1 California a.gov/portal/hom e/dmv.htm If you are a visitor in California over 18 and have a valid driver license from your home state or country, you may drive in this state without getting a California driver license as long as your home state license remains valid. If you become a California resident, you must get a California driver license within 10 days. Residency is established by voting in a California election, paying resident tuition, filing for a homeowner s property tax exemption, or any other privilege or benefit not ordinarily extended to nonresidents. Limited Term Legal Presence: All original and pending driver license or identification cards will expire on the expiration date of his/her birth date and legal presence document (BD/LP) issued by the Department of Homeland Security (DHS). Your BD/LP document must have an expiration date 30 or more days from your application date. If your BD/LP document has an expiration date less than 30 days, you will not be able to start a driver license or identification card application. If your BD/LP document has an expiration date of less than 60 days, you may complete your licensing requirements (written/vision/driving tests), but you will need to submit another BD/LP document with an expiration date of 60 days or more before your driver license or identification card is mailed to you. Before your limited term driver license expires, the department will mail out an extension letter with instructions on how to complete your application for a driver license. If you are legally present in the US, but ineligible for an SSN, you are exempt from SSN requirements. However, you must still provide an acceptable birth date/legal presence document for any DL/ID card application OR provide a valid SSN. To apply for an original driver license if you are over 18, you will need to do the following: * Visit a DMV office (make an Appointment(s) for faster service) * Complete application form DL 44 (An original DL 44 form must be submitted. Copies will not be accepted.) * Give a thumb print * Have your picture taken * Provide your social security number. It will be verified with the Social Security Administration while you are in the office. * Verify your birth date and legal presence If your current name no longer matches the name on your birth data/legal presence document, see True Full Name and How to Change Your Name for more information. * Provide your true full name * Pay the application fee * Pass a vision exam * Pass a traffic laws and sign test. There are 36 questions on the test. You have three chances to pass. You may not have both, per Colorado Revised Statute Per DMV/DL policy , persons stating they have never been issued a Social Security Number will be required to present documentation indicating they have been denied a Social Security Number, they are not eligible for a number, or have never been issued a Social Security Number. So, if you have never been issued a Social Security Number, you must bring documentation showing that you do not have a number. You will also be required to provide proof of lawful presence. A Driver's License or ID card will not establish lawful presence. Beginning August 1, 2006, individuals who are age 18 years or older and are applying for a public benefit must establish lawful presence in the United States. This law does not apply to tax licenses or tax exemption certificates. Lawful presence is established by (1) submitting a signed affidavit and (2) providing certain types of identification. To be issued a Colorado Driver's License or Identification Card you must prove the following elements: * Your full legal name * Identity * Age * Lawful presence in the United States. Lawful presence is established by: 1. Affidavit: An individual age 18 years or older who is applying or reapplying for a state public benefit must submit an affidavit with the application. Applications that do not include the signed affidavit will be denied. 2. Identification * Certificate verifying naturalized status issued by an authorized agency of the US bearing Applicant's intact photograph impressed with the raised embossed seal of the issuing agency; * Certificate verifying US citizenship issued by an authorized agency of theus bearing Applicant's intact photograph impressed with the raised embossed seal of the issuing agency; * Valid driver's license or ID card bearing Applicant's photograph issued by one of the following (all states are not listed here; only those that verify lawful presence): AL, AZ, AR, CA, CN, DE, DC, FL, GA, ID, IN, IO, KS, KN, LA, MN, ME, MS, MO, MT, NV, NH, NJ, NY, ND, OH, OK, PN, RI, SC, SD, VA, WV, WY; * Valid immigration documents demonstrating Lawful Presence and verified through Systematic Alien Verification for Entitlements, administered by US Citizenship and Immigration Services of the Dept. of Homeland Security. Valid immigration documents are as follows: o Unexpired Foreign Passport bearing an unexpired "Processed for I 551" stamp or with an attached unexpired "Temporary I 551" visa. o Unexpired Foreign Passport accompanied by an "I 94" indicating a specific future "until" date. o "I 94" with refugee or asylum status. o Unexpired "Resident Alien" card, "Permanent Resident" card, "Temporary Resident" card, or "Employment Authorization" card. KRS requires all non U.S. citizens wishing to apply for a Kentucky driver's license or ID card to make application to a Division of Driver Licensing regional office. This excludes permanent residents. Once the Division of Driver Licensing approves the application, the license/id card will be issued from the Circuit Court Clerk's office in the county where the applicant resides. Non U.S. citizens with B1/B2 "Visitor" or WT status will not be approved for a Kentucky license or ID card. All non U.S. citizens may drive in the U.S. on their valid foreign license and International Permit for up to one year from the date of admission into the U.S. provided their home country is part of the Geneva Compact. Drivers from non Geneva Compact countries must obtain a Kentucky license within 30 days of establishing residency in Kentucky. A non U.S. citizen must present all of his or her BCIS documents to Driver Licensing personnel, such as Visa with I 94, Employment Authorization Card (I 688A or I688B or I 766) or I 94 with stamped picture. College students must also present an I 20 form completed by university, along with a letter from the Universities Registrars Office, stating enrolled full time and in good standing. J 1 exchange visitors must have form DS2019.Non U.S. citizens must also provide either a social security card, tax ID number or ineligibility letter from the Social Security Administration. All non U.S. citizens applying for a first time Kentucky license, with the exception of permanent residents, are required to take the written, vision and road tests. This includes transfer driver's holding a valid license from another state or country. Driver's holding a valid out of state license, or a valid license from a Geneva Compact country, will not be required to hold a permit. Non U.S. citizens already licensed in Kentucky are not required to retest but they must be approved by Division of Driver Licensing. If the Source Document presented does not include applicant's full name, and additional source document must be presented to reflect the applicant's full name. Photocopies, notarized copies, and documents with alterations or erasures will not be accepted. If any document is damaged, torn, overly worn, etc., the applicant may be required to obtain a replacement. * You must pass a vision test, knowledge test, and driving test. * An Out of Country license may be valid or expired. The license cannot be suspended. * If licensed for less than 18 months, you will be issued a Maryland Provisional License. * If you have never been licensed in the U.S., you must complete a 3 Hour Drug & Alcohol Education Program. * A valid U.S. Department of Transportation (DOT) physical card or federal/mva waiver (if applying for a Commercial Driver's License) is needed. * An Out of Country license may be required to be accompanied by an international driver's license or translated into English by an approved MVA translator. * If you are from Out of Country, and have never held a license, you must obtain a learner's permit. 3 Massachusettes gov/ rg/mamassachusetts/ap ply license.php#non Citizens If you have a valid driver license from your home country, you may legally drive in Massachusetts for up to one year. Although not required, it's a good idea to obtain an International Driver's Permit from your home country. That provides MA officials to see a translation of the information on your license. If you decide to establish residency in Massachusetts, you must apply for a driver license immediately. There is no grace period. In addition to providing proof of residency and a valid and current foreign passport, and either a SS # or Denial Notice issued by the SS Administration, you must provide 3 other forms of ID with at least one from the Primary ID list. All Primary ID must be original copies. * An Employment Authorization Card (I 688A, I 688B, I 766). * A U.S. Citizen Identification Card (I 179, I 197). * A record of departure in your passport (I 94). * A Certificate of Citizenship (N 560 or N 561). * A Non Resident Alien Canadian Border Crossing Card (I 185 or I 586). * A Temporary Resident Identification Card (I 688). * A Resident Alien Card (I 151, I 551, AR 2, AR 3). * A Certificate of Naturalization (N 550 or N 570). * A Permanent Resident Re Entry Permit (I 327). * A Refugee Travel Document (I 571). * A foreign passport with "Processed for I 551" stamp * Any document based upon decisions by the Department of State, Department of Justice, or the Department of Homeland Security that's specific to your situation. Secondary Forms of Identification * A canceled personal check that's not more than 60 days old and contains a preprinted address and your signature. * An original or certified copy of your foreign birth certificate. * A current or expired identification card (expired for less than 13 months) with your photo and signature that's been issued by a U.S. territory or possession, a Canadian province, or a state of Mexico or the Federal District of Mexico City. * A utility bill (not older than 60 days) that shows your name and address. * A current or expired (for not not more than 12 months) non U.S. driver's license. If it's not in English it must be submitted along with an International Driving Permit or some other acceptable form of translation. Minnesota ate.mn.us/dvs/ind ex.html With the exception of commercial drivers, you have 60 days after becoming a Minnesota resident in which to apply for your Minnesota driver s license or permit. If you have moved from a country other than the ones listed above, you must pass both the knowledge and road tests. As a new resident of Minnesota, you must present one primary and one secondary document at the time you apply for a Minnesota driver s license, ID card, or permit. The primary document must contain your full name and the month, day, and year of your birth. Any document not in English must be accompanied by a qualified English translation. The name on the Minnesota driver s license, identification card, or permit that is issued to you will be the name on the primary document or legal name change document that you present. If you are a temporary United States resident, you may need to show additional proof of your lawful admission period, such as a form I 20, DS 2019, I 797, or other official immigration document or receipt. If you are a foreign national applying for a first time license at a State field office, you must make an appointment. No exceptions. Walk in's will be referred to the website or told to call the MVD appointment line. To get a non commercial driver license, you will need to bring the following documents to any MVD Field Office: One (1) proof of identification number, and One (1) proof of identity, and Two (2) proofs of New Mexico residency. If you are not eligible for a social security number, you will need to bring the following documents to any MVD Field Office: One (1) proof of Identification number No SSN, and One (1) proof of identity No SSN, and Two (2) proofs of New Mexico residency At least one of the proof of identity or proof of identification number documents must also show your date of birth. You will be required to take the following tests: Eye Test, Written Test (Persons with a current out of country license are required to take the test), Road Test (Persons applying for a first time New Mexico driver license, or those with licenses expired over five years, must pass the required road test. This test is not required if you have a current out of state driver license.) The fee is $18.00 for a four year license or $34.00 for an eight year license. State law now requires a DWI records check on all drivers moving to New Mexico from out ofstate. To pay for the records check, those drivers are charged an additional one time $15.00 fee, increasing their total to $33.00 for a four year license or $49.00 for an eight year license. New York v.state.ny.us/ v.state.ny.us/licens e.htm A valid driver license from another country is also valid in NYS. You do not need to apply for a NYS driver license unless you become a resident of NYS. International Driving Permit: An International Driving Permit is not a driver license. The permit only verifies that you hold a valid driver license in your home country. Your foreign driver license, not the International Driving Permit, allows you to drive in NYS. Contact the authorities in your home country to get an International Driving Permit. If you are not a resident of the US, you cannot apply for an International Driving Permit in the US. You are not required to have an International Driving Permit to drive in NYS, but the permit has value. The permit verifies, in several languages, that you have a valid foreign driver license. A police officer who cannot read the language on your foreign driver license can read the permit. According to NYS law, a resident of another country can get a NYS driver license. The DMV does not recommend this because: * NYS recognizes your foreign driver license if you remain a resident of the nation that issued the license. You do not need to have a NYS driver license to drive in NYS unless you become a resident of NYS. * If you have a driver license from any nation except Canada, you must pass a written test, complete a 5 hour pre licensing course and pass a road test to qualify for a NYS driver license. * You must show a SS Card. If you are not eligible for a SS Card, you must provide a letter or form SSA L676 from the US SS Administration (SSA) that states that you are not eligible. The SSA Letter or form must have been issued no more than 30 days before the date of your application. You must also show the U.S. Citizenship and Immigration Services (USCIS) documents that the SSA used to determine that you are not eligible for a Social Security Card. The USCIS was formerly known as the Immigration and Naturalization Service (INS). Read the specific requirements on the identification requirements page. * When you receive your NYS driver license, you must surrender your foreign driver license to the DMV road test examiner. The local DMV office keeps your foreign driver license, and then destroys the license after 60 days. If you plan to return to your home country and use your foreign driver license, ask the road test examiner how to make sure that your foreign driver license is not destroyed. If you need to get your foreign driver license, go to the local DMV office where you applied for your NYS driver license.

5 Pennsylvania tate.pa.us/centers /licenseidcenter.s html A minimum of one year legal presence is required by Pennsylvania law. PennDOT determines the expiration date of products based on your length of stay documents (typically the I 94) along with information from the Department of Homeland Security (DHS). PennDOT verifies immigration documents electronically with DHS. This verification may not be able to be completed on the day of your visit and may require additional verification which can take up to 3 weeks to complete. All applicants must present the appropriate Department of Homeland Security (DHS), United States Citizenship and Immigration Services (USCIS), or other U.S. governmental documents which indicate their current status or applicant status. J 1 Exchange Visitor requirements: Passport I 94 Visa or other official evidence as determined by PennDOT Social Security Card, or letter from SSA indicating that SSA did not make a decision yet, or SSA rejection letter Written verification from employer showing proof of employment I 797 indicating that extension of status has been filed if stay documents are expired or about to expire (less than 6 months) IAP 66 or DS proofs of residency Note For proof of residency, Cellular/Mobile or Pager Bills are not acceptable. If you reside with someone, and have no bills in your name, you will still need to provide two proofs of residency. One proof is to bring the person with whom you reside along with their Driver's License or Photo ID to the Driver License Center. You will also need to provide a second proof of residency such as official mail (bank statement, tax notice, magazine, etc.) that has your name and address on it. The address must match that of the person with whom you reside. Washington a.gov/driverslicen se/ a.gov/driverslicen se/moving.html By law, you have 30 days to get your Washington driver license once you establish residency in Washington State. You are considered a resident when you do any of the following: * Arrive in Washington and begin establishing a home in the state. * Register to vote. * Receive state benefits. * Apply for any state license. * Seek in state tuition fees. If you have valid license from another country Germany and British Columbia are the only locations that have reciprocity agreements with Washington State. * If you have a valid German or British Columbia driver license, you may get a Washington State driver license by following the steps above for new residents with a valid license from another state. * If you have moved to Washington State from a country other than Germany or a Canadian province other than British Columbia, you must complete all the steps to getting your first license. If you are visiting Washington State from another country, you may use your out ofcountry driver license for up to 1 year. When you apply for a Washington State driver license, instruction permit, or identification (ID) card, you must: 1. show us proof of identity. 2. provide your Social Security number if you are applying for a driver license. 3. have your photograph taken. 6 Wisconson isconsin.gov/drive rs/drivers/apply/in dex.htm Visitors to Wisconsin (at least 16 years old) who do not plan to establish permanent residency, and members of the Armed Forces and their families living in Wisconsin but with permanent residence elsewhere, are not required to obtain a Wisconsin driver license. However, they must have a valid license from their home jurisdiction to operate a motor vehicle in Wisconsin. Visitors and students from out of the country who are in Wisconsin for more than twelve months and plan to operate a motor vehicle in Wisconsin, must obtain a Wisconsin license. Eligibility requirements are the same as those for a native Wisconsin resident. Foreign motorists from any of the countries who are party to the United Nations Convention on Road Traffic (Geneva, 1949) can drive legally using their valid domestic driver's license for a period not to exceed one year from date of arrival. They may drive either a personal or rental car. In addition to having a valid foreign driver's license, visitors are advised to carry an International Driving Permit obtained in their home country, as authorized by the 1943/1949 or 1968 conventions, or attach an English translation to their national driving license. It can be useful in emergencies, such as traffic violations or auto accidents, particularly when a foreign language is involved. Visitors from foreign countries must obtain their International Driving Permit in their native country prior to arrival in the U.S. List of countries part to the UN Convention on Road Trafffic: The Division of Motor Vehicles (DMV) issues a probationary license to new drivers, persons with a driver license from another country who pass the required tests. A probationary license is not an instruction permit or learner's permit. It is a valid driver license for operation within and outside of Wisconsin. Probationary licenses are issued to expire two years from the applicant's next birthday. The expiration date of a license for a non immigrant foreign visitor will depend on the applicant's length of authorized stay. Wisconsin residents OVER 18 years of age are eligible for a probationary driver license if they fulfill the following requirements: Proof of U.S. citizenship, legal permanent resident status, conditional resident status or temporary visitor status. Proof of name and date of birth Proof of identity Proof of Wisconsin resdiency Hold an Instruction permit ofr at least seven days (unless you hold a foreign driver license & have passed the knowledge test) Pass the driving skills test Pay the necessary fees
