Rakesh Kumar, Scientist & Head, NEERI, Mumbai could not attend the meeting. Leave of absence was granted to them. Chairman of the committee welcomed the members of the committee and allowed proceeding of the meeting to start. The meeting thereafter deliberated on the agenda items (Book-let no. 11, 12 & 13) placed before the committee and following decisions were taken. Refusal of Consent to establish Regarding EC Refusal of expansion Refusal of consent to 1 st operate It was noted that RRZ committee in its meeting dtd has asked PP to submit following documents/information: 1. PP shall submit revised project details with layout and building plan and copy of approved building plans obtained from Town planning dept. / Local body to Envt. Dept. and MPCB. 2. PP shall submit plan layout approved from Irrigation Dept showing the minimum distance of STP & MSW plant from HFL. 3. PP shall submit copy of EC obtained or status of EC. There will be no review of refusal as PP has proposed to change the scope of project by deleting 3 star hotel and IT Park which were in RED category, thereby claiming nonapplicability of RRZ policy, It was decided to inform PP to freshly apply for C to E as they have changed project, alongwith above mentioned information as per minutes of RRZ policy committee meeting held on It was decided to consider industry s request to waive condition of obtaining EC imposed in consent towards BUA more than 20,000 sq.m., as their BUA is 13,597 sq.m. and not sq.m. which was mentioned due to oversight. Amendment in consent shall be issued subject to submission of affidavit regarding actual BUA, non-requirement of EC and capacity of Co-generation plant (12 MW ). It was decided to get clarification along with documents regarding when was the additional BUA added and when did they apply for consent to the board for the additional BUA. There will be no review of refusal of consent as they have violated C to E condition of not to take any effective steps towards implementation of 2

Pune Refusal of Consent to establish As per industry s request, industry s representative presented their case before CAC. They have accepted that they have carried out expansion without prior consent of the Board. They have informed that they have provided six STPs and one ETP and the treated effluent is being disposed on their own land. They have also informed that they have submitted letter dtd wherein facts about expansion and application submitted in 2011 for C to E expansion are mentioned. CAC pointed out that they have carried out shot blasting and painting activity in open without APC system, to which representative said they have installed APC system but they could not produce details of the same during the meeting. It was decided to submit all details in chronological in next CAC meeting. 3

Industry shall submit Board Resolution towards starting construction of 1 st expansion before obtaining EC thus violated C to E conditions and thereby the provisions of Environmental laws and in future, they will not do such violations and BG of Rs. 2 lakh by towards submission of Board Resolution. 3. Industry shall affidavit within 15 days in the prescribed format towards not taking further effective steps for 1 st expansion prior to obtaining EC and BG of Rs. 10 lakh by for ensuring compliances of the same. 3 VRS Food Ltd., P. It was also decided to issue SCN for refusal to the other part ( which was kept in abeyance) as EC is not valid and SEIAA in its meeting dtd has asked PP to go to SEAC III for fresh appraisal of the project as the project will take 8 more years to complete. -- It was decided to keep the case in abeyance and meanwhile compliance to be obtained as per NGT s regarding joint inspection, directions to be incorporated in consent and then put up to CAC It was decided to grant first consent to operate and amalgamation with existing consent by imposing following conditions: 1. Industry shall carry out treatability study of ETP cum STP by and submit BG of Rs. 2 lakh towards compliance of the same. 2. Industry shall submit design details of bag filter by to TAC and submit BG of Rs. 1 lakh by towards compliance of the same. --- It was decided to keep the case in abeyance and resubmit to CAC alongwith the detailed chart of the project prepared during the decision of application of VIVA MALL. 11 John Distillery Pvt. Ltd., A/p. Hitali, Tal. Rahata, Dist. Ahmednaar Establish COU or 5 years whichever is earlier It was decided to grant consent to establish for production of ethanol 30 KLPD from rectified spirit ( as raw material) by imposing condition that effluent generated from cooling shall be 100% recycled in process. 6

Ahmednagar -- It was decided to keep the case in abeyance and get clarification for decrease in CI and resubmit the case in CAC meeting dtd consent upto by imposing following conditions: 1. Thereafter review along with distillery cases. -- It was decided to issue SCN for refusal and closure direction due to noncompliance of consent conditions observed and complaints received against the industry. 5 Pad Dr. V.V. Patil SSK, Pravaranagar, Dist. Ahmednagar and amalgamation consent and amalgamation with consent of acetaldehyde unit by imposing following conditions: 1. Industry shall submit BG of Rs. 5 lakh towards providing H2S scrubber in case of gaseous fuel for treatment at the point of generation with adequate stack height by lakh towards O & M of pollution control system It was decided to grant first consent to operate by imposing following conditions: 1. Industry shall submit BG of Rs. 10 lakh towards O & M of pollution control system. 2. Industry shall submit design details of APC system by to TAC and submit BG of Rs. 1 lakh towards compliance of the same. PROPOSAL FOR PERMISSION OF OPERATION IN RAINY SEASON 1 John Distillery Pvt. Ltd., A/p. Chitali, Tal. Rahata, Dist. Ahmednagar REVIEW ITEM 1 Compliance status in respect of directions issued by CPCB u/s. 5 and u/s. 18(1)(b) to the non-complying industries in the State It was decided to grant permission for operation of distillery in rainy season by imposing BG of Rs. 5 lakh towards compliance of conditions stipulated in the permission letter. To be discussed on , AST to put up note. General points: 11

Discussion was held during the meeting regarding mentioning the by-products or waste products of distillery units such as bio-compost & bio-gas in consent letter, JD(WPC) to put up a note regarding the same in next CAC. 2. CAC noted that there are few rivers for which survey has not been carried out till date to decide line of HFL with respect to RRZ policy, 2009 and it was decided to communicate the same to Environment Dept., Government of Maharashtra for guidance in granting permission to industries which are located and to be located in such river basin
