3 Introduction The Judgment Registry contains active federal and provincial judgments, provincial maintenance judgments and federal writs of execution that are registered against personal property and lands in Saskatchewan. It was established under Section 18(1) of The Enforcement of Money Judgments Act. The act came into force on May 28, The Judgment Registry replaces the Saskatchewan Writ Registry (SWR), which in turn replaced the general records of the former Saskatchewan Land Titles offices. Under The Land Titles Act, 2000, all judgments have to be registered in the Judgment Registry to affect goods and lands in the province. Changes to Interest Registration Types under The Enforcement of Money Judgments Act Pursuant to Section 132(1) of The Enforcement of Money Judgments Act, writs of execution and maintenance orders registered before the act came into force are considered enforcement charges. All enforcement charges fall under the new act. There will not be any conversion of existing writs or maintenance orders. The names that currently appear in the Saskatchewan Personal Property Registry (SPPR) and on search or verification reports will not be updated. Under previous legislation, the available writ and maintenance order registration types were: A writ of execution provincial or a creditor s relief certificate (SWR); A writ of execution federal (SWR); A maintenance writ of execution (SWR); or A maintenance order (SWR). 4 Under The Enforcement of Money Judgments Act, the available judgment registration types are: An enforcement charge provincial judgment; An enforcement charge federal judgment; An enforcement charge provincial maintenance judgment; or An enforcement charge - federal writ of execution. You are still able to amend and discharge existing writs of execution and maintenance orders. However, you cannot register any new writs or maintenance orders. Maintenance writs of execution and maintenance orders have been rolled into one new registration type known as an enforcement charge provincial maintenance judgment. Previously, when you registered a writ of execution, an additional five (5) days was added on to the expiry date. That is no longer the case. The lifetimes of the new judgment registration types are as follows: An enforcement charge provincial judgment is registered for 10 years from the date of judgment. An enforcement charge federal judgment is registered for 10 years from the date of issue. An enforcement charge provincial maintenance judgment is registered for infinity. An enforcement charge - federal writ of execution is registered for 6 years from the date of issue. Serial property can now be added to any enforcement charges during the setup process. Existing registrations can also be amended to include serial property items, as per The Enforcement of Money Judgments Regulations. SPPR Reference Sheet April

5 If you have a judgment that was registered before The Enforcement of Money Judgments Act came into effect, it is advisable to amend the registration to include serial property. Otherwise, the priority of your registration may be at risk. If you currently register federal writs of execution, you will need to decide whether you want to register federal judgments and/or federal writs of execution. The only difference functionality/system-wise is the lifetime (10 years for an enforcement charge federal judgment and 6 years for an enforcement charge federal writ of execution). Determining which registration type to use will be an internal policy decision for your organization. SPPR Reference Sheet April
