GUIDE TO FILING THE DECLARATION OF FILING DAY FINANCES AND PERMISSIVE FUNDS REPORT 2018 STATEWIDE, GENERAL ASSEMBLY AND STATE BOARD OF EDUCATION CANDIDATES DECLARATION OF FILING-DAY FINANCES REPORT PERMISSIVE FUNDS REPORT R.C. 3517.109 FILING DEADLINE: February 14, 2018 for campaign committees of candidates for the office of member of the General Assembly and Statewide candidate campaign committees August 15, 2018 for campaign committees of candidates for the office of State Board of Education

OVERVIEW Campaign committees of candidates running for member of the General Assembly or Statewide Office, including State Board of Education, in the year 2018 must file a statement indicating the status of their finances in preparation for the 2018 campaign. These statements include the Declaration of Filing-Day Finances (Form 31-W), the Waiver of Declaration of Filing-Day Finances (Form 31-AA) and the Permissive Funds Report (Form 31-W). Form 31-W is the cover page for both the Declaration of Filing- Day Finances and the Permissive Funds Report. Campaign committees of candidates for Chief Justice of the Supreme Court or Justice of the Supreme Court are not subject to R.C. 3517.109 and do not have filing requirements related to the Declaration of Filing Day Finances. Prior to filing Form 31-W, a campaign committee should first check to see if it qualifies for the Waiver of Declaration of Filing Day Finances (From 31-AA). If eligible to file the waiver, a campaign committee does not have to file the Declaration of Filing Day Finances and Permissive Funds reports. When to File Whether filing the Waiver of Declaration of Filing Day Finances or the Declaration of Filing Day Finances and Permissive Funds Report, either must be received within seven days following the petition filing deadline. For General Assembly and Statewide candidates, the petition filing deadline is February 7, 2018, meaning either form must be received by February 14, 2018. For nonpartisan offices, including the State Board of Education, the petition filing deadline is August 8, 2018, making the forms due no later than August 15, 2018. ABOUT THE DECLARATION OF FILING DAY FINANCES R.C. 3517.109 requires that campaign committees review their account and contribution history upon filing petitions to run for offices subject to contribution limits. A statement detailing the account status of a campaign committee may be required, which may also require the disposal of excess funds (see Permissive Funds Report section below). CALCULATING THE PRE-FILING PERIOD Determining the pre-filing period is an important step regardless of whether you file the waiver or the full reports. The pre-filing period of a campaign committee begins on the latest of three dates, as described in R.C. 3517.109(A)(9): January 1st of the year following the general election in which that state office was last on the ballot; January 1st of the year following the general election in which the candidate was last a candidate for any office; The first day of the month following the primary election in which the candidate was last a candidate for any office. The pre-filing period ends on the declaration of candidacy or nominating petition filing deadline. Declaration of Filing-Day Finances Report / Permissive Funds Report 1 Instruction Manual Nov. 2017

FILING THE WAIVER OF DECLARATION OF FILING DAY FINANCES The campaign committee of a candidate is eligible to file a Waiver of Declaration of Filing Day Finances (Form 31-AA) if the following two conditions are met: 1. The campaign committee did not accept any contributions during the pre-filing period in excess of the contribution limits set forth in R.C. 3517.102; and 2. The campaign committee had a cash-on-hand balance less than the carry-in amount at the beginning of the pre-filing period. The carry-in amount is based on office being sought and is set as follows: House or State Board of Education $35,000 Senate $100,000 Statewide $200,000 If the committee meets both of these criteria, it may file a Waiver of Declaration of Filing Day Finances. If the committee accepted any excess contributions or had a balance on hand larger than the carry-in amount, then it must file the Declaration of Filing Day Finances and Permissive Funds Report (Form 31- W). All waivers must be received by the February 14, 2018 or August 15, 2018 deadlines described above. Example 1: A house member is running for re-election in 2018. Both the candidate and the office were last on the ballot in 2016. The candidate did not run for any office in 2017. The pre-filing period begins on January 1, 2017. The candidate looks back to her cash-on-hand balance on January 1, 2017 and determines it was $15,000, and the candidate did not accept any contributions in excess of the limits. This candidate qualifies to file a Waiver of Declaration of Filing Day Finances because the cash-on-hand balance at the beginning of the pre-filing period was less than the carry-in amount of $35,000. Example 2: A current house member is running for Senate in 2018. The candidate was last on the ballot in November 2016 and the office was last on the ballot in November 2014. The candidate did not run for any office in 2017. The pre-filing period begins on January 1, 2017. The candidate looks back to his cash-on-hand balance on January 1, 2017 and determines it was $115,000. The candidate did not accept any contributions in excess of the limits. This candidate does not qualify to file a Waiver of Declaration of Filing Day Finances because the cash-on-hand balance at the beginning of the pre-filing period exceeded the carry-in amount of $100,000. This candidate must file the Declaration of Filing Day Finances Report. FILING THE DECLARATION OF FILING-DAY FINANCES AND PERMISSIVE FUNDS REPORT If the campaign committee does not qualify for the waiver, then it must file the Declaration of Filing Day Finances and Permissive Funds Report. The cover page for this report provides an overview of the committee s finances and determines the amount of permitted funds and the amount of excess funds that Declaration of Filing-Day Finances Report / Permissive Funds Report 1 Instruction Manual Nov. 2017

must be disposed, if any. The following information can be used to complete the Declaration of Filing Day Finances and Permissive Funds Report and to determine if the committee has excess funds. Calculating Cash and Assets on Hand The committee must calculate the sum of the cash on hand and the assets available to the campaign committee on the filing day deadline (February 7, 2018 or August 8, 2018, dependent upon the office sought). Line 1 of the form should be completed with the amount of cash on hand on the filing day deadline and Line 2 should be completed with the value of all campaign assets 1 available to the campaign committee on the filing day deadline. The sum of Lines 1 and 2 should be placed in Line 7 of the Permissive Funds section of the cover page. If the campaign committee has reportable assets in Line 2, those assets should be listed on the Statement of Assets (Form 31-X) and attached to the Declaration of Filing Day Finances and Permissive Funds Report. Calculating Total Permitted Funds Total Permitted Funds are calculated by adding together the Total Allowable Aggregate Contributions Received (Line 3) and the Applicable Carry-In Limit (Line 6) (see Filing the Waiver of Declaration of Filing Day Finances section, above). This sum of Lines 3 and 6 should be placed in Line 8 of the Total Permitted Funds section of the cover page. Total Allowable Aggregate Contributions Allowable Aggregate Contributions are those contributions received during the pre-filing period that are not in violation of the contribution limits set forth in R.C. 3517.102. Please refer to the attached contribution limit chart to determine these limits. If all the contributions received were within the prescribed limits, then all the contributions received during the pre-filing period are Allowable Aggregate Contributions. If any contributions received are in excess of the prescribed limits, then those become excess aggregate contributions and the amount of excess aggregate contributions should be entered on Line 5 of the report. If there are excess aggregate contributions, they are considered excess funds and campaign committee must dispose of the excess amount (see Disposing of Excess Funds section, below). If the campaign committee has any excess aggregate contributions, those should be listed on the Statement of Excess Aggregate Contributions Received During the Election Period (Form 31-Y). Example 3: A candidate for Senate s campaign committee raised $250,000 during the pre-filing period, all of which were allowable aggregate contributions because all were within the prescribed contribution 1 For the purpose of these reports, campaign assets are prepaid, purchased or donated items or services that are available for use by the campaign committee, that have a value greater than $500, and that will be consumed or depleted during the course of the campaign. Examples include prepaid media time, postage or prepaid consulting or advertising services. See R.C. 3517.109(A)(12) and (F)(2)(b). limits. The campaign committee s total permitted funds are $350,000, which is the sum of the allowable aggregate contributions ($250,000) and the carry-in limit ($100,000). Example 4: A candidate for Treasurer raises $750,000 during the pre-filing period. However, this candidate inadvertently accepts a contribution that is $1,000 over the prescribed contribution limits. This candidate s total allowable aggregate contributions received is only $740,000. The campaign committee s total permitted funds are $940,000, which is the sum of the allowable aggregate contributions ($740,000) and the carry-in limit ($200,000). The committee must dispose of the $1,000 that was over the allowable limit, as it is an excess aggregate contribution. Calculating Excess Funds In addition to having excess funds from excess aggregate contributions, a campaign committee can have excess funds if the Cash and Assets on Hand balance exceeds the Total Permitted Funds amount. If the Cash and Assets on Hand total does not exceed the Total Permitted Funds amount, and there were no excess aggregate contributions, then there are no excess funds. In completing the form, if the Line 8 total is greater than the Line 7 total, the committee can simply enter N/A in box 9 as there are no excess funds. Example 5: A house candidate s committee did not qualify to file the waiver and raised $100,000 during the pre-filing period, all within the applicable contribution limit amounts. The Total Permitted Funds for this committee is $135,000 (contributions added to the carry-in amount). On filing day, the campaign committee had no assets and $110,000 cash-on-hand. Because the Cash and Assets on Hand total is less than the Total Permitted Funds amount, the campaign committee does not have any excess funds. Example 6: The campaign committee for a senator seeking re-election raises $400,000 during the preelection period, making the Total Permitted Funds amount $500,000 (contributions added to the carry-in amount). On filing day, the campaign committee had assets totaling $2000 and a cash-on-hand balance of $515,000. The Cash and Assets on Hand total is $517,000, which exceeds the $500,000 in permitted funds by $17,000. The $17,000 is excess funds. If a campaign committee has excess funds, the committee must dispose of the excess amount by the petition filing deadline. Any candidate whose campaign committee fails to dispose of the excess amount in the prescribed time may not appear on the ballot. See R.C. 3517.109(D). DISPOSING OF EXCESS FUNDS If a campaign committee has excess funds, the committee must expose of all excess funds by the petition filing deadline of either February 7, 2018 or August 8, 2018, depending on the offices sought as described above. This deadline is prior to the filing of the Declaration of Filing Day Finances and Permissive Funds Report. A campaign committee may dispose of excess funds in any of the following ways: Refunding all or part of an individual contribution; Giving the excess to a tax-exempt entity; or Giving the excess to the Ohio Elections Commission Fund. If a campaign committee has excess funds, it must report the disposal of those funds using the Statement of Disposal of Excess Funds and Excess Aggregate Contributions (Form 31-Z) and include that form with the Declaration of Filing Day Finances and Permissive Funds Report filing. ADDITIONAL EXAMPLES Example 7: A current city council member who last appeared on the ballot in November 2014 is a house candidate. The campaign committee for this candidate had $30,000 cash-on-hand on January 1, 2017 at the start of the pre-filing period. During the pre-filing period, the campaign committee raised a total of $100,000. However, the campaign committee did receive a contribution that was $5000 over the allowable contribution limits. Because of this, this campaign committee does not qualify for the waiver. The campaign committee s cash-on-hand balance on filing day is $120,000 and it has no assets. The campaign committee should complete the balance section of the Declaration of Filing Day Finances and Permissive Funds Report as follows: In addition filing the Form 31-W, the campaign committee is also required to file the Statement of Excess Aggregate Contributions Received During the Election Period (Form 31-Y) listing the excess contribution and also the Statement of Disposal of Excess Funds and Excess Aggregate Contributions (Form 31-Z) to disclose how the excess aggregate contributions were disposed. Example 8: A current member of the Senate is running for Attorney General. The candidate and the office were both last on the ballot in November of 2014. The pre-filing period begins on January 1, 2015. The campaign committee had a cash-on-hand balance of $300,000 at the beginning of the pre-filing period, and did not accept any contributions over the prescribed contribution limits. This campaign committee does not qualify for the waiver because the cash-on-hand balance was over the $200,000 carryin amount on January 1, 2015. During the pre-filing period, the campaign committee received contributions totaling $800,000, all within the prescribed contribution limits. On the filing deadline, the campaign committee has $900,000 cash on hand and $50,000 in assets. The campaign committee should complete the balance section of the Declaration of Filing Day Finances and Permissive Funds Report as follows: The campaign committee is also required to file the Statement of Assets (Form 31-X) to disclose the $50,000 in assets. However, because the committee had no excess funds or excess aggregate contributions, those additional forms are not required. Example 9: A campaign committee for a first-time candidate who is running for the house had $5,000 on January 1, 2017, the beginning of the pre-filing period. The campaign committee did not raise any contributions over the prescribed contribution limits. Having raised $2,000,000 during the pre-filing period, the campaign committee has a cash-on-hand and asset total of $1,750,000 on the filing deadline. The campaign committee s total permitted funds are $2,035,000. However, this campaign committee does not need to file the full report because the cash-on-hand total of $5,000 at the beginning of the prefiling period allows the campaign committee to file the Waiver of Declaration of Filing Day Finances. Example 10: An incumbent member of the Senate is running for re-election. The Senator did not run for any other office since being elected to the current office. The beginning of the pre-filing period is January 1, 2015. The campaign committee does not qualify for the waiver because the cash-on-hand balance on January 1, 2015 was $250,000, which is over the $100,000 carry-in amount. During the prefiling period, the campaign committee raised $450,000, all within the prescribed contribution limits. On the filing deadline, the cash-on-hand balance is $575,000 and the campaign committee has assets totaling $10,000. The campaign committee should complete the balance section of the Declaration of Filing Day Finances and Permissive Funds Report as follows: In addition filing the Form 31-W, the campaign committee is also required to file the Statement of Assets (Form 31-X) detailing the campaign committee s assets, and the Statement of Disposal of Excess Funds and Excess Aggregate Contributions (Form 31-Z) to disclose how the excess funds were disposed. POINTS TO REMEMBER Only those candidate filing petitions for the 2018 primary election are required to file these reports no later than February 14, 2018. Independent or candidates for non-partisan office must file no later than August 15, 2018. Incumbent officeholders or candidates not seeking election in 2018 are not required to file these reports. Waiver of Declaration of Filing Day Finances Form 31-AA R.C. 3517.109(G) Due: not later than seven days after the petition filing deadline. Any candidate who does not file this waiver must file a Declaration of Filing-Day Finances not later than seven days after the petition filing deadline. The (Committee's Name) campaign committee established for the candidacy of (Candidate's Name) who is seeking the office of (Office sought; if general assembly, or state board of education include district) to appear on the ballot in the year (Year) attests that: 1. the campaign committee did not accept any aggregate contribution from a contributor in excess of the limits provided in R.C. 3517.102 during the pre-filing period as defined in R.C. 3517.109; and 2. the campaign committee had less than the carry-in amount in cash on hand at the beginning of the pre-filing period, if applicable. (House candidates $35,000, Senate candidates $100,000 and statewide candidates $200,000.) Therefore the undersigned attests that the campaign committee is not required to file a Declaration of Filing-Day Finances. This statement made under the penalty of election falsification. Form 31-W Instructions This form is used ONLY by the campaign committees of statewide, general assembly and state board of education candidates. Campaign committees of candidates for justice or chief justice of the Supreme Court do not have to file this form. A Permissive Funds Report must be filed by any statewide, general assembly or state board of education candidate who is required to dispose of excess funds or excess aggregate contributions. A Declaration of Filing-Day Finances must be filed by any statewide, general assembly or state board of education candidate who files a declaration of candidacy or nominating petition for a state office. The Declaration of Filing-Day Finances is not necessary if the campaign committee files a Waiver of Declaration of Filing-Day Finances Form No 31-AA [R.C. 3517.109]. Cover pages identify who filed the report and what type of report is being filed. They also summarize the detail inside the report. Do not use the cover page as a substitute for listing information on the appropriate form. Form 31-X Instructions This form is used ONLY by the campaign committees of statewide, general assembly and state board of education candidates. This form is only filed as part of a Permissive Funds Report and Declaration of Filing Day Finances filing when necessary. It is not ever part of a regularly filed campaign finance report. The Statement of Assets lists non-monetary assets available to a committee on the filing deadline for the office that the candidate is seeking. Any prepaid, purchased, or donated assets worth $500 or more that will be consumed or depleted during the course of the campaign need to be listed. Some examples of this type of asset include, but are not limited to: postage, prepaid radio, television and newspaper advertising, prepaid rent for campaign headquarters, personal services and prepaid consulting services [R.C. 3517.109(A)(12)]. Items such as computer equipment or furniture that will not be consumed or depleted during the campaign do not need to be listed. A brief, accurate description of each campaign asset should be entered into the box marked. This form is used to list the methods by which excess funds and excess aggregate contributions were disposed. The excess amount disposed of may be in the form of campaign funds or campaign assets. The full name and address of the individual or entity to which the funds or assets are given must be entered into the appropriate blocks. Date blocks should be completed with six digits. For example, February 20, 2010, would appear as 02 20 10. If the excess given was monetary, enter the actual dollar amount in the Value block. When disposing of campaign assets, the Value block should reflect the fair market value of the asset.
