7 ORI Transfer Function Law Enforcement Agencies ONLY Transfer To ORI - previously modified in the Person Source screen. Now, that field will be for display only, the modification/update will be performed in the Arrest Segment.

8 ORI Transfer Function Query the OTN in the Arrest Segment In the Transfer To Code field select: INSTATE - For a transfer to another agency in Georgia OUTOFSTATE - For a transfer to another agency outside of Georgia

9 ORI Transfer Function Instate transfer enter ORI of the agency you are transferring to, a dropdown box is available to search for the ORI.

11 Forwarded for Prosecution Action Forwarded for Prosecution (FFP) action in the arrest segment Removes any existing TER and prevents a TER from being applied Research agency records to determine if arrest was forwarded to prosecutor Query the OTN in the Arrest Segment Click Expand ALL or the + sign next to the CTN where NFF will be applied Click Add Arrest Action Enter FFP in the Action field, Action Date, and Action ORI. Click SAVE

12 Modifying Arrest or Demographic Data Does your agency fingerprint for another agency? Do you often need to correct arrest or demographic data after it has been submitted to GCIC but can t because you have no authority under their ORI? Then you have to contact the agency to request the correction or have another CCH User ID with their ORI to make the correction. GOOD NEWS!

13 Modifying Arrest or Demographic Data Now law enforcement (arresting) agencies who print for other agencies will be able to update/modify arrest/demographic information without a User ID connected to that agency s ORI Use the Arrest Segment to Update: Arresting ORI Arrest Date Date Printed Action Date for the offense code Action ORI for the offense code Case Number Use the OTN/CRAM to Update: Name Date of Birth (DOB) Social Security Number (SOC) Sex Race Offense Date *An agreement between the two agencies is still required

14 Modifying Arrest Data Changing the Offense Code Can be changed in the OTN/CTN CRAM screen Requires LEA Supervisor Access Cannot change if disposition has been added SO WHAT S NEW? Law enforcement users can change the offense code for agencies they print for without having to log in with a user ID under that agencies ORI

15 Modifying Demographic Data You changed the Name, DOB, SOC, SEX, or RACE in the OTN/CTN CRAM screen. Are you finished? No! You must also make the change in the Person Source segment in order to show the change in the identification section of the RAP sheet *Supervisor Access required to make updates/modifications in the Person Source screen

16 Modifying Demographic Data If you are changing the DOB you should make the change Person Source first to avoid a status error Status Error You must correct the following error(s) before proceeding: : OTN was not found using the Name and DOB provided. (p_parse_cycle) : The SID value is not allowed as the transaction is for a new cycle. (p_parse_cycle)

17 Senate Bill 367 Clarified first offender status and provided responsibilities of the Clerk of Court, Department of Community Supervision, Department of Corrections and GCIC relating to Reporting of Dispositions Dissemination of Records Modification of Records

18 Senate Bill 367 GCIC no longer responsible for modifying First Offender records (b) The records of the Georgia Crime Information Center showing treatment as a first offender shall be modified only when a court of competent jurisdiction enters: (1) An adjudication of guilt for the offense for which the offender has been sentenced as a first offender; (2) An order modifying the sentence originally imposed; or (3) An order correcting an exoneration of guilt and discharge entered pursuant to subsection (g) of Code Section

23 SB First Offender - Discharged as a Matter of Law O.C.G.A (e) A defendant sentenced pursuant to this article shall be exonerated of guilt and shall stand discharged as a matter of law as soon as the defendant: (1) Completes the terms of his or her probation, which shall include the expiration of the sentence by virtue of the time frame of the sentence passing, provided that such sentence has not otherwise been tolled or suspended; (2) Is released by the court under Code Section , , or prior to the termination of the period of his or her probation; or (3) Is released from confinement and parole, provided that the defendant is not serving a split sentence.

24 Coming Soon Coming Soon Coming Soon Using the disposition date and the amount of time entered to calculate, CCH will automatically seal the FOA upon the completion of: Confinement Probation Parole The court may choose to enter FOA Completed (372) at any time to override the calculation and seal the record.

25 Coming Soon Coming Soon Coming Soon Tolling Orders GCIC will create a Tolled and Un-tolled disposition for entry by the clerk When a Tolled disposition is added to a record with a FOA (318) disposition, calculations to seal as a matter of law upon the passage of time will stop and the record will not seal Adding an Un-tolled disposition will restart the calculations, adding the Tolled time to the longest period of confinement/probation/parole time. When that time passes the FOA record will seal and a notification will be sent to the court "The First Offender Record, OTN XXX has been sealed pursuant to O.C.G.A (e)" Entry of FOA Completed (372) at any time will override calculations and seal the record

26 Duties of DCS, DOC & Other Probation Agencies (f) Shall notify the clerk of court within 30 days the defendant has: Completed active probation supervision Completed the term of probation or is being released by the court prior to the termination of the period of probation Completed the term of parole and not serving a split sentence Has been released from confinement

27 Duty of clerk to transmit information When an individual is placed on probation or in confinement under this article, within 30 days of the filing of such sentence, the clerk of court shall transmit a record of the first offender sentence to the Georgia Crime Information Center. The clerk shall also transmit any subsequent order or notification regarding a first offender's sentence, including, but not limited to, notification that the defendant completed active probation supervision, was released early from probation supervision, or completed the term of probation, notification that the defendant completed the term of prison or parole, an order revoking a first offender sentence, an order of exoneration of guilt and discharge, and tolling orders, to the Georgia Crime Information Center within 30 days of receiving such order for filing or notification.

29 SB 367 Accountability Courts Accountability Courts (4)(B) PRIOR TO THE ENTRY OF THE JUDGMENT, IN CONTEMPLATION THAT THE DEFENDANT'S CASE WILL BE DISMISSED OR NOLLE PROSSED, THE COURT MAY, IN ITS DISCRETION, RESTRICT THE DISSEMINATION OF THE DEFENDANT'S CRIMINAL HISTORY RECORD INFORMATION THE COURT SHALL SPECIFY THE DATE SUCH RESTRICTION SHALL TAKE EFFECT THE COURT MAY REVOKE SUCH ORDER AT ANY TIME.

30 SB 367 Accountability Courts & Restricted Records (4)(C) (1) CRIMINAL HISTORY RECORD INFORMATION RESTRICTED PURSUANT TO THIS CODE SECTION SHALL ALWAYS BE AVAILABLE FOR INSPECTION, COPYING, AND USE: (A) TO CRIMINAL JUSTICE AGENCIES FOR LAW ENFORCEMENT OR CRIMINAL INVESTIGATIVE PURPOSES OR FOR PURPOSES OF CRIMINAL JUSTICE AGENCY EMPLOYMENT; (B) TO JUDICIAL OFFICIALS; (C) BY THE JUDICIAL QUALIFICATIONS COMMISSION; (D) BY A PROSECUTING ATTORNEY OR PUBLIC DEFENDER WHO SUBMITS A SWORN AFFIDAVIT TO THE CLERK OF COURT THAT ATTESTS THAT SUCH INFORMATION IS RELEVANT TO A CRIMINAL PROCEEDING; (E) PURSUANT TO A COURT ORDER; AND (F) BY AN INDIVIDUAL WHO IS THE SUBJECT OF RESTRICTED CRIMINAL HISTORY RECORD INFORMATION UPON COURT ORDER.

Courts and Prosecutors will receive a pop-up warning when a restriction disposition is entered on a prohibited disposition (guilty). "Per OCGA this disposition does not qualify for restriction, do you wish to continue and restrict the charge? If the agency selects OK the restriction disposition will be applied.

33 Coming Soon Coming Soon Coming Soon Felony Sentenced as a Misdemeanor Occasionally a person is charged with a felony but sentenced as a misdemeanor. The charge is not amended. The law gives the judge the discretion to sentence as a misdemeanor. GCIC will create a disposition code with a literal of Guilty Sentenced as a Misdemeanor CCH will be programmed to override the severity flag for dissemination and IFFS calculations
