2 CITY OF MEXICO, MISSOURI CITY COUNCIL MEETING MINUTES MARCH 26, 2018 The Council of the City of Mexico, Missouri met in work session on March 26, 2018 at 6:00 p.m. in the Council Chambers of City Hall, with the following members present: Mayor Chris Miller; Council Member Ron Loesch; Council Member Dr. Ayanna Shivers. Also present were Bruce Slagle, City Manager; Roger Haynes, Deputy City Manager; Russell Runge, Assistant City Manager/Economic Development; Kensey Russell, Public Works Director; Rita Jackson, Community Development Director; Chad Shoemaker, Parks & Recreation Director; Chief Susan Rockett, Public Safety Department; Drew Williford, City Civil Engineer; Patrick Shaw, IT Specialist; Lou Leonatti, City Attorney; Marcy LeCount, City Clerk; as well as members of the media and interested citizens. Absent, Council Member Steve Nichols; Chairman Pro Tem Chris Williams. The Meeting was called to order with Mayor Miller presiding. COUNCIL DISCUSSION DEPARTMENT OF COMMUNITY DEVELOPMENT DEPARTMENT UPDATE City Manager Slagle called upon Director Jackson to provide the annual department update. Director Jackson provided an update of the Community Development Department s programs and responsibilities. Director Jackson provided an overview of the divisions within the department. Director Jackson reported on Building Code; Code Enforcement; Mexico Animal Shelter; Demolition Program; and Building & Grounds Maintenance. Director Jackson also reported on programs that are offered through the department, e.g. backflow valve program, sidewalk replacement program, demolition program and the household hazardous waste collection facility. Director Jackson also provided an overview of the various boards and commissions that are a part of the department. Mayor Miller and Director Jackson spoke on storage units that were recently denied by the Planning & Zoning Commission. Discussion was held by Council Members, Director Jackson and City Manager Slagle regarding City Code regulations on the placement of storage units. OTHER BUSINESS CONSIDERATION OF FUTURE DISCUSSION ITEMS City Manager Slagle stated that the April Work Session will cover the renewal of the Capital Improvement Sales Tax (CIST) and a timeframe. The current CIST is to sunset on June 30, 2020 and Council will need to allow a year between votes, should it fail on the first try, and the vote will need to be taken 18 months prior to the sunset. This would allow the CIST to be put on the ballot this year or early next year. The current CIST is ½ cent and is used for the improvements to streets, stormwater and other projects that would not otherwise be funded. PROJECT UPDATES None ADJOURNMENT Mayor Miller moved to close the open session. The motion was seconded by Council Member Loesch. APPROVAL OF MINUTES MARCH 12, 2018 REGULAR SESSION MEETING Council Member Loesch moved for approval of the March 12, 2018 regular session minutes as presented. Council Member Shivers seconded the motion. On a call by the Chair for ayes and nays, the motion carried, with the vote on passage as follows: Ayes, Williams, Shivers, Loesch, Miller. Nays, none. Absent, Nichols. The Minutes were approved as presented. PUBLIC HEARING STORMWATER MANAGEMENT PLAN Council Member Loesch moved to open the Public Hearing. Chairman Pro Tem Williams seconded the motion. On a call by the Chair for ayes and nays, the motion carried, with the vote on passage as follows: Ayes, Williams, Shivers, Loesch, Miller. Nays, none. Absent, Nichols. The Public Hearing was open for discussion. City Manager Slagle called upon City Engineer Williford to provide the report. The City of Mexico is seeking public input on revisions to its Stormwater Management Plan. As a regulated Municipal Separate Storm Sewer System (MS4) community, the City is required to develop Best Management Practices (BMPs) to mitigate pollutants entering the storm sewer system. A draft of the City s Stormwater Management Plan has been available for public viewing and comments on the City s website. This Public Hearing is being held to gather any additional input on the plan. Once all comments have been reviewed and the Stormwater Management Plan has been finalized, the document will be sent to the Missouri Department of Natural Resources (MDNR) for final review and approval. The City s MS4 Permit, issued to the City by MDNR, has also been posted for viewing. City Engineer Williford recommended Council proceed with the advertised public hearing. There were no public comments. Mayor Miller moved to close the Public Hearing. Council Member Loesch seconded the motion. NEW BUSINESS RESOLUTIONS (READING BY TITLE ONLY AND PASSAGE) Bill No A Resolution Authorizing the City Manager to Sign Task Order No. 2 with Horner and Shifrin for the Survey, Inspection and Mapping of Sanitary Sewer Manholes. City Manager Slagle called upon Director Russell to provide the report. The budget allows for $30,000 to plan, design, map and survey. The City continues to map the existing sanitary sewer collection system using Geographic Information System (GIS) technologies. This process includes the survey, inspection, and mapping of every manhole in the City Limits. The City Page 1 City of Mexico, Missouri Council Minutes March 26, 2018

4 has previously mapped the southern, northwestern and northcentral portions of the Mexico City Limits. This Task Order will include the surveying, inspection and mapping of 400+ manholes in both the Town Branch Sewer Shed and East Sewer Shed. This process utilizes the City s on-call consultant, Horner and Shifrin, to complete these tasks within a six-month period this spring/summer. The cost of this task order has been established as a maximum not to exceed amount of $30,000. Director Russell recommended Council proceed with reading by title only and passage of Bill No Council Member Loesch moved for reading of Bill No by title only. Bill No was passed as Resolution No Bill No A Resolution Authorizing the City Manager to Enter Into a Contract with Insituform Technologies, LLC for the 2018 CIPP 2 Project. City Manager Slagle called upon Director Russell to provide the report. The budget allows $370,000 for slip lining, manhole lining, and collection system improvements. This contract plus the initial contract for CIPP and manhole work total $365,720. This is the second phase and includes CIPP work in the Randy, Eagle and Falcon neighborhood. The 2018 Cast in Place Pipe 2 (CIPP) project was advertised in the Mexico Ledger on February 27, 2018 with bids received March 13, Staff received bids from 3 contractors with Insituform Technologies, LLC of Chesterfield, Missouri submitting the lowest bid. Insituform Technologies has completed the 2017 CIPP work satisfactorily and currently has the original 2018 CIPP Project. City Manager Slagle called upon Deputy City Manager Haynes to provide the report. The City of Mexico currently has a tourism tax that is collected by the hotels/motels within the city limits. 5 receive tourism funding for an advertising campaign. Bill No was passed as Resolution No Bill No A Resolution Authorizing the City Manager to Execute A Memorandum of Understanding with the East Central Drug Task Force. City Manager Slagle called upon Chief Rockett to provide the report. The East Central Drug Task Force, organized in 2001, is a joint cooperative effort between the Sheriff s offices in Audrain, Cooper, Howard, Montgomery, Monroe, Pike, Ralls and Warren Counties and Police Departments in the cities of Bowling Green, Fayette, Glasgow, High Hill, Jonesburg, Louisiana, Mexico, Montgomery City, New Florence, New Franklin, Palmyra, Vandalia, and Warrenton; and the Missouri State Highway Patrol. The East Central Drug Task Force identifies and targets for prosecution the most criminally active drug enterprises that affect the Task Force area and all criminal activities of the drug enterprises are addressed by the Task Force. The Task Force enhances the effectiveness of federal, state and local law enforcement resources through a well-coordinated initiative seeking the most effective investigative and prosecutive avenues by which to convict and incarcerate drug offenders. The Task Force is a joint operation with all agencies acting as partners and an Executive Board comprised of the participating entities. The attached Memorandum of Understanding outlines the operation of the Task Force for the grant year. The City of Mexico is anticipated to contribute $11,500 during this grant year and has been properly funded. The list of claims was approved. COUNCIL COMMENTS Council Member Loesch announced that this would be his last Council Meeting and expressed thanks for having the opportunity to serve the community for 12 years it has been a pleasure to work with current Council Members, previous Council Members and City Employees. Council Member Loesch also wished Council the best of luck for the future. Mayor Miller expressed appreciation and thanks to Council Member Loesch for his years of service to the community. Chairman Pro Tem Williams expressed thanks to Council Member Loesch for working with him as Council Member. Chairman Pro Tem Williams also commented on a recent fire activity in the community and the Department of Public Safety s response to that fire. Chief Rockett answered Chairman Pro Tem Williams concerns on the fire response. Chairman Pro Tem Williams also commented on a domestic call that was dispatched during the fire. Chairman Pro Tem Williams inquired about the domestic situation and Chief Rockett provided information. Council Member Shivers congratulated Council Member Loesch on his years of service. Council Member Shivers spoke on the fire and also spoke on joint public safety and fire departments. Council Member Shivers commented on the Presser Performing Arts Center God Spell production. Mayor Miller congratulated Council Member Loesch for his years of service. Mayor Miller also commented on God Spell, Maundy Services, Good Friday Services and Easter Services that are also being held in the community. City Manager Slagle commented on the PAFR that has been mailed out to the residents of Mexico and provides a review of last year s financials. PUBLIC COMMENTS None ADJOURNMENT Mayor Miller moved to adjourn the meeting. The motion was seconded by Chairman Pro Tem Williams. Love Dear City Council Members: This public hearing concerns a request for an Additional Use Permit from James and Darlene Spencer to operate a bed and breakfast in their home at 317 E. Love. Bed and breakfast means a single-family residence where there are guest rooms provided for overnight stay with breakfast being the only meal served and where the host resides on the property. This property is located on the north side of East Love Street between North Calhoun to the west and Woodlawn Street to the east. This property is zoned C-2, General Commercial. ARTICLE XI. ADDITIONAL USE REGULATIONS Section Additional buildings and uses authorized upon permit obtained, generally. In addition to the buildings and uses of buildings and land authorized elsewhere in this chapter, the following building and uses shall be permitted in the various districts pursuant to permit first obtained from the city council in conformity with sections through : (13) Bed and breakfasts. Section of the City of Mexico Code states that each such application received by the City is reviewed by the Planning and Zoning Commission for investigation and report as to the effect such building or use will have upon traffic, fire hazards, and the character of the neighborhood and the general welfare of the community. A report and recommendation shall be filed with City Council. Notices were sent to thirty-five (35) surrounding property owners within 185 of the request. City Staff received no written or verbal communication regarding this request. On March 6, 2018, the Planning and Zoning Commission met to consider this request and made a recommendation of approval to the City Council. The minutes of that meeting are attached. City Code requires that City Council conduct a Public Hearing to make a determination of whether the applied for use will: 1. Substantially increase traffic hazards or congestion; 2. Substantially increase fire hazards; 3. Adversely affect the character of the neighborhood;

9 City Council Members April 9, 2018 Page 2 4. Adversely affect the general welfare of the community; 5. Overtax public utilities. If Council s findings are negative to all the above, then the application shall be granted; if the findings are affirmative, as to any of the above, then the permit shall be denied. Approval or denial of the permit is done in the form of a motion. Staff recommends Council conduct the advertised Public Hearing and make a motion to grant approval or denial of the Additional Use Permit request for James and Darlene Spencer to operate a bed and breakfast in their residence at 317 E. The Planning and Zoning Commission held a regular meeting on Tuesday, March 6, 2018, at 3:30 p.m. in the 3 rd Floor Council Chambers. Commissioners present were: Chairman Helen Fenlon; Commissioner Craig Kimbel; Commissioner Ron Whittaker; and Commissioner Ralph Mika. Also attending were Community Development Director Rita Jackson; and Acting Secretary Jamie Pehle; as well as interested citizens. Absent, Commissioner Bryan Gruber; Commissioner Kyle Cone and Commissioner Dave Wilburn. The meeting was called to order with Chairman Fenlon presiding. APPROVAL OF MINUTES Minutes from the February 6, 2018 meeting were presented for approval. There being no additions, deletions or corrections the minutes stand approved as presented. LOVE STREET Chairman Fenlon called upon Director Jackson to provide the Staff Report. Director Jackson stated that the City of Mexico Community Development Department received a request from Darlene Spencer for an Additional Use Permit to operate a bed and breakfast at her property located at 317 E. Love. The property, located on the north side of East Love Street between North Calhoun to the west and Woodlawn Street to the east, and is currently zoned C-2, General Commercial. Notices were sent to thirty-five (35) surrounding property owners within 185 of the requested Additional Use Permit. Staff received two telephone calls with no opposition regarding the request. Darlene Spencer was called upon for questioning. Commissioners held discussion regarding the entry/exit options, off street parking provided, number of rooms in both the estate and guest house. There were no surrounding property owners present in opposition at the meeting. Commissioner Mika made a motion to recommend approval of Case No Commissioner Whittaker seconded the motion and on a call for ayes and nays the motion carried with the vote on passage as follows: Ayes: Fenlon, Kimbel, Whittaker, Mika. Nays: None. Absent: Gruber, Wilburn, Cone. HOLT STREET Chairman Fenlon called upon Director Jackson to provide the Staff Report. The City of Mexico Community Development Department received a request from Jet Up, LLC, Trenton and Jordan Vaughn for an Additional Use Permit to construct commercial storage units on their property located at 913 E. Holt. The property, located on the north side of East Holt Street between South Johnson Street to the west and Green Boulevard to the east, and is currently zoned C- 2, General Commercial. 15 ARTICLE XI. ADDITIONAL USE REGULATIONS Section Additional buildings and uses authorized upon permit obtained, generally. In addition to the buildings and uses of buildings and land authorized elsewhere in this chapter, the following building and uses shall be permitted in the various districts pursuant to permit first obtained from the city council in conformity with sections through : (14) Commercial storage units. Section of the City of Mexico code states each such application by the City is reviewed by the Planning and Zoning Commission for investigation and reports as to the effect such building or use upon traffic and fire hazards, the character of the neighborhood and the general welfare of the community. A report and recommendation shall be filed with City Council. The Comprehensive Plan is a resource to empower those involved with community decision-making processes to evaluate opportunities and to actively pursue initiatives that build towards the longrange goals envisioned by this plan. Notices were sent to thirteen (13) surrounding property owners within 185 of the requested additional use permit. Staff received one telephone call, one office visit and seven (7) petitions all in opposition of the request. Staff recommended the Planning & Zoning Commission review and investigate the following criteria: (1) Substantially increase traffic hazards or congestion, (2) Substantially increase fire hazards, (3) Adversely affect the character of the neighborhood, (4) Adversely affect the general welfare of the community; or (5) Overtax public utilities. Trenton Vaughn was called upon to present his request. In his presentation he stated that the property currently has an abandoned house that is scheduled to be demolished in March of 2018 by the City of Mexico. Vaughn referenced the location of the property to other nearby businesses in the area. Plans included the installation of a privacy fence, around the property boundary, as well as a security camera system that can be monitored from his cellular phone. Vaughn indicated that he would start with ten storage units and eventually add more. Comments were made by neighborhood residents expressing opposition and concerns: DeReath Pasley, Robert Pasley and Nancy Gould. Concerns included additional traffic, people coming and going all hours of the day and night, reduced property valves, the fact that they already have to deal with the traffic generated by ADM and it is their neighborhood. Discussion was held by Commissioners, Jordan and Trenton Vaughn, and neighborhood residents regarding the impact of the Additional Use Permit on the neighborhood. The selection process of tenants, the entry/exit into the neighborhood at all hours of the day and night, property values, and the overall impact on the neighborhood were the main concerns expressed. Commissioner Kimbel made a motion to approve Case No Commissioner Mika seconded the motion and on a call for ayes and nays the motion carried with the vote on passage as follows: Ayes: None. Nays: Fenlon, Kimbel, Whittaker, Mika. Absent: Gruber, Wilburn. Cone. After the vote, Chairman Fenlon stated that Additional Use Permits need to be examined on a case by case basis; a majority of the Commissioners voted to deny the request; it s a negative; it s a neighborhood and; personal to the property owners that reside in that neighborhood. The minutes of that meeting are attached. On March 20, 2018, the City received a request from Trenton Vaughn, Jet Up, LLC Owner, to be heard in front of City Council regarding their request to construct commercial storage units at 913 E. Holt. A notice of Public Hearing to Consider an Additional Use Permit was advertised in the Mexico Ledger on Thursday, March 22, and Thursday, March 29, Notices were sent to thirteen (13) surrounding property owners within 185. The City received two written correspondence from property owners within the 185 and from one that is not within 185 all in opposition of the request. City Code requires that City Council conduct a Public Hearing to make a determination of whether the Additional Use Permit will: 1. Substantially increase traffic hazards or congestion; 2. Substantially increase fire hazards; 3. Adversely affect the character of the neighborhood; 4. Adversely affect the general welfare of the community; 5. Overtax public utilities. If Council s findings are negative to all the above, then the application shall be granted; if the findings are affirmative, as to any of the above, then the permit shall be denied. Approval or denial of the permit is done in the form of a motion. Staff recommends that Council conduct the advertised Public Hearing and make a motion to grant approval or denial of the request for an Additional Use Permit for Jet Up, LLC to construct commercial storage units at 913 E. Pasley. I have lived on Holt Street since birth. Currently, I am part owner of 909 East Holt Street, (which was one of the first homes built on Holt Street) and the full owner of 404 East Bass Street. The Holt Street property abuts the subject property where the proposed storage unit is to be built. 404 East Bass Street is directly across the street from the subject property. It distresses me, that an individual not from our community and who would have never entered our community to purchase property as recently as five years ago, now desires to erect a storage unit that will decimate the peace, safety and tranquility that has been fervently maintained on a street filled with legacy and historical prominence. For years, Holt Street and the surrounding area, has been one of the steadfast middle class streets for the African American community in Mexico. Historically, property owners invested in this area both financially and socially. Families were raised and elders have enjoyed retirement in this neighborhood. Homes and properties are and continue to be maintained. Taxes are and continue to be paid. Individuals sacrificed and continue to sacrifice to promote the family environment of the area. Despite the destruction of the street due to the imposition of the Soybean Mill's huge 18 wheeler trucks impacting the peace and stability of Holt street, (and at many times inconveniencing the residents by blocking driveways and the roadway), the long-term property owners of Holt Street still maintain their homes and strive to keep the neighborhood orderly and maintained. There is an expectation of privacy and safety that envelopes this area, that is aggressively protected. The recent influx of drug activity coming from one property on Holt Street (from yet another individual not respectful of the area), has been fought diligently and aggressive attempts continue to eradicate this negative influence. With the increased mobility of individuals in Mexico who now live in different areas, (which did not exist during most ofmy residence in Mexico) Holt Street has become a more integrated street and the neighborhood as a whole has become more integrated. Nevertheless, the premise of keeping the neighborhood safe and secure is still paramount among the vast majority of the residents in this area. As such, there is an inherent right

32 Page 2 of 2, objection to zoning change of each long term property owner and resident to have this safety and security maintained and protected. To erect a storage unit, where there are transient and unknown individuals coming into the neighborhood at all hours of day and night, greatly impacts the safety and security of Holt Street and the surrounding areas. Additionally, the erection of such a commercial edifice, increases the influx of the negative drug and criminal activity that is diligently fought against in the Holt Street area. These storage units promote absolutely no benefit to any of the long-time property owners that reside on Holt Street and the surrounding areas. The erection of these storage units not only instantly devalues the properties I own, but also impacts the ability to encourage individuals to live in the properties that espouse the precepts of safety and upgrading of the neighborhood. The only person to benefit from this storage unit is the new owner, who certainly has other options in commercial areas of Mexico to promote this venture. Holt Street and the surrounding area is a NEIGHBORHOOD; not a commercial area. Despite the inconvenience and disturbance imposed by the Soybean Mill in the area, the property owners protect and maintain this NEIGHBORHOOD. Storage units do not promote and encourage the upgrade and protection of a neighborhood. Instead. there is an instant depreciation of property, safety, and community values that accompany such a business. Therefore, I adamantly oppose the construction of the proposed storage unit at 713 East Holt Street and will take any and all means to prevent this construction and venture. Further, I vehemently oppose any change to the existing zoning of the area and will take the necessary means to prevent this change. At some point, the heritage of a neighborhood as rich as that in the Holt Street area must be maintained. I will earnestly and diligently fight to make sure that this heritage is honored. The Planning and Zoning Commission held a regular meeting on Tuesday, March 6, 2018, at 3:30 p.m. in the 3 rd Floor Council Chambers. LOVE STREET Chairman Fenlon called upon Director Jackson to provide the Staff Report. Director Jackson stated that the City of Mexico Community Development Department received a request from Darlene Spencer for an Additional Use Permit to operate a bed and breakfast at her property located at 317 E. Love. The property, located on the north side of East Love Street between North Calhoun to the west and Woodlawn Street to the east, and is currently zoned C-2, General Commercial. Notices were sent to thirty-five (35) surrounding property owners within 185 of the requested Additional Use Permit. Staff received two telephone calls with no opposition regarding the request. Darlene Spencer was called upon for questioning. Commissioners held discussion regarding the entry/exit options, off street parking provided, number of rooms in both the estate and guest house. There were no surrounding property owners present in opposition at the meeting. Commissioner Mika made a motion to recommend approval of Case No Commissioner Whittaker seconded the motion and on a call for ayes and nays the motion carried with the vote on passage as follows: Ayes: Fenlon, Kimbel, Whittaker, Mika. Holt. The property, located on the north side of East Holt Street between South Johnson Street to the west and Green Boulevard to the east, and is currently zoned C- 2, General Commercial. 34 ARTICLE XI. ADDITIONAL USE REGULATIONS Section Additional buildings and uses authorized upon permit obtained, generally. In addition to the buildings and uses of buildings and land authorized elsewhere in this chapter, the following building and uses shall be permitted in the various districts pursuant to permit first obtained from the city council in conformity with sections through : (14) Commercial storage units. Section of the City of Mexico code states each such application by the City is reviewed by the Planning and Zoning Commission for investigation and reports as to the effect such building or use upon traffic and fire hazards, the character of the neighborhood and the general welfare of the community. A report and recommendation shall be filed with City Council. The Comprehensive Plan is a resource to empower those involved with community decision-making processes to evaluate opportunities and to actively pursue initiatives that build towards the longrange goals envisioned by this plan. Notices were sent to thirteen (13) surrounding property owners within 185 of the requested additional use permit. Staff received one telephone call, one office visit and seven (7) petitions all in opposition of the request. Staff recommended the Planning & Zoning Commission review and investigate the following criteria: (1) Substantially increase traffic hazards or congestion, (2) Substantially increase fire hazards, (3) Adversely affect the character of the neighborhood, (4) Adversely affect the general welfare of the community; or (5) Overtax public utilities. Trenton Vaughn was called upon to present his request. In his presentation he stated that the property currently has an abandoned house that is scheduled to be demolished in March of 2018 by the City of Mexico. Vaughn referenced the location of the property to other nearby businesses in the area. Plans included the installation of a privacy fence, around the property boundary, as well as a security camera system that can be monitored from his cellular phone. Vaughn indicated that he would start with ten storage units and eventually add more. Comments were made by neighborhood residents expressing opposition and concerns: DeReath Pasley, Robert Pasley and Nancy Gould. Concerns included additional traffic, people coming and going all hours of the day and night, reduced property valves, the fact that they already have to deal with the traffic generated by ADM and it is their neighborhood. Discussion was held by Commissioners, Jordan and Trenton Vaughn, and neighborhood residents regarding the impact of the Additional Use Permit on the neighborhood. The selection process of tenants, the entry/exit into the neighborhood at all hours of the day and night, property values, and the overall impact on the neighborhood were the main concerns expressed. Commissioner Kimbel made a motion to approve Case No Commissioner Mika seconded the motion and on a call for ayes and nays the motion carried with the vote on passage as follows: Ayes: None. Nays: Fenlon, Kimbel, Whittaker, Mika. Absent: Gruber, Wilburn. Cone. After the vote, Chairman Fenlon stated that Additional Use Permits need to be examined on a case by case basis; a majority of the Commissioners voted to deny the request; it s a negative; it s a neighborhood and; personal to the property owners that reside in that neighborhood. Coal St., Mexico, Mo Dear City Council Members, I would like to be heard at the April 9th Mexico City Council meeting on my request to construct storage units at 913 E. Holt St. (legal description: SURVEY 51 (80 X 167) PT Sl/2 LOT 3, DESC BEG 350' E OF SW COR SURVEY 51, E 80', N 167', W 80', S 167' TO POB). This property is currently zoned as C2 commercial and contains an abandoned home. This requested additional use permit hearing is made in accordance with Mexico City Ordinance Sec On February 15, 2018, I submitted a request to build storage units on our lot. That request was forwarded to the Planning and Zoning Committee meeting on March 6th and, based upon community opposition, our request was denied. Because my wife and I are property owners on Holt Street, as well, we only aim to better the community, not devalue it (as evidenced, in part, by my signature on a City requested Holt Street easement within 24 hours of my acquisition of title to 913 E. Holt St.). We firmly believe that if you fully examine our plans to erect 10 small storage at the back of the property, you will agree that replacing an abandoned house with a clean, well-maintained business will do just that: better the community. We recognize the criteria the City Council will be reviewing in Mexico City Ordinance Sec (see appendix A), and know that our plan will pass each issue when fully vetted: (1) Substantially increase traffic hazards or congestion a. Traffic will be minimally impacted, if at all. We are planning to place 10 units toward the back of our property. Storage units are not visited on a daily basis by occupants. At the very nature of the business, items are placed in storage for safe-keeping, to be left for a significant duration of time. i. In comparison, in accordance with City Code (Appendix B), we are allowed to erect an apartment, hotel, veterinary clinic, or medical clinic without an additional use permit from the City. Each of these would significantly increase traffic in the area at a rate much higher than storage units. In fact, even a rental home, with tenants coming and going on a daily basis would be more traffic than 10 small storage units. ii. We will have space for parking within our lot. Therefore, there should be no on-street parking of storage unit renters.

37 (2) Substantially increase fire hazards a. There will be no increase in fire hazard. The storage unite; will be metal buildings set on a paved lot. There will be no electricity available to the individual units. (3) Adversely affect the character of the neighborhood a. Concern expressed by neighbors at the Planning and Zoning hearing is that the area is primarily residential. However, the majority of lots directly surrounding our property at 913 E. Holt St. are currently either vacant, abandoned, or occupied by a commercial business, not residential. i. Within the same block of Holt Street, there are two residences ( one of which is a rental), two businesses (Sonic Drive-In and Pure Skin & Wellness Spa), and five vacant lots. ii. iii. Across Green Blvd., there is a hotel (Budget Inn). Across Holt St., there are five houses (two of which directly across the street are abandoned) and one vacant lot. b. Storage units will not lower the property value. The current house on 913 E. Holt St. is dilapidated and abandoned. Tearing down this house and erecting new, clean storage units only increases the property value. Having property located next to an abandoned house is in no way good for your own property value or resale value. c. The storage units will have 8' privacy fences on each side, reducing noise and visibility of the units for neighbors. ( 4) Adversely affect the general welfare of the community a. Concern from those present at the Planning and Zoning hearing was that storage units bring unknown individuals and dangers into the area, thereby decreasing safety. However, our property will be safe; the crime referred to by neighbors has not proven to be true for storage units. i. Storage units bring rental tenants, not unknown, dangerous people. There is no factual basis for the complaints that 10 storage units will bring transient individuals, as stated in one opposition letter mentioned below. We fully vet our current rental house tenants and will fully vet and monitor renters of this storage facility. It is, in fact, a disservice to both ourselves and the community to have drugs or any illegal activity in our storage units, and we will therefore, diligently avoid this. ii. iii. Storage units have not proven to increase crime. Other storage units currently in place in Mexico have not brought the crime and unrest to surrounding neighborhoods discussed in the opposition letters. In fact, other storage units in Mexico remain peaceful, safe, and well-kept, as will ours. We will take safety and security measures, both for the protection of the community, as well as the protection of our property. We will install 8' privacy fences. We will place security cameras that will be monitored from an app on our phones. If any suspicious activity is taking place at any time, the Mexico police will be notified immediately. This is more protection than would be in place for a rental home. Page 2

38 (5) Overtax public utilities a. Overtaxing public utilities does not apply in this case; the storage units will have minimal utilities, paid for privately. Although not required by ordinance, before the Planning and Zoning Committee meeting, the City sent out letters to the property owners within 185' of my property at 913 E. Holt St. At the Planning and Zoning Committee hearing, two parties from the surrounding area (one of which lives outside the 185' radius) attended in opposition. Less than four hours before the Planning and Zoning Committee meeting on March 6th, the City received several opposition letters. Ten such letters were received by the city, representing seven different properties within 185'. Nine of the letters were a "stock" form that one person created, with signatures from others, and the other opposition letter claims multiple falsities, the most concerning of which suggests we are proposing a zoning change or amendment, which is not even the issue at bar. Again, my wife and I fully believe that when the City Council reviews the sole issue at hand - our request for an additional use permit - against the criteria of Mexico City Ordinance Sec , the City Council will agree the storage units are an improvement to the lot and the surrounding area. I have been working with other small business owners in Mexico to design the storage units and would like the opportunity to submit plans to the City inspector for official stamping. Additionally, I have been working with the City to have the current home on the property demolished; I would like to get started on the storage unit construction as soon as possible to improve this lot that is currently an unsafe eyesore.
