Decker, Ill, a Judge of the above captioned court, personally appeared before me Senior Inspector Justin Bates, who being first duly sworn, deposes and says: Beginning November 13, 2017, the above-named individual, a Corrections Officer with the Florida Department of Corrections became the subject of an investigation concerning the unlawful introduction of contraband and sexual misconduct. Such information was derived from inmate and fellow officer sources. On November 13, 2017, several inmates housed at Hamilton Correctional Ins ~ Threat Group {STG) Sergeant Rodney Milam that Inmate was in a relationship with Correctional Officer Tarra Avery. Those inmates saying Avery was currently pregnant and- was the father. Milam then conducted a search of- property and discovered several hand-written letters and envelopes with a return address suspected to be Officer Avery's home address. Based on the content of the letters, it was obvious the author was Avery because the content spoke about the pregnancy and other things that were indicative of the person being emp correctional facility. Milam also found Avery's personal cellular phone number written in address book. The address on these letters was later proven to be Avery's On November 28, 2017 during a sworn recorded interview, admitted to being in a relationship with Avery. - ould not comment on whether he was the father of Avery's child but admitted their relati~ was far more than the expected Officer/Inmate relationship. confirmed the name "T- in the address book was Officer Avery and the number listed was hers. On November 28, 2017, I reviewed several recorded. one calls to - sister while. was housed at RMC in transit to Taylor Cl. In. calls, ells his sister the defendants name, Tarra Avery as the person he is talking to. nd Avery have several conversations about the pregnancy and him being the father of the child. In one of the calls,. instructs his sister to send Avery $ to assist with expenses of the pregnancy and birth. During a call on 1

2 November 10, 20~1aces a call to his sister and she is obviously distraught based on the tone of her voice...-sister eludes that prison authorities are aware of the relationship and for..,ot to contact her any longer either through calls or letters. This act of intercourse has since caused Avery to be pregnant with the child of Inmate Contrary to Florida State Statute (b)2 or Sexual Misconduct. on or about August 1, 2017, Correctional Officer Tarra Avery and Inmate began corresponding by sending and receiving hand written letters s housed at Hamilton Correctional Institution, Reception and Medical Center and Correctional Institution. Avery send and received these letters without any prior 3

4 authorization from the Correctional Officer Chief at neither of the facilities; Contrary to Florida State Statute (a)1 or Introduction of Contraband. AND HAVING DETERMINED PROBABLE CAUSE TO EXIST FOR SAID CHARGES, THESE ARE THEREFORE TO COMMAND YOU TO FORTHWITH ARREST AND BRING THE ABOVE NAMED DEFENDANT BEFORE ME TO BE DEALT WITH ACCORDING TO LAW.
