3 CITY OF McHENRY 2018 FARMERS MARKET VENDOR RELEASE AND HOLD HARMLESS AGREEMENT I,, understand that my participation and/or involvement in the City of McHenry s Farmers Market carries with it the potential for certain risks, some of which may not be reasonably foreseeable. I further acknowledge that these risks could cause me, or others around me, harm, including, but not limited to, bodily injury, damage to property, or emotional distress. I am a willing participant in the City of McHenry s Farmers Market. By signing this agreement, I agree to release, indemnify, and hold harmless the City of McHenry, as well as all their employees, agents, representatives, successors, etc. from all losses, claims, theft, demands, liabilities, causes of action, or expenses, know or unknown, arising out of my participation in the City of McHenry s Farmers Market. 4 McHenry Farmers Market 2018 Rules City Of McHenry, IL Market Details: The market is located on the north side of Veterans Park (formerly Pearl Street Park) on Pearl Street in McHenry. The market will run every Thursday evening from May 17th to September 27th, Market hours are 4:30P to 8:00P. The market is coordinated through and managed by the market manager/city of McHenry. Applications: All vendors must sign and complete a Vendor Application. By signing the application the vendor agrees to abide by all 2018 Market rules, information, and decisions made by the market manager/city of McHenry. Approval of applications is at the sole discretion of the market manager/city of McHenry. Completed and signed applications are due by March 15, 2018 along with $110 check. Approvals will be announced by April 6, Cost: The cost for the market is $220 for the season. All vendors must submit a 50% payment of $110 with their application, payable via check only. All approved vendors must pay their remaining $110 at the Vendor Informational meeting on Thursday May 10, 2018 at 4:30P. Payable via check only. There are no refunds for cancelled market days due to weather or non-attendance. Please make checks payable to the City of McHenry. Spaces: Each space is 10x10. Market spaces are assigned by the market manager at the beginning of the season. Each vendor must supply their own table and canopy. Every canopy must have a minimum of 35 pounds weight on each corner for safety reasons. Spaces must be manned during the entirety of the market hours. You may arrive as early at 2:30p to begin setup. You must be set up 3 feet away from the sidewalk, and as close to your neighbors as possible. Vendors must have clear signage for their business. We encourage signage at eye level or above as well as table signage. Our most successful vendors benefit from multiple types of signage. Electricity is extremely limited. Electrical sites will be assigned at the discretion of the market manager.

5 Other vendor rules: There is a limit of 2 product lines per market space. Additional product lines must be approved by the market manager and additional charges may apply. No dogs allowed in park. No alcohol allowed in park unless previously approved by the City of McHenry. No smoking near any vendor areas. If you are offering food tasting, please follow all McHenry County Health Department Rules and Procedures. Appropriate permits are required. Homegrown food, homemade items, or special services will be allowed in the Farmers Market. Non-homegrown food must not account for more than 30% of items, and must be clearly marked as such, including state/area of origin. Produce must have state/area of origin displayed. All vendors must be completely set up and ready to vend at 4:30P sharp. All vendors must remain set-up for the duration of the market day, until 8:00P. If you choose to remain set-up during the concert in the park, that is at your discretion. Inclement Weather: All vendors must be prepared to vend despite rain or wind. Weather can clear up quickly in the summer and we need to be sure customers can rely on our continued presence. Market cancellation due to weather will be decided on a case-by-case basis by the market manager. However if the City of McHenry is under a Severe Weather Watch, a Severe Weather Warning, a Tornado Watch, or Tornado Warning the market will be cancelled.
