The investigation performed as part of the application process revealed that: The application conforms to the written application requirements for police permits outlined in Los Angeles Municipal Code section "The Police Permit Review Panel may issue this permit pursuant to Los Angeles Municipal Code section , which regulates the Cafe Entertainment/Show permit. No criminal history for the Applicant that should prohibit granting of the permit existed in the California Department of Justice records at the time of investigation. No adverse Police Commission permit or disciplinary history was found. The Department of Building and Safety has deemed that the business is a permitted use at the location. A copy of the first page of this grant and all Conditions and/or any subsequent appeal of this grant and its resultant Conditions and/or letters of clarification shall be printed on the building plans submitted to the Development Services Center and the Department of Building and Safety for purposes of having a building permit issued. 6. Indemnification. The applicant shall defend, indemnify and hold harmless the City, its agents, officers, or employees from any claim, action or proceedings against the City or its agents, officers, or employees relating to or to attack, set aside, void or annul this approval which action is brought within the applicable limitation period. The City shall promptly notify the applicant of any claim, action, or proceeding and the City shall cooperate fully in the defense. If the City fails to promptly notify the applicant of any claim action or proceeding, or if the City fails to cooperate fully in the defense, the applicant shall not thereafter be responsible to defend, indemnify, or hold harmless the City. The restaurant shall be subject to the following [imitations: a. The restaurant shall not exceed 5,125 interior square feet and the exterior patio shall not exceed 1,500 square feet. b. Seating shall be limited to a total of 150 seats including the interior restaurant, the covered patio and the karaoke rooms. c. Hours of operation shall be limited from 11 a.m. to 2 a.m. daily. d. Prior to utilization of the grant, the applicant shall obtain a Certificate of Occupancy for the existing restaurant consistent with approved Exhibit A. 8. A maximum of twelve (12) karaoke rooms shall be maintained on the premises in conformance to approved Exhibit A and subject to the following: a. Visibility into each room shall have doors with windows with clear glass and/or windows to said rooms which shall also be constructed of clear glass. At no time shall these door windows nor windows be obscured so as to prevent a clear view of the occupants of the room. b. No physical obstructions including but not limited to planters, partitions, or items of decor shall be placed or attached to an section of the door, walls or ceiling which would obstruct the view into any portion of the interior of the room or which would cover any portion of the glass within the door or any wall. No frosting, tinting, etc. of the glass shall be permitted. c. Doors to said rooms will remain unlocked and shall not have any form of a locking mechanism attached to or near the door. d. The lighting in the karaoke rooms shall have no "dimmer" type lighting controls in the interior of said rooms. Lighting shall be sufficient to make easily discernible the appearance and activities of all persons in the booth/rooms at all times. e. The karaoke rooms shall not contain refrigeration units of any type.

7 CASE NO. ZA (CUB) PAGE 3 f. The karaoke rooms shall be equipped with audio and video equipment sufficient for performances commonly associated with karaoke style entertainment. g. Each karaoke room shall be equipped with its own equipment which shall be retained permanently in each room and not shared or moved to other karaoke rooms. h. Karaoke style entertainment shall be available at all times in said rooms during the hours of operation. i. All food and beverages shall be served to patrons in karaoke rooms by a waiter/waitress. No employees/agents of the business shall be allowed to stay or remain in the karaoke rooms. Once employees deliver food or drinks, all employees shall leave the karaoke rooms. 9. The authorization granted herein for the on-site sale and dispensing of a full line of alcoholic beverages is for a period of five (5) years from the effective date of this grant. Thereafter, a new authorization to allow the on-site sale and dispensing of beer and wine will be required. The applicant is advised that he/she should allow appropriate time for a new entitlement application to be processed and the application should be approved prior to the expiration date of this grant in order to continue the sale of beer and wine at the restaurant. 10. If at any time during the period of the grant, should documented evidence be submitted showing continued violation(s) of any condition(s) of the grant, resulting in a disruption or interference with the peaceful enjoyment of the adjoining and neighboring properties, the Zoning Administrator will have the right to require the petitioner(s) to file for a plan approval application together with the associated fees, to hold a public hearing to review the petitioner's compliance with and the effectiveness of the conditions of the grant. The petitioner(s) shall submit a summary and supporting documentation of how compliance with each condition of the grant has been attained. 11. The premises shall be maintained as a bona fide eating place (restaurant) with an operational kitchen and shall provide a menu containing an assortment of foods normally offered in such restaurants. Food services shall be available at all times during normal business hours. 12. The business establishment shall have an on-duty manager name and photo posted daily at the front entrance, clearly identifying whom is responsible for the daily operation of the facility. 13. A minimum one State-licensed security guard shall be maintained on the premises Thursday through Saturday from 9 p.m. to one half hour after closing. The guard shall at all times patrol the interior and exterior of the facility. The guard shall monitor the interior of the facility for illegal activities and shall deter loitering, public drinking, pandering, graffiti, noisy or rowdy behavior and littering in the parking lot. The guard shall be exclusively employed for the subject

8 CASE NO. ZA (CUB) PAGE 4 business and should not conduct any security duties for surrounding and neighboring businesses. 14. The applicant may not employ, solicit, nor allow to operate on premise any employee or agent to be permitted to accept money or anything of value from a customer for the purpose of sitting or otherwise spending time with customers while in the premises, nor shall the licensee provide, permit or make available, either gratuitously or for compensation, male or female patrons who act as escorts, companions or guests of and for the customers. 15. Parking shall be provided in compliance with the Municipal Code and to the satisfaction of the Department of Building and Safety. No variance from the parking requirements has been requested or granted herein. 16. Except for the twelve (12) karaoke rooms permitted herein, there shall be no other entertainment such as a piano bar, jukebox, dancing, live entertainment, movies, etc. There shall be no disc jockey, male or female performers, or fashion shows. 17. The applicant shall obtain a current Café Entertainment Show (CES) permit from the City of Los Angeles Police Commission or appropriate agency. 18. No music, sound or noise shall be emitted from the subject businesses at a level prohibited by the noise regulations of the Los Angeles Municipal Code. Amplified recorded-music shall not be audible beyond the area under control of the applicant, and any sound or noise emitted that is under the control of the petitioner that exceeds the decibel levels permitted by the city's noise orginance shall constitute a violation of Section of the LAMC, including any loud, unnecessary or unusual noise that disturbs the peace or quiet of any neighborhood or that causes discomfort. The establishment shall make an effort to control any unnecessary noise made by restaurant staff or any employees contracted by the restaurant, or any noise associated with the operation of the establishment, or equipment of the restaurant. 19. There shall be no coin-operated game machines or video machines permitted on the premises at any time. 20. The conditions of this grant, a police permit, a copy of a business license, insurance information and an emergency contact phone number for the operator and valet service(s), if any, shall be retained on the premises at all times and be immediately produced upon request of the Los Angeles Police Department, the Department of City Planning, State Department of Alcoholic Beverage Control or other responsible agencies. The manager and all employees shall be knowledgeable of these Conditions. 21. Within six months of the effective date of this action, all employees involved with the sale of alcoholic beverages shall enroll in the Los Angeles Police Department "Standardized Training for Alcohol Retailers" (STAR). Upon completion of such training, the applicant shall request the Police Department to issue a letter

9 CASE NO. ZA (CUB) PAGE 5 identifying which employees completed the training. The applicant shall transmit a copy of the letter from the Police Department to the Zoning Administrator who acted on this case as evidence of compliance. In the event there is a change in the licensee, within one year of such change, this training program shall be required for all new staff. All employees who serve alcoholic beverages shall attend follow-up STAR classes every 24 months. The STAR training shall be conducted for all new hires within 2 months of their employment. 22. The applicant shall not permit any loitering on the premises or on property adjacent to the premises. 23. The applicant shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, including the sidewalk in front of the restaurant. 24. An electronic age verification device shall be retained on the premises available for use during operational hours. This device shall be maintained in operational condition and all employees shall be instructed in its use. 25. The applicant/restaurant operator shall identify a contact person and provide a 24-hour "hot line" telephone number for any inquiries or complaints from the community regarding the subject facility. Prior to the utilization of this grant, the phone number shall be posted on the site so that is readily visible to any interested party. The hot line shall be: posted at the entry, and the cashier or customer service desk, provided to the immediate neighbors, schools and the Neighborhood Council, and responded to within 24-hours of any complaints/inquiries received on this hot line. 26. The applicant shall document and maintain a log of complaints received, the date and time received and the disposition of the response. The log shall be made available for review by the Los Angeles Police Department and the Zoning Administrator upon request. 27. The applicant shall comply with (b) of the Labor Code, which prohibits smoking within any place of employment. The applicant shall not possess ashtrays or other receptacles used for the purpose of collecting trash or cigarettes/cigar butts within the interior of the subject establishment. 28. Only the front door shall be used for patron access. All other doors shall be equipped on the inside with an automatic locking device and shall be kept closed at all times other than to permit temporary access for delivery of supplies and trash removal. These doors shall be solid.

ZA (CUB) PAGE Trash/recycling pick-up and emptying or disposing of trash/recycling into outside containers is permitted to occur only between the hours of 7:00 a.m. and 8:00 p.m., Monday through Friday, and 10 a.m. to 4 p.m., Saturdays and Sundays. a. Trash/recycling containers shall be locked when not in use. b. Trash/recycling containers shall not be placed in or block access to required parking. 30. Petitioner(s) shall install and maintain security cameras and a two-week DVR that covers all common areas of the business, high-risk areas, entrances and exits. The DVRs shall be made available to the Los Angeles Police Department upon request. 31. No pay phone may be maintained on the exterior of the premises. 32. Within 30 days of the effective date of the Department of Alcoholic Beverage Control license, and within 30 days of the effective date of any modification or alteration of terms of said license, the applicant shall transmit a copy of the valid Department of Alcoholic Beverage Control license to the Zoning Administrator for attachment to the case file. 33. Within 30 days of the effective date of this grant, a covenant acknowledging and agreeing to comply with all the terms and conditions established herein shall be recorded in the County Recorder's Office. The agreement (standard master covenant and agreement form CP-6770) shall run with the land and shall be binding on any subsequent owners, heirs or assigns. The agreement with the conditions attached must be submitted to the Zoning Administrator for approval before being recorded. After recordation, a certified copy bearing the Recorder's number and date shall be provided to the Zoning Administrator for attachment to the subject case file. OBSERVANCE OF CONDITIONS - TIME LIMIT - LAPSE OF PRIVILEGES All terms and conditions of the approval shall be fulfilled before the use may be established. The instant authorization is further conditional upon the privileges being utilized within three years after the effective date of approval and, if such privileges are not utilized or substantial physical construction work is not begun within said time and carried on diligently to completion, the authorization shall terminate and become void. TRANSFERABILITY This authorization runs with the land. In the event the property is to be sold, leased, rented or occupied by any person or corporation other than yourself, it is incumbent upon you to advise them regarding the conditions of this grant.

ZA kk;UB) PAGE 7 VIOLATIONS OF THESE CONDITIONS, A MISDEMEANOR Section of the Los Angeles Municipal Code provides: "A variance, conditional use, adjustment, public benefit or other quasi-judicial approval, or any conditional approval granted by the Director, pursuant to the authority of this chapter shall become effective upon utilization of any portion of the privilege, and the owner and applicant shall immediately comply with its Conditions. The violation of any valid Condition imposed by the Director, Zoning Administrator, Area Planning Commission, City Planning Commission or City Council in connection with the granting of any action taken pursuant to the authority of this chapter, shall constitute a violation of this chapter and shall be subject to the same penalties as any other violation of this Code." Every violation of this determination is punishable as a misdemeanor and shall be punishable by a fine of not more than $2,500 or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment. APPEAL PERIOD - EFFECTIVE DATE The applicant's attention is called to the fact that this grant is not a permit or license and that any permits and licenses required by law must be obtained from the proper public agency. Furthermore, if any Condition of this grant is violated or if the same be not complied with, then the applicant or his successor in interest may be prosecuted for violating these Conditions the same as for any violation of the requirements contained in the Municipal Code. The Zoning Administrator's determination in this matter will become effective after July 31, 2015, unless an appeal therefrom is filed with the City Planning Department. It is strongly advised that appeals be filed early during the appeal period and in person so that imperfections/incompleteness may be corrected before the appeal period expires. Any appeal must be filed on the prescribed forms, accompanied by the required fee, a copy of the Zoning Administrator's action, and received and receipted at a public office of the Department of City Planning on or before the above date or the appeal will not be accepted. This would include clarification, verification of condition compliance and plans or building permit applications, etc., and shall be accomplished BY APPOINTMENT ONLY,in order to assure that you receive service with a minimum amount of waiting. You should advise any consultant representing you of this requirement as well. FINDINGS OF FACT After thorough consideration of the statements contained in the application, the plans submitted therewith, the report of the Zoning Analyst thereon, the statements made at the public hearing on May 20, 2015, all of which are by reference made a part hereof, as well as knowledge of the property and surrounding district, I find that the requirements for authorizing a conditional use permit under the provisions of Section W,1 have been established by the following facts: BACKGROUND The site is a rectangular-shaped, corner parcel of land composed of a single lot, with frontages of approximately 135 feet along Wilshire Boulevard and 60 feet along Manhattan Place. The Wilshire Community Plan designates the property for Regional Center Commercial land uses with the corresponding CR, C1.5, C2, C4, P, PB, RAS3, RAS4, R3, R4, and R5 Zones. The site is zoned C4-2 and is not located within any specific plan area. The site consists of a 15-foot Building Line along Manhattan Place established by Ordinance No. 46,548, and a 5-foot Building Line along Wilshire Boulevard established under Ordinance No. 59,577. The subject property is currently developed with a two-story restaurant building and surface parking lot. Under ZA CUB-CU, the existing restaurant was permitted for on-site sales of a full line of alcohol within a 5,430 square-foot restaurant with nine karaoke rooms, seating for 138 patrons, and hours of operation from 11:00 a.m. to 2 a.m., daily. The floor plan (Exhibit "A") approved in conjunction with the previous conditional use permit indicates operations to be limited to two floors, including a 720 square-foot outdoor patio dining area with 32 seats. The project site currently provides 16 on-site parking spaces within its surface parking lot with no proposed use of valet parking service. There are no additional parking spaces being provided in conjunction with the proposed project. The applicant is seeking approval of a Conditional Use to allow the safe and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with an existing restaurant with 12 karaoke rooms on the second floor with hours of operation from 11 a.m. to 2 a.m., daily. The adjacent properties to the north are zoned C4-2 and R5-2, and developed with a two-story church building and mid-rise multi-family residential buildings. The adjacent properties to the west are zoned C4-2 and R5P-2 and developed with a high-rise

13 CASE NO. ZA (CUB) PAGE 9 commercial building and a surface parking lot. The adjacent properties to the south, across Wilshire Boulevard, are zoned C4-2 and developed with two- and three-story retail and office uses. The adjacent properties to the east are zoned C4-2 and developed with a single-story strip mall and a three-story parking structure. Previous Cases on the Subject Property: Case No. ZA (CUB)(CU) On February 8, 2011, the Zoning Administrator approved a Conditional Use permit to allow on-site sales of a full line of alcohol within a 5,430 square-foot restaurant with hours of alcohol sales from 11:00 a.m. to 2:00 a.m., with nine karaoke rooms for live entertainment. Case No. ZA (CUB) On June 4, 2008, the Zoning Administrator denied a request for the continued use and sale of alcoholic beverages for on-site consumption in conjunction with a square-foot restaurant. Case No. ZA (CUB)-I A - At the meeting on March 14, 2006, the Central Area Planning Commission denied an appeal submitted by Jun Suk Lee, sustained the Zoning Administrator's approval for the sale and dispensing of a full line of alcoholic beverages for on-site consumption, in conjunction with the proposed addition of eight karaoke rooms to the mezzanine level of an existing 5,430 square-foot restaurant. Case No. ZA (CUB) - On December 2, 2005, the Zoning Administrator approved a Conditional Use Permit for the sale and dispensing of a full line of alcoholic beverages for on-site consumption, in conjunction with a proposed 2,760 square-foot addition including eight karaoke rooms located on the mezzanine level of an existing restaurant (ZIP), seating 169 patrons, having hours of operation from 11 a.m. to 2 am., Monday through Sunday. Case No. ZA (CUB)(ZV) - On December 14, 2004, the Zoning Administrator approved a conditional use to extend hours of operation to 2:00 a.m. daily for a restaurant seating 223 patrons, clarified condition 15-1, a review of conditions as required by Condition 7; and permitted additional parking by lease agreement. Case No. ZA (CUB)(ZV)- On November 5, 2002, the Zoning Administrator approved a Conditional Use Permit authorizing the sale and dispensing of a full line of alcoholic beverages for on-site consumption, in conjunction with the operation, maintenance and use of a proposed 1,961 square-foot restaurant in a 4,680 square-foot retail center; and approved a variance from Section A,4(c) of the Code to permit 16 off-street parking spaces in lieu of the 28 off-street parking spaces required by Code. Previous Cases on Surrounding Properties: Case No. ZA (CUB) - On December 8, 2010, the Zoning Administrator approved a conditional use permit to allow the continued sale and dispensing of beer and wine only for on-site consumption, in conjunction with an existing restaurant [Soju Town], in the C4-2 Zone at 3869 West Wilshire Boulevard.

ZA (CUB) PAGE 10 Case No. ZA (CUB) - On December 8, 2010, the Zoning Administrator approved a conditional use permit to allow the sale and dispensing of beer and wine only for on-site consumption, in conjunction with an existing restaurant [Wang Dae Po], in the C4-2 Zone at 3871 West Wilshire Boulevard. Case No. ZA (CUB)- On May 11, 2011, the Zoning Administrator approved a conditional use permit to allow the sale and dispensing of beer and wine only for on-site consumption, in conjunction with a proposed restaurant within a multi-story mixed use development in the C4-2, C2-2 Zone at 3785 West Wilshire Boulevard, #218. Case No. ZA (CUB)- On June 28, 2012, the Zoning Administrator dismissed a conditional use to permit operating hours after 11 p.m. inasmuch as the property which was defined as a Commercial Corner Development is not subject to the requirements as the property is in Height District 2 which exempts it from said requirements: and, approved a conditional use permit to allow the continued sale of a full line of alcoholic beverages for on-site consumption and the incidental sale of wine for off-site consumption in conjunction with an existing restaurant in the C4-2, R1-1, C2-1 Zones at 3760 Wilshire Boulevard. Case No. ZA (CUB)(ZV) - On April 25, 2013, the Zoning Administrator approved a conditional use to permit the continued sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with an existing restaurant on the first floor and banquet halls on the first and second floors of an existing hotel currently known as Garden Suite in the C2-1 and R4-2 Zones at 681 South Western Avenue. Case No. ZA (CUB)- On March 16, 2012, the Zoning Administrator approved a conditional use permit to allow the sale and dispensing of beer, wine and soju only for on-site consumption in conjunction with an existing restaurant having 10 seats at a bar. 12 seats on the enclosed patio, and 30 seats in the existing dining area, all having hours of operation from 11 a.m. to 2 a.m., daily in the C4-2 Zone at 3839 Wilshire Boulevard. Case No. ZA (CUB) - On August 28, 2012, the Zoning Administrator approved a conditional use permit to allow the sale and dispensing of a full line of alcoholic beverages for on-site consumption, in conjunction with an 8,181 square-foot restaurant in the [T][Q]C2-2 and C2-2 Zones at 621 South Western Avenue, Unit 100. Case No. ZA ICUB) - On September 14, 2012, the Zoning Administrator approved a conditional use to permit the sale and dispensing of beer and wine only for on-site consumption in conjunction with a proposed restaurant; and, a conditional use to permit a deviation from the Mini-Shopping Center/Commercial Corner Development provisions for hours of operation from 11 a.m. to 12 midnight in the C4-2 and C2-2 Zones at 3785 Wilshire Boulevard, #24 and #25. Case No. ZA (CUB)- On May 10, 2013, the Zoning Administrator approved a conditional use permit to allow the continued sale of a full line of alcoholic beverages for on-site consumption in conjunction with an existing restaurant and its expansion in the C4-2 and R4-2 Zones at 3832 Wilshire Boulevard, #202.

15 CASE NO. ZA (CUB) PAGE 11 Case No. ZA (CUB) - On September 19, 2012, the Zoning Administrator approved a conditional use to permit the sale and dispensing of beer and wine only for on-site consumption in conjunction with a new restaurant in the C2-2 and [T][Q]C2-2 Zones at South Western Avenue. Case No. ZA (CUB)(CU) - On December 20, 2012, the Zoning Administrator approved a conditional use to permit the sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with a renovated 2,755 square-foot restaurant with three karaoke rooms for live entertainment; and, a conditional use to permit a deviation from the Mini-Shopping Center/Commercial Corner Development provisions for hours of operation from 11 a.m. to 2 a.m., daily, in the C4-2 and R5P-2 Zones at West Wilshire Boulevard. Case No. ZA (CUB)(CU) - On April 15, 2013, the Zoning Administrator approved a conditional use permit authorizing renewal of Case No. ZA (CUB) including an upgrade from the sale and dispensing of beer and wine only to a full line of alcoholic beverages for on-site consumption in conjunction with an existing restaurant in the C2-2 Zone at 3807 West Wilshire Boulevard. Case No, ZA (CUB)- On June 27, 2013, the Zoning Administrator approved a conditional use to permit the continued sale and dispensing of beer and wine only for on-site consumption in conjunction with an existing restaurant in the C4-2 Zone at 3839 Wilshire Boulevard, #A and #B. Case No. ZA (CUB)- On April 25, 2014, the Zoning Administrator approved a conditional use to permit the sale and dispensing of beer and wine only for on-site consumption in conjunction with an existing restaurant in the C2-2 and [T][Q]C2-2 Zones at 621 South Western Avenue, #301. Case No. ZA (CUB)- On August : the Zoning Administrator approved a conditional use to permit the sale and dispensing of beer and wine only for on-site consumption in conjunction with an existing restaurant in the C2-2 and [T][Q]C2-2 Zones at 621 South Western Avenue, #302. STREETS Wilshire Boulevard is a Modified Major Highway dedicated to a width of 100 feet and improved with asphalt roadway, concrete gutters, curbs, sidewalks, street trees, and landscaped median. Manhattan Place is a Local Street dedicated to a width of 75 feet and improved with asphalt roadway, concrete gutters, curbs, sidewalks, and a landscaped parkway with street trees on the easterly side only. Public Hearing The hearing was conducted on May 20, 2015 in downtown Los Angeles City Hall. The hearing was attended by the applicant, by the applicant's representative, by Sergeant Vincent of the LAPD, by Mr. Ted Oh of the Korean American Federation of Los Angeles and by a representative of Council District 10, Ms. Elizabeth Carlin.

16 CASE NO. ZA (CUB) PAGE 12 Mr. Woo submitted a revised set of plans at the hearing and noted that the proposal for a roof-top patio was not feasible and was deleted from the plans. He noted that the revised plans reduced the restaurant's floor area to a maximum of 5,125 interior square feet and a 1,500 square-foot patio on the ground floor. He noted that the restaurant would be maintained on the ground floor and that the second floor karaoke rooms were reconfigured to allow an expansion to 12 rooms. He stated that the total seating consisted of 150 seats including 48 seats in a covered outdoor patio and including 78 seats in all twelve of the karaoke rooms. Mr. Woo noted that the applicant has operated the restaurant since 2011 and in 2014 became aware that the premises was not properly permitted. The building had Fire Department issues and the restaurant was closed in June of The previous operator applied for a new C of 0 but the C of 0 was never finalized. The applicant has applied for a change of use for the second floor and is currently in plan check and is addressing all code issues. The proposed karaoke rooms are an accessory use to the restaurant and the business will be promoted as a restaurant. The site has a Conditional Use authorizing the on-site sale of alcoholic beverages that will expire in The restaurant has otherwise operated in a manner that has been compatible with surrounding uses. The karaoke use has operated since 2007 and has not been the subject of any problems. Sergeant Vincent noted that she had only met with Mr. Woo and not with the actual applicant. She noted that in June of 2014, there were Fire Code violations on the second floor which was essentially a fire trap. The outside patio was also not permitted. She noted that the applicant is seeking a Type 47 ABC License which would allow minors on the premises but noted that the applicant stated minors would not be allowed in the karaoke rooms. Sergeant Vincent expressed concern that it was important to ensure that employees monitored the karaoke rooms to prevent minors from entering. Although Sergeant Vincent expressed concerns about the site's code violations, she noted that the site was generally not too problematic when it was in business and did not object to the proposed 2 a.m. closing time. She requested that additional cameras be installed on the 2'1 floor to monitor activities and recommended a limited term grant of 3 to 5 years. Mr. Oh testified in opposition to the request. He noted that his wife operates a business down the street. He stated that a large community/town hall meeting was held last year with the LAPD which informed the public that there were 430 ABC licenses in the area including karaoke establishments. Mr. Oh noted that there is too much drinking after midnight in the community and that the area is oversaturated and they don't want any more. Ms. Carlin testified that her office is most concerned with the bad actors (i.e. bad operators) and with those establishments that operate after hours. She noted that the applicant in this case appears to be forthright and moving toward compliance by addressing code violations on the site. She did not object to the request subject to conditions to ensure the use does not become a problem.

17 CASE NO. ZA (CUB) PAGE 13 Correspondence Received Prior to the hearing no correspondence was received from the public or other public agencies. Subsequent to the public hearing, a letter dated June 4, 2015 was received on June 17, 2015 from the Los Angeles Police Department. The letter recommended 29 conditions of approval in the event the Zoning Administrator approved the grant. CONDITIONS IDENTIFIED FOR CONSIDERATION BY THE STATE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL RELATIVE TO THE SALE AND DISTRIBUTION OF ALCOHOLIC BEVERAGES In approving the instant grant, the Zoning Administrator has not imposed Conditions specific to the sale or distribution of alcoholic beverages. even if such Conditions have been volunteered or negotiated by the applicant, in that the Office of Zoning Administration has no direct authority to regulate or enforce Conditions assigned to alcohol sales or distribution. The Zoning Administrator has identified a set of Conditions related to alcohol sales and distribution for further consideration by the State of California Department of Alcoholic Beverage Control (ABC). In identifying these conditions, the Office of Zoning Administration acknowledges the ABC as the responsible agency for establishing and enforcing Conditions specific to alcohol sales and distribution. The Conditions identified below are based on testimony and/or other evidence established in the administrative record, and provide the ABC an opportunity to address the specific conduct of alcohol sales and distribution in association with the Conditional Use granted herein by the Zoning Administrator. No "Happy Hour" type of reduced-price alcoholic beverage or "2 for 1" promotion shall be allowed at any time. Discounted food promotions are encouraged. No cocktail lounge shall be maintained on the premises separate from the dining area. No alcohol shall be allowed to be consumed on any adjacent property under the control of the applicant. There shall be no exterior advertising of any kind or type, including advertising directly to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition. The sale of alcohol shall be incidental to the sale of food. The sale of alcoholic beverages for consumption off the premises is prohibited. The quarterly gross sales of alcohol shall not exceed the quarterly gross sales of food. The business operator shall maintain records which reflect these numbers and make them available to the Police Department upon request. The off-site sale of alcoholic beverages as a secondary use (i.e., "take out") is not permitted. All service of alcoholic beverages shall be conducted by a waitress or waiter or bartender.

18 CASE NO. ZA (CUB) PAGE 14 No bottle service shall be permitted. Alcohol may only be served to patrons who are seated at a table and only in conjunction with a food order. Patrons shall not be served while standing or while waiting to be seated. All personnel selling, dispensing and serving the alcoholic beverages must be 21 years old or older. BASIS FOR CONDITIONAL USE PERMITS A particular type of development is subject to the conditional use process because it has been determined that such use of property should not be permitted by right in a particular zone. All uses requiring a conditional use permit from the Zoning Administrator are located within Section W of the Los Angeles Municipal Code. In order for the sale of beer and wine for on-site consumption to be authorized, certain designated findings have to be made. In these cases, there are additional findings in lieu of the standard findings for most other conditional use categories. FINDINGS Following (highlighted) is a delineation of the findings and the application of the relevant facts to same: 1. The project will enhance the built environment in the surrounding neighborhood or will perform a function or provide a service that is essential or beneficial to the community, city or region. The applicant is requesting a Conditional Use to permit the continued sale and dispensing of beer and wine for on-site consumption in conjunction with an existing restaurant. The sale of beer and wine for on-site consumption was previously approved under Case No. ZA CUB-CU for a 5,430 squarefoot restaurant with seating for 138 patrons, nine karaoke rooms for live entertainment incidental to the subject restaurant, and hours of operation from 11 a.m. to 2 a.m., daily. The applicant seeks to continue the on-site sale of a full line of alcoholic beverages in conjunction with the existing restaurant and karaoke rooms. The applicant proposes to reconfigure the 9 existing karaoke rooms on the second floor to 12 karaoke rooms and to legalize an existing covered patio on the ground floor. The total floor area will remain the same but seating will be increased from 138 seats to 150 seats. The hours of operation will remain unchanged from 11 a.m. to 2 a.m., daily. The subject restaurant use has operated on the site since its construction in 2002 and has no problem history and has not been the subject of calls for service or any ABC violations. While the restaurant's operators and size of the development have undergone some changes over the years, the use continues to serve the surrounding community as a viable restaurant and entertainment facility. The site fronts on Wilshire Boulevard, a designated Major Highway (Modified), and is located less than 500 feet of the Metro Purple Line WilshireNVestem subway station, making it conveniently accessible via multiple modes of travel for those who live, work or shop in the area. Wilshire Boulevard

19 CASE NO. ZA (CUB) PAGE 15 is a major commercial corridor and the restaurant's outdoor dining area will contribute positively toward activating the street along this segment of Wilshire Boulevard. 2. The project's location, size, height, operations and other significant features will be compatible with and will not adversely affect or further degrade adjacent properties, the surrounding neighborhood, or the public health, welfare and safety. The subject property is a single, generally level, rectangular lot located at the northwest corner of Wilshire Boulevard and Manhattan Place. The site is approximately 11,210 square feet with frontages of 135 feet along Wilshire Boulevard and 60 feet along Manhattan Place. Access to the site is from Manhattan Place. The site is zoned C4-2 and improved with an existing, twostory building and surface parking lot. A total of 16 off-street parking spaces will continue to be provided within the on-site surface parking lot. Valet parking service is not proposed as part of the project. The adjacent properties to the north are zoned C4-2 and R5-2, and developed with a two-story church building and mid-rise multi-family residential buildings. The adjacent properties to the west are zoned C4-2 and R5P-2 and developed with a high-rise commercial building and a surface parking lot. The adjacent properties to the south, across Wilshire Boulevard, are zoned C4-2 and developed with two- and three-story retail and office uses. The adjacent properties to the east are zoned C4-2 and developed with a single-story strip mall and a three-story parking structure. The requested Conditional Use Permit is to allow the continued sale and dispensing of alcoholic beverages within an existing restaurant and karaoke rooms. The hours of operation will remain from 11 a.m. to 2 a.m., daily. The perimeter of the subject property is lined by a decorative wrought iron fence, and includes a sliding security gate that remains locked during non-operating hours. The subject restaurant use has operated on the site since its construction in 2002 and has no problem history and has not been the subject of calls for service or any ABC violations. The current operator inherited the premises with code violations. While the site was previously authorized for the on-site sale of alcoholic beverages in conjunction with the restaurant and karaoke rooms, the previous operator never received a final Certificate of Occupancy to convert the second floor to karaoke rooms or for the covered patio on the ground floor. The applicant is in the process of upgrading the restaurant and bringing the premises into compliance with all code regulations. Furthermore, the Los Angeles Police Department submitted a letter dated June 4, The letter did not object to the request but included numerous recommended conditions of approval to address noise, safety and security that have been incorporated into the grant. Thus, as conditioned, the project's location, size, height, operations and other significant features will be compatible

20 CASE NO. ZA (CUB) PAGE 16 with and will not adversely affect or further degrade adjacent properties, the surrounding neighborhood, or the public health, welfare, and safety. 3. The project substantially conforms with the purpose, intent and provisions of the General Plan, the applicable community plan, and any specific plan. There are eleven elements of the General Plan. Each of these Elements establishes policies that provide for the regulatory environment in managing the City and for addressing environmental concerns and problems. The majority of the policies derived from these Elements are in the form of Code Requirements of the Los Angeles Municipal Code. Except for those entitlements described herein, the project does not propose to deviate from any of the requirements of the Los Angeles Municipal Code. The Land Use Element of the City's General Plan is divided into 35 separate Community Plans, each representing a distinct geographic area within the City. The subject property is located within the Wilshire Community Plan area and is designated for Regional Center Commercial land uses with the corresponding CR, C1.5, C2, C4, P, PB, RAS3, RAS4, R3, R4, and R5 Zones. The Wilshire Community Plan describes the Wilshire Center Regional Commercial Center as including "a dense collection of high rise office buildings, large hotels, regional shopping complexes, churches, entertainment centers, and both high-rise and low-rise apartment buildings." The Wilshire Community Plan is otherwise silent in regards to the sale of alcohol and, therefore, the requisite findings for approving the instant request are established by Section of the L.A.M.C. and the requisite findings have been established herein. In following, the project substantially conforms with the purpose, intent and provisions of the General Plan, and the Wilshire Community Plan. The project is not subject to any specific plans. 4. The proposed use will not adversely affect the welfare of the pertinent community. The approval of the Conditional Use to permit the sale of a full-line of alcoholic beverages for on-site consumption in conjunction with the restaurant and karaoke use will not adversely affect the welfare of the community to the extent that the restaurant is an existing use and the sale of alcohol will be incidental to food service. Many properties within a 1,000-foot radius of the site, and within the Wilshire Center Regional Commercial Center and along Wilshire Boulevard, a designated Major Highway, are currently developed with commercial uses, including other similar food or restaurant establishments. The proposed use will be conducted in accordance with conditions of approval and security measures as identified herein. Hours of operation will remain unchanged from 11:00 a.m. to 2:00 a.m., daily. No evidence was submitted for the record indicating that the site has generated any nuisance or criminal activity or any operational issues of detriment to the surrounding neighborhood. Therefore, as conditioned, the proposed use will not adversely affect the welfare of the pertinent community.

21 CASE NO. ZA (CUB) PAGE The granting of the application will not result in an undue concentration of premises for the sale or dispensing for consideration of alcoholic beverages, including beer and wine, in the area of the City involved, giving consideration to applicable State laws and to the California Department of Alcoholic Beverage Control's guidelines for undue concentration; and also giving consideration to the number and proximity of these establishments within a one thousand foot radius of the site, the crime rate in the area (especially those crimes involving public drunkenness, the illegal sale or use of narcotics, drugs or alcohol, disturbing the peace and disorderly conduct), and whether revocation or nuisance proceedings have been initiated for any use in the area. According to the California State Department of Alcoholic Beverage Control licensing criteria, 2 on-site and 1 off-site licenses are allocated to the subject Census Tract No , which had a population of 3,016 as of August, There are currently 18 on-site and 2 off-site licenses active within this census tract. The subject property currently has a pending Type 47 (On Sale General Eating Place) transfer of license application in process with ABC. Statistics from the Los Angeles Police Department's Olympic Division Vice Unit reveal that in Crime Reporting District No. 2022, which has jurisdiction over the subject property, a total of 215 crimes were reported in 2014, compared to the citywide average of 163 crimes and the high crime reporting district average of 196 crimes for the same period. Part I Crimes reported by LAPD include Homicide (1), Rape (3), Robbery (10), Aggravated Assault (14), Burglary (25), Auto Theft (10), and Larceny (56). Part II Arrests include Other Assaults (2), Weapons Violations (4), Prostitution Related (4), Narcotics/Drugs (21), Public Drunkenness (8), DWI (12), and All Other Violations (25). Over concentration can be undue when the addition of a license will negatively impact a neighborhood. Over concentration is not undue when the approval of a license does not negatively impact an area, but rather such a license benefits the public welfare and convenience. The proposed project would continue an existing on-site ABC license within this census tract. Additionally, no site specific evidence was submitted by the LAPD or adjacent residents for the record indicating or suggesting any link between the subject site and the neighborhood's crime rate. The site has no history of nuisance activity and has not been the subject of any complaints. The mode and character of the existing restaurant remains food service and will continue to provide a dining and entertainment use within the Wilshire Center Regional Commercial Center, and is not anticipated to result in any activity that would contribute to the area's crime rate. The instant grant by the Zoning Administrator includes operational conditions that will ensure that the project does not generate any criminal or nuisance activity. The site's location is proper in relation to adjacent uses and the surrounding community to the extent that the site is designated for Regional Center Commercial uses, and existing land uses along Wilshire Boulevard are characterized by a wide variety of commercial retail and office, and residential uses serving the adjacent residential neighborhoods. Thus, as conditioned, it is
