DT Sub: RECRUITMENT - Termination of services of employees appointed on dailywage basis - Further instructions - Issued. Ref: 1. Circular NO.PD-22/1999, dt Circular No.PD-28/2000, Minutes of Joint meeting held byvc & MD with APSRTC NMU (Recognised) on *** Instructions were issued through Circular 1st cited in regard to the procedure to be followed bythe appointing authorities for deleting the name of a dailywage workman from the panel, whose work is found to be un-satisfactorywith reference to the parameters specified therein, since dailywage employees are not employees of the Corporation as per APSRTC Employees (CC&A) Regulations, Instructions were also issued through Circular 2nd cited that if anycasual/dailywage workman is deleted from the select list otherwise than the procedure indicated in the circular 1st cited, the higher authoritycan review the proceedings of {he lower authorityon the basis of a written representation made byaffected person or suo-motto and set aside the proceedings, lacking in the procedure. As per the Minutes of the meeting vide reference 3rd cited, the issue of deletion of names of the casuals from the panel has once again been reviewed and the following instructions are issued in regard to the procedure to be followed when an allegation of mis-conduct is made against the casual/dailywage workman. (List of acts which constitute misconduct and detrimental to the interest of the Organisation, for which a dailywage workman can be charged, is at ANNEXURE). 1.When an employee is appointed on casual/dailywage basis, there must be a specific mention in the appointment order that he/she will be paid dailywage for the days he/she has Worked in the month and would not be entitled for wages for the days he/she has not worked or could not be engaged for non-availabilityof duties. 2.When an allegation of serious mis-conduct is made against a dailywage workman, the disciplinaryauthorityshall frame a charge sheet byquoting this circular (since CC&A Regulations are not applicable to them) dulykeeping him/her under "put off duty", 3.After obtaining the explanation of dailywage workman to the charge sheet or after giving reasonable time to submit the explanation Le., one week, a detailed enquiryshall be
2 conducted as earlyas possible, if necessary, but not later than three months dulyfollowing the principles of natural justice as in the case of regular employee. 4.The delinquent is entitled to 15 days wages for everymonth under put off duty, duly effecting statutoryrecoveries. 5.The disciplinaryauthorityon receipt of EnquiryOfficer's report mayissue a show cause notice depending upon merits of the case dulygiving reasonable time i.e., one week, to enable the delinquent to submit explanation. 6.On perusing the explanation to show cause notice, final orders maybe passed for deletion of name from the select list. 7.If the lapse on the part of dailywage workman does not warrant deletion of his/her name from the select list, such lapses have to be treated as un-satisfactorywork and the daily wage workman shall be counselled for such deficiencywith an advise not to repeat such things in future dulyrecording of such lapses, in the counselling Register which shall be specificallymaintained for this purpose. 8.If such lapses are committed more than thrice, the name of such workman shall be deleted byfollowing the above procedure. 9.The dailywage workman mayappeal against the order of deleting his/her name from the panel, to the authoritynext above that which passed the original order. The instructions issued through the circulars 1 st and 2nd cited are modified to the extent indicated above with immediate effect. These revised instructions shall be followed onlyin case of misconduct of a dailywage workman. 4 ANNEXURE TO CIRCULAR NO.PD-03/2005,Dt: Misconduct: i)unauthorisedlyusing vehicles of the Corporation; ii)driving vehicles of the Corporation without possessing proper licence or without being iii) authorised in writing to do so or allowing anyother person to act in this manner. Collusion with anyperson or persons with a view to depriving the Corporation of its legitimate revenue; iv)abuse or mis-use of propertyof the Corporation. v)loss of printed tickets and loss of other forms. vi) Failure on the part of the Conductor! Booking Clerk to issue valid passengers/ luggage vii) viii) ticket, in accordance with the order passed bythe Corporation or anyother authority under the Corporation, from time to time, before starting or allowing a bus to be started from the point, where such passenger/ luggage, boarded or loaded as the case maybe in respect of mofussil services, and before passing a Ticket Issue Completion Point, fixed from time to time in respect of City/Town Services", Insubordination or disobedience, whether individuallyor with another or others, to anylawful order of a Superior Officer, a) Gross negligence resulting in or likelyto result in, serious loss to the Corporation or inconvenience to the public or both; b) Neglect of duty- resulting in or likelyto result in danger to the lives of employees or of their persons or both; ix)theft, fraud, dishonesty, embezzlement, forgery, cheating in his capacityas an employee or misappropriation in connection with the business or the propertyof the Corporation; x)taking and offering of bribes; xi)improper behaviour towards women passengers; xii) Anyother act involving moral turpitude which is punishable unger the Indian Penal Code, 1860; xiii)being under the influence of drink while on duty; xiv) Assaulting anyperson inside the premises or in the vehicles to the Corporation; xv) Striking work or inciting others to strike working contravention of the provisions of law in force for the time being; xvi) Damage premises vehicles or other propertyof the Corporation wilfullyor due to negligence or connivance at or failure to prevent such damage or loss; xvii)sabotage; xviii)anyact involving moral turpitude which is punishable under the provisions of the Indian Penal Code; xix) Intemperate habits affecting the efficiencyof the work; xx) Breach of anyadministrative circulars or orders; xxi) Riotous or disorderlybehaviour or intimidation in the premises of the Corporation; or outside while on dutyor anyact subversive of discipline; this includes shouting of slogans criticizing the Corporation or anyif its servants and wearing "protest badges"; xxii) Repeated or continued negligence or neglect of work;
5 xxiii)meeting of the employees in the premises, vehicles or other propertyof the Corporation without the prior permission of the competent authority. xxiv)insolence, impertinence or unrulybehaviour towards members of the public or any employee while on duty: xxv)failure on the part of an employee to give full and correct information regarding his previous historyand record or regarding anymatter connected with the Corporation in connection with anyoffence committed byhimself or anyother person, within his knowledge. when demanded bya superior officer; xxvi)issue of used tickets to passengers; xxvii) Excess cash found with a Conductor or driver without proper explanation; xxviii) Under issue of tickets, i.e., issue of tickets for less than the actual distance travelled bya passenger and failure on the part of a Conductor to maintain records in the proper manner; xxix)the making of an allegation. knowing it to be cause, against the Corporation a member of the Corporation or an Officer or member of the staff of the Corporation; xxx)misuse of IdentityCard issued to the employee; xxxi)over-speeding bya driver, xxxii) Tampering with or destroying the evidence relating to offences committed bythe employee himself or another employee; xxxiii) Taking part in subversive or political activities or activities prohibited byanylaw in force or made furnishable byanylaw in force or other activities prejudicial to the interest of the Corporation; xxxiv) Making malicious or false allegations against Corporation or its Official; xxxv)unauthorised communication of official document or information; Anyother act not specificallymentioned above but which is prima facie detrimental to the interests of the Corporation; xxxvi) Violating anyother specific rule o'r instructions of the Corporation in force.
