I am also enclosing a proposed agreement and a list of several references. For the past 20 years I have been the sole associate of Linda Pieczynski and in that capacity have extensive municipal prosecutorial experience in handling traffic, quasi-criminal and building code violations. I have prosecuted in the four field courts for the villages of Lombard, Downers Grove, Hinsdale, Woodridge, Westmont, Lisle and Darien. Linda has agreed to remain "of counsel" to advise in building code matters when needed. Her expertise in these matters is invaluable. In the event of any absences due to court schedule conflict, vacation or illness, the court call will be covered by Linda or Ingrid Nierman, a former Assistant State's attorney with municipal prosecutorial experience. 2 April 9, 2015 Mayor David Brummel City of Warrenville 28 W. 701 Stafford Place Warrenville, IL PROPOSAL MUNICIPAL PROSECUTOR I hereby submit the following proposal for the position of municipal prosecutor for the City of Warrenville: Qualifications and Experience: Please see attached resume. I am an attorney licensed to practice law in the State of Illinois and have been so since I have been an Associate at the Law Offices of Linda S. Pieczynski since 1995 and as such have prosecuted traffic, quasi-criminal ordinance and building code violations for numerous municipalities including Downers Grove, Hinsdale, Warrenville, Westmont, Lombard, Lisle, Darien, and Woodridge. Additionally, I have prosecuted at administrative tow hearings for Lisle. From 1981 until November 1987, I served as an Assistant State's Attorney in DuPage County. Linda Pieczynski will remain available to consult in complex matters of building code violations when needed. In the event of my absence due to court schedule conflicts, vacation, or illness, the court call will be covered by Linda Pieczynski, Ingrid Nierman, a former Assistant State's Attorney with municipal prosecutorial experience, or other qualified attorneys with prosecutorial experience. Costs and Fees: The duties of the position would be performed for a fee of $ per court session at which prosecutable local ordinance violations are to be heard at the designated Field Court. There would be no additional fee for court sessions exceeding two hours in length. Any other appearances such as in the main courthouse in Wheaton or services would be billed on an hourly basis at the rate of $ per hour. Other services would include any telephone consultation, research or trial preparation and time spent preparing court documents or correspondence involving the prosecution of said City ordinance violations. Any consultations, research or document preparation involving the prosecution of City building code violations would be billed at the rate of $ per hour. Any out of pocket expenses incurred would be reimbursed by the City of Warrenville upon proof of expenses. Thank you for your consideration. 5 AGREEMENT THIS AGREEMENT, made this day of 2015 by and between the CITY OF WARRENVILLE, DuPage County, Illinois and CHRISTINE CHARKEWYCZ, Attorney at Law, 2021 Midwest Road, Suite 200, Oak Brook, Illinois, WITNESSETH: WHEREAS, CHRISTINE CHARKEWYCZ, Attorney at Law is an attorney licensed to practice law in the State of Illinois; and WHEREAS, the CITY OF WARRENVILLE is desirous of having its City Ordinances prosecuted in the Courts of DuPage County, Illinois. NOW THEREFORE, in consideration of the mutual undertakings and promises contained herein, the parties hereto agree as follows: CHRISTINE CHARKEWYCZ, Attorney at Law (Hereinafter referred to as CHRISTINE CHARKEWYCZ) shall represent the City at all regular Court sessions held at the Field Court designated for said City's cases during the term of this Agreement. 1. The CITY OF WARRENVILLE shall pay CHRISTINE CHARKEWYCZ One Hundred Seventy ($170.00) per Court session at which prosecutable local ordinance violations are to be heard for the prosecution of said violation at the Downers Grove Field Court. In the event a session exceeds two hours in length, there will be no additional fee assessed. 2. In addition to said fee payment, the CITY OF WARRENVILLE agrees to pay CHRISTINE CHARKEWYCZ One Hundred Dollars ($100.00) per hour for any telephone consultation, research or trial preparation done in connection with the prosecution of said City Ordinance violations, for time spent in preparation of Court documents or correspondence involving said cases and any Court appearances by CHRISTINE CHARKEWYCZ at a Court other than the designated Field Court when she is representing the CITY OF WARRENVILLE in the prosecution of the violations of its ordinances. 3. In addition to said fee payment, the CITY OF WARRENVILLE agrees to pay CHRISTINE CHARKEWYCZ One Hundred Forty Dollars ($140.00) per hour for any telephone consultation, correspondence, research, document or trial preparation done in connection with the prosecution of said City Building Code violations. 4. The CITY OF WARRENVILLE agrees to reimburse CHRISTINE CHARKEWYCZ for any out-of-pocket expenses incurred in the prosecution of its ordinance violations (e.g. postage or photocopying). 5. CHRISTINE CHARKEWYCZ agrees to provide a qualified attorney to represent the CITY OF WARRENVILLE in her absence due to illness, conflict in Court schedule or vacation period. The payment for the service of said third party shall be made by CHRISTINE CHARKEWYCZ to said party. 6. The CITY OF WARRENVILLE may designate that individual cases of its ordinance violations be prosecuted by its City attorneys. 7. This agreement will be effective from June 1, 2015 through May 31, Notwithstanding any provision contained therein to the contrary, this Agreement may be terminated by either party at any time. CHRISTINE CHARKEWYCZ agrees to give thirty (30) days prior written notice to the CITY OF WARRENVILLE.
