PURPOSE OF THIS DOCUMENT This document presents the draft Commission Regulation adopting the programme of LFS adhoc modules, covering the years 2019 to 2021, for the labour force sample survey provided for by Council Regulation (EC) No 577/98, as well as the corresponding annex. DSS members are invited to share views and to comment on the draft delegated act which is planned to be discussed in the dedicated delegated act meeting to take place side-by-side to the European Statistical System Committee of May BACKGROUND The framework regulation on Integrated European Social Statistics (IESS) is currently under discussion. It is planned that this regulation is adopted in 2017/2018. In this case, the Council Regulation (EC) No 577/98 on the organisation of a labour force sample survey will be repealed, including its Article 4(2) on the further set of variables, referred to as the ad-hoc modules. The information to be collected quarterly, annually, biennially and also every 8 years will be specified under the IESS regulation. Given that the adoption date of the IESS regulation and that the first year of implementation of this new regulation remain uncertain at this stage, it is necessary to work in parallel under the assumption that the LFS basic act No 577/98 will remain valid in setting the obligation to have a next multiannual programme for the ad-hoc modules. This ad-hoc module programme, covering three years, will correspond to years 2019 to In accordance with Regulation (EU) No 545/2014 of the European Parliament and of the Council of 15 May 2014 amending Council Regulation (EC) No 577/98 on the organisation of a labour force sample survey in the Community, the adoption of the Programme of ad-hoc modules 2019 to 2021 should occur by the end of 2016, 'not later than 24 months before the beginning of the reference period of the programme'. The programme of LFS ad-hoc modules was discussed by the Labour Market Statistics Working Group (LAMAS) at the June 2014, December 2014 and December 2015 meetings. The final proposal endorsed by the LAMAS is the following: Ad-hoc module 2019: Work organisation and working time arrangements, Ad-hoc module 2020: Accidents at work and other work-related health problems, Ad-hoc module 2021: Labour situation of migrants and their immediate descendants. This proposal is in line with the needs of the key policy users. 3. POLICY NEEDS Eurostat launched a consultation to key users on the topics for modules 2019 to 2021 in April Several users among the Directorates Generals of the European Commission namely, DG EMPL, DG HOME, DG JUST, DG ECFIN submitted proposals for the programme 2019 to A total of five topics were proposed by these four DGs, all of them already implemented as ad hoc modules in the past (see the table hereafter). Eurostat analysed the related policies and their timetable and tried to satisfy the requirements of as many DGs as possible. 2

Each country was nevertheless free to collect these data for national purposes, according to the specifications of the module developed by the ESS. Following in-depth discussions between Eurostat and the main data user, DG EMPL, it has been decided that the module on 'work organisation and working time arrangements' will have priority for the programme. The Commission DGs expect this module to be used in the context of the EU Working Time Directive. There is a need for a comprehensive and comparable set of data on work organisation and working time arrangements, as well as a need for more detailed data on labour market participation, in order to monitor progress towards the common objectives of the Europe 2020 Strategy. Moreover, in the context of the ongoing debate on flexicurity and the expressed need for greater adaptability of both enterprises and workers in Europe, a key issue highlighted in the European Employment Strategy and the Employment Guidelines, it is necessary to have data from a large-scale European survey on the extent of application of various forms of new work organisation practices and working time arrangements as well as workers experiences with these Accidents at work and other work-related health problems A module on occupational health and safety (accidents at work and work-related health problems) is justified on two grounds. First, the Commission has to report at regular intervals on the implementation of the EU OSH (Occupational Safety and Health) legislation pursuant to Article 17a of the Council Directive of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work. Secondly, this ad-hoc module should also feed into the evaluation of the future EU strategic framework for health and safety at work. 3

4 A new ad-hoc module on accidents at work and work-related health problems, similar to the one conducted in 2007 and 2013, will provide considerable value added to the information obtainable from other sources such as the European Statistics on Accidents at Work (ESAW). It will allow, in particular, to compare accident data from administrative sources (ESAW) with the situation of persons on the labour market, and to collect data on work-related health problems. Moreover, it will provide information on occupational exposure to risk factors for physical health and mental well-being Labour situation of migrants and their immediate descendants The labour situation of first and second generation of migrants is high on the political agenda and it is clear that an ad-hoc module on migrants has gained increased policy relevance in the pan-european labour market context. Previous modules on migration have been fielded in 2008 and in Hence, a repetition in 2021 would follow the pattern of fielding this module every 6/7 years. These data aim to inform on recent policy developments about the socio-economic integration of migrants. They are used to provide evidence and put emphasis on migrants' integration in a wider political process, such as the European Semester of the EU2020 Strategy. Indeed, the Commission acknowledged the need for enhancing the economic, social and cultural benefits of migration in Europe and for achieving migrants full participation in all aspects of collective life. The Employment Guidelines adopted by Council Decision 2008/618/EC call for particular attention to be paid to significantly reducing the employment gaps for people at a disadvantage, including the gap between third country nationals and EU citizens. 4. DEVELOPMENT OF THE MULTIANNUAL PROGRAMME A two-step approach was adopted for the development of the multiannual programme covering the years The sub-modules for the ad-hoc modules 2019 were discussed and agreed during the December 2014 LAMAS meeting, while discussion occurred and agreement was reached for the sub-modules of the ad-hoc modules 2020 and 2021 in the December 2015 LAMAS meeting. The draft text of the delegated act was also endorsed by LAMAS during its December 2015 meeting. This current version reflects the technical comments and proposals received from the LAMAS. The programme annexed to this document also establishes, as this was done in the past for the multiannual programme of ad-hoc modules , the deadline for the definition of the list of variables, the reference period, the Member States and regions concerned, the sample (representativeness and completeness) and the deadline for the transmission of the results. Each module must be further specified in a separate legal act, in particular regarding the list of variables. 5. TIMETABLE As a follow-up to the discussion by the DSS, the draft delegated act will be on the agenda of the dedicated delegated act meeting to take place side-by-side to the European Statistical System Committee of May

6 ANNEX: DRAFT DELEGATED ACT COMMISSION REGULATION (EU) No /.. of XXX adopting the programme of ad-hoc modules, covering the years 2019 to 2021, for the labour force sample survey provided for by Council Regulation (EC) No 577/98 (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Council Regulation (EC) No 577/98 of 9 March 1998 on the organisation of a labour force sample survey in the Community 1, and in particular Article 4(2) thereof, Whereas: (1) In accordance with Regulation (EC) No 577/98, it is necessary to specify the elements of the programme of ad-hoc modules covering the years 2019 to (2) There is a need for a comprehensive and comparable set of data on work organisation and working time arrangements, as well as a need for more detailed data on labour market participation, in order to monitor progress towards the common objectives of the Europe 2020 Strategy. 7 (5) The Commission adapted the policy framework on migration as part of a renewed 'Global Approach to Migration and Mobility' 3 and acknowledged the need for enhancing the economic, social and cultural benefits of migration in Europe and for achieving migrants full participation in all aspects of collective life 4. The Employment Guidelines adopted by Council Decision 2008/618/EC 5, which are an integral part of the Integrated Guidelines Package, which is designed to spur growth and jobs in Europe as part of the relaunched Lisbon Strategy, call for particular attention to be paid to significantly reducing the employment gaps for people at a disadvantage, including the gap between third country nationals and EU citizens. HAS ADOPTED THIS REGULATION: Article 1 The programme of ad-hoc modules for the labour force sample survey, covering the years 2019 to 2021, as set out in the Annex, is hereby adopted. Article 2 This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union. This Regulation shall be binding in its entirety and directly applicable in all Member States. 8 ANNEX LABOUR FORCE SURVEY Multiannual programme of ad-hoc modules Reference period: 2019 WORK ORGANISATION AND WORKING TIME ARRANGEMENTS Sub-modules (areas on which more detailed information is to be provided): Sub-module 1: Flexibility of working times Aim: to provide more detail on how the worker can decide on his working time and his absences, but also the frequency of the situations when the worker is required to change working time. Sub-module 2: Methods at work Aim: to collect information on the work environment from the time pressure, control and autonomy perspectives. Sub-module 3: Place of work Aim: to provide more detail on the place of work, as well as on the commuting time expressed as time to get from home to work. List of variables: to be defined before December Member States and regions concerned: All. Sample: the ad-hoc module sample should fulfil the requirements of Annex I, point 4, to Commission Regulation (EC) No 377/2008, i.e. the sample used to collect information on adhoc modules must also provide information on structural variables. Transmission of the results: before 31 March ACCIDENTS AT WORK AND OTHER WORK-RELATED HEALTH PROBLEMS Reference period: 2020 Sub-modules (areas on which more detailed information is to be provided): Sub-module 1: Accidents at work Aim: to identify accidents at work resulting in injuries, their type and their impact in terms of work days lost or disability. Sub-module 2: Work-related health problems Aim: to identify physical or mental health problems caused or made worse by work, their type and their impact in terms of work days lost or disability. Sub-module 3: Risk factors for the physical health and/or the mental well-being Aim: to analyse whether workers are exposed to risk factors that can affect their physical and/or mental health. List of variables: to be defined before December

Sub-module 2: Language skills Aim: to collect information about the language skills of the migrants. Sub-module 3: Obstacles and support to labour market participation Aim: to capture information on obstacles to labour market participation and on individual approaches to finding work.
