I. APPROVAL OF MINUTES Approval of February 8, 2018 County Board Meeting Minutes Mayer moved for approval of the minutes, Parker seconded. The minutes were approved by a unanimous roll call vote of 18 ayes. II. PROCLAMATIONS AND PRESENTATIONS A proclamation recognizing April and May 2018 as "Gerald M. Brookhart Arts in Education Spring Celebration" months III. CITIZENS' REMARKS Chairman Rand announced that Item 6 would be taken after the Consent Agenda. For that item, see below. Bill Morton, General Manager, Lexus of Peoria, addressed the Board with regard to Item 6. He discussed that the dealership had spent money fixing cars due to the Willow Knolls Road intersection, it needs to be repaired, and it is embarrassing. Joy Moore, 7315 N Villa Lake Drive #1, addressed the Board with regard to Item 6. She expressed that she and her friends have had to spend money on car repairs from the intersection at Willow Knolls and Allen Roads and it needs to be fixed. Carol Hornickle, 7501 N Villa Lake Drive 2A, President Fairway Villas Home Owners Association, addressed the Board with regard to Item 6. She noted that the intersection 1 3

C16. Chairman Appointments Fennel moved to approve the Consent Agenda and Robinson seconded. Adamson asked to pull Items C4, C8, and C10. The Consent Agenda, except for Items C4, C8, and C10, was approved by a roll call vote of 17 ayes and 1 nay, with Harding voting nay. C4. A resolution recommending approval to establish the Health Department as the Emergency Management Agency designee. Baietto moved to approve Item C4 and Williams seconded. Adamson asked for a summary of the item and Mr. Sorrel expressed that the duties of Emergency Management would move from the Sheriff s Office to the Health Department; resulting in better grant opportunity. Item C4 was approved by a unanimous roll call vote of 18 ayes. C8. A resolution recommending approval of amendments to Chapter 12 of the Peoria County Code. Dillon moved to approve Item C8 and Rosenbohm seconded. Adamson asked for a summary of the item and Mr. Sorrel discussed that there are changes to match updates in the electrical and energy conservation code. Dillon noted that the updates match other jurisdictions in the area. Item C8 was approved by a unanimous roll call vote of 18 ayes. 3 C10. A resolution recommending approval to a contract extension agreement 5

7 Peoria County Board Minutes Thursday, March 8, 2018 with nurse staffing agencies at Heddington Oaks. Williams moved to approve Item C10 and Mayer seconded. Adamson asked if there is risk involved if the Board goes through with changes in management. Mr. Sorrel noted that contracts have termination clauses with no risk and there is a plan in place for competitive procurement for the services. Item C10 was approved by a unanimous roll call vote of 18 ayes. V. ZONING ORDINANCE AND RESOLUTIONS 1. Case 2-18-U, Petition of Jason Bird (James & Debra Bird, owners). A Special Use as required in Section b of the Unified Development Ordinance. This section allows for a special use when a proposed land split does not meet the 40 acre minimum lot size in the A-1 Agricultural Preservation Zoning District. The petitioner proposes to divide 21 acres from an existing acre parcel in order to construct a single family dwelling. The parcel is located in Millbrook Township. The Zoning Board of Appeals recommends approval. The Land Use Committee concurs. Dillon moved to approve the ordinance and Rosenbohm seconded. The ordinance passed by a unanimous roll call vote of 18 ayes. Watkins left the meeting. 2. Case 6-18-Z, Petition of Kimberly Irwin (Theodore Arndt, owner). A Rezoning request from C-1 Neighborhood Commercial to C-2 General Commercial. The petitioner proposes to rezone this parcel in order to operate a tavern. The parcel is located in Medina Township. The Zoning Board of Appeals recommends approval. The Land Use Committee concurs. Dillon moved to approve the resolution and Elsasser seconded. Dillon explained that the property had operated as a tavern in the past, the business planned to run a tavern, but under the zoning rules, it needed to reapply. The resolution passed by a unanimous roll call vote of 17 ayes. 3. Case 7-18-U, Petition of Kimberly Irwin (Theodore Arndt, owner). A Special Use as required in Section n.1 of the Unified Development Ordinance, which allows for a Tavern, not exceeding a floor area of five thousand (5,0) square feet, if located closer than five hundred (5) feet from any residential district, religious institution or school in the C- 2 General Commercial Zoning District. The petitioner proposes to operate a tavern located immediately adjacent to a residential district. This parcel is located in Medina Township. The Zoning Board of Appeals recommends approval with restriction. The Land Use Committee concurs. Dillon moved to approve the ordinance and Fennell seconded. The ordinance passed by a unanimous roll call vote of 17 ayes. 4. A resolution from your Public Safety and Justice Committee recommending approval of the creation of a Body Worn Camera Program through a joint Grant Award with the Peoria City Police Department and other participating agencies. 4 Baietto moved to refer the resolution back to committee and Salzer seconded. A recommendation from your Executive Committee authorizing execution of Amendment #1 to the Peoria Rural Enterprise Zone Designating Ordinance. Mayer moved to approve the ordinance and Fennell seconded. Williams stated that she would be voting no due to the prevailing wage threshold. Fennel expressed that the Rural Enterprise Zone has been a great stimulus in his district and identified the changes. Adamson asked about the changes and Fennell explained that it is a map change. Pastucha asked about the prevailing wage threshold. Mayer and Parker detailed the reasons for its inclusion and the rules implemented in the ordinance. The ordinance passed by a roll call vote of 16 ayes and 1 nay, with Williams voting nay. 6. A resolution your Executive Committee recommending approval of an Intergovernmental Agreement with the City of Peoria for the purpose of reconstructing the Willow Knolls Road and Allen Road intersection. Rieker moved to approve the resolution and Baietto seconded. Mr. Sorrel reported that the goal to fix the road has been achieved. He presented an overview of the loan agreement, the structure for repayment, the funding sources for the loans, and the design-build process. Morris described that there is a possibility to substitute the federal dollars given for the project to another project if the PPUATS Board accepts the change, which he predicted would happen. Baietto asked if there is something that can be done at the intersection temporarily. Rieker noted that the road needed improvement years ago and there is no best way to fix it. Adamson agreed with Rieker and stressed that the Board needs to be more proactive on roads in poor condition. Dillon summarized that the roads problem is not going away due to the difference in need and funding for projects. Fennell asked if there is an issue with not paying interest in repayment to the Employee Health Fund and if there is any penalty for the City not paying back on time. Mr. Sorrel noted that the fund is controlled by the Board and it may make the decision to pay interest. He also discussed that there is no language in the intergovernmental agreement for late payment. Harding asked if there is recourse for not paying on time and Mr. Sorrel stated that the agreement is a legally binding document. Salzer thanked Chairman Rand for getting the work done now. 5 Elsasser requested information about future votes for the project. Mr. Sorrel noted that there 7

9 Peoria County Board Minutes Thursday, March 8, 2018 would be resolutions for any unspent funds and the repayment terms. Elsasser suggested that there could be interest paid back to the Employee Health Fund, and Mr. Sorrel remarked that it would be up to the Board to set an interest rate. Chairman Rand conveyed that charging interest in repayment only makes the project cost more, but the City will be paying interest on the portion loaned to it. Elsasser brought up that he cannot vote in favor of any project that can result in a roundabout being built. Rieker emphasized that there could be other options for the intersection because it needs to be reconstructed from the base, but it must be done within the cost structure. Rosenbohm noted that a roundabout, if constructed, should be large enough to fit semis. Adamson highlighted that citizens would be paying slightly more to get the work done, but it is needed. Robinson thanked Chairman Rand for his leadership and getting the project done quickly. Baietto expressed that County Engineer Amy McLaren will make the right decisions on the intersection makeup. Chairman Rand reported that under the long-standing intergovernmental agreement when a road is updated, it must be brought up to urban standards, the jurisdiction will be transferred to the City, and the costs are shared. He asserted that the County must wait to complete the projects until the City has the funds. The resolution passed by a roll call vote of 16 ayes and 2 nays, with Elsasser and Harding voting nay. 7. Executive Session Pending Litigation Fennell moved to go into executive session to discuss pending litigation and Morris seconded. The motion passed by a unanimous roll call vote of 17 ayes. VI. MISCELLANEOUS AND ANNOUNCEMENTS Elsasser invited all to the Southside Christian Academy for an open house Saturday, March 10 th from 4 pm to 7 pm. Harding invited all to breakfast at the Expo Gardens Saturday, March 10 th from 7-11 am for $.90, which is the share that goes to the farmers for the meal. Rosenbohm noted that there will be no waste produced from the meal. Fennell expressed that the road problem in the County is serious and he encouraged the Board to look into solutions again. Pastucha asked for attendance at the Morton Civic Chorus event Sunday, March 11 th at 2 pm benefitting Central Illinois Memorial Kidney Fund. Baietto expressed that he hoped to see the State Championship winning Richwoods Girls Basketball Team at the next meeting. 6 Mayer brought up that he and Fennel are holding town hall forums on the Auditor referendum. 8

11 PROCLAMATION WHEREAS, Peoria County congratulates the Richwoods High School Girls Basketball Team on their IHSA Class 3A Championship; and WHEREAS, the Richwoods High School Girls Basketball Team championed over LaGrange Park Nazareth for this state title; and WHEREAS, this is an outstanding fourth state championship for the Richwoods High School Girls Basketball program; and WHEREAS, Peoria County achknowledges the hard work and dedication of each player, both on and off the basketball court; and WHEREAS, Coach Todd Hursey was instrumental in leading the Richwoods High School Girls Basketball program; and WHEREAS, Peoria County is proud of this impressive 35 wins to 1 loss season for Richwoods High School Girls Basketball. NOW THEREFORE I, Andrew A. Rand, Chairman of the Peoria County Board, on behalf of the County Board, do hereby recognize the 2018 Richwoods High School Girls Basketball Team on being state champions. 12 PROCLAMATION The week of May 6-12, 2018, has been designated as NATIONAL CORRECTIONAL OFFICERS RECOGNITION WEEK; and WHEREAS, county and city jails held 740,7 inmates at midyear 2016, down from a peak of 785,5 inmates at midyear 28; and WHEREAS, in 2016, jails reported 10.6 million admissions, a continued decline since 28; and WHEREAS, the jail incarceration rate fell from 237 inmates per 1,0 U.S. residents at midyear 2012 to 229 inmates per 1,0 U.S. residents at midyear 2016, a decline of 3.4 percent. The incarceration rate fell 11.2 percent from midyear 28, when there were 258 inmates per 1,0 U.S. residents, to midyear 2016; and WHEREAS, on December 31, 2016 (year-end) most (65 percent) people held in jail were not convicted of an offense but were awaiting court action on a current charge. The remaining 35 percent were sentenced offenders or convicted offenders awaiting sentencing. Nearly 7 in 10 inmates were held in jail on felony charges, while 1 in 4 were held for misdemeanor offenses; and WHEREAS, jails employed 226,3 full-time staff at year-end 2016, an increase from 213,0 at year-end Nearly 80% of jail employees were correctional officers, deputies, monitors and other custody staff who spend more than half of their time with the incarcerated population. In 2016, the inmate-to-correctional officer ratio was 4 to 1; and NOW, THEREFORE, I, Andrew A. Rand, Chairman of the Peoria County Board, on behalf of the County Board, do hereby acknowledge the week of May 6-12, 2018, as "NATIONAL CORRECTIONAL OFFICERS RECOGNITION WEEK" and urge all citizens and institutions to observe the week of May 6-12, 2018, in Peoria County through observance of National Correctional Officers Recognition Week. 13 PROCLAMATION By Act of Congress and Presidential Proclamation, May 15th of each year is designated NATIONAL PEACE OFFICERS MEMORIAL DAY, and the week in which it falls is NATIONAL POLICE WEEK. The seven-day period is set aside to recognize the contributions to society of our nation's police officers, and to dedicate May 15th to graveside services and other memorials for the police officers who have been killed in the line of duty. WHEREAS, a total of 1,511 law enforcement officers died in the line of duty during the past 10 years, an average of one death every 63 hours or 151 per year. There were 129 law enforcement officers killed in the line of duty in 2017; and WHEREAS, according to the FBI preliminary Uniform Crime Report from January to June , an estimated 442,824 Violent Crimes occurred nationwide, a decrease of 0.8%; and WHEREAS, there are more than 9,0 sworn law enforcement officers now serving in the United States, which is the highest figure ever. About 12 percent of those are female; and WHEREAS, since the first recorded police death in 1791, there have been over 21,0 law enforcement officers killed in the line of duty. Currently, there are 21,540 names engraved on the walls of the National Law Enforcement Officers Memorial; and WHEREAS, the Peoria County Sheriff s Office will hold the annual Honors Board Memorial Ceremony and Awards Banquet on May 15, 2018, beginning in front of the Peoria County Jail at 5:30PM, proceeding immediately thereafter to the Itoo Banquet Hall; and NOW, THEREFORE, I, Andrew A. Rand, Chairman of the Peoria County Board on behalf of the County Board, do hereby acknowledge the week of May 13-19, 2018 as "NATIONAL POLICE WEEK" and urge all citizens and institutions, public and private, to support police services through observance of NATIONAL POLICE WEEK. 14 PROCLAMATION WHEREAS, child abuse is a community problem and finding solutions depends on the involvement of people throughout the community; and WHEREAS, child abuse and neglect can cause traumatic psychological, emotional, and physical harm which can lead to poor outcomes, including detrimental behaviors and mental and physical illesses for children and adults; and WHEREAS, most cases of child abuse are never reported, and children suffer in silence waiting for someone to save them; and WHEREAS, effective child abuse prevention programs succeed because of partnerships created among families, social service agencies, schools, religious and civic organizations, law enforcement agencies, and the business community; and WHEREAS, parents, families, and communities can help reduce child abuse and neglect by promoting the benefits children receive from loving, supportive, and encouraging homes; and WHEREAS, the Youth Services Network Panel, in partnership with Peoria County Government, is hosting the Eleventh Annual Hands Around the Courthouse Event on April 20th, 2018 to raise awareness of child abuse prevention; and WHEREAS, in partnership, together we can eradicate the 1,016 child abuse and neglect cases currently pending in Peoria County; NOW, THEREFORE, I, Andrew Rand, Chairman of the Peoria County Board, on behalf of the County Board, do hereby recognize April as Child Abuse Prevention Month. 29 AGENDA BRIEFING COMMITTEE: Executive Committee LINE ITEM: MEETING DATE: March 27, 2018 AMOUNT: ISSUE: For RESOLUTION: Reauthorize Home in the Heights Neighborhood Revitalization Program Funding from County State Capital Improvement Fund (Keystone) BACKGROUND/DISCUSSION: In October 2016 for FY2017, the County Board authorized up to $3,0 from the Keystone dollars to create a pilot program in Peoria Heights. The program s goal was to revitalize neighborhoods in Peoria Heights, which is landlocked and does not have open space to grow its residential tax base. The only way for Peoria Heights to increase its residential tax base is to make it easier for current home owners to rehabilitate or expand their existing homes or to make it easier to convert rental property into owner-occupied properties. The program s objective were to: Increase homeownership by 10% (currently at 54% owner-occupied) Increase Equalized Assessed Value (70% of homes are currently valued at $30k EAV or less, the goal is to get more homes up to $50k EAV) Create quality construction jobs Attract families (52% family households currently) Stabilize and increase population (9.3% decline since 20) Stabilize school population and high mobility rate Increase overall quality of life The Program itself was envisioned to take a two-pronged approach by: Easing the development process: Home and property owners can follow a streamlined stepby-step process in working with the Village of Peoria Heights and a list of vetted and preferred realtors, lenders and contractors. For example, the Village will work with program participants on any variance or permitting process. Building fees may also be reduced or waived. Incentivizing development: Local incentives will come in three forms - 1. Units of local government (Village, School, County, and Township) are being asked to provide 1% property tax abatement on new improvements for up to five years. 2. The Village of Peoria Heights will also provide waived fees for variance and building permits. 3. Down payment/rehab assistance will also be available through a loan of up to 15% of the project costs, to a maximum of $20,0. This loan will be at 0% interest for a term of 6 years (including a 1st year deferral of repayment). Owner's equity of 5% will be required to put down into the project. The chart at right is an example of how a home project could be financed. In FY2017, we had one (1) participant in the program, which came in December. The participant is rehabbing an existing house that he will flip. Because there had been little activity, the authorization was not included in the FY2018 spending plan adopted by the Board in December. In the first 28

30 quarter of 2018, the Village has had multiple inquiries and the Village Manager and County Administration have been working on methods to streamline the process and administration of the program. The attached resolution reauthorizes the following for the rest of Funding the down payment/rehab assistance program in FY2017 via Keystone Funds in an amount totaling $3,0. The payment/rehab assistance component of the Program is a loan, to be repaid back to the County and loaned out again for continual neighborhood revitalization. The down payment/rehab assistance loan will be secured through a subordinate security position on the property. 2. Providing for a 5-year tax abatement on new improvements for all properties successfully participating in the Program. Re: Reauthorization for Pilot Neighborhood Revitalization Program in Peoria Heights RESOLUTION WHEREAS, Peoria County previously authorized up to $3,0 from the County State Capital Improvement Fund (Keystone) for the purposes of funding the Home in the Heights neighborhood revitalization program in the Village of Peoria Heights; and WHEREAS, the program saw one (1) participant in 2017 but multiple inquiries in the first quarter of 2018 prompting the Village of Peoria Heights to request an extension of the County s incentives for 2018; and WHEREAS, much of the housing stock in Peoria Heights was built in the first half of the 20th century, mostly as two-bedroom homes with 1,0 square feet or less which does not accommodate today s modern family needs; and WHEREAS, the housing stock has resulted in declines in population, homeownership, and families residing in and sending their children to school in Peoria Heights; and WHEREAS, a working collaboration of Peoria County, the Village of Peoria Heights, Peoria Heights Community Unit School District #325, Richwoods Township, and the Greater Peoria Economic Development Council have concluded that - if the process of home renovation and addition was clear and streamlined, as well as financially incentivized, families would choose to purchase and live in homes in Peoria Heights; and WHEREAS, this working collaboration is committed to increasing homeownership; increasing EAV; creating quality construction jobs; attracting families; stabilizing and increasing population; stabilizing school population and high mobility rate; and increasing overall quality of life; and WHEREAS, the program itself is envisioned to take a two-pronged approach of easing the development process in the Village of Peoria Heights and incentivizing new construction, rehabilitation, and the expansion of homes; and WHEREAS, the County of Peoria finds that both the Down Payment/Rehab Assistance revolving loan fund for this Program will serve the interest of the County and the entire community by stimulating economic revitalization. This agreement has been extended on several occasions, the last being in December 2017, with an end date of June 30, Starting July 1, 2018 (State Fiscal Year 2019), it is anticipated that the County's state and federal transportation grant funding (Downstate Operating Assistance and Section 5311 funds) will be passed through to GPMTD for direct oversight and management of the grant funds. IDOT is thus requesting a resolution from both the County and GPMTD agreeing to this fiduciary change in control over the grant funding. The Pavement Management Program was created with the assistance of Bradley University in During that time, the entire County road network was inventoried and evaluated. Due to the wear and tear the roads receive, as well as the preventative maintenance methods that have been applied, it is necessary to periodically update the pavement conditions in the program. This contract will update one half of the County road network. A Pavement Management Program has been defined as a set of tools or methods that assist decision-makers in finding optimum strategies for providing, evaluating and maintaining pavements in a serviceable condition over a period of time. The benefits of a Pavement Management Program are substantial and can help an agency employ more costeffective treatment strategies, allocate funds to the pavement sections that will give the best performance for the funds allocated, and improve the quality of the agency pavement network". Specifically, the implementation of a Pavement Management Program provides a systematic procedure to search, organize, and save pavement information and allows agencies to understand the consequences of deferred maintenance. In addition, a Pavement Management Program seeks to minimize costs of individual projects, use available resources more efficiently, and support agency decision-making. Data received from previous surveys are used to prioritize the annual seal coating program on Peoria County Highways. Additionally, this information is used each year to populate the Highway Department's report for the International City / County Management Association. The data has also been used for the financial analysis of the County's infrastructure and is the back bone of the data being used to decide on a future bond issue for road and bridge funding. R36), designated as Illinois Commerce Commission Stipulated Agreement BACKGROUND/DISCUSSION: The Peoria County Highway Department was contacted by the Illinois Commerce Commission to request that the County take part in a safety project on Kingston Mines Road (C.H. R36) at the highway-rail grade crossing of Keokuk Junction Railway s track near Glasford. The crossing is designated as AAR/DOT #801647K, railroad milepost TPWM. The proposed work includes installation of automatic flashing light signals and gates, raising the railroad tracks 8.6, improving the pavement to match the new track elevation, tree trimming, and installation of signs and pavement markings. Peoria County has been requested to pay a portion of the lights and gates, trim trees 3 each side of the tracks, and to install new signage and pavement markings. The project, estimated at $215,994, will be paid for with 85% Grade Crossing Protection Fund (GCPF), 10% County, and 5% Keokuk Junction Railway, if approved. The estimated cost to the County for the signals and gates is $21,599. Tree trimming, sign installation, and pavement marking installation will be completed as a part of the Highway Department s regular maintenance program. Additionally, the Highway Department will replace two culverts before the pavement work is started with the maintenance crew as part of normal maintenance operations. This resolution will allow the Highway Department to take part in the project, and appropriates $25,0 for the signal and gate installation in case there are cost overruns. 101 AGENDA BRIEFING COMMITTEE: Executive Committee LINE ITEM: MEETING DATE: March 27, 2018 AMOUNT: ISSUE: For RESOLUTION: Grant permission to relocate the Peoria County Civil War Memorial to Springdale Cemetery BACKGROUND/DISCUSSION: The first documented Civil War Memorial in Illinois was dedicated on the Peoria County Courthouse Grounds on October 11, It is NOT the Soldiers and Sailors Monument present today near the intersection of Main and Adams Streets. The Memorial stood on the Grounds until being dismantled and removed in the early 1960s as part of the construction of the current Courthouse. Since that time, pieces of the Memorial have been stored at or near Detweiller Marina. A group of concerned citizens and the Springdale Foundation have been working for several years to locate all the pieces of the Memorial. Except for the limestone American Eagle that topped the Memorial, all the other components of the Memoria have been located. Over time, the limestone Eagle has disintegrated. The group of citizens and Foundation have been working with the Peoria Park District (owner of the Marina property) and the trustees of the Springdale Cemetery Board to restore and relocate the Memorial to Springdale Cemetery. The Foundation is poised to announce a large gift towards the cost of restoration. The citizen group and Foundation request the County Board authorize the relocation of the Memorial as owner of the Memorial. Strangely enough, the County Board of Supervisors in 1865 voted to have the Memorial erected at Springdale. In a subsequent vote in 1866 the Board changed the location to the Courthouse Grounds for no known reason. At this time, there is no request for the County to fund: transportation from Detweiller Marina to Springdale Cemetery; restoration and reassembly, rededication, nor ongoing maintenance. It has been documented that the American Eagle was the inspiration for the corporate logo of Case International. A grant is being pursued through s Case s corporate foundation to recreate the Eagle. Additionally, the American Eagle has been documented to have been the inspiration of the logo for the 101st Airborne Division (Screaming Eagles) of the United States Army. The Division has expressed playing a role, possibly financially, in any rededication ceremonies once restored.
