2 WEED AND RUBBISH ABATEMENT March 6, 2017 The City of Saint Clair desires to solicit qualified proposals to contract for the abatement of weeds, debris, trash, and trees upon lots within the City of Saint Clair in accordance with the terms conditions and specifications contained herein. Contractor shall furnish to the City all qualified labor, equipment and transportation necessary. This entails a one year contract for these services. This contract shall be non-exclusive. Proposal Process At a minimum, proposals must consist of an original signed letter of transmittal, insurance, and cost proposals. Each proposal must be submitted on the prescribed form typewritten or in ink and sealed in an envelope plainly marked: Weed and Rubbish Abatement Contract with the proposing company s name and address. There will be no public opening and reading of bids. Scope of Work Contractor shall be responsible for the removal and disposal of all debris/refuse on each lot. Tree debris may be disposed of at the City Shed upon approval of the Public Works Director. Large amounts of debris/refuse will be immediately brought to the attention of the Building Inspector prior to removal. Contractor shall clean the work site, and all grounds occupied by him of all rubbish, excess materials, temporary structures and equipment. All lots shall be evaluated by contractor prior to abatement for obstacles, obstructions, and hazards etc. No business signs, drugs, or alcohol are allowed on the job sites. Invoices, Meetings, and Digital Images Invoices shall be submitted within a timely fashion after job is complete with the following information: Name, Date, Address, Work Completed, Labor Hours, Equipment Hours, and Total Charge. No additional allowance will be made for cleanup. Contractor Must take digital images before and after completion of each job, submit in.jpeg format and label with address and date. The contractor may be required to attend meetings with the Building Inspector at no additional charge to the City. Permits It is the contractor s responsibility to obtain all permits necessary for completion of the contract at their own cost. All improvements removed or damaged by the contractor's operations shall be replaced in kind or restored to a condition as good as when the contractor entered upon the work, all at the contractor's expense. Default by Contractor In case of default by the contractor, the City of Saint Clair may procure services from other sources and may deduct from any monies due to the contractor, the difference between the price in the invoice and the actual cost to the City. Non-Collusion Affidavit The contractor declares, by signing and submitting a proposal, that the proposal is not made in the interest of, or on behalf of, any undisclosed person, partnership, company, association, organization, or corporation; that the contractor has not in any manner, directly or indirectly, sought by agreement, communication, or conference with anyone to fix the proposal price. RETENTION OF RECORDS Contractor shall be required to retain any records necessary to document charges for goods or services to be performed and make such records available to the City of St. Clair for inspection at the City's request for the year of the contract. LEGALITY The City of St. Clair and contractor each binds itself, its partners, successors, legal representatives and assigns to the other party to this Agreement and to the partners, successors, legal representatives and assigns of such other parties respect of all promises and Agreements contained herein. If any provisions of this Agreement shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. A waiver of a breach or default under this Agreement shall not be a waiver of any other or subsequent default. Subcontractors: A subcontractor which performs any work on the project in excess of onehalf of one percent (.5%) of the prime contractor's total bid will submit herewith proper firm name and business address of each. Upon notice and request by the City of St. Clair, contractor shall be fully responsible and promptly remedy, to include termination of any subcontract as appropriate and necessary, any default or failure to perform in a satisfactory manner the work undertaken by any subcontractor. 1. 4 GENERAL SERVICES AGREEMENT FOR WEED AND RUBISH ABATEMENT SERVICES This Agreement is made as of / / 2017, between the City of Saint Clair, and R E C I T A L S A. The City of St. Clair desires to retain to provide hourly weed and rubbish abatement services for the City of Saint Clair. B. represents to the City of St. Clair that they are fully qualified to provide the above described services. C. The parties have negotiated upon the terms pursuant to which will provide such services and have herein reduced such terms to writing. NOW, THEREFORE, the City of St. Clair and do hereby agree as follows: shall furnish to the City of St. Clair qualified hourly labor, equipment and transportation necessary to remove weeds, rubbish and other debris as designated by the City of Saint Clair Building Inspector. In case of any conflict between the terms of these documents, the terms of this Agreement shall control and prevail. The parties agree that any provisions contained in proposal(s) that add to, vary or conflict with the terms of this Agreement are null and void.
