You requested the following: Any disciplinary actions taken against William Eagan by Hinsdale Township High School District 86 or any of its officials since Jan. 1, 2016 to the present date; Records in William (Bill) Eagan's personnel file, including his employee review; If not included in the above, all records related to internal and external complaints made against Mr. Eagan, including but not limited to allegations of misconduct or conflicts of interest; If not included in the above, all records of internal investigations of William Eagan and records related to disciplinary action taken against him; Any and all resignation agreements and any and all separation agreements with William Eagan. Your request is granted in part and denied in part, as follows. Enclosed please find a copy of the records with the requested information, with certain non-responsive and exempt information removed. Note that we do not interpret your request as requiring the production of personnel file documents that are unrelated to any complaints, disciplinary actions, investigations or resignation. As to the anonymous complaint received in January 2016, we have no knowledge that either the State s Attorney s office or the Regional Office of Education ever investigated or indicated that any legitimate issue was alleged. The District has redacted or withheld exempt information pursuant to the following FOIA exemptions: 1. Pursuant to FOIA Section 7(1)(b), we excluded private information, which includes signatures, home addresses, personal phone numbers and personal financial information. See 5 ILCS 140/2(c-5); 2. Pursuant to FOIA Section 7(1)(f), we removed predecisional and preliminary draft information, including investigation notes and comments and other information that was part of the District s deliberative process. 5 ILCS 140/7(1)(f); Harwood v. McDonough, 344 Ill. App. 3d 242 (1 st Dist. 2003); 3. Pursuant to FOIA Section 7(1)(m), we removed attorney-client privileged correspondence and documents prepared or compiled upon the request of the District s attorney. 5 ILCS 140/7(1)(m); and 4. Pursuant to FOIA Section 7.5(q), we removed all performance evaluations as required under the Personnel Records Review Act, 820 ILCS 40/11. In addition to his position as appointed Treasurer, William Eagan also serves as the district s Chief Financial Officer. The treasurer of a school district is required to keep a record, by fund, of the district s financial transactions, which shows the amount received and the amount disbursed by order of the Board of Education. At the end of the month, the treasurer shall extend the balances, showing the balance in the bank account(s) as well as the balance in each fund and reconcile such balances with the accounting or bookkeeping department of the district. (See 105 ILCS 5/8 6 regarding School Treasurer s custody of school funds.) The treasurer of a school district shall sign all lawful orders of the Board of Education. If a treasurer can determine that an order is illegal, either from previous knowledge or by inspection, he or she shall not affix his/her signature. The treasurer of a school district has no authority to create an order, to change an order in any manner, or to change the fund on which the order is drawn. Treasurer Eagan is by law the official custodian of all district monies, as well as all investments owned by the District. Before assuming the duties of the Treasurer, each school treasurer shall be bonded. MISAPPLICATION OF FUNDS, OFFICIAL MISCONDUCT AND DIVERSION OF TRUST FUND ASSETS I am writing to ask your office to investigate the misapplication of funds (720 ILCS 5/33E 16) by Eagan and Law, the official misconduct (720 ILCS 5/33 3) of Eagan and Law, and the illegal diversion of trust fund assets by Eagan and Law (Article 20 of the School Code, section 20 6). The following statements should aid your office in its review. Upon information and belief, on November 30, 2015, the IMRF Fund of the school district had a balance of $499, This balance was recorded by Treasurer Eagan within his monthly treasurer s report.

23 On December 16, 2015, Treasurer Eagan electronically transferred $3,000, to the IMRF. Upon information and belief, at the time of the $3,000, EFT, Mr. Eagan and Mr. Law did not possess the required lawful order which may only be approved by the Board of Education at a meeting properly called and held in accordance with the Open Meetings Act. Upon information and belief, at the time of the $3,000, EFT, Mr. Eagan and Mr. Law recorded the EFT as an expense of the IMRF Fund of the district at a time at which the IMRF Fund balance was less than $500, Upon information and belief, at the time of the $3,000, EFT, the fund balance of the IMRF Fund was insufficient to cover the EFT; and therefore, Mr. Eagan and Mr. Law unlawfully diverted the assets of one or more other funds of the district to the IMRF Fund in order to execute the EFT to the IMRF on December 16, 2015 and generate the $3,000, booked expense. I ask that you review the above statements, and if your office finds them to be true and correct, that charges of Misapplication of Funds (720 ILCS 5/33E 16) and Official misconduct (720 ILCS 5/33 3) be filed against both Eagan and Law. In addition, I ask that you review 105 ILCS 5/20 6 of the school code for additional charges. The following citations are to the relevant sections of the Criminal Code of 2012 and Article 20. (720 ILCS 5/33E 16) Sec. 33E 16. Misapplication of funds. (a) An officer, director, agent, or employee of, or affiliated in any capacity with any unit of local government or school district commits misapplication of funds when he or she knowingly misapplies any of the moneys, funds, or credits of the unit of local government or school district. (b) Sentence. Misapplication of funds is a Class 3 felony. (720 ILCS 5/33 3) (from Ch. 38, par. 33 3) Sec Official misconduct. (a) A public officer or employee or special government agent commits misconduct when, in his official capacity or capacity as a special government agent, he or she commits any of the following acts: (1) Intentionally or recklessly fails to perform any mandatory duty as required by law; or (2) Knowingly performs an act which he knows he is forbidden by law to perform; or (3) With intent to obtain a personal advantage for himself or another, he performs an act in excess of his lawful authority; or (4) Solicits or knowingly accepts for the performance of any act a fee or reward which he knows is not authorized by law. (c) A public officer or employee or special government agent convicted of violating any provision of this Section forfeits his or her office or employment or position as a special government agent. In addition, he or she commits a Class 3 felony. (105 ILCS 5/20 6) (from Ch. 122, par. 20 6) Sec Willful violation of law. Any member of the school board of any school district to which this Article is applicable, or any other person holding any office, trust, or employment under such school district who wilfully violates any of

24 the provisions of this Article shall be guilty of a business offense and fined not exceeding $10,000, and shall forfeit his right to his office, trust or employment and shall be removed therefrom. Any such member or other person shall be liable for any sum that may be unlawfully diverted from the working cash fund or otherwise used, to be recovered by such school district or by any taxpayer in the name and for the benefit of such school district in an appropriate civil action; provided that the taxpayer shall file a bond for all costs and be liable for all costs taxed against the school district in such suit, and judgment shall be rendered accordingly. Nothing herein shall bar any other remedies. RECOVERY OF MONEYS ACCRUING TO VARIOUS FUNDS OF TOWNSHIP HIGH SCHOOL DISTRICT 86 Additionally, within the Counties Code, the State s Attorney is explicitly authorized to recover any assets illegally diverted by Eagan and Law and to return those monies to the fund (or funds) from which they were illegally diverted. Upon information and belief, Eagan and Law illegally diverted $2,500, from the fund known as the Working Cash Fund of Township High School District Number 86, DuPage and Cook Counties, Illinois and $500, from the fund known as the Operations and Maintenance Fund. The following citation is to the relevant section of the County Code. (55 ILCS 5/3 9005) (from Ch. 34, par ) Sec Powers and duties of State's attorney. (a) The duty of each State's attorney shall be: (2) To prosecute all forfeited bonds and recognizances, and all actions and proceedings for the recovery of debts, revenues, moneys, fines, penalties and forfeitures accruing to the State or his county, or to any school district or road district in his county; also, to prosecute all suits in his county against railroad or transportation companies, which may be prosecuted in the name of the People of the State of Illinois. I ask that you review the above statements, and if your office finds them to be true and correct, that you immediately contact the IMRF regarding the recovery of the $3,000, of assets that are the property of either the Working Cash Fund of Township High School District Number 86, DuPage and Cook Counties, Illinois and/or the Operations and Maintenance Fund. POSSIBLE ARREST BY CITIZEN(S) Finally, as you undoubtedly are aware, Section of the Code of Criminal Procedure of 1963 states: Any person may arrest another when he has reasonable grounds to believe that an offense other than an ordinance violation is being committed. Section of the Code of Criminal Procedure of 1963 states: (725 ILCS 5/107 5) (from Ch. 38, par ) Sec Method of arrest. (a) An arrest is made by an actual restraint of the person or by his submission to custody. (b) An arrest may be made on any day and at any time of the day or night. (c) An arrest may be made anywhere within the jurisdiction of this State. (d) All necessary and reasonable force may be used to effect an entry into any building or property or part thereof to make an authorized arrest.

25 Within the past year, certain park district board members in Clark County were arrested by a citizen for allegedly violating the Open Meetings Act. (See link: Park District Board Placed Under Citizens Arrest html) Given the fact many members of the community will likely be made aware of the misapplication of funds, diversion of funds and official misconduct by both Eagan and Law, it is a distinct possibility that a citizen (or citizens) will, in accordance with Sections and 107 5, arrest them, take them into custody, contact the DuPage County Sheriff Zaruba, and subsequently file a criminal complaint. The internet reporting of the Clark County Park District may result in similar behavior in Hinsdale. Please be advised that the next scheduled meeting of the Board of Education is scheduled for this evening at 7:00 pm. (Hinsdale Central Community Room, 5500 South Grant Street, Hinsdale). After this evening, the next meeting will be held on February 1, Please be advised that a separate letter is being sent to Dr. Darlene Ruscitti (ROE DuPage County) in order to inform her of the actions of Treasurer Eagan and Superintendent Law. Please be advised that a separate letter is being sent to IMRF in order to inform them that they are holding, as a constructive trustee, the assets of various funds of the district and that Eagan had no lawful order to transfer the money as of December 16, Thank you for your immediate attention to this matter.

Please review the matter with your attorney Mr. Berlin in order to determine what actions, if any, you must take regarding contacting the surety bond company underwriting the bond for Mr. William Eagan. If the illegally diverted monies cannot be recovered from the IMRF, the surety bond company may be at risk, and therefore, should be made aware of the situation as soon as possible. In my opinion, the IMRF is holding $3,000, in assets that are the legal property of various funds of district 86. In my opinion, Eagan and Law illegally diverted $2,500, from the fund known as the Working Cash Fund of Township High School District Number 86, DuPage and Cook Counties, Illinois and $500, from the fund known as the Operations and Maintenance Fund. Furthermore, in my opinion, the IMRF is holding $3,000, as a constructive trustee for the two funds mentioned above. I ask that your agency immediately investigate the source of funds of the $3,000, ETF that occurred on December 16, If you investigation determines that Treasurer Eagan had no lawful order to make interfund transfers or to deliver the assets to you, I ask that your agency immediately take all measures necessary to return the assets to the proper funds of the district.
