x AN ORDINANCE OF THE CITY OF RAVENSWOOD, WEST VIRGINIA, AMENDING THE ORDINANCE REQUIRING SECURITY DEPOSIT FOR CITY SERVICES CUSTOMERS. Be it ORDAINED and ENACTED by the Common Council of the City of Ravenswood as follows: (a) Every new customer for City services shall deposit with the City Clerk's Office before such services shall be furnished, the sum of Seventy-Five ($75.00) Dollars which sum shall be held by the City as and for security or credit against any unpaid City services billed to the customer and which sum may be applied against such unpaid services by the City at any time after thirty (30) continuous calendar days of nonpayment and notification of same to the customer. (b) The security deposit hereunder shall be deposited by the City to an interest bearing insured account after a banking institution selected by the City Council and shall be refunded, in whole or part, with accrued interest, to the customer, within a reasonable time following the cessation of City services to such customer and determination of the account status of such customer. (c) City services includes water, sewage, refuse collection, street maintenance, fire and police protection, recreation and street lighting and such other public services as may form time to time be hrnished by the City to its residents and businesses. The foregoing Ordinance was introduced and read by title, by City Attorney Roger Williams, at the regular meetings of the Common Council of the City of Ravenswood on January 5,20 10, and January 19,20 10, and the following publication of Notice of same as a 1-0 legal advertisement in accordance with statute on January 7, 20 10, and after discussion thereon Recorder Garrett moved that the said Ordinance be adopted as read. The motion was seconded by Councilman Romeo, and thereupon the Mayor called for a vote and the following voted AYE: Recorder Garrett, Council members Kelly, Romeo, Sharp and Wiseman. Thereupon the Mayor declared this motion duly passed and the Ordinance once adopted in the year 1998 was once again passed do the requirements of the Public Service Commission on the 1 gth day of January, 201 0, to remain in effect upon passage. On all current usage billings not paid within twenty (20) days, ten percent (1 0%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where if is appropriate. RETURNED CHECK CHARGE Whenever a check is returned for in sufficient funds, a service charge of $25.00 or the actual cost to the utility, whichever is less, shall be charged. (I) SECURITY DEPOSIT - WATER $75.00 A refundable security deposit of 2/12' of the estimated annual charge of $75.00 shall be required prior to service being connected or reconnected. Said deposit will be refunded with interest as stated in the Rules after 12 consecutive months of on time payments.
