2 The purpose of this document is: (1) to finalize the consolidation of the legal acquis for Business Based Social Statistics and (2) to start collecting views on possible amendments. 1. BACKGROUND Eurostat collects a number of Business Based Social Statistics ( BBSS ) that are based on business surveys but belong to the social statistics domain (ESTAT.F) for functional (e.g. quality checks, joint analyses of labour supply/demand) and historical reasons. They include: Tabular data for Quarterly Job Vacancy Statistics ( JVS ), Quarterly Labour Cost Index ( LCI ) and 4 yearly Labour Cost Survey ( LCS ); Micro data for the 4 yearly Structure of Earnings Survey ( SES ) and for the 5 yearly Continuing Vocational Training Survey ( CVTS ). In accordance with the Vision for the next decade 1, Eurostat has engaged in a general revision of the existing legislation in statistics with a view to organize the legal corpus around the 2 main pillars of European statistics, namely data collected from businesses versus households/individuals. This translated into two broad legislative projects namely: the Framework Regulation Integrating Business Statistics ( FRIBS ) and the draft regulation on statistics relating to persons and households - Integrated European Social Statistics ( IESS ). At the Business Statistics Directors Group (BSDG) meeting of May 2015, it was decided to integrate BBSS statistics with the second stage of FRIBS. The main reason was to avoid slowing down the FRIBS 1 process by the integration of additional datasets. 2. SCOPE OF THE BBSS LEGISLATION As a first step to prepare the integration of the corresponding BBSS legislation under an overarching (FRIBS) Framework Regulation, it is useful to take stock of all original acts and amendments that have been adopted in the field since 1999, as listed in Annex. 1 Commission Communication (COM(2009) 404) on the production method of EU statistics: a vision for the next decade

4 The decision to integrate BBSS statistics in FRIBS 2 means that the current legal framework will continue to apply to the domains of SES, LCS, LCI, JVS and CVTS for at least five years. In between, it allows launching an in-depth reflection on the long term future of these statistics, starting by a consolidation of the acquis and also discussing changes in substance. In the long term, given the integration into FRIBS 2, the sectoral CC/EP-CC regulations will disappear and the main elements having an impact on the costs of these statistical data collections will be integrated in the FRIBS 2 framework regulation. It is too early to say how this general framework will be complemented by more specific acts regarding the data and metadata to be transmitted for each domain. However, to prepare for this discussion, the existing pieces of legislation have been grouped into technical packages, one for each domain. The LAMAS-LMI meeting of January 2016 agreed on all packages except for CVTS which is now provided for completeness (see: Doc 54 - Annex 5 - CVTS.docx). The ETS Working Group is being consulted in parallel on this last package. The other packages are also annexed for convenience (see: Doc 54 - Annex 1 - JVS.docx, Doc 54 - Annex 2 - LCI.docx, Doc 54 - Annex 3 - SES.docx, Doc 54 - Annex 4 - LCS.docx) including the (minor) changes agreed at the LAMAS of January. 3. ELEMENTS OF THE REVIEW Beyond the mere consolidation of the legal acquis, the FRIBS review gives an opportunity to make amendments to the substance of the EU legislation in the BBSS field. At the LAMAS-LMI meeting of January 2016, is was agreed to start a reflection on the improvements that could be included in the future legal basis for BBSS statistics in order to meet users needs even better. This work should cover all aspects of the existing regulations namely requirements for: (1) frequency ; (2) timeliness ; (3) breakdowns ; (4) the list of variables ; (5) statistical units ; (6) precision requirements and (7) quality reporting. As regards the list of variables, only marginal changes could be envisaged as the costs on respondents should not increase. This implies that any addition of a variable should be compensated by the withdrawal of another one. 3

FIRST IDEAS As a starting point, it is useful to summarize in one table the main features of the current BBSS requirements as regards the following items: frequency, timeliness, scope, breakdowns, statistical units and precision requirements (see table, next page). The amendments in BBSS legislation will depend to a large extent on the results of the users survey. Moreover, a definitive list of amendments cannot be drawn until a clear timeline is given as regards the 2 nd stage of FRIBS. However, a first list of topics can be drawn already based on previous feedback received from institutional users, as follows: - SES/LCS: Extending the coverage to NACE section O and/or enterprises with 1-9 employees; - SES: timeliness to be moved ahead from t+18 months to t+12 months. Make the transmission of annual Gender Pay Gap data (GPG) compulsory and aligned with the 4- yearly SES benchmarks. Clarify the statistical unit to be used (local unit?); - LCS: NUTS I data to be collected at NACE section level instead of NACE-2 digits (division). Clarify the statistical unit to be used (local unit?); - CVTS: reconsider the frequency against the new periodicity (6 years) for AES (Adult Education Survey). Refer to employees instead of persons employed for better integration with BBSS; - LCI: Harmonize statistical units across countries. Moving the deadline ahead from t+70 to t+60 days as already the case for Real Unit Labour Cost data transmitted in National Accounts. Collecting, on a mandatory basis, quarterly data on the number of hours worked as a proxy for GDP growth in volume. Quarterly data on labour costs, labour costs excluding bonuses as well as wages and salaries would be collected on an optional basis, with a view to check LCI data against components, with no reference needed in EU legislation. - JVS: Harmonize statistical units across countries. Extending the coverage to enterprises with 1-9 employees and to the public sector 2, at least through quarterly extrapolations based on annual benchmarks. Quarterly data by region (NUTS I) and occupation (ISCO1) would be collected as optional variables, further to the possible phasing out of the annual data collection, with no reference needed in EU legislation. Other suggestions from LAMAS-LMI members would be welcome. 2 This is not yet the case for all Member States: in France and Italy, only business units with 10 employees or more are surveyed. Moreover, in the case of public administration, education and human health (NACE Rev. 2 sections O, P and Q), public institutions are not covered. In Malta, only units with 10 employees or more are surveyed. In Denmark, only units within the business economy (NACE Rev 2 sections B to N) are surveyed. 4

For clarity and consistency with other BBSS, it is intended to use employees in the consolidated BBSS legislation.

7 5. NEXT STEPS Given that BBSS legislation will not be revised before the 2 nd stage of FRIBS, there is no possibility to amend the legal framework in the short to medium-term. However, it is important to agree on a clear and exhaustive view of the legal acquis in this field before entering into discussions on future amendments. This is the aim of this document and its 5 accompanying packages which could be approved by LAMAS and ETS delegates before the end of this year. As a second step, it is proposed to launch an informal consultation of the main institutional users and NSIs as regards possible improvements in the BBSS legal acquis. This could be done through an online EU survey to be launched in the course of The consultation would cover all aspects of the BBSS data collections, namely: (1) frequency; (2) timeliness; (3) breakdowns; (4) the list of variables; (5) statistical units; (6) precision requirements and (7) quality reporting. However, all proposals made should keep the overall response burden unchanged. This implies in particular that any suggestion for adding variables should be accompanied by proposals to withdraw others. Likewise, increases in frequency for a data collection should go along with suggestions to decrease it in other BBSS fields. 6. PROPOSAL The LAMAS-LMI is invited: - To take note of the inclusion of the CVTS package under the BBSS review; - To make suggestions as regards possible changes in BBSS requirements; - To agree on launching, in the course of 2017, an informal consultation of the main institutional users and NSIs on BBSS requirements.
