This vacation is exempt from the California Environmental Quality Act of 1970 pursuant to Article Ill, Class 5(3) of the City's Environmental Guidelines. 2_ Adopt the City Engineer's report dated MAY therein. with the conditions contained 3. D.No.l4 VACATION APPROVAL- VAC- El Council File No General Thaddeus Kosciuszko Way between Grand Avenue and Hope Street (Airspace, Subsurface and Street Vacation) RECOMMENDATIONS: A. That street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public right-of-way indicated below and shown colored blue on the attached Exhibit "B" and that the exact limits of the vacation areas be permitted to be adjusted based on the final design of facilities to be constructed in the vacation areas: a) Various 3.5-foot wide portions of limited subsurface below an upper limit of 5 feet below the street surface and above a lower limit of 9. 5 feet below the street surface of General Thaddeus Kosciuszko Way b) Various 8-foot wide by 14.5-foot wide portions of limited subsurface below an upper limit of 5 feet below the street surface of General Thaddeus Koscuiszko Way. c) Various 4-foot wide by 4-foot wide portions of limited airspace and subsurface below an upper limit of 16 feet above the street surface and a above a lower limit of 5 feet below the street surface of General Thaddeus Kosciuszko Way. d) Various approximately foot wide by foot wide portions of limited airspace below an upper limit of an elevation of approximately feet and above a lower limit of the street surface of General Thaddeus Kosciuszko Way, from Hope Street to approximately feet southeasterly thereof.

B. That the Council find that the vacation is exempt from the California Environmental Quality Act of 1970, pursuant to Article III, Class 5(3) of the City's Environmental Guidelines. C. That the City Council find that there is a public benefit to this street vacation. Upon vacation of the street, the City is relieved of its ongoing obligation to maintain the street. That, in conformance with Section 556 of the City Charter, the Council make the finding that the vacation is in substantial conformance with the purposes, intent and provisions of the General Plan. E. That, in conformance with Section 892 of the California Streets and Highways Code, the Council determine that the vacation area is not necessary for nonmotorized transportation facilities. F. That, in conformance with Section 8324 of the California Streets and Highways Code, the Council determine that the vacation area is not necessary for present or prospective public use. G. That the Council adopt the City Engineer's report with the conditions contained therein. H. That the City Clerk schedule the vacation for public hearing at least 30 days after the Public Works Committee approval so the City Clerk and Bureau of Engineering can process the Public Notification pursuant to Section 8324 of the California Streets and Highways Code. FISCAL IMPACT STATEMENT: The petitioner has paid a fee of$10, for the investigation of this request pursuant to Section 7.42 of the Administrative Code. Vacation proceedings in which the conditions have not been completed within 2 years of the Council's action on the City Engineer's report shall be terminated, with no further Council action. 1. That any fee deficit under Work Order E be paid. 2. That a suitable map, approved by the Central District Engineering office, delineating the limits, including bearings and distances, and upper and lower limits, of the areas to be vacated be submitted to the Land Development Group prior to the preparation of the Resolution to Vacate.

That a suitable legal description describing the areas being vacated and all easements to be reserved, including copies of all necessary supporting documentation, be submitted to the Land Development Group of the Bureau of Engineering prior to preparation of the Resolution to Vacate. 4. That a title report indicating the vestee of the underlying fee title interest in the areas to be vacated be submitted to the City Engineer. 5. That the following dedications be provided adjoining the petitioner's property in a manner satisfactory to the City Engineer: a) Dedicate 3 feet as a limited public street dedication above Upper Grand A venue grade elevation. b) Dedicate an average 9-foot wide sidewalk easement on Upper Grand A venue. In the event that the required sidewalk easement width is changed by Council action under Council File , the sidewalk easement dedication shall be modified accordingly. 6. That the following improvements be constructed adjoining the petitioner's property in a manner satisfactory to the City Engineer: a) Construct a new 44-foot wide roadway, curb and gutter, and 18-foot wide sidewalks on General Thaddeus Kosciuszko Way between Hope Street and Lower Grand A venue, together with access ramps at each corner of the intersections with Hope Street and with Lower Grand Avenue. Relocate existing catch basins along General Thaddeus Kosciuszko Way. b) Repair andor replace any broken, off-grade or missing curb, gutter or sidewalk along the project and close any unused driveways with full height curb and gutter and sidewalk. 7. That arrangements be made with all utilities agencies maintaining facilities in the area including but not limited to the Department of Water and Power, AT&T, Southern California Gas Company for the removal of affected facilities or the providing of easements or rights for the protection of affected facilities to remain in place. 8. That street lighting facilities be installed as may be required by the Bureau of Street Lighting. 9. That street trees be planted and tree wells to be installed as may be required by the Urban Forestry Division ofthe Bureau of Street Services.

That, if necessary, plans of structural details shown on standard size City sheets and structural calculations both signed by a Civil or Structural Engineer registered in the State of California, be submitted to the Bureau of Engineering for review. That the petitioner record a Covenant and Agreement satisfactory to the City Engineer to run with the land pertaining to the proposed structures located above the limited right-of-way on General Thaddeus Kosciuszko Way and on Hope Street: a. That the petitioner shall be required to maintain the supports to the airspace vacation areas of General Thaddeus Kosciuszko Way and Hope Street for safety and usability to the satisfaction of the City Engineer. An annual fee of $0.10 per plan square foot (with automatic annual escalation proportioned to the cost of Living index) shall be paid to the City Engineer for the purposes of City inspection of the facilities. The City shall be given reasonable access to the structure within and adjacent to the airspace vacation areas for this purpose upon request during normal business hours. The City may request the owner to repair or replace damaged, defective or unsafe structural elements or to correct unacceptable conditions at the owner's expense. The City may make such repairs at the owner's expense if the owner elects not to do so or does not respond within a reasonable time. Owners shall grant reasonable access to the City's contractor to make said repairs. b. The petitioner shall be required to limit use of the structures within the airspace vacation areas to: plaza deck, structural support of plaza deck, pedestrian access to plaza deck, and restaurant. No storage of combustibles will be allowed except as approved in writing by the Department of Building and Safety and the Fire Department, nor will any other use or occupancy be allowed except as approved in writing by the Department of Building and Safety and the Department of Public Works. 11. That the following conditions regarding the airspace vacation areas be complied with satisfactory to the City Engineer: a. That, if necessary, the petitioner obtain approval of the City Engineer for any substantial structural modification within the airspace vacation areas and for any structural element outside the airspace vacation areas which provides lateral or vertical support to the structures within the areas.

That a building permit from the Department of Building and Safety be obtained for the construction of the portion of the structure located within the private property. d. That the petitioner provide and maintain a policy of general liability insurance in an amount not less than $2,000, combined single limit per occurrence. Evidence of such insurance shall be on the City's General Liability Special Endorsement form or other form acceptable to the City Attorney and shall provide coverage for premisesoperations and contractual liability. e. That a Waiver of Damages agreement and an Indemnification Agreement Covenant to run with the land be executed by the petitioner and submitted to the Bureau of Engineering for approval, and subsequently be recorded relieving the City of any liability arising from the construction, maintenance and use of the proposed vacation areas. 12. That the petitioners record a Covenant and Agreement satisfactory to the City Engineer to run with the land pertaining to the proposed subsurface structures located beneath the limited right-of-way on General Thaddeus Kosciuszko Way: a. That the petitioner shall be required to maintain all elements of the structure below the limited street right-of-way of General Thaddeus Kosciusko Way adjoining the property in a safe and usable condition to the satisfaction of the City Engineer. The City shall be given reasonable access to the structure and adjacent to the limited street right-of-way areas for any necessary inspection, upon request during normal business hours. The City may request the owners to repair or replace damaged, defective or unsafe structural elements or to correct unacceptable conditions at the owner's expense if owner elects not to do so. Owner shall grant reasonable access to City's contractor to make said repairs. b. The petitioner shall be required to limit use and occupancy of the structures below the limited street right-of-way of General Thaddeus Kosciuszko Way for: structural support of plaza deck.

The petitioner shall obtain a B-Permit from the City Engineer for any substantial structural modification below the limited right-of-way of General Thaddeus Kosciuszko Way and for any structural element outside said areas which provides lateral or vertical support to structures within the areas. 13. That the petitioner execute and record an agreement satisfactory to the City Engineer to waive any right to make or prosecute any claims or demands against the City for any damage that may occur to the structures underneath the limited right-of-way of General Thaddeus Kosciuszko Way in connection with the use and maintenance operations within said street easement. 14. That any necessary approval be obtained from Los Angeles Department of Transportation 15. That consent to the vacation be secured from the owner of Parcel A of PM adjoining the area to be vacated. TRANSMITTAL: Application dated April16, 2012, from Robert Pinkerton. DISCUSSION: Request: The petitioner, Robert Pinkerton, representing the owners of the property shown outlined in yellow on Exhibit "B", is requesting the vacation of the public street areas shown colored blue and orange. The purpose of the vacation request is to provide for structural supports and structural deck and for pedestrian access to a proposed plaza area. This vacation procedure is being processed under procedures established by Council File No adopted by the Los Angeles City Council on March 5, Resolution to Vacate: The Resolution to Vacate will be recorded upon compliance with the conditions established for this vacation. Previous Council Action: The City Council on June 13, 2012, under Council File No adopted a Rule 16 Motion initiating street vacation proceedings. Zoning and Land Use: The properties adjoining the areas to be vacated to the north and south are zoned C2-4D and are currently being developed with commercial and mixeduse facilities. Description of Areas to be Vacated: The areas sought to be vacated is are:

No. 14 a) Various 3.5-foot wide portions of limited subsurface below an upper limit of5 feet below the street surface and above a lower limit of9.5 feet below the street surface of General Thaddeus Kosciuszko Way b) Various 8-foot wide by 14.5-foot wide portions oflimited subsurface below an upper limit of 5 feet below the street surface of General Thaddeus Koscuiszko Way. c) Various 4-foot wide by 4-foot wide portions of limited airspace and subsurface below an upper limit of 16 feet above the street surface and a above a lower limit of 5 feet below the street surface of General Thaddeus Kosciuszko Way. d) Various approximately foot wide by foot wide portions oflimited airspace below an upper limit of an elevation of approximately feet and above a lower limit ofthe street surface of General Thaddeus Kosciuszko Way, from Hope Street to approximately feet southeasterly thereof. e) The southeasterly 11 feet of limited airspace of Hope Street, above a lower limit of 16 feet above the street surface, adjoining General Thaddeus Kosciuszko Way. f) The limited airspace of General Thaddeus Kosciuszko Way, above a lower limit of 16 feet above the street surface and below an upper limit of the elevation of approximately feet, between Hope Street and Grand Avenue. General Thaddeus Kosciuszko Way is a is a Local Street dedicated 80 feet wide with a 60-foot wide roadway, curb and gutter, and 10-foot wide sidewalks on both sides. The airspace above a lower limit of elevation feet has been merged as Airspace Parcel C under Parcel Map Adjoining Streets: Hope Street is a Modified Two-Way Secondary Highway dedicated 90 feet wide with a 70 foot wide roadway, curbs, gutters and 10-foot wide sidewalks on both sides. Upper Grand Avenue is a Modified Two-Way Secondary Major Highway Class II dedicated 110 feet wide and 84 feet wide, with a variable width roadway, curbs, gutters, and 12-foot wide sidewalks. Lower Grand Avenue is a Major Highway, Class II, dedicated 84 feet wide with a 60-foot wide roadway, curb and gutter, and 12-foot wide sidewalks. Surrounding Properties: The owners oflots adjoining the vacation areas have been notified of the proposed vacation. Effects of Vacation on Circulation and Access: The vacation of portions of street, limited airspace and subsurface of General Thaddeus Kosciuszko Way may have some effect on circulation, since the roadway will be narrowed to accommodate the construction of pedestrian access and structural supports for the structural deck. There is sufficient right of way to provide the necessary roadway and sidewalk to serve this area.

11 Public Works Committee -9- C. D. No. 14 The portions of street, limited airspace and subsurface are also not needed for the use of pedestrians, bicyclists or equestrians. Objections to the vacation: There were no objections to the vacation submitted for this project. Reversionary Interest: No determinations of the underlying fee interest of the vacation areas have been made as to title or reversionary interest. Dedications and Improvements: It will be necessary that the petitioner provide for the dedications and improvements as outlined in the conditions of this report. Sewers and Storm Drains: There are existing sewer lines in General Thaddeus Kosciuszko Way that do not require relocation due to the vacation. There are, however, existing storm drain facilities within General Thaddeus Kosciuszko Way and Lower Grand A venue that are to remain in place, but will require catch basin relocation. Public Utilities: The Department of Water and Power, Southern California Gas Company and AT&T did not respond to the Bureau of Engineering's referral letter dated May 17, City Department of Transportation: The Department of Transportation stated in its communication dated July 20, 2012 that the vacation is not opposed, provided that all abutting property owners are in agreement, and that if applicable, provisions are made for lot consolidation, driveway and access approval by DOT, and additional dedication and improvements as necessary to bring all adjacent streets into conformance with the Downtown Street Standards. Additionally, the location of the plaza may impact the signal operations on General Thaddeus Kosciuszko Way at Hope Street and at Grand Avenue. Should any traffic signal work be required for this project, the applicant must work with DOT for the approval of signal modification plans through the B-Permit process of the Bureau of Engineering. City Fire Department: The Fire Department did not respond to the Bureau of Engineering's referral letter dated May 17, Department of City Planning: The Department of City Planning did not respond to the Bureau of Engineering's referral letter dated May 17, Conclusion: The vacation of the public street areas as shown colored blue on attached Exhibit "B" could be conditionally approved based upon the following: 1. They are unnecessary for present or prospective public use. 2. They are not needed for vehicular circulation or access.

This will also increase the processing time by approximately 6 months. If the vacation is located within a Coastal Development Zone, a Coastal Development Permit will be required for the project The applicant should be aware that vacations within a Coastal Development Zone will take longer to process and will be considerably more expensive. If the applicant is required to.have a Coastal Development Pennit processed by the Bureau of Engineering Environmental Management Group, the applicant must submit an additional $30,000 fee deposit. Some city agencies, including LADOT. may require additional fees to be deposited to cover costs during the referral and investigation process. The applicant is responsible for paying the fees to the agency directly. Referral fees paid to other city agencies are separate from the Bureau of Engineering processing fees.
