The position of Senior Crown Counsel is a responsible post and work is expected to be undertaken without supervision. Conditions: Functions in a schedule traveling post and will receive traveling and mileage allowance in accordance with approved rates. 29 Press Releases New Perimeter Roadway for Hewanorra International Airport GREATER ease in patrolling the perimeter of the southern-based Hewanorra International Airport is to be realized in the coming months, when work gets underway on the construction of a multi-million dollar project. The con-struction of the perimeter roadway is made available through a US$1.89-million loan from the International Bank for Reconstruction and Development (IBRD) and credit from the International Development Association (IDA) in the amount of US$4.41 million. The monies are part of St. Lucia s Emergency Recovery Project, of which a sizable portion will go towards the procurement of works for the construction of the perimeter roadway. Director of Airports at the St. Lucia Air and Sea Ports Authority (SLASPA), Peter Jean says the latest initiative is part of continued efforts by SLASPA to conform to safety specifications set out by the International Civil Aviation Organization (ICAO). This is a very exciting achievement for us at Hewanorra, Mr. Jean told the Government Information Service (GIS) in a recent interview. SLASPA, since the September 11th terrorist attacks on the United States has been undertaking activities to enhance the security situation at both airports. This road works being talked about for Hewanorra is supposed to facilitate the free movement of security personnel right across the inner perimeter of the airport compound. This will ensure that there is no security breach or encroachment, while ensuring that the overall security and integrity of the aerodrome is maintained, explained Mr. Jean. The works will consist of approximately 21,500 feet of roadway, the construction of earth embankment, excavations, and the reinforcement of culverts. The construction period is estimated to be 29 weeks. Meantime, the project coordination unit of the of the Emergency Recovery Project invites sealed bids form eligible bidders for the procurement of works for the construction of the perimeter roadway. 30 St. Lucian Prime Minister Vindicated by OECS Appeals Court PRIME Minister of St. Lucia, Dr. Kenny D. Anthony and his Government have been vindicated by an OECS Appeals Court ruling on an undertaking to guarantee debt service for a local hotel resort developer. Dr Anthony had been accused by a local human rights lawyer of acting outside of the law in giving the guarantee without first going to parliament. A civil case had been brought against Attorney General Senator Petrus Compton by the complaining attorney-at-law, Martinus François, claiming Dr Anthony had breached both the island s Constitution and the Finance Act. The case was heard by Justice Indra Harriprasah-Charles in the High Court in Castries late last year and the learned Judge ruled in favour of Mr Francois. Following the ruling of the High Court, which the Attorney General appealed, the government came under intense criticism and there were even calls in some quarters for the Prime Minister to resign. However, the Court of Appeal on March 29, 2004 quashed the earlier High Court ruling. In a rare act, all three Justices of the Appeals Court wrote separate judgments that took the High Court judge to task on several counts. The OECS Court of Appeal quashed all the claims by Mr Francois and upheld the grounds of appeal by the government s team of lawyers, which was led by Dominican Senior Counsel Anthony Astaphan. Mr Astaphan was assisted by a team from the AG s office including Crown Counsels Jan Drysdale, Dwight Lay and Rene Williams. The respondent, Mr. Martinus Francois was accompanied by Mr. Clarence Rambally and Dr. Nicholas Frederick. Watching brief for RBTT were, Mr. Anthony Mc Namera, Q.C. and Mr. Stephen Singh. The appeal was heard by Acting Chief Justice of Appeal Hon. Mr. Albert Redhead, Justice of Appeal Hon. Mr. Adrian Saunders and Acting Justice of Appeal Hon. Mr. Hugh Rawlins. Justice Redhead said in his 19-page summation: The learned trial Judge erred in law and/or misdirected herself when she held that the Minister of Finance acted ultra vires in even seeking a resolution from Parliament, and further that the Parliament acting ultra vires in approving that resolution, presumably on the erroneous basis that the said resolution did not concern or relate to the Government s capital or recurrent expenditure and which in any event was not pleaded by the respondent. Justice Redhead cited several examples where he found that Justice Harriprasad-Charles had erred in confusion, had made no critical analysis of some of the claims by Mr Francois and said he had difficulty in appreciating the judge s argument or reasoning on some issues. According to Justice Redhead, the High Court Judge had fallen into error as she had failed to distinguish the difference between the ability of the Executive in entering into a contract and the performance of that contract The other two Justices concurred with Justice Redhead and also offered several grounds on which they felt the High Court Judge ought to have dismissed the case brought by Mr Francois. Prime Minister Anthony s Press Secretary Earl Bousquet said: The Prime Minister was seriously vilified by politicians and media personnel. Some even asked that he be made to pay back the sums owed as a result of the guarantee from his own pocket. Bousquet continued: The Prime Minister will not gloat about this victory, but suffice to say the judgement of the appeals court reflects what he has always said that he followed the law and acted within the law at all times. The resort in question was the former first class, 300-room Hyatt property in the north of the island, next to the world-famous Pigeon Island National Park, home of the world famous St. Lucia Jazz Festival. 494 SAINT LUCIA GOVERNMENT GAZETTE TUESDAY 13 APRIL 2004 ISSUE 15

31 The property has since been taken over by Gordon Butch Stewart s Sandals Resorts International chain and is currently being run successfully, with average occupancy of over 70 per cent. Since the issuing of the Appeals Court s Judgement on Monday (March 29), Mr Francois has poured scorn on the judgement, claiming appeals court judges in the Caribbean operated under the political influence of governments. He said that was one reason why we oppose the establishment of the proposed Caribbean Court of Justice and indicated that he had already made his intention to appeal known to the British Privy Council, although he admitted that he still had not read the Judgement of the Appeals Court Justices. Attorney General Petrus Compton says Mr Francois would be free to pursue that constitutional right, but doubted whether he would get leave from the court to do so. According to the AG, the findings and rulings of the three Appeals Court judges were so clear-cut that there may simply be no grounds left for appeal. But if Mr Francois was to go to the Privy Council, Senator Compton said, we would have no problem with that, because another victory for us at that level would be even sweeter than that which derives from the ruling of the three learned Appeal Court Justices. NIC Gives Shot in the Arm to Victoria Hospital VICTORIA Hospital is the recipient of a huge shot in the arm from the National Insurance Corporation, which puts the hospital on the verge of adding several new features to its operations. Two fully equipped operating theatres, a three bed recovery room, a six bed intensive care unit, air conditioning system, medical gas system and endoscopy room are just some of the apparatus that will form a new wing to be commissioned by mid year. This gift to the hospital and the people of Saint Lucia coincides with the national observance of St. Lucia s 25th Independence, as well as 25 years of NIC s existence. Director of NIC, Emma Hippolyte says this gift is the NIC s way of bolstering key aspects of the health care provided by the hospital. She explained that notwithstanding the construction of a new health facility on the Millennium Highway, health care would continue to be delivered at Victoria Hospital until the new hospital project was fully completed and operational. Consequently, when we assessed it (Victoria Hospital), we felt that it was important to present this gift at this time, so that the average Saint Lucian would benefit from an improved health care at Victoria Hospital, she said. Since the NIC s announcement, the Ministry of Health, the hospital administration and the NIC have formed a committee to spearhead the implementation of the project. Ms. Hippolyte expressed her satisfaction with the committee and said she was looking forward to the establishment of the project in July of this year. 32 Lending a Hand to Develop Canaries THEY have been giving back to the community with an unwavering com mitment. This has been the passion of the Canaries -UK Association for the past decade. So says Public Relations Officer of the Canaries Improvement Association, Andrew Lansiquot, whilst commending the group members for their hard work and sacrifices, at a recent handing-over ceremony. Mr. Lansiquot observed that although the UK migrants could have become all consumed with leading new lives far away from home, it is indeed remarkable that they continue to remain dedicated to assisting the small village of Canaries. On Saturday, March 27 the Canaries - UK Association handed over a consignment of educational supplies, including ten computers, clothing and two monetary donations totalling over one thousand dollars, towards staging the Canaries Primary School Sports Meet and to assist a fire victim in replacing her losses. Also worth noting, remarked Andrew Lansiquot, is the fact that the Association has tried to maintain a link with both the infant and primary schools through the sponsorship of their sports meet and other activities. Parliamentary representative for Anse La Raye/Canaries, Honourable Cyprian Lansiquot compared the donation of computers to the old proverb that it is better to teach a man how to fish than to feed him for day, because the attainment of a skill is the attainment of a life long asset. I notice the focus is on education; the focus is on computer technology and in this present age of technological advancement, we need to prepare ourselves to face the challenges of the future. When you teach somebody a skill, when you teach him a trade, then he or she will be able to go out there, in this competitive world and fight for him or herself. Mr. Lansiquot described this latest gesture by the Canaries/ Uk Association as quite in keeping with the paradigm shift that is occurring at the national and regional level where it has recognised that the more skilled the human resource of a country, the better its chances of coping with globalisation, where technological skills have become a highly valued commodity.
