The purpose of the Amendment to the Wetzel County Enhanced 911 County Ordnance s for the Wetzel County E-911 call center to serve all ctzens resdng wthn the muncpal boundary of Paden Cty, WV wth E-911 emergency call servce regardless of whether they resde n Wetzel or Tyler County. 2) The Tyler County Commsson hereby grants unto the Wetzel County Commsson full power and authorty to make any and all necessary arrangements wth the Publc Servce Commsson, telephone companes, utlty companes, ndvduals, or any other entty n order to provde E-91 1 servces to the Muncpalty of Paden Cty as set forth n ths Agreement. 3) All E-91 1 fees for resdents of Paden Cty located wthn Wetzel County shall contnue to be collected by the Wetzel County Commsson. 4) All E-91 1 fees for resdents of Paden Cty located wtt@yler County shall contnue to be collected by the Tyler County Commsson. 5) The Wetzel County commsson shall assume full responsblty for mantanng an effectve E-91 1 system for all resdents of the muncpalty of Paden Cty. 6) The Tyler County Commsson shall pay an annual fee of Two Hundred Ffty and 00/100 ($250.00) Dollars to the Wetzel County Commsson for provdng E- 911 servce to the Tyler County resdents of Paden Cty. Sad fee shall be payable on the 1 St day of August of each year commencng on August 1, 2001. 7) All costs and expenses ncurred n convertng Paden Cty, Tyler County resdents to the Wetzel County E-9 1 1 Emergency Telephone Communcaton Center shall be equally pad by the Tyler County Commsson and the Wetzel County Commsson.

8) In the event ths agreement s held to be nvald by the Publc Servce I Commsson or the Tyler County Commsson s prohbted from recevng the E-91 1 fees of Paden Cty, Tyler County resdents for any reason, ths agreement shall be termnated and all costs and expenses ncurred n convertng Paden Cty, Tyler County resdents back I to the Tyler County E-91 1 Emergency Telephone Communcaton Center shall be equally pad by the Tyler County Commsson and the Wetzel County Commsson. 9) Ether party to ths Agreement may termnate the same any tme upon nnety (90) days wrtten notce to the other party. In the event of such termnaton all costs and expenses ncurred n convertng Paden Cty, Tyler County resdents back to the Tyler County E-91 1 Emergency Telephone Communcaton Center shall be pad by the party exercsng the rght of termnaton. 10) The partes agree to amend ther respectve E-9 11 fnal plans n accordance wth West Vrgna Code 24-6-6(e).
