance of any said Services, nor shall this Agreement be interpreted as being an Agreement for the benefit of any third person, including but not limited to the officials, residents or City of Huntleigh. Section 6. Term. This Agreement shall be effective for a period of five years from January l, 2012, and shall expire at midnight, December 31, \J

17 Section 7. Consideration. Huntleigh shall pay to Frontenac, as consideration for the Services provided herein, a first year charge of One Hundred Twenty Six Thousand Five Hundred Fifty Nine Dollars ($126,559.00), payable in advance in equal monthly installments of Ten Thousand Five Hundred Forty Seven Dollars ($10,547.00), each beginning January 1, Thereafter, the annual charge for each of the following four (4) years shall be increased by an amount of 1.5% effective January 1 51 of the year. Section 8. Severability. In the event any provision contained in this Agreement shall be held or declared to be invalid, unlawful or unconstitutional for any cause by a court of competent jurisdiction, then it is hereby declared that the remaining portions and provisions of this Agreement shall be and remain unaffected thereby and shall remain in full force and effect. 18 BILL NO ORDINANCE NO AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT ON BEHALF OF THE CITY OF FRONTENAC, MISSOURI, TO PROVIDE POLICE, FIRE AND EMERGENCY MEDICAL SERVICES, TO THE CITY OF HUNTLEIGH, MISSOURI. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF FRONTENAC, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS: Section One: The City of Frontenac, hereby authorizes the Mayor on behalf of the City, to enter into an agreement, attached hereto as Exhibit "A" and made a part hereof by this reference, to provide police, fire, and emergency medical services to the City of Huntleigh, all within the municipal limits of the City of Huntleigh, for a term of five (5) years beginning January 1, 2012, and for compensation to the City of Frontenac at the rates therein provided. Section Two: This Ordinance shall be in full force and effect from and after its passage by the Board of Aldermen and approval by the Mayor. LOUIS COUNTY, MISSOURI FOR MOSQUITO CONTROL SER~J,Si:~. t~t'h N;_;t( This contract is made and entered into this 2tmt' day of Atlgust, 2011, by and between the City of Huntleigh a Municipal Corporation, (hereinafter referred to as "Municipality") and St. Louis County, Missouri, (hereinafter referred to as "County"). Witnesseth: Whereas, Municipality has enacted its Ordinance No./Resolution No. authorizing said Municipality to enter into this contract with County for mosquito control services to be performed within said Municipality through County's Department of Health; and Whereas, County is authqrized by Article II, Section (20) of County's Charter to cooperate and contract with other political subdivisions for common services; and Whereas, Section SLCRO 1974, as amended, authorizes the County Executive to contract on behalf of the Department of Health with political subdivisions for public health services; and Whereas, in conformity with Section SLCRO 197 4, as amended, the St. Louis County Council has adopted Resolution No. 3670, 1992 that sets forth the terms and conditions upon which mosquito control services are to be provided to Municipality; and Now therefore, in consideration of the mutual promises and undertakings herein set forth, County and Municipality agree as follows: Z06 1. County shall provide mosquito control services as indicated: Yes No a. b. Mosquito control services including adulticiding per County guidelines - to include all necessary materials, equipment, and personnel. Other mosquito control services including larviciding per County guidelines - to include all necessary materials, equipment, and personnel r Municipality shall: a. Pay County for mosquito control services including adulticiding at the hourly rate of seventy-two dollars ($72.00) and for other mosquito services including larviciding, at the hourly rate of forty-five dollars ($45.00). b. Make all payments by check payable to the order of the "St. Louis County Health Department". Billing will occur in November. Payments under above paragraph "a" of this section must be received by County before the 31st day of December, for the initial contract term and before the same day and month in succeeding periods of renewal. The initial contract term shall be for one year with automatically renewable one year periods, for a maximum of five (5) years, subject to changes in prices and services provided therein by County, as agreed to by Municipality. LOUIS COUNTY, MISSOURI FOR MOSQUITO CONTROL SERVICE AND AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF HUNTLEIGH TO ENTER INTO ON BEHALF OF SAID CITY A CONTRACT WITH ST. LOUIS COUNTY, MISSOURI FOR MOSQUITO CONTROL SERVICE. BE IT ORDAINED BY THE MAYOR OF THE CITY OF HUNTLEIGH AS FOLLOWS: SECTION 1: The Mayor is hereby authorized and directed to enter into and execute a contract with St. Louis County, Missouri, whereby said County, by and through its Department of Health, will perform mosquito control service within said City. SECTION 2: The City shall compensate St. Louis County, Missouri for services rendered at the hourly rate set forth in the contract and as such rates are changed in accordance with the terms and conditions of the contract between the City of Huntleigh and St. Louis County. SECTION 3: After execution thereof, this agreement shall be in effect for one ( 1) year with four ( 4) automatically renewable one (1) year periods (maximum five years). 22 CONTRACTUAL AGREEMENT FOR CODE ENFORCEMENT SERVICES LAND DISTURBANCE CODE This contractual agreement made and entered into this November 4, 201 O by and between the COUNTY OF SAINT LOUIS, MISSOURI hereinafter referred to as "COUNTY", and the CITY OF Huntleigh, MISSOURI hereinafter referred to as "MUNICIPALITY". WITNESSETH: WHEREAS, Article II, Section (20) of the 1979 Charter of the COUNTY authorizes COUNTY to contract with MUNICIPALITY for common services; and WHEREAS, the provisions of Section to inclusive, of the Revised Statues of the State of Missouri 1978, as amended, empower municipalities and other political subdivisions to contract and cooperate with each other for a common services; and WHEREAS, TITLE XI, CHAPTER 1114 LAND DISTURBANCE CODE, Section SERVICE TO MUNICIPALITIES of Saint Louis County, Missouri Revised Ordinances (SLCRO) 1974, as approved by COUNTY ordinance 22,468 on September 21, 2005, authorized COUNTY to contract with MUNICIPALITY enforce on behalf of MUNICIPALITY the Land Disturbance Code as adopted by MUNICIPALITY; and WHEREAS, MUNICIPALITY has duly enacted Ordinance Numbers: 203 and 204 said ordinances, a copy of which are attached hereto and made a part hereof, for the adoption of a Land Disturbance Code being identical in substance with COUNTY'S Land Disturbance Code, as adopted by COUNTY through ordinance 22,468, with said ordinances being approved by COUNTY on September 21, 2005, as amended and including ordinance 24,084, approved on August 12, 2009, and WHEREAS, MUNICIPALITY has duly enacted Ordinance Numbers: 203 and 204 a copy of which are attached hereto and made a part hereof, authorizing the execution of this contractual agreement on behalf of MUNICIPALITY. WHEREAS, MUNICIPALITY has duly enacted Ordinance Numbers: 203 and 204 said ordinances, a copy of which are attached hereto and made a part hereof, for the adoption of an Explosives Code being identical in substance with COUNTY'S Explosives Code, as adopted by COUNTY through last amendatory ordinance 18,693, with said COUNTY ordinance being approved November 12, 1997; and \1 Page 1 of 8

23 WHEREAS, MUNICIPALITY and COUNTY entered into a contractual agreement approved by MUNICIPALITY on November 4, 2010 for and in consideration of the mutual promises, covenants, and obligations stated within said written contractual agreement, a copy of which is attached hereto and made a part hereof, for the enforcement of the EXPLOSIVES Code adopted by MUNICIPALITY NOW, THEREFORE, for and in consideration of the mutual promises, covenants, and obligations hereinafter stated, the COUNTY and MUNICIPALITY mutually agree as follows, to-wit: 1.1 SCOPE OF SERVICES. ARTICLE I SCOPE OF SERVICES COUNTY Authority and Responsibilities: COUNTY shall provide MUNICIPALITY code enforcement services in the manner proscribed in the applicable provision of MUNICIPALITY'S Land Disturbance Code for: MAJOR LAND DISTURBANCES (COUNTY RESPONSIBILITIES) (1) Review plans for Major Land Disturbance Activities, including Best Management Practices (BMP) plans submitted by a permit applicant for the control of erosion, and sedimentation during permitted construction and other Major Land Disturbance activities; and (2) Issue permits for Major Land Disturbance Activities. COUNTY shall not issue any permit for Major Land Disturbance Activities until COUNTY receives confirmation that the proposed activity complies with MUNICIPALITY zoning and roadway requirements. (3) Inspect Major Land Disturbance activities; including activities within or abutting areas designated one-hundred (100) year flood plain for compliance with the MUNICIPALITY approved plans; and (4) Collect and retain appropriate fees from permit applicants for plan review and inspection activities performed by COUNTY (5) Provide inspection reports to MUNICIPALITY to assist MUNICIPALITY in their determination for the release of site development Escrows. ORDINARY LAND DISTURBANCES (COUNTY RESPONSIBILITIES) (1) Review and approve applications and plans for Ordinary Land Disturbance activities, including Best Management Practices (BMP) plans submitted by a permit applicant for the control of erosion and sedimentation during permitted construction and other Ordinary Land Disturbance activities; and (2) Issue permits for Ordinary Land Disturbance activities; and (3) Inspect Ordinary Land Disturbance activities; including activities within or abutting areas designated one-hundred ( 100) year flood plain for compliance with the MUNICIPALITY approved plans; and (4) Collect and retain appropriate fees from permit applicants for plan review and inspection activities performed by COUNTY \I Page 2 of 8

24 (5) Provide inspection reports to MUNICIPALITY MUNICIPALITY Authority and Responsibilities. - MUNICIPALITY shall retain authority and responsibility for code enforcement services in the manner proscribed in applicable provision of MUNICIPALITY'S Land Disturbance Code for: MAJOR LAND DISTURBANCES (MUNICIPALITIES RESPONSIBILITIES) ( 1) Receive applications for Major Land Disturbance permits and forward them to the COUNTY for processing and issuance of permits; and (2) Review and approve application and plan details related to the construction, repair, alteration, maintenance or condition of roadways and roadway right-ofways that are maintained by the MUNICIPALITY; and (3) Review and approve application and plan details related to Major Land Disturbance activities within or abutting areas designated one hundred (100) year flood plain; and (4) Review and approval application and plan details for compliance with Zoning codes and ordinances of the MUNICIPALITY; and (5) Advise permit applicants of their responsibility to cooperate with, and comply with, the requirements of the COUNTY Department of Highways and Traffic, the Missouri Department of Transportation (MODOT) the Metropolitan St. Louis Sewer District (MSD) and the Department of Natural Resources (DNR) when the proposed Land Disturbance Activity impacts the facilities of said principals; and (6) Administer determination, collection and release of site development escrows required by the Land Disturbance Code adopted by MUNICIPALITY; and (7) MUNICIPALITY shall advise COUNTY when proposed Major Land Disturbance activities are in compliance with MUNICIPALITY Zoning codes, roadway requirements and other laws and regulations of the MUNICIPALITY. ORDINARY LAND DISTURBANCES (MUNICIPALITIES RESPONSIBILITIES) (1) Receive applications for Ordinary Land Disturbance permits and forward them to the COUNTY for processing and issuance of permits; and (2) Review and approval of plan details related to the construction, repair, alteration, maintenance or condition of roadways and roadway right-of-ways that are maintained by the MUNICIPALITY; and (3) Review and approve plan details related to Ordinary Land Disturbance activities within or abutting areas designated one hundred (100) year flood plain; and (4) Advise COUNTY when the proposed Ordinary Land Disturbance activities meet the Zoning roadway requirements and other laws and regulations of the MUNICIPALITY STREAM BUFFER PROTECTION, MUNICIPALITY Authority and Responsibilities. - MUNICIPALITY shall retain full authority and responsibility for enforcement of MUNICIPALITY'S Stream Buffer Protection Ordinance. MUNICIPALITY may at its election, request the COUNTY to provide advisory plan review and /or inspection services pursuant to Section of this contractual agreement \I Page 3 of 8

25 ARTICLE II TERM OF AGREEMENT 2.1 TERM OF AGREEMENT. This contractual agreement shall commence on December 1, 2010 and shall continue in effect from year to year unless terminated as provided in ARTICLE IX herein. ARTICLE Ill PERMITS, INSPECTIONS, LICENSING AND APPROVAL OF PLANS 3.1 PERMITS. COUNTY through its Department of Public Works shall issue all permits required by the Land Disturbance Code as set forth in Paragraph herein. 3.2 INSPECTIONS. COUNTY through its Department of Public Works shall execute all inspections required by the Land Disturbance Code as set forth in Paragraph herein. Contractual Agreement Code Enforcement Services Land Disturbance Code 3.3 LICENSING. COUNTY through its Department of Public Works shall license all persons as required by the Land Disturbance Code or other construction codes adopted by COUNTY. 3.4 APPROVAL OF PLANS. COUNTY through its Department of Public Works shall examine all applications and plans for Land Disturbance Activities to determine their compliance with the Land Disturbance Code as set forth in Paragraph herein. ARTICLE IV RESTRICTIVE PROVISIONS 4.1 RESTRICTIVE PROVISIONS. If MUNICIPALITY has adopted provisions applicable to the services as set forth in Paragraph herein said provisions being more restrictive than those contained in COUNTY'S Land Disturbance Code MUNICIPALITY shall approve all plans, prior to submission to COUNTY'S Department of Public Works for issuance of permits. ARTICLE V REGULATORY ORDINANCES 5.1 REGULATORY ORDINANCES. MUNICIPALITY shall review and approve all plans for compliance with MUNICIPAL Land Disturbance Code, other rules, regulations, ordinances, codes or laws of MUNICIPALITY and other applicable regulations identified in Paragraph herein prior to the submission of an application for a Land Disturbance permit to COUNTY'S Department of Public Works. ARTICLE VI ENFORCEMENT OF MUNICIPAL ORDINANCES 6.1 ENFORCEMENT. COUNTY shall not take any action, either at law or in equity, to l \I Page 4 of 8

26 enforce the provisions of MUNICIPALITY'S ordinance for the adoption of MUNICIPALITY'S Land Disturbance Code, as the same shall apply hereto. COUNTY shall notify MUNICIPALITY of any known violations of MUNICIPALITY'S ordinance. ARTICLE VII FEES 7.1 FEE COLLECTION. All fees including, but not limited to "No Permit" penalties and administrative penalties, paid to COUNTY in accordance with COUNTY Land Disturbance Ordinance and shall be collected and retained by St. Louis COUNTY as payment for services rendered pursuant to this contractual agreement. MUNICIPALITY shall collect and retain all fines and costs arising from MUNICIPALITY'S prosecution of code violations. ARTICLE VIII AMENDMENTS TO COUNTY CODE 8.1 AMENDMENTS. The adoption of the Codes referenced herein includes all subsequent amendments to the COUNTY Codes adopted by the MUNICIPALITY. COUNTY shall supply MUNICIPALITY with a copy of the amendment(s) and MUNICIPALITY shall provide to COUNTY with a written confirmation of receipt of the amendments. 8.2 ADOPTION OF NEW CODE. In the event the COUNTY adopts a new edition of the Land Disturbance Code or a new national Code, the MUNICIPALITY shall amend its ordinance to make it identical in substance to the Code adopted by COUNTY. COUNTY shall supply MUNICIPALITY with a copy of its proposed new Code prior to its effective date and MUNICIPALITY shall amend its ordinance within Ninety (90) days of the effective date of said COUNTY adoption. In the event COUNTY shall fail to provide a copy of its proposed Code as provided above, MUNICIPALITY shall have Ninety (90) days to amend its ordinance after receipt of COUNTY'S Code. 8.3 ORDINANCE COPIES. When a new Code is adopted by COUNTY pursuant to 8.2, MUNICIPALITY shall supply COUNTY with at least two (2) copies of all MUNICIPALITY ordinances to adopt a new Land Disturbance Code within five (5) days of said legislation's effective dates. All ordinances must be marked with original signatures of the chief elected official of the MUNICIPALITY, an original signature of the attesting Clerk of the MUNICIPALITY and an embossed MUNICIPALITY seal. ARTICLE IX TERMINATION 9.1 FAILURE TO AMEND. In the event MUNICIPALITY shall fail to amend its ordinance as required by Paragraph 8.1 herein this contractual agreement shall be terminated. 9.2 TERMINATION FOR CONVENIENCE. Either COUNTY or MUNICIPALITY may terminate this contractual agreement at any time by giving Ninety (90) days prior written notice to the other party.
