1 WINDSOR-ESSEX COUNTY ASSOCIATION OF REALTORS CONTEST #1 (THE "CONTEST") OFFICIAL RULES 1. CONTEST PERIOD: Contest starts May 5, 2018 at 12:01 AM Eastern Standard Time ( EST ) and ends October 5, 2018 at 11:59:59 PM EST (the Contest Period ) and consists of five (5) separate entry pools and corresponding prizes (see Rule #6). 2. ELIGIBILITY: Legal residents of Canada (except Quebec) who have reached the age of majority in their province or territory of residence at the time of entry may enter this Contest. Persons in any of the following categories are NOT eligible to participate or win a prize: (a) any person who, at any time who, was or is a director, officer, agent, representative, or employee of Windsor-Essex County Association of Realtors ( Sponsor ) or its parent, affiliates, subsidiaries, or service agencies (if any), who is directly involved in the planning or execution of the Contest; (b) any other individuals engaged in the development, production or distribution of materials for the Contest or engaged in the administration or execution of this Contest (collectively, with the entities listed in 2(a), the Contest Entities ); and (c) persons who are or purport to be immediate family members (defined as biological or step-mother/ father, sister, brother, daughter, son, dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household as any person in any of the preceding categories. Contest is subject to all applicable federal, provincial and local laws and regulations.

2 4. HOW TO ENTER: NO PURCHASE NECESSARY: Enter using either method of entry outlined below. No entries will be accepted by any other means. An entrant will not receive additional entries for entering by both Mail-In Entry and Online Entry. (i) Mail-In Entries: On a 3" x 5" card or piece of paper, hand-print your full name, phone number (with area code), your address, and mail it inside a standard envelope with sufficient postage to: Windsor-Essex County Association of Realtors Contest #1, Windsor-Essex County Association of Realtors, 3020 Deziel Drive Windsor, ON, N8W 5H8. You will receive one (1) entry into the applicable Contest Draw. Only one (1) request per envelope allowed. Limit one (1) Mail-In Entry per person. Mail-In Entries must be postmarked no later than an Entry Period End Date and received before the corresponding Entry Period Drawing Date in order to be eligible for the applicable random drawing. Entries mechanically reproduced or made in any fashion other than as specified herein are void. Mail-In Entries must be legibly hand-written. Mechanical reproductions, postage-due, and Mail-In Entries sent in excess of the entry limits set forth below will not be accepted. Mail-In Entries received without a verifiable and legible return address will be deemed incomplete and not valid entries. (ii) Online Entries: Visit and scroll to the bottom of the webpage for the Contest entry form. You will be asked to provide your: first and last name, address, phone number, and to check the I m not a robot by clicking on the checkbox. Upon clicking submit, you will receive one (1) entry into the applicable Contest Draw. Limit one (1) Online Entry per person. Entrants are not permitted to share the same address. Online Entries must be received no later than an Entry Period End Date and received before the corresponding Entry Period Drawing Date in order to be eligible for the applicable random drawing. Any attempt by any entrant to use multiple/different addresses, identities, registrations, or any other methods will void that entrant's entries and entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of disqualification, any prize that entrant might have been otherwise entitled to will not be awarded. In the event of a dispute regarding the identity of an entrant, the entry will be deemed to have been made by the authorized account holder of the address submitted with the Program registration. Authorized account holder is defined as the natural person who is assigned to an address by an internet access or online service provider, or other organization responsible for assigning addresses for the domain associated with the registered address. Each entrant may be required to show proof of being an authorized account holder. Online Entries sent in excess of the entry limits set forth below will not be accepted. Online Entries received without a verifiable and legible address will be deemed incomplete and not valid entries.

RANDOM CONTEST DRAWS: At each Draw Date (see Rule #2), the Sponsor will randomly draw one (1) entry for each Contest Draw (each a Potential Winner and, if verified, Winner ) from among all eligible entries received for each Contest Draw, for a total of five (5) draws. The draws will take place at in Windsor, Ontario. The odds of winning a prize depend on the total number of eligible entries received throughout the Contest Period for each Contest Draw. Each Potential Winner will be subject to verification of eligibility and compliance with these Official Rules. Non-winning entries will carry forward into subsequent Contest Entry Periods consisting of non-winning entries from preceding entry pool(s) and any other eligible entries. 6. PRIZES: For each Contest entry pool, one (1) prize will be awarded as follows (for a total of five (5) prizes throughout the Contest Period): Prize 1 (Entry Period #1 Draw) - One (1) Prize available: Winner will receive one (1) Nest Protect Smoke + Carbon Monoxide Alarm, 2nd Gen (Battery). Approximate retail value ( ARV ) of Prize: $ CAD. Prize 2 (Entry Period #2 Draw) - One (1) Prize available): Winner will receive one (1) Nest 3 rd generation smart thermostat. ARV of Prize: $ CAD. Prize 3 (Entry Period #3 Draw) - One (1) Prize available): Winner will receive one (1) Ring Video Doorbell 2 with Bonus Chime and 1-year Ring Video Cloud Recording. ARV of Prize: $ CAD. Prize 4 (Entry Period #4 Draw) - One (1) Prize available: Winner will receive one (1) Google Home Home Smart Speaker. ARV of Prize: $ CAD. Prize 5 (Entry Period #5 Draw) - One (1) Prize available: Winner will receive one (1) Century Sense Smart Deadbolt with Bluetooth Technology in Satin Nickel. ARV of Prize: $ CAD. Total ARV of all Contest Prizes: $1, CAD. Any difference between stated ARV and actual value of a prize will not be awarded. Prizes are not transferable, or redeemable for cash, and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. All federal, provincial and local taxes (including income and withholding taxes), if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the Winner s responsibility, regardless of whether a prize is used in whole or in part. All prize details are at the Sponsor's sole discretion. 7. HOW TO CLAIM YOUR PRIZE: To be eligible to be declared a Winner, Potential Winners must first correctly answer, unaided, a mathematical skill-testing question to be administered by telephone or . Potential Winners will be contacted by phone, and/or mail at the

4 postal address, , or telephone number provided with the entry, with instructions on how to claim the prize. Potential Winners may be required to execute and return a Declaration of Eligibility, a Liability Release, and, where lawful, a publicity release, within five (5) business days from the time it is postmarked as having been sent by the Sponsor or its representative, or the prize will be forfeited and, at the Sponsor s sole discretion, the prize may be awarded to an alternate Winner. If a Potential Winner is found to be ineligible or not in compliance with these Official Rules, declines to accept a prize, fails to correctly answer the mathematical skill-testing question administered by Sponsor, or Sponsor is unable to contact a Potential Winner within five (5) business days, or in the event that a prize notification or prize is returned undeliverable, the prize will be forfeited and, at the Sponsor s sole discretion, prize may be awarded to an alternate entrant. Sponsor may select up to three (3) alternate entrants; thereafter, if a Potential Winner cannot be verified in accordance with these Official Rules, the prize will not be awarded. Potential Winners may be required to furnish proof of identification. Allow 5-7 business days for verification and shipment of your prize. The Contest Entities shall not be held responsible for any delays in awarding a prize for any reason outside of their control. Prizes will only be delivered to verified Winners. Any unclaimed prize will not be awarded. The Contest Entities are not responsible for any change of mailing address, address, and/or telephone number of entrants. By accepting a prize, each Winner agrees and consents to the use of his/her name, address (city and province of residence), voice, and statements relating to the Contest or Sponsor, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by Sponsor or any related entities in any and all media now known or hereinafter developed, including the internet, without territorial or time limitation, except where prohibited by law. CONDITIONS OF ENTRY: 8. By entering, entrants: (i) acknowledge and represent that they are in full compliance with these Official Rules including all eligibility requirements; and (ii) agree to be bound by these Official Rules and the decisions of the Sponsor, made in their sole discretion, which shall be final and binding in all respects. Entrants who have not complied with these Official Rules are subject to disqualification and all associated entries will be void. These Official Rules apply to the Contest and entry into the Contest is deemed acceptance of these Official Rules. 9. The Contest Entities are not responsible for late, lost, damaged, stolen, misdirected, mutilated, garbled, illegible, or incomplete submissions of requests/entries. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. All entries become the property of the Sponsor and in no case shall be returned to the sender. 10. Sponsor reserves the right to disqualify any entrant's registration in the Contest (and void all associated entries) or entitlement to a prize if, in the sole discretion of the Sponsor, it determines or suspects that the entrant has attempted to undermine the legitimate

5 operation of the Contest by tampering, cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries or points generated by script, macro, robotic, programmed, or any other automated means or any other means which subvert the entry process). 11. Entrants agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference, solely govern the relationship between entrants and Sponsor in connection with this Contest. Entrants agree to waive any right to claim ambiguity in these Official Rules. Personal data collected during the course of the Contest including, but not limited to, name, mailing address, phone number, and address will only be used for the purpose of administering the Contest. This does not affect any other consents provided. This data may also be used by Sponsor to verify an entrant s identity, postal address, address, and/or telephone number in the event they are deemed a Potential Winner. As a condition of entering, entrants agree (and agree to confirm in writing): TO INDEMNIFY AND HOLD HARMLESS CONTEST ENTITIES FROM ANY CLAIMS, ACTIONS, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS FEES), INJURY, LOSS OR DAMAGES OF ANY KIND (COLLECTIVELY, CLAIMS ), RESULTING FROM PARTICIPATING IN THE CONTEST OR ANY CLAIMS ARISING FROM THE ACCEESTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS BROUGHT BY THIRD PARTIES. ENTRANTS AGREE THAT CONTEST ENTITIES HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE CONTEST OR ANY PRIZE AWARDED. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, CONTEST ENTITIES DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE SPONSOR SITE OR ANY PROMOTIONAL WEB SITE AND CONTEST ENTITIES SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUESTIONS OR ERRORS RELATED THERETO. THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS, AND NOTHING IN THESE OFFICIAL RULES SHALL EXCLUDE OR LIMIT IN ANY WAY ANY ENTITY'S LIABILITY FOR PERSONAL INJURY OR DEATH CAUSED BY ITS NEGLIGENCE, FOR FRAUD OR FOR ANY OTHER WHERE LIABILITY MAY NOT AS A MATTER OF LAW BE LIMITED. Sponsor s failure to enforce any term of these Official Rules shall not constitute a waiver of such term or any other provision. Sponsor reserves the right to disqualify any entrant who violates these Official Rules, any other rules, guidance or instructions set out by the Sponsor in promotional material relating to the Contest or interferes with the Contest in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate such entrant s eligibility to participate in the Contest. Any attempt by an individual to access any website associated

6 with the Contest via a bot script or other brute force attack or any other unauthorized means will result in that individual s IP address and all entries from that IP address becoming ineligible. Use of automated entry devices or programs is prohibited. Without limiting the generality of the foregoing, each entrant agrees to release and hold harmless the Contest Entities from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action that relate in any way to the entry. 12. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of England, without regard to any other conflicts of law principles. All entrants consent to the jurisdiction and venue of the federal, provincial, and local courts of Ontario, Canada. 13. Sponsor reserves the right in its sole discretion (subject to applicable laws) to cancel, modify and/or suspend this Contest at any time if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes (such as force majeure events) impairs the administration, security, integrity or proper play of the Contest. In the event of cancellation, Sponsor reserves the right in its sole discretion, to randomly select the Winners for the drawing(s) at issue from among all eligible, non-suspect entries received for the applicable drawing(s) up to time of such cancellation. In no event will the Sponsor be liable for more than the total stated number and ARV of prizes in these Official Rules. 14. The Contest Entities do not warrant that access to the Contest will be uninterrupted. The Contest Entities are not responsible for any problems that may arise, including but not limited to: (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, internet service providers, websites, or other connection, availability or accessibility problems arising in connection with or over the course of the Contest; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in connection with the administration of the Contest, the processing of points or entries, or the offering or announcement of any prize or in any Potential Winner or Winner notification documents; or (d) for any other errors of any kind relating to or in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or (f) damage to a user's system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest. The Contest Entities are also not responsible for lost, late, delayed, garbled, stolen, incomplete, misdirected, illegible, damaged or undelivered mail, , or entries. Proof of transmission (screenshots, etc.) does not constitute proof of delivery.

7 DISCLOSURES: 15. Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorneys' fees) from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrants engaging in any of the foregoing activities may be disqualified (and all associated entries will be void) and will forfeit any prize won. Sponsor s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 16. Notwithstanding anything elsewhere in these Official Rules, no person s or entity s liability for death or personal injury caused by its negligence shall be limited in any way, and nor shall their ability for fraud or for any other matter where liability may not as a matter of law be limited or excluded. Where these Official Rules provide for discretion exercisable by a Contest Entity that could otherwise be capable of causing a significant imbalance in the parties rights and obligation hereunder, to the detriment of a consumer and contrary to the requirement of good faith, shall be exercised reasonably and in good faith. 17. In the event of any conflict with any Contest details contained in these Official Rules and Contest details contained in Contest Materials (including television, and print advertising, promotional packaging, and other promotion media), the details of the Contest as set forth in these Official Rules shall prevail. 18. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 19. This Contest is subject to all applicable federal, provincial, and municipal laws. 20. This Contest is solely sponsored by Windsor-Essex County Association of Realtors, 3020 Deziel Drive Windsor, ON, N8W 5H Information collected from entrant is subject to Sponsor s Privacy Policy.
