1 CHAPTER 225: CITY PARK REGULATIONS ARTICLE I. GENERALLY SECTION : DEFINITIONS For the purposes of this Chapter, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context words used in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory. BOARD: The Parks Board of the City of O'Fallon, Missouri. CITY COUNCIL: The City Council of the City of O Fallon, Missouri. CITY: The City of O'Fallon, Missouri. DIRECTOR: Includes any person immediately in charge of any park areas and its activities, to whom all park attendants of such areas are responsible. PARK: Any park preservation, playground, recreation center, building or any other area owned or used by the City and devoted to passive or active recreation. PERSON: Includes any person, firm, partnership, association, corporation, company or organization of any kind. POLICE: A person authorized and commissioned by the City of O'Fallon, Missouri, as a Law Enforcement Officer. RANGER: A person authorized and employed by the City of O'Fallon, Missouri, to enforce any and all provisions of Chapter 225 of the Code of the City of O'Fallon, Missouri, and to regulate and direct traffic in and adjacent to any City of O'Fallon, Missouri, park or any other area if so directed by the Police. VEHICLE: Any conveyance, whether motor powered, animal drawn, or self propelled. The term shall include any trailer in tow of any size, kind or description. Exception is made for vehicles in the service of the City Parks. (CC ; Ord. No , ; Ord. No , ) SECTION : FAILURE TO OBEY PARK RANGER It shall be unlawful to willfully fail or refuse to comply with any lawful order or direction of any City of O'Fallon, Missouri, Ranger or other City employee. (Ord. No , ) SECTION : PARK PROPERTY It shall be unlawful for any person while in or about any City Park to: 1. Willfully mark, deface, disfigure, injure, tamper with, or displace or remove any building, playground equipment, bridge, table, bench, fireplace, railing, paving or paving materials, water line or other public utility or parts or appurtenances thereof, sign, notice or placard whether temporary or permanent, monument, stake, post or other boundary marker, or other structure or equipment, facility or park land property or appurtenances whatsoever.

2 2. Fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition. No person over the age of six (6) years shall use or enter the restrooms and washrooms designated for the opposite sex. Exception is made for City employees or agents of the City performing cleaning of said rooms. 3. Damage or remove any rock, stone, tree, shrub or plant, down timber or other wood or materials or make any excavation by tool, equipment, blasting, or other means or agency except on special written permit as provided for in this Chapter. 4. Construct or erect any building or structure of whatever kind, whether permanent or temporary in nature, or run or string any public service utility into, upon, or across such lands, except on special written permit as provided for in this Chapter. 5. Climb any tree or walk, stand or sit upon any monument, vase, fountain, railing or fence or upon any other property not designated or customarily used for such purposes. 6. Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot, or throw projectiles of any kind or nature at any animal, fish, reptile or bird; nor shall he/she remove or have in his/her possession the young of any wild animal, or the eggs or nest or young of any reptile or bird; nor shall he/she collect, remove, have in his/her possession, give away, sell or offer to sell, or buy or offer to buy, or accept as a gift, any specimen alive or dead of any of the group of tree snails, or in any manner violate the Missouri Wildlife Code. 7. Give or offer or attempt to give any animal or bird any tobacco, alcohol, drug, or other known noxious substances. (CC ; Ord. No , ) SECTION : SANITATION It shall be unlawful for any person while in or about any City Park to: 1. Throw, discharge or otherwise place or cause to be placed any solid or liquid in the waters of any fountain, swimming pool, pond, lake, stream, or any other body of water in or adjacent to any park or any tributary, stream, storm sewer, or drain flowing into such water, which will or may result in the pollution of said waters or damage to equipment, individual, animals or fish. 2. Dump, deposit or leave any ashes, papers, boxes, cans, rubbish, waste, garbage, refuse or other trash, in any City Park other than use of authorized trash receptacles in conjunction with Park usage. Nor shall such refuse or trash be placed in any waters in or contiguous to any park. 3. Bring into, dump, deposit or leave any glass bottles or broken glass upon the grounds of any City Park. 3 SECTION : TRAFFIC A. It shall be unlawful for any person while in or about any City Park to: 1. Fail to comply with all applicable provisions of the State laws and City ordinances and regulations pertaining to equipment and operation of motor vehicles. 2. Fail to obey the reasonable instructions of Police Officers, Rangers and park employees, such persons being hereby authorized and instructed to direct traffic whenever needed in the City parks in accordance with the provisions of such regulations as may be issued by the City Council, Director or Police. 3. Fail to observe carefully all traffic signs indicating speed, direction, caution, stopping or parking, as well as all other signs posted to control traffic and to safeguard life and property. a. Drive or ride a vehicle at a rate of speed exceeding fifteen (15) miles per hour, except as otherwise posted. b. Drive or park any motor vehicle on any park area except the paved park roads or designated parking areas. c. The closing of park driveways or parks, or any section thereof of parks, shall only be at the direction of the Board, City Council, Police, or the Director. d. The closing of park driveways or any section thereof shall be accomplished by the erection of a suitable barrier or other visible marker across the driveway. e. The primary criteria for closing a park driveway or any section thereof shall be the promotion of the public health, welfare, safety or the protection of public property. 4. Drive a truck in excess of one (1) ton upon the driveways, parking lot, or any other area, except when making deliveries of operation or maintenance supplies to the park, or for some social function under permit of the Director. 5. Repair, service or maintain a vehicle except those in need of emergency repair. 6. Operate a vehicle in a careless and imprudent manner on any park drive, parking lot, or area. 7. Operate any vehicle in any City park without any required operator or vehicle license except for those used for maintenance or by special permit issued by the Director. 8. Operate a motorized scooter or motorized bicycle as defined in Section Fail to use a muffler adequate to deaden the sound of the engine in a motor vehicle. (CC ; Ord. No , ) B. Any person found to be in violation of the provisions of this Section shall be subject to a penalty as set out in Section of this Code. (CC ; Ord. No , ; Ord. No , ; Ord. No , ; Ord. No , )

4 SECTION : PARKING It shall be unlawful for any person while in or about any City Park to: 1. Park a vehicle contrary to the directions and instructions of any park attendant or Police Officer who may be present. Park a motor vehicle other than in designated areas. SECTION : BICYCLES/Rollerblades/Skateboards It shall be unlawful for any person while in or about any City Park to: 1. Ride a bicycle or use roller blades or skateboards where signage prohibits. Ride a bicycle or use roller blades or skateboards without reasonable regard to the safety of others, and without signaling all turns and stops. 2. Leave a bicycle, roller blades or skateboard lying on the ground or pavement, or lying against a tree or in any place or position where other persons may trip over or be injured by it. SECTION : RECREATIONAL ACTIVITIES--UNLAWFUL ACTIVITIES, ETC. A. Bathing and Swimming. It shall be unlawful for any person while in or about any City Park to: 1. Swim, wade, bath, or wash in any waters or waterway in any park, except in such waters and at such places as are provided therefore, and in compliance with such regulations as are herein set forth or may be hereafter adopted. Nor shall any person frequent any waters or places customarily designated for the purpose of swimming or bathing, or congregate there when such activity is prohibited by the Director upon a finding that such use of the water would be dangerous or otherwise inadvisable. 2. Congregate around any swimming pool, bathhouse, waters or places designated for the purpose of swimming or bathing, except between such hours of the day as shall be designated by the Director for such purposes for each area. 3. Undress in any area, or in any vehicle, toilet or other places, except in such bathing houses provided for that purpose. 4. Disregrd or disobey any rules regulating the use of the swimming pool as established by the Director and posted at the facility. B. Firearms. No person in a City Park shall use, carry, or possess firearms (except as otherwise allowed by law), or air rifles, spring guns, bows and arrows, slings or any other forms of weapons potentially inimical to wildlife and dangerous to human safety, or any instrument that can be loaded with or fire blank cartridges, or any kind of trapping device. Shooting into park areas from beyond park boundaries is

5 forbidden. The Director may from time to time permit the trapping of any animals considered to be a nuisance or threat to safety, to the extent allowed by law. C. Picnic Area Use. No person shall: 1. Picnic or loiter in restricted areas. Attendants shall have the authority to regulate the activities in such areas when necessary to prevent congestion and to allow the maximum use for the comfort and convenience of all. Park visitors shall comply with any reasonable directions given to achieve this end. 2. Violate the regulation that use of the individual BBQ pits together with tables and benches follows generally the rule of "first come, first served." 3. Have exclusive use of any area unless granted such permission by the Director. 4. Leave a picnic area before a barbecue pit fire is completely extinguished, and before all trash, papers, cans, garbage and other refuse is placed in the receptacles provided. If no such trash receptacles are available, then refuse and trash shall be carried away from the park area by the picnicker to be properly disposed of elsewhere. D. Camping. No person shall camp in any City Park area other than by permit in the designated group camping area of Fort Zumwalt Park. This area shall only be available for camping in accordance with rates determined and set by the Board, collected and enforced by the Director. A camping permit includes the right to erect tents E. Horseback Riding. No person shall ride a horse or pony or allow same to run at large except in conjunction with a civic parade sponsored by the City or a bona fide organization with the permission of the Director. Such horseback riding shall be confined to the driveways of the park. When permitted in parades, horses shall be thoroughly broken and properly restrained, ridden with due care, and shall not be allowed to graze or go unattended, nor shall they be hitched to any rock, tree or shrub. F. Tennis Court. Players shall limit play when others are waiting to use the courts. 1. Players must wear athletic shoes. 2. Tennis courts may be reserved by the Parks Department for games, lessons or tournaments for a definite period of time as determined by the Director. 3. Players or spectators shall not sit or stand on the ends of the courts or otherwise interfere with play. 4. Tennis courts may not be used for any activity other than the playing of tennis.

6 G. Musical Instruments, Sound Equipment. 1. No person shall operate or play any musical instrument, radio, mechanical record or tape player, loud speaker, public address system or sound amplifying equipment of any kind within the boundaries of any City Park in such a manner as to cause the sound emanating there from to exceed a loudness of seventy-five (75) decibels when measured on the seventy (70) D.B. scale at a distance of fifteen (15) feet from the sound source, without a written permit issued by the Director. 2. In the event the operation or playing of any musical instrument, radio, mechanical record or tape player, loudspeaker, public address system or sound amplifying equipment shall unduly disturb other park occupants or persons living near the parks, the Director or Police shall have the authority to order the person responsible for such disturbances to reduce the sound to a level that will not disturb other park occupants or persons living near any park, regardless of permit or sound levels. 3. In the event the person or persons responsible for disturbing other park occupants or persons living near any park by operating or playing any musical instrument, radio, mechanical record or tape player, loudspeaker, public address system or sound amplifying equipment of any description, refuse(s) to reduce the sound level as directed by the Director, Police, or any Parks Personnel employed by the City, he/she shall be subject to arrest and or ejection from the park regardless of any permit or sound level. H. Boating. No person shall use or attempt to use any boat or canoe in any body of water in any park unless authorized by the Director. (CC ; Ord. No , ) SECTION : BEHAVIOR OF VISITORS TO PARK It shall be unlawful for any person while in or about any City Park to: 1. Have or cause to be brought in, keg or drawn beer of any kind, into any City Park; without notification to the Director. Sale of alcohol is not permitted through the parks concession stands. 2. Drink or consume alcoholic beverages who has not attained the age of twenty-one (21) years. 3. Be under the influence of controlled substances or drugs, consume or use controlled substances or drugs, or have in his/her possession controlled substances or drugs of any kind, type or description unless prescribed by a doctor of medicine. 4. Have brought, or have in his/her possession, or discharge any fireworks, rockets, or explosives, or to discharge or throw them into any park area from roadways or land adjacent thereto without permission of the Director. This prohibition includes any substances or compound that would be dangerous from any of the

7 foregoing standpoints. This section does not regulate fireworks displays sponsored by the City of O Fallon, Missouri. 5. Have been responsible for the entry in a City Park of a dog or other domestic animal unless such animal shall be restrained at all times on an adequate leash not greater than eight (8) feet in length. All dogs must have a current St. Charles County rabies control tag attached to the collar or in owner s possession. 6. Occupy any seat or bench, baseball diamond, building, field, court, horseshoe pit, or enter into or loiter or remain in any pavilion or other park structure or grounds, or section thereof which may be reserved and designated by the Board or the Director for use by certain other persons or groups. 7. Solicit contributions for any commercial purpose except as expressly authorized by City permit. 8. Build or attempt to build a fire on the ground, paving, or any other areas except under such regulations as may be designated by the Director. 9. Sit or lounge on vehicles; sleep or protractedly lounge on the seats or benches, or other structures; or engage in loud, boisterous, threatening, abusive insulting or indecent language, or engage in any disorderly conduct or behavior tending to a breach of the public peace or otherwise create a nuisance. 10. Fail to produce and exhibit any permit from the Director he/she claims to have upon request of any authorized person who shall desire to inspect the same for the purpose of enforcing compliance with any City ordinance or regulation. 11. Disturb or interfere unreasonably with any person or party occupying any area, or participating in an activity, under the authority of a permit. (CC ; Ord. No , ) SECTION : MERCHANDISING, ADVERTISING AND SIGNS It shall be unlawful for any person while in or about any City Park to: 1. Expose or offer for sale any article or thing; nor shall anyone station or place any stand, cart or vehicle for the transportation, sale, or display of any such article or thing. Exception is here made as to any regularly licensed concessionaire and to any person or organization operating under special permit of the Director. 2. Announce, advertise or call the public attention in any way to any article or service for sale or hire. 3. Paste, glue, tack or otherwise post any political, commercial or personal sign, placard, advertisement, or inscription whatever on any public land, building, wall, fence, tree, post, telephone pole, or roadway adjacent to a park. 4. Pass out commercial handbills, pamphlets, newsletters, literature, pictures; make speeches designed to promote the sale of any item or thing, without the written permission of the Director. 5. The provisions of this Chapter relating to merchandising, advertising and signs shall not apply to regularly licensed concessionaires or organizations acting under authority and regulation of the Director, or in Civic Hall as approved by the Director. 8 SECTION : PARK OPERATING POLICY A. Hours. Except for unusual and unforeseen emergencies, parks shall be open to the public every day of the year during designated hours. The opening and closing hours for each individual park shall be posted therein for public information. B. Any person authorized by permit of the Director may be in any park during closed periods. C. The finding of lost articles by park attendants shall be reported to the Director who shall make a reasonable effort to locate the owner. The Director and park attendants shall make a reasonable effort to find articles reported lost. D. Permit. A permit shall be obtained from the Director or his/her designate before participating in the following park activities: Sponsorship of a public picnic, public celebration or event, concert, organized use of picnic grounds by persons, schools, companies, etc., baseball or softball fields, tennis courts, soccer fields, football fields, and any other areas or fields to be used for league play, games or tournament play. Application. A person seeking issuance of a permit hereunder shall file an application with the Director. The application shall state: a. The name and address and phone number of the applicant. b. The name and address of the person, persons, corporation or association sponsoring the activity. c. The day and hours for which the permit is desired. d. The park or portion thereof for which such permit is desired. e. An estimate of anticipated attendance. 2. Standards for issuance. The Director shall issue a permit when he/she finds: a. The proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park. b. The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare and safety and recreation. c. The proposed activity or use is not anticipated to incite disorderly conduct, violence, or crime. d. The proposed activity will not entail unusual, extraordinary or burdensome expense or police supervision by the City. e. The facilities desired have not been reserved for other use at the day and hour required in the application.

9 3. A permittee shall be bound by all park rules and regulations and all applicable ordinances as fully as though the same were inserted in said permits. Permittee agrees that all persons involved in the presentation of the event will observe the terms and conditions of the permit when issued, and will comply with requests of Director concerning traffic arrangements, sound and crowd control measures, and use of park facilities. 4. The permittee shall be liable to any person by reason of the negligence of the permittee. 5. The Board, Director, and Police shall have the authority to revoke a permit upon determination of violation of any rule or ordinance, or for other good cause. (CC ; Ord. No , ) SECTION : ENFORCEMENT AND PENALTIES A. Officials. The Director, Police or other officials employed by the City shall in connection with their duties imposed by law enforce the rules and regulations of this Chapter 225. B. Arrest or Ejectment. The Director, Police or other officials employed by the City shall have the authority to have arrested, or ejected from the park, any person acting in violation of rules and regulations or any ordinances governing the parks of the City of O'Fallon, Missouri. C. Seizure of Property. The Director, Police or any other officials employed by the City shall have the full authority allowed by law to seize and confiscate any property, thing, animal or device used in the park in violation of these rules and regulations. D. In addition to the provisions of Subsections (A--C) of this Section, any person who has been found to be in violation of any of the provisions of this Chapter shall be guilty of an offense and upon conviction thereof may be punished as set out in Section of this Code. (CC ; Ord. No , ) SECTION : REGULATIONS AND RESTRICTIONS CONCERNING THE T. R. HUGHES STADIUM AND OZZIE SMITH FIELD 1. Missouri Cities of the Third Class, O'Fallon, Missouri, being such, have the power to set forth regulations for the parks and related entities within the municipal City limits. 2. No person, other than authorized personnel, shall, on the park grounds, at any time sell or attempt to sell tickets for any event held at, or to be held at, the T. R. Hughes Stadium and Ozzie Smith Field in the City of O'Fallon, Missouri. 3. No animals, with the exception of service animals (such as seeing eye dogs) and Police canine, shall be allowed in the stadium or onto the playing field, playing

10 diamond, playing court, track, ring, stage, or any other playing or exhibition area, or any other restricted area immediately adjacent therein at the T. R. Hughes Stadium and Ozzie Smith Field in the City of O'Fallon, Missouri, unless specifically authorized by the City of O'Fallon. 4. No person who is a spectator at any athletic event or exhibition shall shoot, throw toss or deposit any bottle, can, metal, paper or debris or thing of any type or nature whatsoever onto the playing field, playing diamond, playing court, track, ring, stage, or any other playing or exhibition area, or any other restricted area immediately adjacent therein, or at any person participating as a player, official or promoter or employee thereof, unless specifically authorized by the City of O'Fallon. 5. No person who is a spectator at an athletic event or exhibition shall disturb the peace of others by riotous or disorderly conduct; or by profane, obscene, indecent, lewd or offensive language, calculated to provoke a breach of the peace; or by violent, tumultuous, offensive or obstreperous conduct; or by assaulting, striking or fighting another at an athletic event. 6. No person who is a spectator at any athletic event or exhibition shall go onto the playing field, playing diamond, playing court, track, ring, stage, or any other playing or exhibition area, or any other restricted area immediately adjacent thereto, designated as restricted by the promoter of the event or exhibition, without first obtaining the permission of the promoter thereof. 7. Every person promoting any athletic event or exhibition to which the public is admitted shall announce to the spectators before commencing the event or exhibition the contents of Subsections (D--F) of this Section and the penalties for violation of this Section. 8. No person shall bring any food, beverage(s), or cooler(s) of any kind into the T. R. Hughes Stadium, or the adjacent parking areas, without the specific permission of the City of O'Fallon and the promoter of any event in the stadium. An exception will be made for persons needing such items for medical reasons provided notification is made to the promoter prior to entering the stadium. 9. Smoking Prohibited Within T. R. Hughes Stadium. l. As used herein, the following term shall have the following meaning: SMOKE: Possession of burning tobacco in the form of a cigarette, cigar, pipe or other smoking equipment. 2. A person shall not smoke within T. R. Hughes Stadium in the City of O'Fallon, Missouri. 3. Any person in violation of this Subsection shall be punished by a fine not exceeding five hundred dollars ($500.00). 10. Any person found to be in violation of any provision of this Section shall be subject, upon conviction, to a fine of up to five hundred dollars ($500.00) or to imprisonment in the St. Charles County Jail for up to ninety (90) days, or to both such fine and imprisonment. 11 ARTICLE II. RULES, REGULATIONS AND RESTRICTIONS OF THE FESTIVAL DISTRICT SECTION : FESTIVAL DISTRICT DECLARED Whenever the Mayor or City Administrator declares a festival occurring in Westhoff Park, the Ozzie Smith Field or the T. R. Hughes Stadium, the area described as: "The entire area of land within the corporate City limits of O'Fallon, including all residences, business and commercial establishments, streets, parks, common grounds, and all other areas, encompassed by the Norfolk & Southern Railroad track to the south, the west side of St. Matthew Street to the west, Highway 79 to the north, and Pearl Drive to the east, (excluding Highgrove Estates) and also including the entire length of each of Tom Ginnever Boulevard, Eggering Drive, and St. Joseph Avenue" will be declared the "Festival District", and special restrictions as described in this Article will be in effect during the dates and times to be determined by the Mayor or City Administrator. (Ord. No , ) SECTION : NOTIFICATION--PUBLIC ANNOUNCEMENTS Whenever a festival is declared, notification shall be, but not be limited to, public announcements on the O'Fallon cable public access channel and publication once in one (1) weekly newspaper delivered to all residences within the Festival District and the majority of other City residents. This notification shall be made at least thirty (30) days before the first (1st) day of the festival event. The City may utilize other means of notification whenever possible. (Ord. No , ; Ord. No , ) SECTION : PARKING VIOLATION -- IMPOUNDMENT OF VEHICLES The O'Fallon Police Department is hereby authorized to tow and impound any vehicle(s) parked in violation of any provision of this Article. It will be the responsibility of the owner of any towed or impounded vehicle to pay for any tow or impoundment charges or fees. (Ord. No , ) SECTION : PARKING RESTRICTIONS Whenever a festival is declared, parking restrictions on residential streets and thoroughfares within the Festival District will be in effect during the dates and times of the festival as follows: 1. No parking at any time will be allowed on the following streets and thoroughfares: a. St. Joseph Avenue; b. Clover Lane; c. St. Matthew Avenue (south of Tom Ginnever); d. Eggering Drive; e. Tom Ginnever Boulevard; f. Cool Springs Road; g. T. R. Hughes Boulevard; h. Pearl Drive;

12 i. Sunflower; j. Wabash; k. East Wabash; l. Cool Springs Industrial. The above indicated streets and thoroughfares will be designated as immediate tow zones with any vehicles parked in violation of this Article towed in order to ensure the safe and efficient flow of traffic. 2. No parking at any time will be allowed on the north side of the following streets: a. Moonstone Court; b. Onyx Court; c. Amethyst Court; d. Zircon Court; e. Sir Lancelot; f. Princess Grace Court; g. King George Court; h. Prince Albert Court. 3. No parking at any time will be allowed on the south side of the following streets: a. Lakeside Manor Drive; b. Knob Hill; c. Havenview Circle; d. Havenview Court; e. Blackberry Lane; f. Trudy Lane; g. Daffodil Court; h. Pepper Lane; i. Larkspur Lane; j. Primrose Court; k. Gabriel Lane; l. Diamond Pointe Court. 4. No parking at any time will be allowed on the east side of the following streets: a. St. Matthew (north of Tom Ginnever); b. Havenview Drive; c. Havenview Circle; d. Pinewoods Place Drive; e. Meadowlark Lane; f. Red Bud Lane; g. Eastbrook Lane (north of St. Joseph); h. Aster Lane; i. Diamond Pointe Court; j. Topaze Drive. 5. No parking at any time will be allowed on the west side of the following streets: a. Eastbrook Lane (south of St. Joseph Avenue); b. Topaz Drive (south of St. Joseph); c. Lady Ann Court;

13 d. King Edward Court; e. Duke William Court; f. Queen Victoria Court; g. Lord Edward Court. 6. No parking at any time will be allowed on the inside circle of Green Park Lane. 7. No parking will be allowed at any other location posted by the City of O'Fallon, either permanently or temporarily, provided proper signage is installed. (Ord. No , ; Ord. No , ) SECTION : TRAFFIC FLOW PATTERNS -- CHANGES The City of O'Fallon is authorized to change traffic flow patterns, establish one-way streets, add, delete or alter any traffic control device(s), restrict parking, control ingress and egress from all public streets, public or private parking lots or private roadways, or establish any other traffic control measures deemed necessary to assist in the traffic flow and to ensure emergency vehicle access. The above shall be approved by the City of O'Fallon Traffic Engineer and the Chief of Police. However, the Chief of Police or his designee may implement or utilize any of the above traffic measures without the approval of the Traffic Engineer in an emergency situation. (Ord. No , ) SECTION : RESTRICTIONS When the Mayor or City Administrator declares a festival and the Festival District is established, the following restrictions shall be in place in Westhoff Park, Ozzie Smith Field, and the T. R. Hughes Stadium: 1. No dangerous and deadly weapons shall be allowed in the above areas in accordance with Section of this Code, as amended. 2. Temporary shelters such as tents, large umbrellas, gazebos, dining canopies, etc., will be allowed during the festival times. These structures must: a. Not exceed a size of twelve (12) feet by twelve (12) feet. b. Be temporary and safe in design. c. Not be placed in pedestrian, bicycle or vehicular traffic lanes. d. Not be placed in an area which will affect the normal ingress or egress of pedestrian traffic to any area. e. Not be placed within one hundred fifty (150) feet of any main entertainment stage or within one hundred fifty (150) feet of any secondary stage. f. Be taken down no later than 8:30 P.M. g. Be immediately taken down prior to impending strong winds after notification by festival promoters, City of O'Fallon Officials or law enforcement personnel. h. Be immediately taken down, at any time and for any reason, at the request of festival promoters, City of O'Fallon Officials or law enforcement personnel. 3. It is unlawful for any person(s) to bring glass containers into the above indicated areas during the festival times. "Coolers", defined as any device used to keep beverages, foods or ice cool, may be brought into the above

14 indicated areas but are subject to search by law enforcement or park personnel at any time. 4. All persons are hereby prohibited from bringing animals of any type, with the exception of service animals (such as seeing-eye dogs) or Police canine or horses, into any O'Fallon City park during any festival as declared by the Mayor or City Administrator unless written permission is received from the Director of Parks. This includes pets on leashes or other restraints. 5. It is unlawful for any person(s) to ride skateboards, rollerblades, in-line skates or bicycles in the above indicated areas during any festivals. 6. Any or all of the above restrictions may be waived by the Parks Director. (Ord. No , ) SECTION : PENALTY Conviction of a violation of this Article is punishable by a fine of up to five hundred dollars ($500.00) or imprisonment in the St. Charles County Jail for a period up to ninety (90) days, or to both such fine and imprisonment. (Ord. No , ) ARTICLE III. VETERANS MEMORIAL PARK SECTION : VETERANS MEMORIAL PARK -- RULES AND REGULATIONS A. Because the Memorial Walk is a memorial to the veterans of the armed forces of the United States and because certain acts, appropriate elsewhere, are not appropriate in the Memorial Walk, all visitors, including persons attending or taking part in any picnic, celebration, parade, service or exercise, shall observe proper standards of decorum and decency while within the Memorial Walk grounds. For the foregoing reasons, the following acts by any person within the confines of the Memorial Walk shall be, and the same are hereby, prohibited: 1. Climbing, cutting, breaking, injuring, defacing or disturbing any tree, shrub, plant, rock, building, monument, fence, bench or other object, structure, apparatus or property; plucking, pulling up, cutting, taking or removing any tree, shrub, bush, plant or flower; gathering or taking any fruit or nut; cutting, writing or marking upon any building, monument, fence, bench, table or other object, structure, apparatus or property. 2. Injuring, defacing or destroying any notice, rule or regulation posted by the City or posted with the consent of the Parks and Recreation Department. 3. Cutting or removing any wood, turf, grass, soil, rock, sand or gravel. 4. Making, kindling or maintaining a fire for any purpose, except in places expressly provided therefore by the Parks and Recreation Department. No person shall discard or throw away any lighted match, cigar, cigarette or other burning object except after extinguishing the same and then only in a receptacle provided therefore by the City. 5. Indulging, inciting or engaging in riotous, boisterous, threatening, immoral or indecent conduct. 6. Using any lewd, abusive, threatening, vulgar or profane language. 7. Engaging in any picketing, demonstration or similar conduct.

Engaging in any orations, speeches or similar conduct to assembled groups of people, unless the oration is part of an event, as defined in Subsection (B), authorized pursuant to Subsection (D). 9. Distributing any handbill, pamphlet, leaflet or other written or printed matter within the Memorial Walk, except that a program or other written or printed matter may be distributed if done in connection with an event, as defined in Subsection (B), authorized pursuant to Subsection (D). 10. Selling or offering for sale any merchandise, article or thing whatsoever except through duly authorized concessions or as expressly permitted by the Director of Public Relations. 11. Throwing or depositing any bottle, tin can, broken glass, paper, clothes, rubbish or other object of any description except in receptacles provided for that purpose. 12. Causing or permitting any animal that is either owned by or in one's custody or control to enter or remain in a park, except a dog restrained by a leash not exceeding eight (8) feet in length. 13. Riding, driving or propelling or causing to be propelled any vehicle or automobile elsewhere than on the roads or drives provided for such purposes. 14. Starting, stopping, running or operating in any manner any: a. Motorcycle except one licensed by the State of Missouri or any other State, b. Tricycle except one licensed by the State of Missouri or any other State, c. Minibike or other similar vehicle. 15. Riding or driving any vehicle of any kind at a speed exceeding fifteen (15) miles per hour. 16. Parking of any vehicle shall be only in designated parking areas and shall be limited to patrons or persons using the Memorial Walk. 17. Possessing or discharging any firearm, fireworks, firecracker, explosive, air gun, bow and arrow, BB gun or slingshot within the limits of the Memorial Walk except by permit. 18. Using, placing, displaying or erecting any signboard, sign, billboard, bulletin board, post, pole or device of any kind for advertising or any other purpose whatsoever without the prior written consent of the Director of Public Relations, except temporary directional signs posted for the purpose of directing person or patrons to an authorized event shall be permitted. 19. Teasing, annoying, disturbing, molesting, catching, injuring or killing, throwing any stone or missile of any kind at or striking with any stick or weapon, any animal, bird or fowl; or to feed any fowl except in areas designated by the Parks and Recreation Department. 20. Operating or using any loudspeaker or other mechanical means of amplifying sound without the written permission of the Director of Public Relations.

16 21. Consuming alcoholic beverages in the Memorial Walk or possessing an open container of an alcoholic beverage unless authorized by special permit by the City. B. No company, society, organization or group of more than ten (10) persons shall hold or conduct any picnic, celebration, parade, service or exercise ("event") without first obtaining a permit, and it shall be unlawful for any person to take part in any event held or conducted contrary to the provisions hereof. C. The Memorial Walk shall be open for use twenty-four (24) hours per day. D. Requests by members of the public for a permit to conduct any event shall be submitted to the Director of Public Relations Department at least thirty (30) days prior to proposed event date. Such requests shall describe the proposed event in detail, to the extent possible, to include the type of event, the name of the individual or organization sponsoring the event, the names of all key individuals participating in the event, the estimated number of persons expected to attend the event, the date and time of the event, the expected length of the event, the event's format and content, whether permission to use loudspeaker systems or musical instruments or flags during the service is requested and, if so, a description of the programs, and whether any military organization's support or presence is requested. Events and event participants and attendees shall obey all rules set out in Section (A) and shall act in a dignified and proper manner at all times while in the Memorial Walk. No permit request that meets the requirements stated herein shall be unreasonably withheld. E. Any person violating any of the provisions stated herein shall upon conviction be fined a sum not to exceed five hundred dollars ($500.00) and/or confinement in the County Jail for a period not to exceed ninety (90) days. F. The City Council, the City Administration, the Public Relations Department, and the Parks and Recreation Department shall, at their request, be advised on matters concerning the Memorial Walk by the Veterans Commission.
