No person shall enter upon e premises of any residence in e City for e purpose of soliciting orders for, or selling goods, wares, merchandise or services of any kind or character, unless such person shall have first obtained an identification card as hereinafter provided. (Ord Passed ) CARD APPLICATION, FEE AND ISSUANCE. (a) Whoever desires e issuance of an identification card required by Section shall file wi e Records Clerk of e City a written application, on a form to be provided, correctly containing e following information: (1) Full name of applicant. (2) Address. (3) Birdate, height, weight, color of eyes and hair. (4) If applicant uses motor vehicle; e make, model, year and current registration number ereof. (5) State of issuance of driver s license and number ereof. (6) Name and address of employer. (7) Brief description of goods, wares, merchandise or services involved. (8) Wheer applicant has ever been convicted of any crime, and, if so, e nature ereof and penalties erefor. (b) Upon approval of e application by e Police Chief and Public Safety Director, e applicant shall pay a fee often dollars ($10.00) to compensate for e costs incident to e issuance ereof. (c) Upon compliance wi e foregoing, e identification card, which shall be valid for a period of one year from e date of issuance, shall forwi be issued to e a~plicant.
4 REVOCATION OF CERTIFICATION CARD; APPEAL. (a) Should any subsequent investigation disclose at e applicant has falsified any information required in his application which was e basis upon which e identification card was issued, e Records Clerk of e City shall immediately revoke e identification card and notify e holder ereof, eier in person or by certified mail, of such action so taken. (b) Any person whose identification card is so revoked may, wiin ten days after receipt of e revocation notice, appeal to Council by filing wi e Clerk of Council a signed written statement briefly setting for his grounds of appeal. Council shall give e appellant due notice of a hearing by certified mail. The appellant may appear before Council in person or by attorney, and e decision of Council ereon shall be final. (Ord Passed ) PENALTY. Whoever violates any provision of is chapter is guilty of a minor misdemeanor for each such offense.

Peddler means every person who shall sell or offer for sale, barter or exchange any goods, wares, produce, merchandise or oer articles of value at any place in, along or rough e streets or oer public places. (Ord Passed ) LICENSE REQUIRED. Every peddler, huckster, itinerant retailer or oer person shall, before engaging in e business of selling, bartering or offering for sale vegetables, provisions, goods or merchandise or anying of value, upon e public streets or oer public places wiin e City, procure a license for such purpose and obtain a license erefor from e Director of Public SeR ice. (Ord Passed ) LICENSE FEE. The applicant and grantee of any license for e purposes enumerated in Sections and shall pay e following fees for e license: (a) A license for a motor vehicle shall be fifty dollars ($50.00) per year. (b) A license for a handcart shall be ten dollars ($10.00) per year. The license for a participant in e Farmers Market on e Front Street Mall selling produce oer en at personally grown shall be a fee of ten dollars ($1 0.00) per year. (c) A license where e merchandise being sold is carried by e seller shall be ten dollars ($10.00) per year. If an applicant desires e license for less an one year, e license fee for e same shall be at e rate of five dollars ($5.00) per day. (Ord Passed )
6 INSPECTION OF LICENSE. Every grantee of a license to peddle under is chapter shall, when so requested by any member of e Police Department, produce such license for inspection. (Ord Passed ) EXCEPTION. (a) Noing in is chapter shall be construed to require e payment of any license fee by e owner of any product or article of his own raising or manufacture for selling such article or product, eier personally or by an agent. (b) A person registered under Chapter 757 does not need to pay a peddler s fee as required under is chapter. (Ord Passed ) PENALTY. Whoever violates any provisions of is chapter is guilty of a minor misdemeanor for e first offense, and a misdemeanor of e four degree for e second or any subsequent offense.
7 CRIMINAL TRESPASS. (a) No person, wiout privilege to do so, shall do any of e following: (1) Knowingly enter or remain on e land or premises of anoer; (2) Knowingly enter or remain on e land or premises of anoer, e use of which is lawfully restricted to certain persons, purposes, modes or hours, when e offender knows e offender is in violation of any such restriction or is reckless in at regard; (3) Recklessly enter or remain on e land or premises of anoer, as to which notice against unauorized access or presence is given by actual communication to e offender, or in a manner prescribed by law, or by posting in a manner reasonably calculated to come to e attention of potential intruders, or by fencing or oer enclosure manifestly designed to restrict access; (4) Being on e land or premises of anoer, negligently fail or refuse to leave upon being notified by signage posted in a conspicuous place or oerwise being notified to do so by e owner or occupant, or e agent or servant of eier. (b) It is no defense to a charge under is section at e land or premises involved was owned, controlled or in custody of a public agency. (c) It is no defense to a charge under is section at e offender was auorized to enter or remain on e land or premises involved when such auorization was secured by deception. (d) (1) Whoever violates is section is guilty of criminal trespass, a misdemeanor of e four degree. (2) Notwistanding Section , if e person, in committing e violation of is section, used a snowmobile, off-highway motorcycle, or all-purpose vehicle, e court shall impose a fine of two times e usual amount imposed for e violation. (3) If an offender previously has been convicted of or pleaded guilty to two or more violations of is section or a substantially equivalent municipal ordinance, or state law, and e offender, in committing each violation, used a snowmobile, off-highway motorcycle, or all-purpose vehicle, e court, in addition to or independent of all oer penalties imposed for e violation, may impound e certificate of registration of at snowmobile or off-highway motorcycle or e certificate of registration and license plate of at all-purpose vehicle for not less an sixty days. In such a case, Ohio R.C applies. (e) As used in is section: (1) All-purpose vehicle, off-highway motorcycle and snowmobile have e same meaning as in Section of e Traffic Code. (2) Land or premises includes any land, building, structure, or place belonging to, controlled by, or in custody of anoer, and any separate enclosure or room, or portion ereof. (ORC )
8 SOLICITATION PROHIBITED. No person shall go upon any premises and ring e door bell upon or near any door, or rap or knock upon any door, or create any sound in any manner calculated to attract e attention of any occupant of such premises for e purpose of securing an audience wi e occupant(s) ereof to engage in solicitation as defined in is chapter if: (a) It is earlier an 9:00 a.m. or later an 9:00 p.m. local time; or (b) There is posted upon or near e main entrance door of such premises a notice, not less an ree inches by five inches and not more an fifteen square inches, containing e words No Soliciting in letters at least one inch in height; or (c) There is posted upon or near each entrance to a residential development e inhabitants of which are members of a bona fide condominium or homeowners association a sign, placed by said association, not less an two and not more an four square feet containing e words No Soliciting in letters at least four inches in height. Any sign which complies wi is section shall not count as a sign for purposes of determining e maximum number of signs permitted by e Sign and Landscaping Code. (Ord Passed ) PENALTY. Whoever violates Section shall be guilty of a minor misdemeanor on e first offense and a misdemeanor of e second degree for any subsequent offense. Whoever violates any one e oer provisions of is chapter, or files or causes to be filed a registration containing false or fraudulent misstatements, is guilty of a misdemeanor of e second degree.
