3 FORWARDING LETTER The Director, Bhopal Memorial Hospital & Research Centre, Raisen Bye Pass Road, Bhopal (M.P.) Dear Sir, With reference to the above Tender Enquiry I/We are submitting herewith our tender documents. The tender document is duly paginated and contains page no 01 to I/We, the undersigned, hereby submit my/our tender for the Registration of firm/company for the supply of Plumbing & Sanitary consumable items for 365 days on rate contract basis. 2. We are submitting Bid security declaration as per (Annexure-II) or DD No...of Rs.12,000/- dt...in favour of Director BMHRC. 3. Once the tender is decided, the performance 5% of the contract value will be furnished by the undersigned (approved firm) in the form of DD in favor of Director BMHRC or Bank Guarantee from any Commercial Bank in the specified format. The contract value will be estimated on L-1 rates of Annexure III items quoted by successful bidder. 4. I/We undertake to sign the contract/ agreement, if required, within 15 (Fifteen days) from the issue of the letter of acceptance, failing which without any valid reason our/my EMD/Security deposit will may forfeited and our/my name will be removed from the list of suppliers at BMHRC, Bhopal. 5. I/We certify that I/We have gone through & agree to the terms & conditions of Tender Ref No. mentioned above and undertake to comply with them for the contract period (valid for 365 days from the date of signing of the agreement deed plus extendable for further one year on same terms, conditions & item rates if mutually agreed between vendor and Director, BMHRC). 6. I/We, the undersigned, hereby bind myself to supply the Plumbing & Sanitary consumable items to BMHRC, Bhopal during the validity period of this tender / rate-contract. 7. BMHRC is not bound to take all or any of the articles enumerated in the Annexure-III in full or given in part of the estimated quantity, as the same is indicative in nature. 3

I/We agree that in case of failure to supply the material for which a Purchase order placed upon me/us within the stipulated date of delivery, the institution can go to market for local purchase of the same at my/our risk and cost limited to performance security. 9. I/We will submit the samples as and when required during the finalization of contract. 10. I/We have quoted the price strictly according to the required Technical specifications/brands. The conditions contained herein shall form part of and shall be taken as if they are included in the agreement into or treated as to be entered agreement itself. 11. We shall execute an agreement on Non-judicial Stamp paper of specified denomination as per the norm in case my/our tender is accepted and if I/We asked to act so, an agreement will be executed by me/us within 15 days of the intimation of acceptance of rates for the tender. 12. BMHRC reserves the right to change any article on its being found to be of inferior quality or defective. It shall be replaced by me/us free of cost within the given time to avoid any inconvenience to the hospital. 13. The tenders should reach this office on or before up to 2:00 PM duly sealed & marked Tender number: BMHRC/ Limited Tender/ES/Civil/Material-Plumbing & Sanitary/ /15 (2 nd Call). Quotations written in pencil will not be entertained. Tender (Technical Bid) will be opened on same day at 3:30 pm in the presence of bidder s representative, who decides to attend, at the time and date as specified. 2. Applicable GST to be mentioned along with the rate quoted & must include all types of taxes. No other charges will be considered. 3. Tender should invariably be submitted in two parts Viz. Part-I Technical Bid (Without Prices) in sealed envelope with EMD, Bid Security declaration & credentials and Part-II shall contain the Price Bid. The sealed envelopes of part-i & Part-II should be kept in large envelope & sealed. The tenderers are requested to submit detailed Quotation in formats mentioned in the Tender Document. 6 6. The agencies registered under make in India scheme of Govt of India would be entitled to avail relaxations as per the provisions of scheme. 7. The agencies registered under MSME/SSI are exempted from submission of tender cost & EMD prescribed in tender. 8. Offer will be valid for 90 days from the opening of the tenders. The tender rates should be kept open / valid for a period of 365 days from the date of signing the agreement. 9. If the delivery is not affected within 15 days from the date of issue of order, local purchase from other sources would be made on risk/ liability of bidder, limited to performance security. 10. Price bid shall preferably & submitted in typewritten form and hand written quotations shall be accepted at the bidders risk in case of any discrepancy in the figures the rate mentioned in words will only be considered. 11. Tender should be accompanied with Bid Security Declaration (Annexure-II) or an EMD/BID security amounting to Rs.12,000/- by way of demand draft of any commercial bank drawn in favor of Director, BMHRC, Bhopal, failing which the tender shall not be considered for acceptance and will be out rightly rejected. Cash/cheque is not acceptable at all. The EMD/BID security deposited against any other tender cannot be adjusted or considered for this tender/rate enquiry. No interest is payable on EMD/BID security. EMD/BID Security will be returned to all unsuccessful bidders after finalization of the tender. 12. The Successful bidder shall furnish the performance security within 15 days of issue of acceptance letter from BMHRC. The performance security should be for an amount of 5% of the contract value worked out from L-1 rates of required quantities of items quoted by responsive L-1 bidder payable in form of Demand Draft/Bank guarantee from any commercial Bank in favor of Director, BMHRC, and it shall be valid for the period beyond 3 months after the completion of contract period. The Performance Security shall be released on satisfactory completion of all contractual obligations. No interest shall be payable on the performance security. Failure to furnish performance security in time would entail forfeiture of earnest money deposited by the firm & cancellation of the contract. 13. The Director, BMHRC, Bhopal shall be the final authority to reject full or any part of the supply which is not conforming to the specification and other terms and conditions. 6

7 14. No payment shall be made for rejected material. The supplier have to remove rejected items within one week from the date of rejection at their own cost. In case these are not removed, these will be disposed off in a manner as deemed fit by the Director BMHRC at the risk and responsibility of the suppliers without any further notice. 15.In case of failure to supply the materials for which the purchase order is placed by BMHRC to the selected bidder within the stipulated date of delivery, the institute may procure the same from local market on the risk & liability of supplier agency limited to performance security. 16. The firm should not have been blacklisted in the past by any government/ Private institution and there is no Vigilance/ CBI case pending against the firm supplier. 17. The quantity of items shown in the tender can be increased or decreased depending upon the actual requirement. 18. The tenderer s must quote rates including freight, insurance, cartage, labor charges etc for supply at BMHRC Civil maintenance stores. 19. The court of BHOPAL will have the jurisdiction to trial any matter, dispute or reference between the parties arising out of the contract. It is specifically agreed that no court outside Bhopal have jurisdiction in the matter. 20.Selection will be made purely on the basis of Techno-Commercial Bid & lowest quoted rate for the items including specifications as described in the Annexure III. 21.Tender by Tele-fax/fax/ will not be accepted. 22.The price charged for the Stores, under the reference by the supplier shall in no case exceed the MRP/ lowest price at which the supplier charged the Store of same identical description to any other person /organization, Institution during the period of contract. If at any time, during the said period the supplier reduces the said prices of such/stores or sales such stores to any other person/organization/institution at price lower than the chargeable to BMHRC, he shall forthwith notify such reduction in sale price to the Director, BHOPAL MEMORIAL HOSPITAL & RESEARCH CENTRE, BHOPAL and the price payable for the Stores supplied after the date of coming into force of such reduction or sale shall stand correspondingly be reduced, for the items supplied to BMHRC. 7

8 23.The agency / firm should be having trading experience of minimum 3 years and shall enclose self attested copy of its registration as proprietorship establishment, partnership firm or company. 24.The Vendor should enclose the copy of GST Registration No. 25. Payment to the supplier Company/agency shall be made within 60 days from the submission of the bill and receipt of stores in good & satisfactory condition. 26.The Director has full power to terminate the rate contract at any time during the period of contract without assigning any reason. 27. The Registered Office or Branch Office/Distributor of the Agency/ Trading Firm shall preferably located in the Bhopal City. 28. Force Majeure: Any failure of omission or commission to carry out the provisions of this contract by the Parties to the contract shall not give rise to any claim by any party, one against the other if such failure of omission or commission arises from events such as war, riot or an act of God making the performance of contract impracticable & impossible. Provided that notice of the occurrence of any event by either party to the other shall be given within two weeks from the date of occurrence of such event which could be attributed to Force Majeure conditions. 29. Arbitration (Dispute Settlement): i. All dispute or difference of any kind shall arise between the Purchaser and the supplier in connection with or relating to the contract, contained herein, shall be mutually discussed and settled between the parties. ii. In event of any disagreement or dispute remaining unresolved, the same shall be referred to the Director BMHRC for arbitration who will act as arbitrator or will appoint an arbitrator whose decision shall be final and binding on all parties. iii. The courts of Bhopal shall have exclusive jurisdiction in all matters arising out of this Tender. 30. Conditional tender will not be accepted. 31. The bidder shall disclose all the required information such as address, registration of firm, Proprietor, Trading experience of firm in Bio-Data sheet (Annexure-I). 8

General Specification of Plumbing & Sanitary items : All the Plumbing & Sanitary items supplied to BMHRC should be of standard quality durable and shall conforms to relevant BIS specifications, free from flaws and defects of any kind, items samples may be submitted to Engineering Services Department for quality compliance as & when required, during finalization of contract. B). Particular Specification of items : 1) GI Pipes Glass B. : Conforming to IS-1239(Part-1) : 2004 (sixth revision) all pipes shall be clearly finished and reasonably free from injurious defects the ends shall be free from sharp edges and burrs of pipe, the tubes shall be reasonably straight. The pipes shall withstand the pressure tests and shall not show any sign of leakage, sweating or other defects of any kind. 2) GI Tubulars Sockets & Fittings: Conforming with IS-1239(Part-2) :2011 Tubulars sockets & fittings shall be clearly finished and reasonably free from scale, surface flaws, laminations and other defects. The screw threads of tubular, sockets and fittings shall be clean and well cut. The ends shall be cut clearly and square unless otherwise specified. 3) Vitreous Sanitary Appliances: The general requirements relating to terminology, materials, manufacture, glazing defects, minimum thickness, tolerances, performance and methods tests shall conform to IS-2556 (Part 1-16) : as per CED-3. 4) CI Cast Spun Pipes & Fittings : Conforming with IS-8329 :2000 (Reaffirmed 2005). The CI pipes & fitting shall be of good quality, sound and free from surface or other defects, the pipes shall withstand the pressure tests and shall not show any sign of leakage, sweating or other defects of any kind. The metal used for the manufacture of pipes shall be of good quality commensurate with the mechanical requirements laid down in tensile test schedule of IS-8329: ) Forged Brass Gate, Globe & Check valves for water works purpose: Conforming with IS-13114: 1991 (Reaffirmed 2003). The design of valve bodies shall be such as to provide ample resistance to distortion under maximum working pressure. All valves shall be conforming to hydrostatic pressure tests for the body and there shall be no visible leakage during the tests. Marking : Valves shall be marked with the following information either forged integral or stamped on the body and shall be clearly visible. a) Manufacture's Name of trade mark b) Nominal size c) Batch No. d) An arrow showing the direction of flow in case of globe valves and check valves. 9
