The Town Council at its April 5, 2016 meeting directed staff to find ways to help visitors identify the location of the Jupiter Medical Center Campus. These code changes would allow Jupiter Medical Center to install an identification sign for public and semipublic facilities (P-2 sign) for directional purposes that would assist visitors in finding the hospitals. The proposed changes also are modifying the definition for directional signs (P-6) and clarifying the regulations on what uses are allowed an on and off-site directional signs. PLANNING AND ZONING COMMISSION RECOMMENDATION: At their November 8, 2016 meeting, the Planning and Zoning Commission recommended approval (by a 7-0 vote) of the proposed text amendment, as recommended by staff. Planning and Zoning Commission Recommendation. At the November 8, 2016 meeting, the Planning and Zoning Commission recommended approval of the proposed zoning text amendment (by a 7-0 vote). Staff Recommendation. The staff recommends approval of the proposed text amendments, as shown in Exhibit 1, with additional language indicated by underline and deleted language indicated by strikeout. Those sections of the regulations that are not underlined or stricken are not proposed to be modified.

The Town of Jupiter Town Council at its April 5, 2016 meeting directed staff to find ways to help visitors identify the location of the Jupiter Medical Center Campus (see Attachment A). Since that time, Staff has had regular meetings with Jupiter Medical Center to discuss and address a variety of on-premise and off-premise sign options. In addition, staff has met with the Town Attorney to address concerns with allowing specific off-premise signage to ensure the proposed changes do not create unintended issues with defending the Town s sign code. Finding the Jupiter Medical Center is a valid safety concern that should be addressed, particularly with new visitors or under emergency situations. The hospital is located at the northwest corner of Jupiter Lakes Boulevard and Old Dixie Highway. Both roads are classified as local roads 1. These local roads do not have significant pass by traffic. It is not until these roads intersect with Toney Penna Drive (Collector) and Military Trail (Minor Arterial) that traffic numbers increase and the potential for increased visibility occurs by pass by traffic. One method the hospital has utilized to help visitors locate the hospital is Blue H signs that are situated at various locations in the Town (for example at Military Trail and Jupiter Lakes Boulevard, Toney Penna and Old Dixie Highway, etc.) Although, these sign indicate the location to the hospital, at about four square feet, they can be easy overlooked (see Attachment B H signs). The existing signage can be problematic for visitors to the area who need to find the hospital quickly, especially in an emergency situation. Analysis. Existing sign code. The existing sign code allows the following types of signs for a hospital use (see Attachment C and D): Identification signs for public and semipublic institutions (P-2). These signs are used for such facilities as schools, churches, hospitals, libraries, clubs and public utilities and are only allowed on-premise, 10 from the property line. They are allowed at 32 square feet and 15 feet in height. Directional signs (P-6 signs). These signs typically are used on a property to help visitors locate items such as a drive-thru lane or an ATM machine. These signs are also currently allowed off-premise for public and quasi-public uses. Way-finding signs (P-16). These signs are on-premise directory signs indicating the businesses on a property. When used, wayfinding signs must be a minimum of 50 from a property line. These signs are not allowed off-premise. Proposed amendments. Staff is proposing changes to the P-2 (Identification for public and semipublic) and for P-6 (directional) signs for the following reasons: Identification signs for public and semipublic institutions (P-2). Directional (P-6) and way-finding signs (P-16) do not address the safety concerns raised related to locating the hospital in an emergency situation. After consultation with the Town Attorney, staff is recommending to amend the standards for P-2 signs to allow hospitals with emergency 1 Pursuant to the Traffic Element of the Town s Comprehensive Plan, Table 1, entitled Functional classification Existing Network

4 Sign Regulations Amendment ZTA Page 3 of 4 rooms to have an additional sign to serve as an off-premise directional sign. The sign code permits a 32 square foot sign copy area for P-2 signs, which will be of sufficient size to be visible when located in a right-of-way. However, staff has proposed to limit the sign height to a maximum of five (5.0 ) feet tall, instead of 15 tall, given that these signs will be permitted off-premise and within a right-of-way, close to passing traffic. Further, the Department of Engineering, Parks and Public Works recommended the signs be 15 feet back from the front curb for sight visibility purposes. Staff is also proposing to delete clubs from the uses allowed to have a P-2 sign since the type of signage permitted should depend on the type of club and the zoning district the club is located. Pursuant to Section 27-1, entitled Definitions, clubs include such uses as Moose lodge, Elks lodges, or historic societies. Clubs are allowed in a variety of zoning districts, including commercial, industrial and the Indiantown Road Overlay Zoning District. Clubs may also be located in residential districts, such as a golf or tennis club within a residential Planned Unit Development. Based on the existing code, a 15 freestanding sign would be permitted for a tennis club on residentially zoned property. Therefore, Staff s recommendation that clubs be deleted as a use that can request a P-2 sign. Therefore, clubs would need to adhere to the signage regulations of the zoning districts in which they are located. Directional signs (P-6 signs). Staff is recommending that Sec of the code, specifically the definition of directional signs be updated. The term non-advertising in nature should be deleted to address the recent Supreme Court decisions of Reed v. Town of Gilbert which emphasizes that municipalities should not restrict free speech by regulating the content of a sign. Stating a sign shall be commercial or non-commercial in nature could be construed that a municipality is regulating the message. The regulations should remain content neutral. Although the term non-advertising has been deleted, staff has added language in the definition and in Sec that indicates these signs must be necessary to help visitors find a specific facility or activity on the property that warrants a sign to safely guide traffic. Currently, the code allows off-premise directional signs to be used for public and quasipublic facilities. The Town Code does not specifically define quasi-public facilities. There are numerous uses allowed in the Quasi-public zoning district such as religious establishments, child care, assisted living facilities and schools. The Town has not received requests nor any permits been issued for off-premise directional signs in the recent past. Given the number of quasi-public uses in Town, staff is proposing quasipublic uses be removed as uses that are allowed off-premise signage. Finally, the regulations for P-6 signs allow for groups, such as civic and home owners associations to place signs off-premise announcing the time and place of their meeting. Staff has recommended that these types of signs only be allowed on-premise and that they must receive the approval of the property owner of the site on which the sign is placed. If the zoning text amendment is adopted, the Jupiter Medical Center proposes to use the new regulations to construct a sign at the intersection of Jupiter Lakes Boulevard and Military Trail (see Attachment E and F for an example sign). The sign would include the name of the center and the direction to the facilities main entrance. The Town Engineer has reviewed the proposed sign and noted it would be permitted at the proposed location if it is setback further to

5 Sign Regulations Amendment ZTA Page 4 of 4 meet the sight visibility requirements (setback 15 feet from the curb) and it is designed as a frangible (easily break apart) structure for safety purposes. Conclusion Staff finds the recommended zoning text amendments benefit the health, safety and general welfare of the public, and are consistent with the comprehensive plan. Therefore, staff recommends approval. 6 ATTACHMENT A TC Minutes Page 8 April 5, 2016 REPORTS TOWN ATTORNEY Attorney Client Session for Harbourside - Mr. Baird mentioned an Attorney Client Session was scheduled for April 13, 2016 during the CRA meeting. He added a second session may be necessary. Councilor Kuretski moved to proceed with the April 13, 2016 Attorney Client Session previously authorized and provided for a follow up Attorney Client Session, if necessary; seconded by Vice-Mayor Kaufer; motion passed. TOWN MANAGER Love Street Application - Mr. Lukasik indicated the Love Street agenda item would not be ready for the April 19, 2016 Town Council meeting. He suggested the Option Agreement be scheduled at the same time as the site plan application, possibly in May Jupiter Medical Center - Mr. Lukasik summarized the proposed concept to better identify the location of the Jupiter Medical Center Campus. The proposal included distinctive signage not currently allowed by Code. The majority of Council agreed to ask Staff to pursue the proposal (TW, JK, IK) TOWN COUNCIL LIAISON REPORTS AND COMMENTS VICE-MAYOR KAUFER Timeline for Agendas Vice-Mayor Kaufer asked Mr. Lukasik for an update. Mr. Lukasik indicated he was implementing standards to have the agenda items posted one week in advance of the meetings. Minutes Vice-Mayor Kaufer suggested, to improve efficiency, Council submit any revisions to the minutes directly to the Town Clerk. Mayor Wodraska recommended this be discussed during the Strategic Planning Workshop. Business Tax Receipts - Vice-Mayor Kaufer asked to receive an update from Mr. Lukasik regarding the current timelines and problem issues.

8 ATTACHMENT C Sec Permanent signs. Subject to the other provisions of this article, the following types of permanent signs are permitted throughout the Town: (1) P-1. All signs and signals owned or operated by governments or governmental agencies. (2) P-2. Identification signs for public and semipublic facilities, such as schools, churches, hospitals, libraries, clubs and public utilities. (3) P-3. Nameplates identifying the owner or resident of a private property, or identification of property through the use of addresses. (4) P-4. Memorial or historical markers or tablets. (5) P-5. Signs indicating the private nature of a road, driveway, or other premises, and signs controlling the use of private property, such as the prohibition of hunting or fishing. (6) P-6. Directional signs indicating the route or direction to a place, establishment or activity, as permitted by the Department of Community Development. All off-premises directional signs shall be limited to those which indicate the direction or route to a public or quasi-public facility or activity, or which indicate the location of civic organizations, and to signs, notices or symbols indicating the time and place of civic meetings. All on-premises directional signs shall be limited to signs directing and regulating pedestrian or vehicular traffic, such as entrance, exit, caution, slow, no trespassing, etc. All directional signs shall be nonadvertising in nature. (7) P-7. Commercial or office "point of purchase" wall signs, attached to the building, for individual establishments in districts other than residential. No wall signs shall be permitted for any business located above the first floor. Wall or building signs shall not be located above the bottom of the second floor window line. Tenant wall signs shall be attached to the exterior wall of the tenant space being advertised. However, this provision shall not prohibit installation on a building in excess of one story of a building identification sign located immediately below the roof line of the structure. (8) P-8. Free-standing identification or directory signs in districts other than residential, and in addition to those signs allowed as P-7. Freestanding directory signs shall be permitted in lieu of a freestanding identification sign; however, such signage shall be located perpendicular and setback 25 feet from an abutting right-of-way or rights-of-way providing direct vehicle access to the property. A P-8 sign shall be located on the same lot as the nonresidential property it is intended to identify. (9) P-9. Land development, multifamily development and subdivision identification sign shall mean a freestanding sign that identifies the name of a planned unit development, development of regional impact, or a commercial or residential subdivision and may include a limited number of general uses or activities the purpose of which is to give direction or to indicate the general use or activity on a site. In a commercial subdivision, the sign shall be incorporated into an entry wall, perimeter wall or fence and/or a pedestrian amenity. Directions and general uses located on the sign shall be a smaller type face than the name of the overall development. (10) P-10. Apartment identification signs either free standing or attached to the building. (11) P-11. Interior mall signs or "point of purchase" signs attached to store front facing a mall's interior concourse. (12) P-12. Freestanding changeable copy signage. (13) P-13. Freestanding changeable copy signage for movie theaters. (14) P-14. Facade-mounted changeable copy signage for movie theaters. Page 1

9 ATTACHMENT C (15) P-15. Menu board signs for the display of the type and price of food and beverage sold in connection with a restaurant's drive-thru service. The sign shall not be noticeably visible from the public right-of-way. Menu board signs associated with an outdoor seating area shall be regulated in regards to size and type by Article X, Division 13, of Chapter 27, entitled "Outdoor seating at restaurants/sidewalk cafes." (16) P-16. Way finding signs for the listing or indexing of the names of businesses or tenants within a commercial, industrial, public or quasi-public institutional development and may also contain the overall name of the PUD, DRI, or commercial or residential subdivision. The sign is meant to be informative and provide directional information within a site for pedestrian and vehicular traffic and is not meant to be viewed from the adjacent streets or rights-of-way. Way finding signs shall not include any corporate logos. The sign design and typeface shall be consistent throughout the development. (17) P-17. Automatic teller machine (ATM) sign identifying the individual business, logo, and/or principal services associated with an ATM. The sign shall be integrated into the design of the machine. 16 ORDINANCE NO AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF JUPITER, FLORIDA, AMENDING CHAPTER 27 OF THE TOWN CODE PERTAINING TO SIGNAGE; PROVIDING FOR THE AMENDMENT OF SECTION 27-1, TO MODIFY THE DEFINITION OF A DIRECTIONAL SIGN; PROVIDING FOR THE AMENDMENT TO SECTION TO ADD AND MODIFY THE REQUIREMENTS OF P-2, PUBLIC AND SEMIPUBLIC INSTITUTIONS) AND P-6, DIRECTIONAL SIGNS; PROVIDING FOR THE AMENDMENT OF SECTION TO PROVIDE FOR SPECIFIC REQUIREMENTS FOR OFF-PREMISE DIRECTIONAL SIGNS FOR HOSPITALS WITH EMERGENCY SERVICES; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF LAWS IN CONFLICT; PROVIDING FOR CODIFICATION, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Town Council of the Town of Jupiter, Florida ( Town ) has adopted a Comprehensive Plan which has been determined to be in compliance with Chapter 163, Part II, Florida Statutes; and WHEREAS, pursuant to Section (2), Florida Statutes, municipalities are required to provide specific and detailed land development regulations as part of the implementation of their adopted comprehensive plans; and WHEREAS, the Town Council has previously enacted land development regulations in regards to signage, which have been codified in Chapter 27 of the Town Code; and WHEREAS, the Town staff recommends various amendments pertaining to signage within Chapter 27 of the Town Code to further the public s health, safety and general welfare; and WHEREAS, Town s Planning and Zoning Commission has made its recommendations to the Town Council regarding the amendments proposed by the Town staff; and WHEREAS, the Town Council, after duly noticed public hearings has determined that the adoption of the proposed amendments would be consistent with the Town s Comprehensive Plan and would further the public s health, safety and general welfare.

17 Ord # Page NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF JUPITER, FLORIDA THAT: Section 1. The foregoing whereas clauses are incorporated herein as the legislative findings of the Town Council. Section 2. Chapter 27, Article I, Section 27-1, entitled Definitions of the Town Code is hereby amended to read as follows: Directional sign shall means an on-premises or off-premises content-neutral sign permanently or temporarily erected by or with the approval of the Town or any authorized government agency which is necessary for the solely purpose to guide and/or direct pedestrians or and vehicular traffic to a facility place or activity, and which is nonadvertising in nature. Section 3. Chapter 27, Article I, Section , entitled Permanent signs of the Town Code is hereby amended to read as follows: (2) P-2. Identification signs for public and semipublic institutions, such as schools, churches, hospitals, libraries, clubs and public utilities; provided, however that a hospital with emergency services may place an off-premises content neutral directional sign which in the opinion of the Town Manager is necessary to the health and safety of residents and visitors of the town at a location on an arterial road adjacent to or in the vicinity of a full service hospital for the sole purpose of directing residents and visitors. (6) P-6. Directional signs indicating the route or direction to a place, establishment or activity, as permitted by the Department of Planning and Zoning. Community Development. All An off-premises directional signs shall be permitted solely when necessary to direct vehicles or pedestrians to a hospital or public place, limited to those which indicate the direction or route to a public or quasi-public facility or activity, or which indicate the location of civic organizations, and to signs, notices or symbols indicating the time and place of civic meetings.
