1 Land Indenture England 1710 Box 13 Folder 1 L25 Transcription [1] This Indenture made the Fifteenth day of Aprill in the Nynth year of the Raigne of our most Gratious Soveraigne Lady Anne by the grace of God Queen of Great [2] Brittain France and Ireland Defender of the Faith etc And in the year of our Lord God One Thousand and Seaven hundred and Ten Between John Coppoce of [3] Blackbrook in Leinshulme alias Levonshulme in the parish of Manchester and County of Lancaster Tanner of the one part and James Crompton the Younger of [4] Crompton=Fould in the parish of Boston and County of Lancaster aforesaid Gentleman Charles Worsley of Platt in the parish of Manchester aforesaid in the said [5] County of Lancaster, Gentleman, William Coppoce of Ringey in Lale in the County of Chester Tanner and Arnold Drinkwater of Bent in Warburton in the parish of [6] Lym and County of Chester aforesaid Gentleman of the other part Witnesseth That Whereas there is a Marriage by the grace of God Intended shortly [7] to bee had and Solempnized Between the said John Coppoce and Esther Crompton Sister of him the said James Crompton (if they the said John Coppoce and Esther Crompton shall thereunto Consent & Agree And the Lawes of this [8] Realme of Great Brittain p[er]mitt the same Now this Indenture Witnesseth that hee the said John Coppoce For and in Considerac[i]on of the said Intended Marriage (if the same shall happen to take effect) And of

2 [9] the Sum[m]e of three hundred pounds of Lawfull money of Great Brittain to bee paid to him (as a Marriage portion with her the said Esther and to the end that all and every the Several Messuages Tenements Laws & hereditam[en]ts [10] herein after in these presents menc[i]oned may remaine Continue and bee to the several and respective uses Trusts intents and purposes herein after Declared Limitted Directed and appointed Hath Granted Aliened Bargained [11] sold Released and Confirmed And by these presents Doth Grant Aliene Bargaine Sell Release and Confirme unto them the said James rompton Charles Worsley William Coppoce and Arnold Drinkwater and their heirs and [12] the Survivors of them and his heirs All and every That and those the Severall Messuages Tenements Lands and hereditaments whatsoever of him the said John Coppoce and Com[m]only called and knowne by the name or Names of [13] Blackbrook Lands Birches Lands the Hen Acre and Miller Lands Scituate lyeing and being in Leinshulme als Levenshulme aforesaid in the said Parish of Manchester and County of Lancaster whereof or wherein hee the said [14] John Coppoce now hath any Estate of Inheritance in possession reversion remainder or otherwise And all houses Edificies Buildings Outhouseing Barnes Stables Cowhouses Barkhouses Tanpitts Tan Yards Orchards Gardens [15] Tofts Crofts Closes Clausures Fields Feedings Lands Meadows pastures Woods Underwoods Waies Waters Watercourses Com[m]ons Com[m]on of pasture and Turbary rights members priveledges and appurten[an]ces whatsoever thereunto or to any of them

3 [16] belonging or in any wise appertaining or thereto or therewith or to or with them or any of them now or at any time heretofore had held use Occupied Demysed Letten or Enjoyed or accepted reputed taken or knowne to bee as part parcel [17] member or appurtenant thereof in any wise All which said premises late were in the severall tenures holdings or possessions of him the said John Coppoce and of Ralph Tomlinson alias Bowerhouse And Mary Nicholson Widow as undertenants [18] to him the said John Coppoce with their and every of their rights Members privelidges and appurtenances whatsoever And now are in the Achtuall possession of them the said James Crompton Charles Worsley William Coppoce & Arnold Drinkwater [19] by force and virtue of One Indenture of Bargaine and sale for Six Monthes bearing date the day next before the day of the date of those presents made or menc[i]oned to bee made Between the said John Coppoce and of Ralph Tomlinson alias Bowerhouse And Mary Nicholson widow as undertenants [20] them the said James Crompton Charles Worsley William Coppoce and Arnold Drinkwater of the other part For the Considerac[i]on of Five Shillings therein Expressed and of the statute for Transferring of uses of Lands into possession And [21] the Reverc[i]on and Reverc[i]ons remainder and remainders rents issues and profits of all and Singular the said premises and of every part and parcel thereof To have and to hold all and every the said Messuages [22] Tenements Lands hereditaments and premises with their and every of their appurten[an]ces and every part and parcel thereof unto them the said James Crompton Charles Worsley William Coppoce and Arnold Drinkwater and their heirs And

4 [23] to the Survivors and Survivour of them their and his heirs To and for the severall uses behoofes Trusts intents Limitac[i]ons and purposses herein after in these presents menc[i]oned Limitted & Declared And to and for noe other use [24] intent or purposse whatsoever And the said John Coppoce for himself his heirs Executors and Adm[inistr]ators and every of them Doth Covenant promise grant and Agree to and with them the said James Crompton Charles Worsley William [25] Coppoce and Arnold Drinkwater their heirs and Assignes and to and with every of them by these presents That they the said James Compton Charles Worsley William Coppoce & Arnold Drinkwater and their heirs And the Survivors [26] and Survivor of them and his heirs and every of them shall and may be virtue of these presents stand and bee seized of and in all and every the said Messuages Tenements Lands hereitam[en]ts and premises herein before menc[i]oned [27] their and every of their appurten[an]ces and every part and parcel the reef To the severall uses behoofes intents and purposes and under and upon the severall Trusts Liberties Limitations Provisoes and Resucitt[i]ons herein after in these presents menc[i]oned [28] Limitted expressed Directed and Declared and to for noe other use or uses intents or purposses in any wise whatsoever That is to say as for and Concerning All and every the said Messuages Tenements Lands and hereditam[en]ts in Leinshulme alias [29] Levenshulme aforesaid with their and every of their appurten[an]ces To the use and behoofe of him the said John Coppoce and his heirs vutill the solempnizac[i]on of the said Intended Marriage and from the Imediatly after the said marriage shall

5 [30] happen to take effect Then to the use and behoofe of him the said John Coppoce For and dureing the terme of his Naturall Age (without Impeachment of or for any manner of Wast) and from and Immediately after his decease (or as his Estate in the said [31] premisses by virtue of these presents or other wise shall respectively end and Determine Then to the use and behoofe of the said JamesCrompton Charles Worsley William Coppoce and Arnold Drinkwater and their heirs and to the survivors and [32] survivor of them and his heirs Dureing the life line of the said John Coppoce To the intent and purpose to prefer the Contingent uses and remainders of the premisses from being barred or Destroyed in the use time of { } said John Coppoce [33] And for that purpose to make Entries as Occasion shall require Yet never the lesse to permit and Suffer him the said John Coppoceto take the rents issues and profits of all and every the said premisses Dureing his Naturall life And from and [34] Imediatly after his Decease Then as for and Concerning the Severall Messuages Lands and hereditaments Com[m]only called the Blackbrook and Berches Lands aforesaid And one Close of Land in Leinshulme als Levenshulme aforesaid (usually Occupied [35] with the said Berches Lands and Com[m]only called and knowne by the name of the Hen Acre with th appurten[an]ces thereunto belonging TO the use and behoofe of her the said Esther for and dureing the terme of her Naturall life zfor and in Liew and and [36] sattisfac[i]on of their Joynture and Dower (Subject to the Provisoe or Condition Following That is to say Provided allwaies That if shee the said Esther shall happen to marry againe having Child or Children begotten of her body by the said John

6 [37] Coppoce and living at the time of such her second Marriage Then onely for the raiseing of the Clear Sum[m]e of Fifteen pounds samm of good and Lawfull Money of Great Brittain forth of and by the percepc[i]on of the rents issues and profits of the [38] said Messuages Levies Tenements and hereditaments called Blackbrook and Berches Lands and the Hen Acre aforesaid (over and above all Charges and reprizes whatsoever (To and for the use of her the said Esther for and Dureing the terme of her [39] Naturall life The same to be paid and payable to her the said Esther or her Assignes on the yearly Feast daies of St John Baptist and St Martin the Bishopp in Winter by even and equall portions The first of such payments to Comence and begin at [40] such of the said Yearly Feast daies as shall first and next happen after such the second Marriage of her the said Esther And to have Continuance dureing the terme of her Naturall life and noe longer And the same to bee in how & full Sattisfac[i]on [41] of all the Joynture or Dower which shee the said Esther can or may in any wise have or claime of in or unto all every or any the Messuages Lands or hereditaments of him the said John Coppoce by virtue of these presents in any wise And from and [42] Immediately after the Decease of them the said John Coppoce and the said Esther his now intended wife (if the said Marriage shall take effect) and as their severall Estates and Interests in the said premisses shall respectively end and Determine Then to [43] the use and behoofe of the first son of him the said John Coppoce and the said Esther his now intended wife (if the said Marriage shall take effect) and as their severall Estates and Interests in the said premisses shall respectively end and Determine

7 [44] the elder always and his heirs male to bee prefelared before the Younger and his heirs Male (Charged and Chargable never thelesse with such Sum[m]e and Sum[m]es of Money and payable to such person or persons And such method manner & [45] Forme as is hereafter in these presents for that purpose menc[i]oned ex[ressed Limitted Declared and appointed and to and for noe other use intent or purpose in any wise whatsoever And in Default of Issue male of such First son [46] Lawfully to bee begotten Then to the use and bejoofe of the Second Son of him the said John Coppoce (on the Bodie of the said Esther Lawfully to bee begotten, and to the heirs Males of such second son Lawfully to bee begotten according [47] to his and their Seniority in Age and Priority of Birth The Elder allwaies of such heirs Male to bee preferred before the Younger and his heirs Male Charged and Chargable as aforesaid And soe in the manner to the Third Fourth [48] Fifth Sixth Seaventh and every other son and sons of the said John Coppoce on the Body of her the the said Esther Lawfully to bee begotten in Tail-Male according to his and their seniority in Age and priority of BIrht the Elder allwaies [49] and his heirs Male to bee preferred before the Younger Charged and Chargable as aforesaid And in Default of such issue male of him he said Coppoce of the Bodie of the said Esther Lawfully to bee begotten Then to the right [50] heirs of him the said John Coppoce on the Bodie of her the said Esther Lawfully to bee begotten And for Default of such issue Then to the right heirs of him the said John Coppoce for ever Provided Neverthelesse And it is

8 [51] hereby Covenanted granted and Agreed By Between and Amongst all and every the said parties to these presents for them their heirs and Assignes and every of them respectively in Manner and Forme Following That is to say [52] That it shall and may bee Lawfull to and for him the said John Coppoce at any time or times hereafter Dureing his Naturall lfie by any his Act or Acts Deed or Deeds in Writeing or by his last Will and Testament in Writeing (such Act [53] or Acts Deed or Deeds or Last Will and Testament it bee sealed and Executed in the sight and presence of Three or more Credible Witnesses To Charge all or any part of the said Messuages Tenements Lands Hereditaments and premisses in [54] {Illegible Line} [55] Sum[m]es of Money to her the said Esther for her life onely as in and by these presents is or are Directed Limitted and expressed (Dureing the Continuance of such her Estate or Interest therein by virtue of these presents (onely excepted & [56] Foreprized) With any Sum[m]e or Sum[m]es of money in the whole not Exceeding the Sum[m]e of Four hundred Pounds TO and for the preferment of the Younger Child or Children of the bodie of him the said John Coppoce on the bodie of her the said Esther [57] Lawfully to bee begotten in such manner Method and Forme as hee the said John Coppoce shall Direct Limitt or appoint the same by such his Act or Acts Deed or Deeds or last Will and Testament as aforesaid And that they the said James [58] Crompton Charles WOrsley William Coppoce and Arnold Drinkwater and their heirs and the survivors and Survivor of them their and his heirs shall and may by virtue of these presents likewise stand and be Seized of and in all and

9 [59] every (or such part of the said MEssauges tenements Lands and hereditaments in Leinshulme alias Levenshulme aforesaid with their and every of their appurten[an]ces (Except as is herein before Excepted) for soe long time and Untill hee they or some of [60] them shall by the percepc[i]on of the rents issues and proffitts thereof have raised and had such Sum[m]e or Sum[m]es of money soe to bee Charged as aforesaid )Over and above all Charges and reprizes) And after the same shall bee [61] soe raised received and had That then they the said James Crompton Charles WOrsley William Coppoce and Arnold Drinkwater and their heirs or the Survivors or Survivor of them or his heirs or some of them Immediately on his or [62] their receipt thereof shall pay and Dispose of the same Persuant to such the Direction and appointment of him the said John Coppoce as aforesaid And Lastly the said John Copopoce for himself and his heirs Doth Covenant promise [63] grant and Agree to and with them the said James Crompton Charles Worsley William Coppoce and Arnold Drinkwater their heirs and Assignes and to and with every of htem by these presents That the said Messuages Tenements Lands & [64] hereditaments herein before menc[i]oned with their and every of their appurten[an]ces and every part and parcel thereof and of every of them shall from time to time and at all times hereafter remaine Continue and bee (and that all and [65] every Fyne and Fynes Recovery or Recoveries Deed or Deeds Conveyance or Conveyances or other Assureances heretofore had made Levied suffered or Executed of the said premisses or any part hereof shall bee and Enure And soe
