3 STAFF REPORT To: Gary Klaphake, City Administrator From: Susan Koster, City Clerk Susan Barker, Deputy City Clerk Date: October 25, 2016 Subject: Public Hearing/ Resolution No / Granting a New Brew Pub Liquor License / Trapp Hospitality Group, Inc. dba UTurn BBQ / 599 Crossing Dr., Lafayette, CO Recommendation: Council motion to approve Resolution No / Granting a New Brew Pub Liquor License / Trapp Hospitality Group, Inc. dba UTurn BBQ / 599 Crossing Dr., Lafayette, CO Background: A complete Brew Pub Liquor License application was received from Trapp Hospitality Group Inc. on September 26, The applicant filed a concurrent review with the Colorado Liquor Enforcement Division, which will issue the state license upon receiving evidence of approval by the Local Authority. A Brew Pub license allows for the sale of malt, vinous, and spirituous liquor for consumption on the premises and the manufacture of up to 1,860,000 gallons of malt liquor annually on its premises. Food sales must constitute 15% of the gross on-premises food and drink income of the brew pub. Brew Pubs may also sell their own manufactured malt liquor in sealed containers for off-premises consumption. A diagram of the proposed licensed premise provides for liquor service in the interior of the building and on an outdoor patio. Zoning regulations for this location have been met, allowing for the continued use of the drive-through window. The applicant is completing a tenant finish and the Fire Marshall and Building Official will conduct final inspections when work is complete. Resolution No conditions approval of the license upon the applicant obtaining a Certificate of Occupancy. Trapp Hospitality Group Inc. holds a lease on the premises from 599 Crossing, LLC until December 31, The Lafayette Police Department conducted preliminary background checks for owners Shemryn Trapp and Timothy Trapp. No disqualifying information was discovered. 4 Trapp Hospitality Group Inc. Brew Pub Liquor License Page 2 Oedipus Inc. conducted a Needs and Desires Survey of the surrounding neighborhood within a 1/2 mile radius established by the City Clerk. A summary of the survey indicates that, of the 406 total door knocks, 184 eligible persons signed the petition, 30 declined, and 186 did not answer the door. 137 residents and 40 business owner/managers were in favor of the issuance of the license and 7 residents were opposed. The public hearing for this application was noticed in the Colorado Hometown Weekly on October 19, 2016 and the premises were posted on October 11, 2016 in accordance with the 10-day posting requirement. Preliminary findings by the City Clerk support the approval of the new license and staff recommends Liquor Authority approval. 5 CITY OF LAFAYETTE RESOLUTION No RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, GRANTING A NEW BREW PUB LIQUOR LICENSE TO TRAPP HOSPITALITY GROUP, INC dba UTURN BBQ, LLC WHEREAS, the City received an application for a new Brew Pub Liquor License, on September 26, 2016, and said application was verified complete; and WHEREAS, the applicant has paid the required application and license fees and filed for a concurrent review with the Colorado Liquor Enforcement Division; and WHEREAS, the Lafayette City Council, sitting as the Local Licensing Authority, considered the new application on November 1, NOW, THEREFORE, the City Council of the City of Lafayette finds as follows: 1. The applicant is entitled to possession of the premises for which application is made under a lease agreement between 599 Crossing LLC (landlord) and Trapp Hospitality Group, Inc. (tenant), the term of which expires in December The applicant has filed a floor plan of the interior and exterior patio area. The Council approved said floor plans without exceptions. 3. The sale of liquor for consumption on the premises is permitted at the location for which the license is sought under the applicable zoning ordinances of the City of Lafayette. 4. The parties shown by the application as having a financial interest in the business for which the license is requested are Shemryn Trapp and Timothy Trapp. 5. The Lafayette Police Department has conducted a preliminary background check of Shemryn Trapp and Timothy Trapp and found no disqualifying information. Criminal history investigations are underway at CBI and FBI to determine whether the applicants character and reputation are satisfactory to the Local Authority and therefore qualified to hold a liquor license. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Lafayette, Colorado, as follows: 1. The application from Trapp Hospitality Group, Inc. dba UTurn BBQ is hereby approved subject to: A. Final criminal clearance from FBI and CBI, which will be reported to the City Clerk through the Police Department.

Upon receiving a Certificate of Occupancy from the City of Lafayette Building Department the City Clerk is hereby authorized to release the license to the applicant; and C. Recommendation: Staff recommends: 1. Approval of Ordinance No. 37, Series 2016 adopting the 2015 International Residential Code, International Mechanical Code, International Fuel Gas Code, International Plumbing Code, International Energy Conservation Code, International Property Management Code, International Building Code, and International Existing Building Code. 2. Scheduling a public hearing for December 6, 2016 for the purposes of the second reading of Ordinance No. 37, Series Background: The international building codes are revised every three years by a national consensus process. The revision process is necessary to address new construction methods and materials, and to proactively address safety issues that have become apparent in the last three years. Some of these safety issues are recognized by statistics, while others are recognized by first hand experiences. The code revision process also eliminates requirements that are found to be no longer relevant to the safety of a building and its occupants. This is a dynamic process involving building officials, architects, engineers, and industry experts from around the country. The City of Lafayette adopts the latest codes every three years in order to afford its citizens the very best safety that the most current codes can offer. These codes include national standards, and are used by most jurisdictions across the country. This code uniformity is a benefit to the general public, design professionals, contractors, and the code enforcement community. The ordinance includes an amendment to the International Residential Code by deleting section R313. This section is a requirement that all single-family homes, two-family homes, and townhomes include fire sprinklers. This amendment has no effect on the requirement that apartments and condominiums be fire sprinkled. The reason for the amendment is to allow more time to identify and alleviate the unintended consequences that this requirement presents. Another issue of concern is the sizing of the water services in existing subdivisions. If the services are not adequate for the required fire flow, it could mean replacing the undersized water service line including the added cost of a larger water meter. These and other issues will require careful consideration by the Public Works Department, Fire Department, and Building Division of the Planning & Building Department. Currently, the following jurisdictions are not requiring fire sprinklers per R313: Broomfield, Longmont, Erie, Thornton, Denver, Aurora, Lakewood, Boulder and Parker. The Building Safety Division and Lafayette Fire Department are in agreement that a delay of these requirements would be appropriate at this time. The attached ordinance adopts the 2015 Codes by reference. When adopting codes by reference state law requires Council, at the time of the first reading of the ordinance, to schedule a public hearing for the second reading of the ordinance. This public hearing must be noticed twice, once at least 15 days prior to the hearing and once at least eight (8) days prior to the hearing. In order to comply with this notification requirement staff recommends that the public hearing associated with second reading of the ordinance be scheduled for December 6, Fiscal Impact: Staff is not aware of any budgetary impacts with respect to the adoption of new building codes. Workman Mill Road, Whittier, California 90601, all to have the same force and effect as if set forth herein in every particular. The subject matter of the adopted codes includes comprehensive provisions and standards regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of all residential buildings and structures for the purpose of protecting the public health, safety and general welfare. SECTION 2. That Section , Penalties, of Article II, BUILDING CODE, of Chapter 30, BUILDINGS AND BUILDING REGULATIONS, of the Code of Ordinances of the City of Lafayette, Colorado, is hereby repealed and reenacted to read as follows: Sec Penalties. (a) The following penalty clause as contained in the International Building Code Edition and International Residential Code, Edition, is hereby set forth in full and adopted: Any person who violates a provision of this code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the building official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as prescribed by law. (b) Any violation of the provisions of the International Building Code Edition and International Residential Code, edition, adopted hereby, by a person who is eighteen (18) years of age or more on the date of said violation shall be punished by a fine not exceeding the current maximum amount established by the state for municipal ordinance violations, or by imprisonment not exceeding one (1) year, or by both such fine and imprisonment. Any such violation by a person who is under the age of eighteen (18) years at the time of said violation, shall be punished by a fine not exceeding the current maximum amount established by the state for municipal ordinance violations. shall be punishable by a fine not to exceed one thousand dollars ($1,000.00) or

That Section , Amendments to International Building Code of Article II, BUILDING CODE, of Chapter 30, BUILDINGS AND BUILDING REGULATIONS, of the Code of Ordinances of the City of Lafayette, Colorado, is hereby repealed and reenacted to read as follows: Sec Amendments. (a) The International Residential Code, edition, Section R108.2, is hereby amended to read as follows: The building permit fees under the International Building Code shall be set forth pursuant to resolution of the City Council. (b) The International Residential Code, Edition, Section R313 is hereby deleted entirely. (c) The International Residential Code, Edition, Section R302.3 is hereby amended to read as follows: Dwelling units in two-family dwellings be separated by wall and floor assemblies having not less than a 2-hour fire resistance rating where tested in accordance with ASTM E 119 or UL 263. Fire-resistance-rated floor/ceiling and wall assemblies shall extend from the foundation to the underside of the roof sheathing. (d) The International Residential Code, 2012 Edition, Section R302.2 is hereby amended to read as follows: Sec. R302.2 Townhouses. Each townhouse shall be considered a separate building and shall be separated by a 2-hour fire-resistance rated wall assembly. (e) The International Residential Code, 2012 Edition Section R302.3 is hereby amended to read as follows: Sec. R302.3 Two-family dwellings. Dwelling units in two-family dwellings shall be separated from each other by wall and/or floor assemblies having not less than a 2-hour fire resistance rating. Fire-resistance rated floorceiling and wall assemblies shall extend to and be tight against the exterior wall, and wall assemblies shall extend from the foundation to the underside of the roof sheathing. SECTION 4. That Section , Adoption, of Article V, PLUMBING REGULATIONS, of Chapter 30, BUILDINGS AND BUILDING REGULATIONS, of the Code of Ordinances of Lafayette, Colorado, is hereby repealed and reenacted to read as follows: Sec Adoption.

SECTION 5. That Section , Penalties, of Article V, PLUMBING REGULATIONS, of Chapter 30, BUILDINGS AND BUILDING REGULATIONS, of the Code of Ordinances of the City of Lafayette, Colorado, is hereby repealed and reenacted to read as follows: Sec Penalties. That Section , Adoption, of Article IV, MECHANICAL CODE, of Chapter 30, BUILDINGS AND BUILDING REGULATIONS, of the Code of Ordinances of the City of Lafayette, Colorado, is hereby repealed and reenacted to read as follows: Sec Adoption. Pursuant to Title 31, Article 16, Part 2, Colorado Revised Statutes, as amended, there is hereby adopted as the mechanical code of the City of Lafayette, Colorado, by reference thereto, the following: (a) (b) The International Mechanical Code, edition, published by the International Code Council, 5360 S. Workman Mill Road, Whittier, California 90601, all to have the same force and effect as if set forth herein in every particular. The subject matter of the adopted code includes minimum standards to safeguard life, limb, health, property and construction, installation, quality of materials, location, operation and maintenance or use of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat-producing appliances within the City of Lafayette, Colorado, for the purpose of protecting the public health, safety and general welfare. The International Fuel Gas Code, edition, published by the International Code Council, 5360 S. Workman Mill Road, Whittier, California 90601, all to have the same force and effect as if set forth herein in every particular. The subject matter of the adopted code includes the regulation of the design, construction, installation, location, operation, materials and maintenance and use of fuel gas systems, fuel gas appliances and other miscellaneous heat producing appliances within the City of Lafayette, Colorado, for the purpose of protecting the public health, safety and general welfare. SECTION 8. That Section , Penalties, of Article IV, MECHANICAL CODE, of Chapter 30, BUILDINGS AND BUILDING REGULATIONS, of the Code of Ordinances of the City of Lafayette, Colorado, is hereby repealed and reenacted to read as follows:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, AS FOLLOWS: Section 1. Article VII of Chapter 5 of the Lafayette Code of Ordinances is hereby repealed in its entirety and reenacted to provide: ARTICLE VII. - DIVERSITY AND INCLUSIVENESS ADVISORY BOARD Sec Diversity and inclusiveness advisory board (a) Established. There is hereby established the Diversity and Inclusiveness Advisory Board. (b) Membership. The advisory board shall consist of seven (7) city [residents] [electors] of at least eighteen (18) years of age who shall be appointed by city council. Council may appoint up to two (2) alternate members, who shall be called upon to serve and vote in the absence of a regular member(s). The board may recruit and recommend nominees to city council for appointment. A city employee appointed by the city administrator shall serve as the city's nonvoting staff liaison to the board. (c) Term and Compensation. Members shall be appointed to serve three-year terms. Members seeking reappointment may be recommended by the current board and must be approved by city council. Vacancies for any unexpired term shall be filled by city council appointment. Board members serve at the pleasure of council. Board members 1

39 shall not receive a salary or other compensation for their service, but may receive reimbursement for necessary expenses in accordance with city policy. (d) Purpose. The purpose of the advisory board is to foster mutual respect and understanding and to create an atmosphere conducive to the promotion of amicable relations among all members of the community and to serve as a vehicle through which citizens can convey their suggestions on city policies with respect to diversity and inclusiveness. (e) Duties and responsibilities. In addition to other tasks that the city council may assign to it, the advisory board shall: (1) Study, prepare and recommend to the city council a plan of long and short range priorities and specific legislation or programs to alleviate problems related to diversity and inclusiveness, including programs administered by the city to promote diversity and inclusiveness; (2) Upon request of the council or the city administrator, or upon its own initiative, advise the city council or administrator on the diversity and inclusiveness impact of proposals to be acted upon by the council or upon areas to which the council's attention should be directed; (3) Facilitate conversation related to incidents of division and conflict on issues of diversity and inclusiveness and attempt to correct them by issuing recommendations to appropriate city departments and to the city council for actions necessary or helpful to eliminate such division and conflict; and (4) Consider, research, study and make recommendations to the city council regarding any contemplated or proposed action by any federal, state or municipal government, or any agency or instrumentality thereof, which may have an effect on diversity and inclusiveness in the community. (f) Meetings and bylaws. The board is authorized to adopt bylaws and other administrative guidelines to govern the conduct of its meetings and activities. Section 2. In accordance with the City Council s authority under Section 4.13 of the Charter of the City of Lafayette, the Diversity and Inclusiveness Advisory Board is hereby established and the Latino Advisory Board is hereby abolished. Section 3. 41 STAFF REPORT TO: Gary Klaphake, City Administrator FROM: Tammy Tucker, Superintendent of Recreation & Facility Management DATE: October 26 th, 2016 SUBJECT: Resolution No / Great Outdoors Colorado Grant Recommendation: Approve Resolution for the application of a grant of up to $350, from Great Outdoors Colorado to fund teen-centered adventure elements, sandbox features, and improve mechanical efficiency on the existing lap pool at the Great Outdoors Waterpark. Background: An application to Great Outdoors Colorado (GOCO) for a Local Park and Recreation Grant (LPOR) is being pursued by the City to fund additional elements of the Great Outdoors Waterpark, including a teen-based adventure zone at the existing lap pool. This request will include a beaver water walk and overwater slack line made by Playtime, a Curve Climbing Wall and Zip n Zipline made by AquaClimb, as well as ADA diggers and other play features for the sandpit. The Great Outdoors Colorado LPOR grant is a matching grant, requiring a 25% contribution from the applicant; a minimum of 10% which must be cash. The 25% match for this grant would be appropriated from funds already budgeted for the project. The elements that this application will fund are geared to engage teens, an age group that is not specifically addressed by the other elements of the waterpark, such as the lazy river, waterslides and zero-depth entry pool, which primarily target a younger age group. Resolution No provides approval for submission and, if necessary, acceptance of the GOCO LPOR grant, as well as compliance with the requirements of the grant such as matching and reporting. The Mayor opened the public hearing at 6:27 p.m. and asked if anyone wished to speak. Ron Spaulding (Lafayette) expressed his support for the issuance of the license. Mayor Berg closed the hearing at 6:29 p.m. Owners Ryan Wallace, Tiffany Wallace, and Michael Ochs addressed questions and concerns posed by the Authority. City Attorney Williamson had no issues with the application. The owners circulated a needs and desires petition within a ½-mile radius of the premises. They summarized the results which indicated resident and business owner support for the new tavern.

Return to Regular Council Meeting Public Input Bill Howland (Lafayette) shared results of a survey indicating residents concern with the pace of development in Lafayette. He expressed opposition to the proposed waiver of fees for mixed-use development. John Bollinger (Lafayette) spoke in support of the ballot measure to subsidize bus passes for Lafayette residents. Annette Thull and Yvonne Larson (Lafayette) requested financial support for the 2016 Home for the Holidays event. The following Lafayette residents voiced or registered their opposition to the fee waiver for mixed-use development: Sheryl Mercure, Leslie Wing-Pomeroy, and Denise Chandhari, Judith Sutter, Autumn Graves, Anne Klein, and Ron Spaulding. Seth White (Lafayette) spoke in favor of the Old Town Residential moratorium on new construction. Carolyn Cutler (Lafayette) spoke in favor of the moratorium but shared concerns about the process. Bonnie Freeman registered her support for the moratorium with the City Clerk. The following Lafayette residents voiced or registered opposition to the OTR moratorium City Clerk: Dana Kusjanavic, Eric Ellis, Kurt Munding, Todd Barrs, Ron Spaulding, Jon Simisky, Jeffrey Wynne, Lynda Ladwig, Roger Barbeau, Carol Illlingsley, Chris McGrath, Anji Redmond, Anne Klein, Laura Barr, and Tanya Huebner. Emergency Ordinance Emergency Ordinance No. 36, Series 2016 / Providing for a 270-Day Moratorium on the Acceptance and Processing of Applications, and the Issuance of any Building Permits, for New Structures and Significant Additions to Existing Structures and Significant Additions to Existing Structures in the Old Town Residential Zone District, and Declaring an Emergency. City Attorney Williamson addressed provisions in the Charter allowing for an emergency ordinance. He said Council has the option of considering the ordinance on first reading instead. Council discussed whether an emergency ordinance is needed, as well as the necessity and length of a moratorium. They talked about the Planning Commission s role in making changes to zoning regulations, the involvement of the Historic Preservation Board, and the availability of a consultant to oversee the public process. Acting Planning Director Paul Rayl answered questions concerning demolition and new construction permit processes.

47 Lafayette City Council Meeting October 18, 2016 Page 3 Councilors agreed that existing guidelines for construction in Old Town should become central to the review and revision of existing code. A motion was made by Mayor Pro Tem Reyna and seconded by Mayor Berg to approve on first reading Ordinance No. 36, Series 2016 as presented. A motion was made by Councilor Behanna and seconded by Mayor Berg to amend the ordinance so as to limit the moratorium to 90 days. The motion to amend failed 3 to 4, with Councilors Mazza, Wiesley, Lynch and Walton voting no. A vote was taken on the original motion and it failed unanimously. Purchase Orders and Amendments A motion was made by Councilor Wiesley and seconded by Councilor Lynch to approve the Consent Agenda. The motion passed unanimously. City Attorney s Report City Attorney Williamson asked for Council approval of an addendum to the construction contract for the Great Outdoors Waterpark with Fransen and Pittman, General Contractors. He said the addendum will allow the contractor to start construction before the sale of bonds that will finance the project takes place. A motion was made by Councilor Walton and seconded by Councilor Mazza to approve the addendum as described. The motion passed unanimously. City Administrator s Report City Administrator Klaphake said he will bring the following items to the next Council Meeting: A report on rental inspections, the City Employee Compensation Plan for 2017, and a proposed 3-year contract with Lafayette firefighters. He said tonight s scheduled executive session is no longer necessary. Council Reports A motion was made by Councilor Lynch and seconded by Mayor Pro Tem Reyna to approve a $1,000 donation to Home for the Holidays from Council Contingency funds. The motion passed unanimously. A motion was made by Councilor Lynch and seconded by Mayor Pro Tem Reyna to approve a $250 donation from the Council Contingency account to the American Cancer Society in honor of Sandy Short. The motion passed unanimously.

48 Lafayette City Council Meeting October 18, 2016 Page 4 A motion was made by Councilor Walton and seconded by Councilor Lynch to direct staff to refer a change to the Planning Commission for consideration which would require that a member of staff attend all neighborhood meetings conducted by developers. The motion passed unanimously. Livable Lafayette Councilor Walton and Councilor Lynch proposed a Livable Lafayette work group, which would be tasked with conducting a needs assessment and developing implementation strategies for policies centering on the provision of housing for all ages and lower-income levels. City Administrator Klaphake said the new-hire in the Planning Department would be the ideal person to staff this work group, but that individual won t be available until January of next year. Councilors agreed to modify the timeline accordingly. Mayor Pro Tem Reyna said he would propose an amendment to the code concerning Public Land Dedication at the next meeting. Resolutions of Support A motion was made by Mayor Pro Tem Reyna and seconded by Councilor Behanna to approve Resolution No / Supporting Boulder County Open Space Tax Ballot Measure 1B. The motion passed unanimously. A motion was made by Councilor Walton and seconded by Councilor Lynch to approve Resolution No / Supporting Boulder County Sustainability Tax Ballot Measure 1C. The motion passed 6-1 with Councilor Wiesley voting no.
