2 Information pursuant to operative paragraph 10 (a) of the General Assembly Resolution concerning violations of protection, safety and security of the Embassy of Ukraine in the Russian Federation for During the period of systematic pickets (more than 15 cases) involving up to 400 people took place near the Embassy of Ukraine in the Russian Federation. Participants of such unauthorised actions used posters with anti-ukrainian propaganda, distributed agitation newspapers in support of restoration of the USSR's borders, conducted unauthorized filming including by using a quadcopter, etc. These actions created pressure on Ukrainian diplomats and their family members and impede the proper functioning of the diplomatic Mission. There were no actions taken by the Russian Federation law enforcement agencies in this regard.

3 Information pursuant to operative paragraph 10 (b) of the General Assembly Resolution concerning the measures taken by the Ukrainian authorities in relation to data contains in the document A/711130/Add.l (information received, subsequent to the submission of the main report, from the Russian Federation in response to the request contained in paragraph 10 of the General Assembly Resolution 69/121). 1. On 22 February 2014, extremists armed with clubs stopped a vehicle of the Embassy of the Russian Federation in Ukraine as it was leaving the Kyiv Pechersk monastery and demanded that it undergo an "inspection". Two deputies of the Verkhovna Rada of Ukraine took part in the search. The case was registered in the Unified Crime & Offence Registry and proper review was done. On the results of the investigation no elements of criminal offense in the mentioned facts were established, in this connection the information into the Unified Registry of Pre-trial Proceedings was not entered. 2. On 19 March 2014, in Kharkiv, the Consulate General of the Russian Federation received threats of an attack against the building and reprisals against its employees. The heads of the local law enforcement agencies were informed of those threats. They did not react in an appropriate manner. The case was registered in the Unified Crime & Offence Registry and proper review was done. As the result of the investigation, no elements of criminal offense in the mentioned facts were established, and this information was not entered into the Unified Registry of Pre-trial Proceedings. 3. During the night of April2014, in Chernihiv, a group of unknown persons threw stones at the entrance at the premises ofthe Honorary Consulate of the Russian Federation. The nameplate of the Consulate was torn down and appropriated and leaflets with offensive content were posted. Damage was caused to Consulate property. The decision was made to close the criminal proceeding in accordance with Paragraph 2 of Part 1 of Article 284 of the Code of Criminal Procedure of Ukraine due to the absence of the elements of criminal offense. 4. On 14 June 2014, the Embassy in Kyiv was attacked by extremists. Firecrackers, smoke bombs, stones and bottles of green antiseptic were thrown at the building and all the windows were damaged. The demonstrators tore down the Russian flag from the flagpole on the territory of the diplomatic mission. All the vehicles with diplomatic license plates that were parked near the building were overturned and their wheels were removed. With the assistance of an officer of the Ukrainian security service, four of the assailants and four representatives of the Ukrainian media entered the Embassy and handed over a written communication to the Russian authorities. The police did absolutely nothing. The Russian side demanded that the Ukrainian side take all measures necessary to ensure the security of Russian diplomats in Kyiv. The fact of acts of hooliganism was registered under No in the Unified Crime & Offence Registry of Solomyanskyi District Administration of the Directorate general of the Ministry of Internal Affairs of Ukraine in Kyiv. The decision was made to enter the information on criminal offense under No I 08 into the Unified Registry of Pre-trial Proceedings dated June 14, 2014 in accordance with Part 2 of Article 296 of the Criminal Code of Ukraine.

4 5. On 16 June 2014, in Odessa, some 100 people staged a demonstration near the building of the Consulate General demanding the removal of the Russian national flag. The Vice Governor of the Odessa region, Zoya Kazanzhi, was spotted among the demonstrators. The police arrested four participants in the demonstration who had started a fight. Explosives and knives were found in their possession. Several people were wounded in the clashes. The Ministry off oreign Affairs of the Russian Federation called upon the Ukrainian side to abide strictly by the provisions of the Vienna Convention on Diplomatic Relations and other international agreements for the protection of diplomatic missions and demanded that all measures necessary are taken to ensure the security of the Embassy and of the Consulates General in Odessa, Kharkiv and L'viv and to facilitate the normal work of the missions. Four criminal proceedings were opened and qualified in accordance with Part 2 of Article 296 (Hooliganism), Part 2 of Article (Illegal manufacturing, modification or repair of firearms or forgery, illegal removal or altering of markings, or illegal manufacturing of ammunition, explosive devices), Part 2 of Article 28 (commitment of crime by a group of persons, a group of persons by prior conspiracy, an organized group or a criminal organization), Part 1 of Article 263 (Unlawful handling of weapons, ammunition or explosives) and Part 2 of Article 15 (Criminal attempt), Part 2 of Article 258 (Ierrorist Act) of the Criminal Code of Ukraine. 6. On 22 June 2014, in Kyiv, some 50 people rioted near the consular section of the Embassy. They attempted to break through the police section and threw stones at the Embassy building. The case was registered in the Unified Crime & Offence Registry and proper review was done. On the results of the investigation no elements of criminal offense in the mentioned facts were established, in this connection the information into the Unified Registry of Pre-trial Proceedings was not entered 7. On 9 July 2014, an unknown man threatened over the telephone to blow up the Consulate General in Kharkiv unless N. Savchenko, a Ukrainian national who had been detained in the territory of the Russian Federation and was accused of involvement in the murder of Russian journalists, was released. The decision was made to close the criminal proceeding in accordance with Paragraph 2 of Part 1 of Article 284 of the Code of Criminal Procedure of Ukraine due to the absence of the elements of criminal offense. 8. On 22 August 2014, in Kyiv, unknown persons painted the fence around the Embassy building in the colours of the Ukrainian national flag. The fact of unlawful actions was registered under No in the Unified Crime & Offence Registry of Solomyanskyi District Administration of the Directorate general of the Ministry of Internal Affairs of Ukraine in Kyiv. The notice hereof was considered in accordance with the requirements of the Law of Ukraine "On Citizens' Appeals" and the materials were added to the case No dated September 12, On 28 August 2014, in Kharkiv, a group of masked persons threw smoke bombs and firecrackers against the premises of the Consulate General. The local authorities did not react in any way to the incident. The case was registered in the Unified Crime & Offence Registry and proper investigation was done. On the results of the investigation no elements of criminal offense in the mentioned

5 facts were established, in this connection the information into the Unified Registry ofpre-trial Proceedings was not entered. 10. On 28 August 2014, in Kyiv, two employees of the Embassy, including the Ambassador's bodyguard, were detained, regardless of having shown their diplomatic passports. On 11 June 2015, in Kharkiv, during the Russia Day reception, the Consulate General was attacked. No action was taken by the Ukrainian law enforcement agencies. Some 80 members of the Obshchestvennaya strazha ("Community guard") organization and associated movements threw eggs and bags of flour and green antiseptic against the Consulate building. The emblem of the Russian Federation was violated and the building sustained significant damage. The radicals shouted aggressive nationalist slogans and threw various objects, including stones, at the attendees. Police officers were stationed around the perimeter of the building but took no action to calm the radicals. The Ministry of Foreign Affairs of the Russian Federation demanded that the Ukrainian side investigate the incident, find and punish the participants and instigators of the provocations and provide compensation for the damage caused. Kyiv Police Department of the Directorate General of the National Police of Ukraine in Kharkiv region conducts pre-trial investigation in accordance with Part 2 of Article 296 of the Code ofcriminal Procedure ofukraine. 11. On 12 June 2015, in L'viv, during a reception on the occasion of Russia Day in the Consulate General, dozens of activists from the Varta-1, Rabov v rai ne puskayut ("No slaves allowed in paradise") and Samooborona Maidana ("Maidan self-defence") organizations picketed the building. The picketers blocked the entry to and exit from the territory of the Consulate General with four vehicles and tore down a plate with the inscription "Consulate General of Russia in L'viv", which they later threw over the fence into the territory of the Consulate General. Red and black flags of the Ukrainian nationalists, Ukrainian national flags and posters with the names of the above-mentioned organizations were placed on the fence of the Consulate General. The case was registered in the Unified Crime & Offence Registry and proper investigation was done. On the results of the investigation no elements of criminal offense in the mentioned facts were established, in this connection the information into the Unified Registry of Pre-trial Proceedings was not entered. 12. On 6 March 2016, in Kyiv, the Embassy was attacked. During the night of 5-6 March, an organized group of persons wearing camouflage and masks, armed with baseball bats, approached the back door of the Embassy, threw firecrackers and smoke bombs into the territory and damaged three Embassy vehicles with diplomatic license plates that were parked nearby. During a demonstration near the Embassy that was held on 6 March, two people in camouflage broke into the territory of the Embassy and, approaching the main entrance, broke several windows and video cameras. The demonstrators threw paint and eggs at the Embassy building. The fact of acts of hooliganism was registered under No in the Unified Crime & Offence Registry of Solomyanskyi District Police Administration of the Directorate General of the National Police of Ukraine in Kyiv. The decision was made to enter the information on criminal offense under No to the Unified Registry of Pre-trial Proceedings dated March 6, 2016 in accordance with Part 2 of Article 296 ofthe Criminal Code ofukraine.

6 13. On 9 March 2016, in L'viv, a group of radicals headed by V. Parasyuk, a deputy of the Verkhovna Rada of Ukraine, who were picketing the Consulate General and demanding the release of the Ukrainian national N. Savchenko, attempted to break into the territory of the Consulate General. The entry gates were damaged and the radicals threw eggs and smoke bombs into the territory of the Consulate General. V. Parasyuk broke into the territory of the Consulate General and tore down the Russian flag from the flagpole. He took it out of the territory and gave it to the protesters, who trampled on and burned it. Lychakivsk Police Department of the Directorate General of the National Police of Ukraine in Lviv region conducts pre-trial investigation in accordance with Part 2 of Article 338 (Outrage against state symbols) ofthe Criminal Code ofukraine. 14. During the night of 9-10 March 2016, three radicals attempted to set fire to the Embassy building by pelting it with petrol bombs. Several burning bottles fell into the territory of the diplomatic mission. All three persons were detained and taken to a police precinct, where they were questioned and then released. A criminal case was subsequently opened concerning the incident under articles 15 and 194 (attempt to inflict deliberate damage to property) of the Criminal Code of Ukraine. The fact of acts of hooliganism was registered under No in the Unified Crime & Offence Registry of Solomyanskyi District Police Administration of the Directorate General of the National Police of Ukraine in Kyiv. The decision was made to enter the information on criminal offense under No to the Unified Registry of Pre-trial Proceedings dated March 10, 2016 in accordance with Part 2 of Article 296 of the Criminal Code of Ukraine. 15. On 11 March 2016, the Ministry of Foreign Affairs of the Russian Federation sent the following note to the Ukrainian side: Recently, Russian diplomatic and consular missions in Ukraine have been attacked by organized and trained militants belonging to Ukrainian nationalist groups. Their actions have been encouraged, and sometimes even led, by deputies of the Verkhovna Rada and Ukrainian political and public figures, which clearly proves that these provocations were planned. As in the past, the personnel of Ukraine's law enforcement agencies did not react appropriately to the antics of the extremists. It is particularly outrageous that V. Parasyuk, a deputy of the Verkhovna Rada, opted to violate the Russian national flag after it had been removed from the flagpole in front of the Consulate General of the Russian Federation in L'viv. Russian diplomatic and consular missions have sustained serious damage and the lives and safety of their employees have been put at risk. The Russian side demands that the Ukrainian side prosecute and pw1ish all persons who were involved in those illegal actions. The Russian side expects that, in the future, the Ukrainian authorities and law enforcement agencies will ensure all conditions necessary for the fulfilment of Ukraine's international obligations in compliance with the provisions of the Vienna Convention on Diplomatic Relations concerning the special duty of the receiving State to "take all appropriate steps to protect the premises of the mission against any intrusion or damage and to prevent any disturbance of the peace of the mission or impairment of its dignity". The Ukrainian side bears full responsibility for any provocations against Russian diplomatic and consular missions in Ukraine and all adverse consequences. On 10 June 2016, in Odessa, some 50 representatives of the Pravy sektor ("Right sector") and Azov civil corps blocked the Consulate General, where a gala reception to celebrate Russia

7 Day was to be held. Eggs and potatoes were thrown into the territ01y of the Consulate General. The police did not intervene. The case was registered in the Unified Crime & Offence Registry and proper investigation was done. On the results of the investigation no elements of criminal offense in the mentioned facts were established, in this connection the information into the Unified Registry of Pre-trial Proceedings was not entered 16. Dw ing the night of September 2016, the Embassy of the Russian Federation in Kyiv was shelled by pyrotechnic devices by a group of up to 20 unknown persons. The assault lasted for several minutes, after which the delinquents left the scene. A video of the assault was posted on social media. No Embassy employee was injured and the building sustained slight damage (traces of soot from the explosions of the firecrackers), which was assessed at $1,000 by the engineering service of the diplomatic mission. At approximately 1 a.m. on 17 September 2016, a police patrol unit arrived at the Embassy, conducted a cursory examination of the area from which the shelling had originated and left eight minutes later. At 6 a.m., an investigative unit of the Kyiv police arrived at the Embassy and removed the remaining elements of the firing devices from the scene. To date, the Ukrainian law enforcement agencies have not taken any action to identify and detain the persons involved in the incident. The fact of acts of hooliganism, was registered under No in the Unified Crime & Offence Registry of Solomyanskyi District Police Administration of the Directorate General of the National Police of Ukraine in Kyiv. The decision was made to enter the information on criminal offense under No to the Un~fied Registry of Pre-trial Proceedings dated September 17, 2016 in accordance with Part 2 of Article 296 of the Criminal Code of Ukraine.
