RECOMMENDATION: Approve the use permit for a community service use, subject to the proposed conditions of the staff report, and with a County Board review in one (1) year (February 2020). ISSUES: This is a request for a new use permit for a culinary training and entrepreneurship center located at 3507 Columbia Pike, and no issues have been identified as of the date of this report. SUMMARY: The applicant is requesting to establish a culinary training and entrepreneurship center within the ground floor space of the mixed-use project known as Gilliam Place, located at 3507 Columbia Pike. La Cocina - Virginia (LCVA) is proposing to utilize approximately 4,800 square feet of the overall ground floor space as a café, open-environment office spaces, training kitchen, technology/training center, and a conference room. The proposed uses are collectively categorized in the Arlington County Zoning Ordinance as community service uses, County Manager: ##### County Attorney: ***** Staff: Anika Chowdhury, DCPHD, Planning Division Joanne Gabor, DES, Development Services Division 8.

2 will allow LCVA to expand the number of programs it currently offers including the addition of a small business development program, a catering service, and a public café. The proposed use is permitted in the Form Based Code (FBC) for ground floor spaces through a special exception use permit. Staff is recommending approval of the subject use permit, with a County Board review in one (1) year (February 2020). BACKGROUND: In December 2015, the County Board approved a Form Based Code (FBC) development application for a 6-story mixed-use building, consisting of 173 affordable apartment units and approximately 8,900 square feet of retail/civic uses. During this time, a FBC amendment was also approved to expand the list of uses considered appropriate when proposed within the ground story of mixed-use buildings subject to the Commercial FBC. Address/RPC: 3507 Columbia Pike / (RPC# and -016) Neighborhood: Zoning: Land Use: Approved Development: The site is located in the Alcova Heights Citizen s Association and adjacent to Douglas Park Civic Association, Arlington Heights Civic Association and Barcroft School & Civic League. The site is zoned CP-FBC, Columbia Pike Form Based Code District and C-2, Service Commercial-Community Business District. The site is designated on the General Land Use Plan (GLUP), as Semi- Public and Service Commercial. The site is approximately 56,761 sq. ft. and includes a new 6-story residential building with a 3-level underground parking garage. 5 DISCUSSION: La Cocina Virginia (LCVA), a nonprofit organization providing essential workforce and entrepreneurship services, proposes to occupy a portion of the available ground floor space located within the Gilliam Place project at the intersection of Columbia Pike and South Lincoln Street. LCVA s proposal represents a culinary training and entrepreneurship center consisting of a café, open offices, training kitchen, technology/training center, and a conference room. The proposed mix of uses would be supported by 12 on-site employees with access to commercial kitchen equipment including industrial ovens and stoves, refrigerators and freezers. The following details the proposed use and provides staff s assessment: PROPOSED USE: Type of Use: Location: Hours of Operation: A community service use consisting of a culinary training and entrepreneurship center, which will use a café, open offices, a training kitchen, a technology and training center, and a conference room. The use will be located on the ground floor of the Gilliam Place building. 6 a.m. to 10 p.m.; Monday through Friday 8 a.m. to 10 p.m.; Saturday through Sunday STAFF ASSESSMENT: Land Use and Zoning: The proposed culinary and entrepreneurship center is permitted via a special exception use permit as prescribed in the Form Based Code (FBC) and consistent with B. of the Zoning Ordinance use standards. The Arlington County Retail Plan designates Columbia Pike as a gold retail or retail-equivalent street type, which allows for more flexibility on retail and retail-equivalent uses, including civic and government uses. As the FBC supersedes the Retail Plan, the Plan aligns with the FBC classification of retail and retail-equivalent uses and will promote the FBC s vision to shape clear public space with a healthy array of uses including retail. The LCVA proposal does not include any alterations to the approved facades of the Gilliam Place project, will maintain transparency within the ground floor window spaces, and will help activate the Columbia Pike and S. Lincoln Street streetscapes, helping meet the intent of the FBC. The applicant has also agreed to condition language requiring compliance with the proposed hours of operation (as listed above) and to designate a community liaison for residents of the Gilliam Place building and the surrounding neighborhood. Vehicular Parking: The Gilliam Place project provides a total of 205 parking spaces within a below-grade parking structure. Of that total, 173 parking spaces are reserved for residents of the building, while 23 represent shared spaces for visitors. Per FBC regulations, an additional nine (9) shared spaces have been provided to meet the

6 minimum ratio of 1 space per 1,000 Gross Floor Area (GFA) required for all retail or civic uses found in the ground floor of this project. Bicycle Parking: For retail and most civic uses, the FBC specifies a minimum of one (Class 1) employee space per 25,000 square feet and one visitor space for every 5,000 square feet. This minimum requirement has been met as part of the original approval of the Gilliam Place project, where employee Class 1 spaces were provided within the parking structure and additional bike racks are located along the streetscape environment for visitor use. The number of bicycle spaces provided meet the minimum requirements and are supported by staff. Public Transit: The Gilliam Place project is accessible through various transportation options, including bus transit along both Columbia Pike and nearby Glebe Road. Buses serving the site originate and/or terminate at Metrorail stations. ART bus routes 41, 74 and 75 and Metrobus routes 16ACE, GH, L and Y service Columbia Pike in this area, while ART bus route 45 and Metrobus routes 22A, B and C service Glebe Road nearby. There is an abundant array of public transit options available for accessing the building, and therefore the proposed space will be able to accommodate the transportation requirements of its patrons. Loading: Loading and unloading of goods and supplies will occur at the Gilliam Place loading dock which is accessed from S. Lincoln Street using the building s rear alley. The original approval required two loading docks, one for the residential use and a separate dock for commercial uses. One loading berth will be suitable to handle the proposed deliveries to the space. Pick-up and drop-off of individuals attending classes will occur in the parking garage which shares the same access from S. Lincoln Street. Signage: The Gilliam Place project includes several residential and directional parking signs along the perimeter of the new structure. Additional signs serving the retail/civic uses located within the ground floor storefronts are permitted in the FBC and may include wall signs, blade signs, and window signs. The applicant has not finalized their sign plan and will continue to work with staff to ensure any proposed signs can be approved consistent with the provisions of the Zoning Ordinance. PUBLIC ENGAGEMENT: Level of Engagement: Communicate This level of engagement is appropriate because the proposed use is not anticipated to adversely impact the neighborhood. Outreach Methods:

7 Public notice was given in accordance with the Code of Virginia Notices of the County Board hearing on the use permit were placed in the January 29, 2019 and February 5, 2019 issues of the Washington Times for the February 23, 2019, County Board Meeting. In addition to the above legal requirements: Individual letters outlining the project description and public hearing details were mailed to surrounding property owners of the subject property. Placards were placed in various locations surrounding the subject property within seven (7) days of the public hearing. Civic associations were informed of the application via communication. The subject property is located within the Alcova Heights Citizen s Association and Columbia Pike Revitalization Organization and is adjacent to the Arlington Heights Civic Association, Barcroft School & Civic League, and the Douglas Park Civic Association. Community Feedback: Alcova Heights Citizens Association (AHCA): Staff reached out to AHCA for comment, but no response has been received as of the date of this report. Arlington Heights Civic Association (AHCA): Staff reached out to AHCA for comment, but no response has been received as of the date of this report. Barcroft School & Civic League: Staff contacted Barcroft and they are in support of the proposal. Columbia Pike Revitalization Organization: Staff contacted CPRO and they are in support of the proposal. Douglas Park Civic Association: Staff reached out to DPCA for comment, but no response has been received as of the date of this report. CONCLUSION: The proposed community service use is not anticipated to cause any adverse impacts on the surrounding community and will serve a growing necessity in the County for hands-on career and professional training, particularly in the Columbia Pike area. Staff also supports the proposed use permit, as it complies with the regulations of the CP-FBC and C-2 zoning districts and is located within close vicinity to transit options. With the conditions as proposed, the use is not anticipated to adversely affect the health or safety of persons residing or working in the neighborhood and will not be in conflict with the purposes of the ACZO and Columbia Pike Form-Based Code. Therefore, staff recommends that the County Board approve the use permit for a community service use intended for a culinary training and entrepreneurship

8 center, subject to the proposed conditions of the staff report, and with a County Board review in one (1) year (February 2020). Proposed Conditions: 1. The applicant agrees to comply, by way of illustration and not limitation, with all applicable requirements of County Ordinances and State statutes, including the laws and regulations enforced by Virginia State Code, and the Fire Marshal, the Police Department and the Virginia Alcohol Beverage Control Board (ABC). 2. The applicant agrees that the permitted hours of operation shall be from 6 a.m. to 10 p.m., Monday through Friday and from 8 a.m. to 10 p.m., Saturday through Sunday. 3. The applicant agrees to designate and make available a neighborhood liaison to communicate with nearby residents and neighbors to address concerns. The neighborhood liaison shall be available during the hours of the business operation to receive and respond to community concerns. The name, telephone number, and address (if applicable) shall be submitted to the Zoning Administrator and a copy sent to Gilliam Place building and the Alcova Heights Citizens Association prior to issuance of a Certificate of Occupancy. 4. The applicant agrees that any alterations or modifications to the permitted façade approved by the County Board on December 12, 2015, will be subject to further review by staff and shall only be permitted subject to the approval of an administrative change by the Zoning Administrator.
