1 ANNEXURE-I Misconduct: 1. Irregular to his/her duties; 2. Fails to wear Uniform; 3. Not courteous with the passengers; 4. Fails to pick up passengers enroute; 5. Loss of printed tickets and loss of other forms; 6. Failure on the part of the Conductor/Driver to issue valid passenger/luggage ticket in accordance with the order passed by the Corporation or any other authority under the Corporation, from time to time, before starting or allowing a bus to be started from the point, where such passenger/luggage, boarded or loaded as the case may be in respect of mofussil services and before passing a Ticket issue Completion Point, fixed from time to time in respect of City/Town Services; 7. Issue of used tickets to passengers;

2 8. Excess cash found with a Conductor or driver without proper explanation; 9. Under issue of tickets, i.e., issue of tickets for less than the actual distance traveled by a passenger and failure on the part of a Conductor/Driver to maintain records in the proper manner; 10. Over-speeding by a driver or driving the bus in rash and negligent manner; 11. Intemperate habits affecting the efficiency of the work; 12. Consuming alcohol or under the influence of drink while on duty; 13. Insolence, impertinence or unruly behaviour towards members of the public or any employee while on duty; 14. Improper behaviour towards women passengers; 15. Insubordination or disobedience, whether individually or with another or others, to any lawful order of Superior Officer; 16. Gross negligence resulting in or likely to result in serious loss to the Corporation or inconvenience to the public or both; 17. Negligence of duty resulting in or likely to result in danger to the lives of employees or other persons or both;

3 18. Repeated or continued negligence of work; 19. Theft, fraud, dishonestly, embezzlement, forgery, cheating in his capacity as an employee or misappropriation in connection with the business or the property of the Corporation; 20. Sabotage; 21. Unauthorized using of vehicles of the Corporation; 22. Driving vehicles of the Corporation without possessing proper licence or without being authorized in writing to do so or allowing any other person to act in this manner; 23. Collusion with any person or persons with a view to depriving the Corporation of its legitimate revenue; 24. Abuse or misuse of property of the Corporation; 25. Misuse of identity Card issued to the employee; 26. Assaulting any person inside the premises or in the vehicles of the Corporation; 27. Taking and offering of bribes; 28. Striking work or inciting others to strike work in contravention of the provisions of law in force for the time being;

4 29. Damage to premises/vehicles or other property of the Corporation willfully or due to negligence or connivance at or failure to prevent such damage or loss; 30. Riotous or disorderly behaviour or intimidation in the premises of the Corporation or outside on duty or any act subversive of discipline, which includes shouting of slogans, criticizing Corporation or any of its servants and wearing protest badges; 31. Meeting of the employees in the premises, vehicles or other property of the Corporation without the prior permission of the Competent authority; 32. Failure on the part of an employee to give full and correct information regarding his previous history and record or regarding any matter connected with the Corporation in connection with any offence committed by himself or any other person, within his knowledge, when demanded by a superior officer; 33. Making malicious or false allegations against the Corporation, a member of the Corporation or an Officer or member of the staff of the Corporation; 34. Tampering with or destroying the evidence relating to offences committed by the employee himself or another employee; 35. Taking part in subversive or political activities or activities prohibited by any law in force or punishable by any law in force or other activities prejudicial to the interest of the Corporation; 36. Unauthorized communication of official document or information; Any other act not specifically mentioned above but which is prima facie detrimental to the interests of the Corporation;

5 37. Breach of any administrative circulars or orders; 38. Violating any other specific rule or instructions of the Corporation in force. 39. Any other act involving moral turpitude which is punishable under the Indian penal Code, 1860; **** ANNEXURE II CONTRACT SERVICE AGREEMENT THIS DEED OF AGREEMENT is arrived at between the APSRTC through its Depot Manager (hereinafter called as the FIRST PARTY and Sri/Smt./Ms. s/o d/o w/o aged about years, R/O of H.No. (hereinafter called as the SECOND PARTY) for engaging the services of the SECOND PARTY as Driver/Conductor. WHEREAS the Corporation (FIRST PARTY) desires to engage the SECOND PARTY on contract basis for a period of months and the SECOND PARTY has agreed for such engagement on contract basis. Hence, this agreement is entered into between the parties on the following terms and conditions.

6 TERMS AND CONDITIONS 1. He/She is engaged as Driver/Conductor on contract basis for a period of months from(date) to (date) and the period of contract is extendable from time to time up to 2 years from the date of initial engagement based on the requirement. 2. His/Her contract engagement comes to an end on expiry of the period of contract mentioned above i.e., on dt.. 3. He/She shall be paid consolidated salary of Rs. (Rupees only) per month on engagement. He/She is not entitled for any other amount or allowances or privileges. 4. The contract engagement is terminable on either side by issuing one month s written notice. 5. He/She shall not indulge in any activity detrimental to the interest of the Corporation. The contract employee shall adhere to the disciplines while performing duty. His/Her conduct should not tarnish the image of the Corporation. 6. He/She shall have to produce valid Driving/Conductor licence to the Depot Authorities. 7. He/She should procure uniform prescribed under the M.V.Act 1989 at his/her cost. 8. He/She shall have to pay Rs. (Rs.2,500/- in case of the Driver and Rs.5,000/- in the case of conductor) towards Security Deposit. The Security Deposit will be refunded on expiry of the contract of engagement duly recovering loss, if any, caused to the Corporation or any other dues to the Corporation.

7 9. He/She shall be responsible for the safe custody of the equipment/tools/vehicle and records entrusted to him/her. He/She is liable to recoup the loss, if any, caused by him/her to the Corporation. 10. He/She is not entitled to TA or DA or any other allowances. 11. He/She shall be punctual and he/she shall not absent himself/herself from the duty without prior permission of the Controlling Official. 12. He/She shall be responsible for carrying out the duties to the full satisfaction of the Unit Officer/Supervisor/Superior Officials. 13. He/She is entitled to Provident Fund as per the provisions of EPF & MP Act, He/She and his/her family members are entitled to free medical attendance during the subsistence of their contract period through APSRTC Hospitals/Dispensaries on par with regular employees of the Corporation. 15. He/She is entitled to 8 paid holidays including National Holidays in a calendar year. 16. He/She is entitled to one day leave with wages for every 20 days of actual work performed. The female employee is entitled to Maternity Leave, on full wages, for a period of twelve weeks after having worked for a period not less than eighty days in the twelve months immediately preceding the date of her expected delivery. 17. Both the parties hereby agree and understand clearly that the period of contract comes to an end on the date mentioned above by efflux of time and the contract employee is not

8 entitled to claim renewal of contract. He/She is also not entitled to claim further engagement on contract basis or to claim for regular appointment as Driver/Conductor in APSRTC at a future date. 18. The terms and conditions of engagement shall form part of this Agreement. He/she is governed by the terms and conditions of the Contract Service Agreement entered into with the Corporation and the instructions issued from time to time by the VC&MD. 5. He/she is entitled to weekly off after performing six days duty. 6. He/she will not be entitled for wages for the days he/she absents for duty or for the days he/she is not engaged.

If his/her performance during the period of engagement is not satisfactory i.e. if he/she is not regular to his/her duties, or fails to wear uniform or he/she is not courteous with the passengers, or fails to pick up passengers enroute, or drives the bus in rash and negligent manner (in respect of Drivers only), or fails to issue tickets properly or he/she is under the influence of liquor, or commits any other misconduct, as notified through Circular No.PD- /2009, dt , his/her contract can be terminated duly deleting the name from the Select List duly following the procedure prescribed in Circular No.PD- /2009, dt and in that case, he/she shall not have any claim for appointment either on contract basis or on regular basis pursuant to the Select List when once his/her name is deleted from the Select List. 8.
