2 Page 2 Process and Documents: This process is for the selection of a new High Intensity Drug Trafficking Area (HIDTA) Strategic Intelligence Program Coordinator. Due to the relationship of HIDTA and the State of Kansas, this selection and contracting process must follow the purchasing regulations of the State of Kansas. As such this is being done as a sealed bid request for proposal (RFP) process. The following is a high level overview of the process and the steps that applicants will need to complete. 1. Applicant shall complete the Bidder Registration application on the homepage of our website, Please use commodity code 9210 Public Order and Safety. 2. After the applicant has completed the registration they shall send an to Brienne Wilkins (brienne.wilkins@ks.gov) letting her know that the applicant has registered. 3. Questions/Amendment - No pre-proposal conference is scheduled for this Bid Event. Questions requesting clarification of the Bid Event must be submitted via (in MS Word format) to the Procurement Officer (Event Contact) indicated above prior to the close of business on October 20, Each question or clarification should reference the appropriate Bid Event section. Any modification to this Bid Event as a result of written responses to questions received, shall be made in writing by amendment and dispatched to all bidders invited to this event. Only written communications are binding. Answers to questions will be available in the form of an amendment on the Procurement and Contracts' website, It shall be the responsibility of all participating applicants to acquire any and all amendments and additional information as it is made available from the web site cited above. 4. Delays in mail delivery or any other means of transmittal, including couriers or agents of the issuing entity shall not excuse late bid submissions. Faxed, ed or telephoned proposals are not acceptable. Proposals received prior to the closing date shall be kept secured and sealed until closing. The State shall not be responsible for the premature opening of a proposal or for the rejection of a proposal that was not received prior to the closing date because it was not properly identified on the outside of the envelope or container. 5 Page 5 TAX CLEARANCE INSTRUCTIONS A Tax Clearance is a comprehensive tax account review to determine and ensure that the account is compliant with all primary Kansas Tax Laws administered by the Kansas Department of Revenue (KDOR) Director of Taxation. Information pertaining to a Tax Clearance is subject to change(s), which may arise as a result of a State Tax Audit, Federal Revenue Agent Report, or other lawful adjustment(s). To obtain a Tax Clearance Certificate, you must: Go to to request a Tax Clearance Certificate Return to the website the following working day to see if KDOR will issue the certificate If issued an official certificate, print it and attach it to your signed renewal document If denied a certificate, engage KDOR in a discussion about why a certificate wasn t issued Contractors must submit a current Tax Clearance Certificate along with the signed Renewal Document. No renewal will be processed unless a current Tax Clearance Certificate is submitted. Per KSA (c), the Director of Purchases may reject the bid of any bidder who is in arrears on taxes due the State of Kansas. The Secretary of the Kansas Department of Revenue is authorized to exchange such information with the Director of Purchases as is necessary to determine a bidder s tax clearance status, notwithstanding any other provision of law prohibiting disclosure of the contents of taxpayer records or information. 6 Page 6 CERTIFICATION REGARDING IMMIGRATION REFORM & CONTROL All Contractors are expected to comply with the Immigration and Reform Control Act of 1986 (IRCA), as may be amended from time to time. This Act, with certain limitations, requires the verification of the employment status of all individuals who were hired on or after November 6, 1986, by the Contractor as well as any subcontractor or subsubcontractor. The usual method of verification is through the Employment Verification (I-9) Form. With the submission of this bid, the Contractor hereby certifies without exception that Contractor has complied with all federal and state laws relating to immigration and reform. Any misrepresentation in this regard or any employment of persons not authorized to work in the United States constitutes a material breach and, at the State s option, may subject the contract to termination and any applicable damages. Contractor certifies that, should it be awarded a contract by the State, Contractor will comply with all applicable federal and state laws, standards, orders and regulations affecting a person s participation and eligibility in any program or activity undertaken by the Contractor pursuant to this contract. Contractor further certifies that it will remain in compliance throughout the term of the contract. At the State s request, Contractor is expected to produce to the State any documentation or other such evidence to verify Contractor s compliance with any provision, duty, certification, or the like under the contract. 8 Page 8 1. INSTRUCTIONS 1.1. Bid Event ID: The Bid Event ID, indicated in the header of this page, as well as on the first page of this proposal, has been assigned to this RFP and MUST be shown on all correspondence or other documents associated with this RFP and MUST be referred to in all verbal communications. All inquiries, written or verbal, shall be directed only to the procurement officer reflected on Page 1 of this proposal. There shall be no communication with any other State employee regarding this RFP except with designated state participants in attendance ONLY DURING: Negotiations Contract Signing as otherwise specified in this RFP. Violations of this provision by bidder or state agency personnel may result in the rejection of the proposal Negotiated Procurement: This is a negotiated procurement pursuant to K.S.A ,102. Final evaluation and award will be made by the Procurement Negotiation Committee (PNC) consisting of the following entities (or their designees): Secretary of Department of Administration; Director of Purchases, Department of Administration; and Head of Using Agency 1.3. Cost of Preparing Proposal: The cost of developing and submitting the proposal is entirely the responsibility of the bidder. Copies of individual bid responses may be obtained under the Kansas Open Records Act by visiting Information in bid files shall not be released until a contract has been executed or all bid responses have been rejected Disclosure of Proposal Content and Proprietary Information: All proposals become the property of the State of Kansas. The Open Records Act (K.S.A et seq) of the State of Kansas requires public information be placed in the public domain at the conclusion of the selection process, and be available for examination by all interested parties. ( No proposals shall be disclosed until after a contract award has been issued. The State reserves the right to destroy all proposals if the RFP is withdrawn, a contract award is withdrawn, or in accordance with Kansas law. Late Technical and/or Cost proposals will be retained unopened in the file and not receive consideration or may be returned to the bidder. Trade secrets or proprietary information legally recognized as such and protected by law may be requested to be withheld if clearly labeled "Proprietary" on each individual page and provided as separate from the main proposal. Pricing information is not considered proprietary and the bidder's entire proposal response package will not be considered proprietary. All information requested to be handled as "Proprietary" shall be submitted separately from the main proposal and clearly labeled, in a separate envelope or clipped apart from all other documentation. The bidder shall provide detailed written documentation justifying why this material should be considered "Proprietary". Procurement and Contracts reserves the right to accept, amend or deny such requests for maintaining information as proprietary in accordance with Kansas law. The State of Kansas does not guarantee protection of any information which is not submitted as required Exceptions: By submission of a response, the bidder acknowledges and accepts all terms and conditions of the RFP unless clearly avowed and wholly documented in a separate section of the Technical Proposal to be entitled: "Exceptions" Notice of Award: An award is made on execution of the written contract by all parties.

10 Page TERMS AND CONDITIONS This Agreement ( Agreement ) shall evidence the terms by which the Kansas Bureau of Investigation ( KBI ) engages individually as an independent contractor ( Contractor ), for the purpose of performing the services hereinafter enumerated in relation to the Midwest High Intensity Drug Trafficking Area ( Midwest HIDTA ), with such additional duties and responsibilities as made being hereinafter prescribed from time to time from the Office of the National Drug Control Policy ( ONDCP ) and the Midwest HIDTA Executive Board ( Board ). This agreement is contingent on funding by a Grant/Award and made available through ONDCP Term of Agreement: The term of this agreement shall be from the date of award through June 30, 2018 with one (1) option to renew for an additional two (2) year period Services: Contractor agrees to perform the professional services of the Midwest HIDTA Strategic Intelligence Program Coordinator, as directed by the Board including, but not limited to, the following: Conduct research and analysis on all areas and topics regarding drug trafficking and drug use trends from local, regional, national and international perspectives. Work closely with both intelligence and enforcement elements within the Midwest HIDTA s law enforcement community and establish points of contact with key federal, state, local and tribal agencies and other intelligence units. Identify and document strategic threats and challenges for local and national dissemination. Serve as principal contact between Midwest HIDTA and ONDCP s Heroin Response Strategy Drug Intelligence Officers (DIO) and Public Health Analysts (PHA). Examine data and statistics through the utilization of Excel and similar programs for organizing information and producing charts and graphs. Primary contributor to all written strategic intelligence products and reports. Prepare and provide briefings/presentations on any strategic findings. Assist in implementing strategic planning actions taken by the Director, Deputy Director, and the Executive Committee. Other duties as assigned Relationship: Contractor is and shall at all times be an independent contractor and is not to be considered an agent or employee of the KBI. The KBI s only responsibility under this contract is to administer the Cooperative Agreement Contract between ONDCP and the KBI by supplying ONDCP the proper documentation regarding any payment due the Contractor, and disbursing such funds to the Contractor Payment: As full payment for those professional services rendered in accordance with this Agreement, the KBI shall disburse to Contractor an amount equivalent to the United States Government Salary Table 2017-RUS Incorporating a Locality Payment of 14.16% for the Locality Pay Area of Rest of U.S. ( GS Pay Scale ), at Grade 11, Step 3, as effective January Upon the effective date of this Agreement, that amount is $64,223, plus an additional 25% for benefits, but annual adjustments to the contract rate shall occur commensurate with adjustments to the GS Pay Scale Expense Reimbursement: Contractor shall be entitled to reimbursement for certain approved expenses incurred while performing the services contained in this Agreement in accordance with the terms of the Payment and Expense Reimbursement Approval paragraph (see Article 2.6 below) over the term of this agreement.

11 Page Payment and Expense Reimbursement Approval: Payment for services rendered shall be paid on a monthly basis. The Contractor shall submit a monthly billing, indicating the monthly payment and shall submit the original receipts for expenses to be reimbursed. All requests for payment and/or reimbursement shall be reviewed and approved for payment by the Board. All requests for expense reimbursement submitted shall be in conformance with the current published guidelines used in the administration of the Midwest HIDTA Payment and Expense Reimbursement Processing: Contractor shall submit approved invoices to the KBI for payment and reimbursement. The KBI shall arrange for the payment of such invoices through the appropriate KBI processes Taxes: Contractor shall be solely responsible for any and all federal, state, and local tax consequences that result from receipt of any payments or reimbursements paid in accordance with this Agreement Automobile Restrictive Use: Contractor shall be provided a vehicle allowance for use during official Midwest HIDTA business Other Equipment Use: Contractor shall be provided a mobile cellular telephone for official use. Contractor will reimburse the KBI for personal calls made from the cellular telephone Termination: This Agreement may be terminated by either party at any time without cause provided; however, should the Contractor terminate this Agreement, Contractor shall give the KBI fourteen (14) days written notice of his intent to terminate the Agreement. Contractor understands that should they no longer be able to perform the services required herein for any reason, this entire Agreement shall automatically terminate without notice. In any event, at the termination of this Agreement, the Contractor shall receive as sole compensation payment for the services actually performed in accordance with the payment provision of Article 4 of this Agreement, plus any expenses to which he is due and owed at the time of the termination Notice: All notices required to be given hereunder shall be given in writing by electronic mail, overnight mail, facsimile transmission, certified or registered mail, or by hand delivery at the respective addresses of the parties set forth herein, or at such other addresses as may be designated in writing by either party. 12 Page Miscellaneous Provisions: a. This Agreement shall not bestow any rights upon any third party, but rather shall bind and benefit the Contractor and the KBI only. b. This Agreement contains all the agreements of the parties relating the subject matter hereof and is full and final expression of the agreement between the parties. c. This Agreement may be amended by mutual written consent of both parties. d. The Contractor, his officers or agents and employees agree to and shall indemnify, hold harmless, and defend the KBI, its officers, agents and employees from and against any and all claims, losses, damages, causes of action, suites and liability of any kind, including all expenses of litigation, court costs, and attorneys fees for any and all damages arising out of or in connection with the services performed or advice given by the Contractor, his officers, agents, or employees, pursuant to the Agreement, where such damages are caused in whole or in part by the negligence of the KBI, its officers, agents or employees. It is the express intention of the parties hereto, both the Contractor and the KBI, that the indemnity provided for in this paragraph is indemnity by the Contractor to indemnify and protect the KBI, its officers, agents and employees from the consequences of the negligence of the KBI, its officers, agents or employees, whether that negligence is the sole or concurring cause of the resulting damage(s). e. Contractor does hereby for himself, his officers, agents, employees, successors, assigned personnel, representatives, heirs, executors and administrators, collectively referred to in this paragraph as Contractor, release, acquit and forever discharge the KBI, its officers, agents and employees collectively referred to in this paragraph as KBI of any and all debts, damages, claims, causes of actions, suits, liabilities, and demands of whatever nature which Contractor might now have or might subsequently accrue by reason of any matter or thing whatsoever, and particularly growing out of or in any way connected with, directly or indirectly, this Agreement and/or services to be performed pursuant to the same, including, but not limited to, any claims or workers compensation, health insurance or any other benefit provided by the KBI, or its officers/employees; and claims challenging the constitutionality or legality of the provision of this Agreement; any and all existing or future common law statutes or laws, civil rights or constitutional claims, and any tort claims of any nature. f. Contractor covenants and agrees he will not employ any individual to perform the services described within this Agreement, unless such individual has signed a release and indemnity agreement releasing and indemnifying the KBI from all claims, losses, damages, causes of action, suits and liability of every kind, regardless of any negligence on the part of the KBI. Such release and indemnity agreement must be in accordance and provide at a minimum the same protection to the KBI as afforded in subsections (d) and (e) above. g. Notwithstanding anything to the contrary contained within this Agreement, the KBI and the Contractor hereby agree that no claim or dispute between the KBI and the Contractor arising out of or in relation to this Agreement shall be decided by any arbitration proceeding including, without limitation, any proceeding under the Federal Arbitration Act (9 U.S. C. ss 1-14) or any applicable state arbitration statute, provided that in the event the KBI is subjected to an arbitration proceeding notwithstanding this provision, Contractor consents to be joined in the arbitration proceeding if the Contractor s presence is required or requested by the KBI for complete relief to be recorded in the arbitration proceeding. h. Neither Contractor nor the KBI shall sell, assign or transfer any of its rights or obligations under this Agreement in whole or in part without prior written consent of the other party. i. Failure of either party hereto to insist on the strict performance of any of the provisions of this Agreement, herein or to exercise any rights or remedies accruing thereunder upon default or failure of performance shall not be considered a waiver or the right to insist on and to enforce by all appropriate remedies, strict compliance with any other obligations hereunder to exercise any right or remedy occurring as a result of any future default or failure of performance. j. This agreement shall in all respects be interpreted and construed in accordance with and governed by the laws of the State of Kansas, regardless of the place of its execution or performance.

All parties agree that should any provision of this Agreement be determined to be invalid or unenforceable, such determination shall not affect any other term of this Agreement, which shall continue in full force and effect. l. In the event of any ambiguity in any of the terms of this Agreement, it shall not be construed for or against any party hereto on the basis that such party did or did not author the same. m. The parties agree that the attached contractual provision attachment (DA146a) is hereby incorporated into the above referenced contract, and is made a part thereof. n. The officers executing this Agreement on behalf of the parties hereto confirm that such officers have full authority to execute this Agreement and to bind the party he/she represent.

14 Page 14 Contract Announcement Strategic Intelligence Program Coordinator Salary: GS-11/3 Placed under the Midwest HIDTA Management and Coordination Initiative, the Strategic Intelligence Program Coordinator will primarily be responsible for policy level strategic and management support to the Investigative Support Center (ISC) and management staff; to include the collection, analysis, and dissemination of drug-related strategic intelligence to partner entities; this intelligence will be in various formats to include annual reports, threat assessments, and intelligence bulletins. The position requires strong analytical and writing skills. This is a contract position which falls under the Midwest HIDTA. The Strategic Intelligence Program Coordinator is a grant funded position that is contingent upon annual HIDTA funding from the Office of National Drug Control Policy. The position is responsible to the Midwest HIDTA Executive Committee on policy and program related issues, and functions within the Office of the Director, Midwest HIDTA. Periodic travel within Missouri and adjoining states is required. Position will be located in the Kansas City, Missouri area. MINIMUM QUALIFICATIONS Pass a Secret Security clearance background and be able to obtain DEA access. At least ten years experience in a criminal justice system agency. Possession of a bachelor s degree or equivalent experience as an Intelligence Analyst. Proficiency in Microsoft Word, Excel and PowerPoint. Possession of a valid driver s license, proof of insurance and regular availability to a vehicle. Proficiency in the use of the internet for open source database research. Ability to work flexible hours and travel as required. Good interpersonal people skills and ability to maintain sensitive information in confidence. Aptitude for working well in a team and small group environment. Must possess exceptional writing and public speaking skills. KEY RESPONSIBILITIES AND DUTIES Conduct research and analysis on all areas and topics regarding drug trafficking and drug use trends from local, regional, national and international perspectives. 15 Page 15 The Strategic Intelligence Program Coordinator is a contract position renewable yearly based upon performance and program continuation. Contracting procedures for this position will be in accordance with fiscal agent policies. Annual starting contract rate is $80, All travel expenses to include vehicle allowance will also be reimbursed according to contract terms. 16 Page 16 Department of Administration DA-146a (Rev ) State of Kansas CONTRACTUAL PROVISIONS ATTACHMENT Important: This form contains mandatory contract provisions and must be attached to or incorporated in all copies of any contractual agreement. If it is attached to the vendor/contractor's standard contract form, then that form must be altered to contain the following provision: "The Provisions found in Contractual Provisions Attachment (Form DA-146a, Rev ), which is attached hereto, are hereby incorporated in this contract and made a part thereof." The parties agree that the following provisions are hereby incorporated into the contract to which it is attached and made a part thereof, said contract being the day of, Terms Herein Controlling Provisions: It is expressly agreed that the terms of each and every provision in this attachment shall prevail and control over the terms of any other conflicting provision in any other document relating to and a part of the contract in which this attachment is incorporated. Any terms that conflict or could be interpreted to conflict with this attachment are nullified. 2. Kansas Law and Venue: This contract shall be subject to, governed by, and construed according to the laws of the State of Kansas, and jurisdiction and venue of any suit in connection with this contract shall reside only in courts located in the State of Kansas. 3. Termination Due To Lack Of Funding Appropriation: If, in the judgment of the Director of Accounts and Reports, Department of Administration, sufficient funds are not appropriated to continue the function performed in this agreement and for the payment of the charges hereunder, State may terminate this agreement at the end of its current fiscal year. State agrees to give written notice of termination to contractor at least 30 days prior to the end of its current fiscal year, and shall give such notice for a greater period prior to the end of such fiscal year as may be provided in this contract, except that such notice shall not be required prior to 90 days before the end of such fiscal year. Contractor shall have the right, at the end of such fiscal year, to take possession of any equipment provided State under the contract. State will pay to the contractor all regular contractual payments incurred through the end of such fiscal year, plus contractual charges incidental to the return of any such equipment. Upon termination of the agreement by State, title to any such equipment shall revert to contractor at the end of the State's current fiscal year. The termination of the contract pursuant to this paragraph shall not cause any penalty to be charged to the agency or the contractor. 4. Disclaimer Of Liability: No provision of this contract will be given effect that attempts to require the State of Kansas or its agencies to defend, hold harmless, or indemnify any contractor or third party for any acts or omissions. The liability of the State of Kansas is defined under the Kansas Tort Claims Act (K.S.A et seq.). 5. Anti-Discrimination Clause: The contractor agrees: (a) to comply with the Kansas Act Against Discrimination (K.S.A et seq.) and the Kansas Age Discrimination in Employment Act (K.S.A et seq.) and the applicable provisions of the Americans With Disabilities Act (42 U.S.C et seq.) (ADA) and to not discriminate against any person because of race, religion, color, sex, disability, national origin or ancestry, or age in the admission or access to, or treatment or employment in, its programs or activities; (b) to include in all solicitations or advertisements for employees, the phrase "equal opportunity employer"; (c) to comply with the reporting requirements set out at K.S.A and K.S.A ; (d) to include those provisions in every subcontract or purchase order so that they are binding upon such subcontractor or vendor; (e) that a failure to comply with the reporting requirements of (c) above or if the contractor is found guilty of any violation of such acts by the Kansas Human Rights Commission, such violation shall constitute a breach of contract and the contract may be cancelled, terminated or suspended, in whole or in part, by the contracting state agency or the Kansas Department of Administration; (f) if it is determined that the contractor has violated applicable provisions of ADA, such violation shall constitute a breach of contract and the contract may be cancelled, terminated or suspended, in whole or in part, by the contracting state agency or the Kansas Department of Administration. Contractor agrees to comply with all applicable state and federal anti-discrimination laws. The provisions of this paragraph number 5 (with the exception of those provisions relating to the ADA) are not applicable to a contractor who employs fewer than four employees during the term of such contract or whose contracts with the contracting State agency cumulatively total $5,000 or less during the fiscal year of such agency. 6. Acceptance Of Contract: This contract shall not be considered accepted, approved or otherwise effective until the statutorily required approvals and certifications have been given. 7. Arbitration, Damages, Warranties: Notwithstanding any language to the contrary, no interpretation of this contract shall find that the State or its agencies have agreed to binding arbitration, or the payment of damages or penalties. Further, the State of Kansas and its agencies do not agree to pay attorney fees, costs, or late payment charges beyond those available under the Kansas Prompt Payment Act (K.S.A ), and no provision will be given effect that attempts to exclude, modify, disclaim or otherwise attempt to limit any damages available to the State of Kansas or its agencies at law, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. 8. Representative's Authority To Contract: By signing this contract, the representative of the contractor thereby represents that such person is duly authorized by the contractor to execute this contract on behalf of the contractor and that the contractor agrees to be bound by the provisions thereof. 9. Responsibility For Taxes: The State of Kansas and its agencies shall not be responsible for, nor indemnify a contractor for, any federal, state or local taxes which may be imposed or levied upon the subject matter of this contract. 10. Insurance: The State of Kansas and its agencies shall not be required to purchase any insurance against loss or damage to property or any other subject matter relating to this contract, nor shall this contract require them to establish a "self-insurance" fund to protect against any such loss or damage. Subject to the provisions of the Kansas Tort Claims Act (K.S.A et seq.), the contractor shall bear the risk of any loss or damage to any property in which the contractor holds title. 11. Information: No provision of this contract shall be construed as limiting the Legislative Division of Post Audit from having access to information pursuant to K.S.A et seq. 12. The Eleventh Amendment: "The Eleventh Amendment is an inherent and incumbent protection with the State of Kansas and need not be reserved, but prudence requires the State to reiterate that nothing related to this contract shall be deemed a waiver of the Eleventh Amendment." 13. Campaign Contributions / Lobbying: Funds provided through a grant award or contract shall not be given or received in exchange for the making of a campaign contribution. No part of the funds provided through this contract shall be used to influence or attempt to influence an officer or employee of any State of Kansas agency or a member of the Legislature regarding any pending legislation or the awarding, extension, continuation, renewal, amendment or modification of any government contract, grant, loan, or cooperative agreement.
