1 EUROPEAN COMMISSION Employment, Social Affairs and Inclusion DG Employment and Social Legislation, Social Dialogue Social dialogue, Industrial Relations SECTORAL DIALOGUE COMMITTEE HORECA Draft Minutes of the Plenary Meeting 13 December Approval of the agenda The agenda was approved. 2. Approval of the minutes of the SSDC Plenary meeting of 11 December 2012 The minutes of the last SSDC Plenary meeting were approved, with the reservation of EFFAT to have a final look, as the minutes were sent only shortly before the plenary. Commission minutes have been drafted on the basis of HOTREC minutes. 3. Qualifications and Skills Passport (QSP) Ms Howald (EFFAT) updated the members on the latest developments on the QSP. The skills list has been translated into all European languages and forwarded to national Social Partners and EFFAT/HOTREC member organisations, asking them to proofread the list and to verify whether the appropriate sectoral terminology was used. EFFAT and HOTREC had sent the approved EN version of the skills list to the EURES secretariat for a test upload. The functional specifications for the skills passport application in EURES are about to be finalised. However, as the tool's overall development has been delayed, the skills passport might be ready in early The skills lists will also be accessible in all languages on HOTREC and EFFAT respective websites. Ms Woodruff (DG EMPL/EURES) made a practical demonstration of how the QSP skills list will work within EURES. (see annex ppt presentation). Ms Howald expressed EFFAT s satisfaction to see that the results of the work of the SSDC are finally becoming a reality. The EURES tool goes indeed much further than expected, e.g. with regard to the endorsement of skills. Mr Couchman (HOTREC) endorsed what Ms Howald said. He raised questions regarding the time needed to fill in the EURES documents, possibilities to correct entries and how the job match will function. He also suggested that the translation in Croatian should be added. Mr Juyaux (CFDT) expressed his hope that the tool will be operational soon, and informed that the French social partners in the Rhone-Alpes region, in cooperation with the Pôle- Comment [MSOffice1]: To be added 1
2 Emploi, are ready to test the skills passport in their region. He also suggested that this passport should be linked not only to competences and skills but also to professional experience, to allow workers to pursue a professional path in the sector. Ms Sobrino (HOTREC) asked whether there was a possibility to add a competence not listed, and the Commission's representative confirmed that there would be open space for that. Mr Banquet d'orx (UMIH) added that this tool should also be promoted outside the EU. Mrs Woodruff explained that there will be a test version available soon to experiment the tool. A full communication to promote the new EURES tools will be launched, and that the Commission would welcome social partners' contributions. Ms Howald proposed a joint communication event. Ms Woodruff was invited to present the new EURES tool at the next HOTREC General Assembly in April 2014 and the next General Assembly of the EFFAT Tourism Sector in April She accepted on the principle. Mr Weinz (ILO) proposed to put the link to EURES on the ILO website. Mr Stjernquist (DG EMPL/EURES) proposed to set up a little working group in order to work on the idea of a joint communication event. EFFAT and HOTREC agreed to be part of the working group on the joint promotion campaign of the passport. 4. ILO Tourism policy: Sustainable Tourism - ILO policy, mandate and tools Mr Weinz, ILO Hotels, Catering and Tourism Specialist, presented the ILO work in the field of tourism. (see annex ppt presentation) The next initiative will be a tool / a code of practice on decent work and socially responsible tourism, to promote e.g. standards and rights, employment and enterprise development, social protection and social dialogue. The tool shall contain - non-binding - technical standards, but with the possibility of certification, and it shall be tripartite. A brainstorming workshop will take place in 2014 to which the International and European employers organisations and trade union federations will be invited, a first non-paper will be issued in On the possibility of promoting the passport internationally, Mr. Weinz said that ILO could promote via its website specifically on the Hotels, catering and tourism sector/department of ILO. It should be possible to insert a link on the Hospitality Skills Passport. 5. Undeclared work / Illegal working practices Mr Couchman made a reference to EFFAT and HOTREC response to the Commission consultation of the social partners on the issue of undeclared work. He said that there was not much to be discussed on this dossier as the social partners are waiting for the Commission Communication on undeclared work and for the Commission to position itself on the possibility of setting up a platform to fight undeclared work. Ms Clement pointed out that the Commission (DG EMPL) is actually evaluating the impact assessment on the future Communication on the topic of undeclared work. The impact assessment has tried to take into account the social partners responses/input. This impact assessment has been sent to inter-service consultation for further evaluation. There is still nothing decided on the possibility of setting-up a platform, and whether the platform will become mandatory for Member States representatives and what form it will adopt. 2
3 The document Successful measures and initiatives to combat undeclared work in the hotel & restaurant sector, jointly elaborated on the basis of the contributions made by the national social partners at the last plenary meeting, was further discussed). Ms Howald is of the opinion that EFFAT and HOTREC should make good use of the best practices on undeclared work that were presented at the SSD plenary meeting of 2012 and that have been compiled together in a document. EFFAT and HOTREC will wait for the Commission to issue its Communication on undeclared work to continue discussions on the issue. 6. CSR The draft document CSR initiatives in the European hotel & restaurant sector, drawn up on the basis of the contributions made by the national social partners at the SSDC plenary meeting in December 2012 (see attached), will be further discussed at the next SSDC Steering Committee meeting. 7. Health and Safety at the Workplace: actions in the HORECA sector Ms O'Brien (OSHA) gave an overview of the OSHA activities and particularly on the work done in the HORECA sector (see annexe ppt presentation). Ms Howald informed that EFFAT and HOTREC agreed to work on health and safety at work in housekeeping. They had asked OSHA whether anything had been done already on this issue, and whether a joint initiative could be taken. Ms O'Brienpresented OIRA, the Online Interactive Risk Assessment, which offers a tailor-made H&S tool for sectors She offered to provide a full picture of OIRA. It needs the commitment of European and national social partners, offers solutions for the workplaces, and also contains training elements. 4 of the success stories presented on the occasion of 15 years of sectoral social dialogue were about OIRA. EFFAT, HOTREC and OSHA agreed to look further into the possibilities offered by OIRA at the next SSDC Steering Committee meeting. Comment [MSOffice2]: To be added 8. European Skills, Competences/Qualifications and Occupations (ESCO) EFFAT and HOTREC are members of the ESCO Reference Group Hospitality and Tourism" (ESCO RG H&T). Ms Howald and Mr Couchman updated the members on the latest developments on ESCO, assisted by Mr Zarb, the Chair of the ESCO RG H&T. The European Commission wants to develop a new taxonomy. A first version will hopefully be ready next year. The work is not easy, the hospitality and tourism sector are not well advanced. Another meeting will take place in January The QSP skills list prepared by the EFFAT-HOTREC SSDC is part of this work. Mr Couchman however expressed his scepticism on what the final outcome will be and how ESCO will avoid overlapping between the sectors. 9. SAFE HOST Project on Combating Sexual Exploitation of Children in Tourism Mr Gugliemi (FILCAMS-CGIL) presented the results of the SAFE HOST project and made a demonstration of the interactive training toolbox. Further information on the project is available on the website 3
4 One of the objectives of this project is to raise public awareness on this topic. At the conference in Florence in May 2013, the scope of the phenomena and the profile of offenders and victims were shown, and interesting examples of initiatives and measures by various actors to fight the sexual exploitation of children in tourism were presented. Representatives from DG ENTR Tourism Unit expressed high interest in the project and were ready to follow up with European level actors. The SAFE HOST project was presented at the European Tourism Forum in Vilnius (17-18 October 2013). The launching event of the SAFE HOST toolbox took place in Brussels on 20 November HOTREC attended this Conference. Mr Couchman thanked Mr Gugliemi for his presentation and congratulated him. HOTREC is ready to take the project forward, e.g. by informing about it in the HOTREC Newsletter. Thanks to this project we now have a study with some background information available, as well as a very useful practical tool. We have to use it and many EU tourism associations are ready to support it. The support of the DG ENTR and DG HOME is needed as well. 10. Latest developments in social affairs, update by the Commission Ms Clement gave an overview of the state of play of the following dossiers (see annex ppt presentation): - the Commission s REFIT Communication - the Councils' decision on the European Social Partners Hairdressers agreement - the European Youth Employment Package and the last Commission's initiatives Mr Couchman informed that youth employment is actually discussed in the UK, especially on how to make sure that the funding can reach the local level and how to avoid the abuse of traineeships. There is also a massive raise of the number of apprentices in the UK, the time length of apprenticeship has to be at least one year, as otherwise time would not be long enough for a real crafts training. Mr Juyaux added that given the high number of young and mobile workers in the seasonal tourism sector, more employees should be trained during the inter-season period, in order to get them ready for the high season working period. More than 300 young workers already benefited from this system, and it could be a good tool to promote regional cross border mobility and to fight youth unemployment. Ms Howald informed that EFFAT has relaunched its activities on Young workers. Comment [MSOffice3]: To be added 11. Latest developments in tourism matters - Update by the Commission There was no representative from the DG ENTR to make an update this time, as the Head of Unit as well as the person in charge of the dossier have recently changed at the EC. They will be invited in the future, when more acknowledged with their files. Ms Howald informed about the information meeting organised by DG ENTR Tourism Unit on 2 December 2013 on the initiatives for the future of the tourism sector, and about two public consultations on European tourism policies that will soon be launched by DG ENTR: one on European tourism of the future, one on Regulatory and administrative framework on tourism businesses, public administrations, and other tourism stakeholders in the EU. 4
5 Ms Howald strongly criticised that employment and social affairs issues are subject of the consultation on the regulatory and administrative framework, and that they are dealt with from a purely negative perspective (the only assessment that can be given to all measures is: too costly, unnecessary, too restrictive, too excessive, too complex, lacks transparency or lacks protection). Martin Couchman agrees technically with Ms. Howald worries. Mr Couchman further pointed out that many of the questions raised in the consultations are difficult to respond for SMEs who are often not aware of the information requested by the Commission. 12. EFFAT-HOTREC Work Programme 2014 The Work Programme 2014 was formally adopted by the SSDC Plenary. Ms Howald stated that there are a lot of issues of common interest that the social partners want to address in the sectoral social dialogue committee HORECA. She expressed the need to make sure not to have such a heavy agenda at the 2014 plenary meeting. Mr Couchman supported this idea. 13.
