8 MEMBERSHIP AGREEMENT I, the undersigned, hereby declare that I am the applicant on page 2 of this document or properly authorized and competent to sign this application on behalf of the applicant (hereinafter applicant) and confirm that on acceptance of this application by the Brahman Beef Cattle Society of South Africa (hereinafter the Society) a membership agreement between the applicant and the Society comes into being on the following terms: 1. The applicant is bound to the Society s constitution, rules, regulations and bye-laws that are available from the Society on request. 2. The applicant will pay all dues, as determined from time to time by the Council of the Society, within the return dates as prescribed by the Society. 3. A certificate, signed by any authorized official of the Society will prima facie be proof of any amount, including interest, that may be due to the Society by the applicant who signed this certificate, and it will not be necessary to furnish proof of the appointment or authority of the subscriber. 4. The membership agreement between the Society and the applicant will come into being at the place where and when the application is accepted by the Society, irrespective of where and when applicant received notice of or learned that the application had been accepted. 5. The applicant agrees to the physical address mentioned on p. 2 as the applicant s domicilium citandi et executandi for purposes of all notices and documents. Any change in the relevant address must be submitted in writing to the Society either by hand or registered mail delivery. 6. The applicant agrees to the jurisdiction of the Magistrate s Court for the recovery of any outstanding amount which may be due by the applicant to the Society of what grounds so ever. The Society is entitled to follow lawful action by it s own discretion, and the applicant will be held responsible for any such costs incurred due to overdue accounts. 7. This document contains the full agreement between the parties and no amendment or addition to said document will have any legal force, unless presented in writing and duly signed by both parties. 8. The applicant herewith grants permission for the use of all information of applicant s herd by the Society for the purpose of breed improvement and promotion. 9. As Brahman breeder the applicant realises that her/his/their behaviour should be of such a nature that it would be to the advantage of the Brahman and fellow breeders and he/she/they undertake: - to make no destructive remarks on the judges, fellow exhibitors or their animals and to abide by the placing of the judge; - to act in a dignified way, and by so doing so, convey a positive image of the Brahman; - to abide by the rules of the show society and those of the Brahman Society ; - to strive towards showing animals that are a positive advertisement for the Brahman; - to inform the President in writing of complaints regarding the behaviour of a fellow member or staff member. 10. All payments by applicant to the Society, will be made in Bloemfontein, free of any exchange rates or hidden bank costs. 11. Regardless of the address of applicant and place of signature of this agreement both parties agree that: 11.1 This agreement is set in Bloemfontein All achievements- and performances will be delivered by the Society to applicant in Bloemfontein. 12. Should the applicant neglect obligations to the Society and this compels the Society to instruct its lawyers to follow necessary action to protect the Society s interests, the applicant will be held responsible for all legal expenses as agreed between lawyer and client, which will be payable in cash upon request. 14 FORM 5 VERY IMPORTANT: LINKING OF BRAHMAN ANIMALS TO YOUR NEW MEMBER NAME If (i) animals you have already purchased and/or (ii) animals that you will be purchasing have not been officially transferred to your name, you cannot breed with them. Linking of all animals to your new member name is therefore of vital importance. After membership registration is done, and the transfers of the mentioned animal below are confirmed with the seller, certificates of the animals will be send to you.
