1 Addendum 6: BID No Flat Creek WRF Fiber Project January 27, 2012 This is to inform eligible contractors of the final information provided on this Bid. 1. Route Change Between Splice Point A and Splice Point B (Phase 2) See attached Route Map. Note the directional bore path goes further down Browns Bridge Road to Hilton Drive. The directional bore continues on Hilton Drive until the grassy part of the Flat Creek easement is reached. 2. Bid Changes Contractors should submit four (4) Bid Certification forms for this project. Attached are the revised forms for the Primary Bid, Alternate Bid, Phase 4 Bid and Fire Station 4 Bid. The only change to the Primary Bid is with the Fire Station 4 segment. The Primary Bid installation method was changed from aerial to directional bore. The Alternate Bid will no longer include the Phase 4 portion of the project. Only Phase 1, Phase 2 and Phase 3 will be included in the Alternate Bid. The Alternate Bid will include all fiber installations from Pizza Hut to Splice Point C and the Flat Creek WRF. A separate Phase 4 Bid is requested for the segment continuing from Spice Point C to the Liberty Mutual Building and the McEver/Browns Bridge intersection. See attached Route Map for the revised path. Splice Point D moved to a conduit junction box on the front of the Liberty Mutual Building. This box allows access inside the building and to conduit installed to Browns Bridge Road. Contractors should direct bury or bore as terrain allows for this segment. A separate Fire Station 4 Bid is needed for the City to complete this segment of the project if the Alternate Bid is selected instead of the Primary Bid. The City reserves the right to select one or more of the bids submitted independently of the others. Selected Bid(s) will be awarded to the lowest contractor as determined on a per bid basis. Therefore it is possible that different contractors may be awarded the Alternate Bid, Phase 4 Bid and the Fire Station 4 Bid. Page 1 of 19

2 Refer to Addendum 4 for the definitions of each Phase. There may be portions of the project where the route map indicates direct bury, but directional boring is needed for a proper installation. Contractors are responsible for taking this into account when preparing the bid responses. 3. Bid, Payment and Performance Bonds Required Bid bonds: Any bid bond submitted to the city shall be issued with a good and faithful surety or sureties approved by the city. Such bid bond shall secure the faithful acceptance by the offeror of a bid or proposal award and shall be issued for the protection of the city. The bid bond shall be in an amount not less than five percent of the total price specified in the bid or proposal. Bonds shall be of a forfeiture type. All sureties must be licensed to do business in the state, have an A.M. Best rating of A-6 or higher and be listed in the U.S. Department of the Treasury publication of companies holding certificates of authority as acceptable surety on federal bonds and as acceptable reinsuring companies. In lieu of the bid bond described above, an offeror may submit with the bid or proposal a cashier s check payable to the city in an amount not less than five (5) percent of the price specified in the bid or proposal. To the extent permitted by state law, a guaranteed letter of credit in the proper amount will act as bid bond, provided that the form of such letter of credit and the lending institution have been approved by the city in advance. Return of bonds to the successful bidder shall be conditioned upon the bidder s execution of a contract within thirty (30) days following the city s award. Performance and Payment Bond: a. Any required performance bond shall be issued with good and sufficient surety or sureties approved by the city, in favor of the city and in at least the amount of the total price payable under the bid or proposal. Such performance bond shall be conditioned upon the offeror s faithful performance of the terms of the bid or proposal and the contract executed in connection therewith. b. Any required payment bond shall be issued with good and sufficient surety or sureties approved by the city, in favor of the and in at least the amount of the total price payable under the bid or proposal. Such payment bond shall be for the benefit of all persons supplying labor, material, machinery and equipment in the prosecution of the work to be done under the bid or proposal.
