EnjoinsDefendantsfrom enforcing thezerotoleranceruleandany policy thatsuspendsprisonersfromthekosherdietwithoutfirstprovidingan opportunity forthe prisoners to contesttheirrem ovalorsuspension. Policiesand Procedures A ilkosher diet'meansfood prepared consistentwiththerequirem ents recognized by a religiousauthority qualified to detennine whetherfoodiskosher. Forpre-packagedfood, forinstance,thismeansthataqualifiedreligiousauthoritym usthaveapprovedthefoodsas kosher.the Defendantscurrently rely upon the certifiedkosherlistingsonthewebsite maintained bythechicago RabbinicalCouncil(htp://w ww.crcweb.org/).theselistingsare acceptableforcomplyingwith thisinjunction.thedefendantsm ayalso acceptcertifications fromotherauthoritiesuponashowingthatthesecertificationsarereliable. Al1food,including foodconsideredpareve,shallbehandledandprepared in accordance with the proceduresset fol'thinthedepartm entofcorrectionsprocedurt ,which isatached hereto asexhibita. 8. To ensure thatd efendants'personnelconsistently apply theprocedures for procuring and handling the food productsused in the kosherdiet,defendantsshalperiodically conductauditsaccording to theirestablished auditprocedurestoensurethatthefoodbeingused inthekosher diet andthepreparationofth ekosherdietm ealscom ports w iththerequirem entsof Paragraph 7.Defendantswilshare these procedureswiththeunitedstateswithinoneweekof the issuance ofthis injunctionand w ithinone w eek ofanychangesbeingm adeto the procedures. 9. To ensure thatdefendants'chaplainsapply consistentstandardswhenprocessing prisonerviolationspursuantto Procedure ,Defendantsshaltrain a1lchaplainsin processing noticesofviolationsin accordance withprocedure TheDefendantsare

Monitoring & Accountability Monthly Reports 11. D efendants sha lfilew iththec ourtam onthlyreportcontainingtheinform ation listedbelow. Thefirstreportshalbedueonthefirstdayofthem onthfolowingthefirstful month from the date ofthis Order,with subsequentreports due the firstday of each m onth thereafter (Septem ber 1,O ctober 1,etc.). Eachreportshallcontain thefollowinginfonnation: a. Thetotalnumberofprisonersenrolled in thereligiousdietprogram (çlkdp ')on the 15thdayofthepriormonth;and b. A breakdown of the numberof prisonersenroled in ther D Ponthe15thdayof thepriormonthateachfacilityofthefloridadepartm entof Corrections, includingprivately-op eratedfacilities. Quarterly ReportsandDocumentation 12. Defendantsshalalso provide on a quarterly basisreportsand docum entation of processing prisoners'rd P violations. Thefirstreportsha lbedue January 15,2016,forthe last quarterof2015,w ith subsequentdocum entsprovidedontheffteenthdayofthem onthafter eachquarterthereafter(a pril15,2016;july15,2016,etc).thereportsand docum entation shall include: 4

D efendantsshallprovideto thecourtand the U nitedstatesasum m aryreport showing: (1)the totalnum berofprisonersw hopotentiallyviolatedtherdp during themostrecentquarterly period;(2)thebasisofthose violations;(3)the numberofnoticesofviolation issued duringthequarterlyperiod;and (4)the disposition of the noticesofviolation fully processed during thatperiod. T he summ ary reportshalinclude the following inform ationonnoticesofviolation issued: (a) the nam es ofthe prisonersineachinstitutionw ho w ere issueda notice ofviolation;(b)ifdisposition wasreachedduringthatquarter,w hetherthe disposition wasbased upon m iten notification onlyorwhetherafacetoface pastoralinterview wasscheduled;and(c)theresultsofeachdisposition.forany disposition thatresultsin a suspension,the length of suspension shalbe indicated. b. By thefirstofthem onth priortoeachquarterly reportingperiod(september1, 2015;December1,2015;M arch 1,2016;June1,2016,etc.),theUnitedStates shallidentifyfive (5)institutionsforw hichthedefendantsshallprovidecopiesof thedepartmentofcorrections'formdc N olaterthan the end of themonth in w hichthe quarterlyreportis subm ited (January31,2016;July 31,2016,etc.), Defendantsshallprovide to the United Statescopies ofthed C 5-325foreach prisonerlisted on thequarterlysum mary reportforeach ofthefive (5)institutions previously identified by the United States.

Reasonable accesswillbeprovided to atorneys,experts,orotherjusticed epartm entpersorm el. TheDefendantsshall,untiltheterm ination ofthisinjunction,retainandprovide the U nited Stateswith reasonableaccessto documentsrelevantto the issues inthis case (including prisoner requeststojointherd P,responsesthereto,recordsofprisonerviolationsrelatedto ther DP, anddocum entsshowingthecostofrdp m eals). Notice and Opportunity To Cure Violations 14.
