Adopt the findings by the City Engineer on the attached City Engineer report relative to initiating vacation proceedings. This vacation under the Mitigated Negative Declaration No. ENV MND-REC filed with the County Clerk on January 7, 2005 complies with the California Environmental Quality Act of 1970 pursuant to Article VII, Class 5(3) of the City's Environmental Guidelines. 2. Adopt the City Engineer report dated February 18, 2005 with the conditions contained therein. 3. Fiscal Impact Statement: The petitioner has paid a fee of $6, for the investigation of this request pursuant to Section 7.42 of the Administrative Code. Any deficit fee to recover the cost pursuant to Section 7.44 of the Administrative Code may be required of the petitioner. Maintenance of the public easement by City forces will be eliminated. No. 1 SUBJECT: VACATION REQUEST- VAC- E Council File No Bunker Hill A venue and Boston Street Vacation District RECOMMENDATIONS: A. That street vacation proceedings pursuant to the Public Streets, Highways and Service Easements Vacation Law be instituted for the vacation of the public rights-of-way indicated below and shown colored blue on the attached Exhibit "B": Boston Street and Bunker Hill Avenue lying Southeasterly of Figueroa Street and Southwesterly of CesarE Chavez Avenue B. That the vacation of the areas shown colored orange on Exhibit "B", be denied. C. That the City Council find that the attached Mitigated Negative Declaration No. ENV MND-REC filed with the County Clerk on January 7, 2005 pursuant to the City's Environmental Guidelines complies with the California Environmental Quality Act of 1970 for this vacation. D. That, in conformance with Section 556 of the City Charter, the Council make the findings that the vacation is in substantial conformance with the purposes, intent and provisions of the General Plan as determined by the Director of Planning on January 7, 2005 under City Plan Case No. DIR SPR. E. That, in conformance with Section892 ofthe California Streets and Highways Code, the Council determines that the vacation areas are not necessary for nonmotorized transportation facilities.

That, in conformance with Section 8324 of the California Streets and Highways Code, the Council determines that the vacation areas are not necessary for present or prospective public use. G. That the Council adopt the City Engineer's report with the conditions contained therein. H. That the City Clerk schedule the vacation for public hearing at least 30 days after the Public Works Committee approval so the City Clerk and Engineering can process the Public Notification pursuant to Section 8324 of the California Streets and Highways Code. Wall 451 Harvard Drive Arcadia, CA CONDITIONS: The Conditions specified in this report are established as the requirements to be complied with by the petitioner for this vacation. Vacation proceedings in which the conditions have not been completed within 180 days ofthe Council's action on the City Engineer's report and without proper time extension, shall be terminated, with no further Council action. 1. That a title report indicating the vestee of the underlying fee title interest in the areas to be vacated be submitted to the City Engineer. 2. That a suitable legal description describing the areas being vacated and all easements to be reserved, including copies of all necessary supporting documentation, be submitted to the Land Development Group of the Bureau of Engineering prior to preparation of the Resolution to Vacate. 3. That the following dedications be provided adjoining the petitioner's properties in a manner satisfactory to the City Engineer:

5 Public Works Committee -4- C. D. No.1 a) Dedicate a 7-foot and variable width strip ofland adjoining the petitioner's properties as public street along the southwesterly side of Cesar E. Chavez Avenue, to create a 57-foot and variable width half right ofway (Major Highway-Class II!Dual Left Tum Lanes with Flared Section standards). b) Dedicate 2 feet as public street adjoining the petitioner's properties along the southeasterly side of Figueroa Street, to create a 52-foot half right ofway (Major Highway-Class II standards). c) Dedicate 20-foot property line radii or a 15-foot by 15-foot property line cut comer as public street at the intersection of Figueroa Street with Cesar E. Chavez A venue. 4. That the following improvements be constructed adjoining the petitioner's properties in a manner satisfactory to the City Engineer: a) Widen the southeasterly side of Figueroa Street adjoining the petitioner's properties to complete a 40-foot wide half roadway, including integral concrete curb and gutter, 12-foot wide sidewalk and catch basin, together with a proper transition to join the existing improvements. b) Close the Boston Street intersection with Figueroa Street with standard street improvements, including full-height integral concrete curb and gutter and 12- foot wide sidewalk or with a standard driveway apron. c) Construct an access ramp for the handicapped at the intersection of Figueroa Street and Cesar E. Chavez A venue. d) Widen the southwesterly side of Cesar E. Chavez Avenue adjoining the petitioner's properties to complete a 45-foot and variable width half roadway, including integral concrete curb and gutter, 12-foot wide sidewalk and catch basin, together with a proper transition to join the existing improvements. e) Close the Bunker Hill A venue intersection with Cesar E. Chavez A venue with standard street improvements, including integral concrete curb and gutter and 12-foot wide sidewalk or with a standard driveway apron. f) Relocate the fire hydrant at the intersection of Bunker Hill A venue with Boston Street to the intersection of Boston Street with Figueroa Street, southeast comer, as required by the Fire Department.

That arrangements be made with the Department ofwater and Power, SEC California and Adelphia for the removal of affected facilities or the providing of easements or rights for the protection of affected facilities to remain in place. 6. That satisfactory arrangements be made with the City Engineer for the relocation or abandonment ofthe existing sewer and storm drain facilities located within the areas to be vacated, unless easements are reserved from the vacation for their protection. 7. That consents to the vacation be secured from the owners of Lots 14 through 19, Block 4, Park Tract, and Caltrans adjoining the areas to be vacated. 8. That upon the reviews of the title report identifying the underlying fee title interest of the vacation areas, agreement be recorded satisfactory to the Bureau of Engineering to hold each parcel of land under the same ownership and its adjoining portions of the areas to be vacated, as one parcel to preclude the creation of landlocked parcels. This is to remain effective until such time as a new subdivision map is recorded over said areas, a parcel map exemption is permitted or until released by the authority of the City of Los Angeles. 9. That plot plans be submitted to the Fire Department for their review and approval. Additional fire lane and access requirement may be required in conjunction with the review. 10. That street lighting facilities be installed as may be required by the Bureau of Street Lighting. 11. That street trees be planted and tree wells to be installed as may be required by the Street Tree Division of the Bureau of Street Services. 12. That provisions be made to provide for vehicular access for Burger King restaurant driveway on the east side of Bunker Hill Avenue south of Cesar Chavez A venue in a manner satisfactory to the Department of Transportation. 13. That arrangements be made with the Metropolitan Transportation Authority for the guarantee of the relocation of the existing bus layover zone to a location close to the current bus layover zone (on Bunker Hill A venue) in a manner that meets the requirements of the Los Angeles County Metropolitan Transportation Authority.

7 Public Works Committee - 6- C. D. No.1 TRANSMITTAL: Application dated May 1, 2003, from Peter Novak, G.H. Palmer Associates. DISCUSSION:. Request: The petitioner, Peter Novak, representing the owners of the properties shown outlined in yellow on Exhibit "B", is requesting the vacation of the public street areas shown colored blue and orange. The purpose of the vacation request is for consolidating the proposed areas to be vacated with the adjoining properties for a mixed use development. This vacation procedure is being processed under procedures established by Council File No adopted by the Los Angeles City Council on March 5, Resolution to Vacate: The Resolution to Vacate will be recorded upon compliance with the conditions established for this vacation. Previous Council Action: The City Council on June 20, 2003, under Council File No adopted a Rule 16 Motion initiating street vacation proceedings. Zoning and Land Use: The properties adjoining the proposed street vacation areas are zoned C2-2D, R5-2D, R5-1. P-2D and (T)(Q) C2-2D and developed for commercial use and parking. Description of Areas to be Vacated: The areas sought to be vacated are (1) Boston Street from Figueroa Street to Bunker Hill Avenue. Boston Street is designated a local street dedicated 60 feet wide and improved with a asphalt concrete roadway, and with concrete curb, gutter and sidewalks on both sides. (2) Bunker Hill A venue from Cesar E. Chavez A venue to Boston Street. Bunker Hill A venue is designated a local street dedicated 60 feet wide and improved with a asphalt concrete roadway, and with concrete curb, gutter and sidewalks on both sides. Adjoining Streets: (1) Figueroa Street is an improved major highway dedicated 100 feet wide with a asphalt concrete roadway, and with concrete curb, gutter and sidewalks on both sides. (2) Cesar E. Chavez Avenue is an improved major highway dedicated 100 feet wide with a asphalt concrete roadway, and with concrete curb, gutter and sidewalks on both sides.

8 Public Works Committee - 7- C. D. No.1 Surrounding Properties: The adjoining owners of Lots 14 through 19, Block 4, Park Tract, have been notified of the proposed street vacation. Effects of Vacation on Circulation and Access: The vacation of the public street may have an adverse effect on vehicular access. There would be a limited adverse effect on vehicular circulation. The streets are not needed for the use of pedestrians, bicyclists or equestrians. Objections to the vacation: The Los Angeles County Metropolitan Transportation Authority has noted an objection to this vacation, in their letter dated August 31, They noted that they have a need for continued use of Boston Street as a layover location to accommodate 5 buses. Prior to June 2003, Figueroa Street was being used for their layover location. Reversionary Interest: No determinations of the underlying fee interest of the vacation areas have been made as to title or reversionary interest. Dedications and Improvements: It will be necessary that the petitioner provides for the dedications and improvements as outlined under Conditions. Sewers and Storm Drains: There are existing sewer and storm drain facilities within the areas proposed to be vacated. Public Utilities: The Department of Water and Power, SBC-Califomia and Adelphia maintains facilities in the areas proposed to be vacated. Tract Map: Since the required dedications can be acquired by separate instruments and the necessary improvements can be constructed under separate permit processes, the requirement for the recordation of a new tract map could be waived. However, it will be necessary that the petitioner records an agreement satisfactory to the Bureau of Engineering to hold each adjoining parcel ofland under the one ownership and its adjoining portion of the area to be vacated, as one parcel to preclude the creation of landlocked parcels. This is to remain effective until such time as a new subdivision map is recorded over the areas, a parcel map exemption is permitted or until released by authority of the City of Los Angeles. City Department of Transportation: The Department of Transportation states that based on field investigation and traffic considerations, the vacation of the areas shaded in blue on your map is not opposed to the vacation subject to the following conditions:

No.1 Caltrans be notified ofthe proposed street vacation to determine if their access to the freeway right-of-way might be limited, and Access to the Burger King restaurant driveway on east side of Bunker Hill A venue just south of Cesar Chavez A venue is maintained. City Fire Department: The Fire Department states that the subject property has been investigated by members of the Fire Department and is recommending the following: Submit plot plans for Fire Department review and approval prior to the recordation of Street Vacation Action. Fire Department access shall be maintained by means of public streets or fire lanes as required by the Fire Department. Fire hydrants shall be located and accessible as required by the Fire Department. Relocate the fire hydrant at the intersection of Bunker Hill A venue with Boston Street to the intersection of Boston Street with Figueroa Street, southeast corner. Any necessary roadway improvement or relocation of utilities shall be at the sole expense of the applicant and shall be to the satisfaction ofthe Fire Department. Department of City Planning: The Planning Department did not respond to the Bureau of Engineering's referral letter dated May 27, Conclusion: The vacation of the public street areas as shown colored blue on attached Exhibit "B" could be conditionally approved based upon the following: 1. They are unnecessary for present or prospective public use. 2. They are not needed for vehicular circulation or access. 3. They are not needed for nonmotorized transportation purposes. The areas shown colored orange should not be vacated because they are needed for public street purposes.
