Summary of Verdicts from the April 2012 Civil Jury Term The Judges have completed the April 2012 civil jury term. Two civil cases reached verdict during the April civil term and the summary is as follows: RONALD CARESTIA AND JOANNE CARESTIA, HIS WIFE v. THE MILTON S. HERSHEY MEDICAL CENTER (2008 CV 15353) This was a medical malpractice action in which the plaintiffs alleged that Mr. Carestia fell while an intensive care unit nurse tried to get him out of bed. It was alleged that Mr. Carestia suffered a hearing loss as a result of the fall. Claims of negligence, corporate liability and loss of consortium were asserted against the Defendant. The defendant disputed that Mr. Carestia fell and that any claimed fall did not result in his hearing loss. Clark, Jr. Verdict: Defendant TIFFANY BARKSDALE, ADMINISTRATIRIX OF THE ESTATE OF JEROME A. FINLEY, DECEASED v. SILVIA DIDIA, M.D., SAFA FARZIN, M.D., ANITA KOSZYK, M.D. AND PINNACLE HEALTH HOSPITALS D/B/A HARRISBURG HOSPITAL (2006 CV 1032) Jerome Finley appeared at the Harrisburg Hospital complaining of a swollen scrotum and pain. The plaintiff claimed that the Defendants failed to properly diagnose severe sepsis which lead to the patient s not being placed on continuous monitoring nor transferred to the ICU. He suffered respiratory arrest resulting in severe brain damage and spent approximately two years in a nursing home/hospital until his eventual death. Plaintiff requested damages for the expenses incurred following the respiratory arrest and unliquidated damages. Counsel for Plaintiff: Charles E.
