STATE OF ARKANSAS EXECUTIVE DEPARTMENT PROCLAMATION TO ALL TO WHOM THESE PRESENTS SHALL COME - GREETINGS: WHEREAS: An extraordinary occasion has arisen making it necessary to convene the 90 th General Assembly into extraordinary session; and WHEREAS: The creation of jobs and economic growth is critical to improving the lives of the citizens of the State of Arkansas; thus there is a need to issue general obligation bonds to effectively compete for and attract large economic development projects. There is a need for the General Assembly, pursuant to Amendment 82 of the Arkansas Constitution, to authorize the Arkansas Development Finance Authority to issue general obligation bonds to finance infrastructure or other needs to attract large economic development projects; and WHEREAS: In order to promote economic growth in Arkansas, it is anticipated Arkansas Highway 63 will be designated as I-555; thus there is a need for the General Assembly to amend Ark. Code Ann. 27-35-210(a)(2)(A)(iv) and (C)(iii) to allow agricultural vehicles to continue to utilize that roadway; and WHEREAS: There is a need to increase efficiency in services provided by the State and provide for cost savings in delivery of these services by combining overlapping functions and eliminating duplication of functions in state government; and WHEREAS: There is a need to amend Arkansas election laws concerning the time for election and candidacy filing dates; and WHEREAS: There is a need to amend Arkansas law concerning the time for the General Assembly to meet in fiscal session; and 1 st Day's Proceedings - May 26, 2015 90 th General Assembly
3 WHEREAS: There is a need to amend Arkansas law concerning the mental state required in Ark. Code Ann. 5-65-103 to ensure the State remains eligible to receive federal safety incentives pursuant to 23 USC 161 and 163 preventing operation of vehicles by intoxicated persons; and WHEREAS: There is a need to honor the life and service of Johnson County Sheriff's Office Auxiliary Deputy Sonny Smith, who served as a non-paid, volunteer officer; and WHEREAS: There is a need to correct engrossment errors created in Acts passed during the regular Session of the 90 th General Assembly. WHEREAS: There is a need to increase efficiency in services provided by the State and provide for cost savings in delivery of these services by combining overlapping functions and eliminating duplication of functions in state government; and NOW THEREFORE, I, ASA HUTCHINSON, Governor of the State of Arkansas, by virtue of the power and authority vested in me by Article 6, Section 19 of the Arkansas Constitution, do hereby call an Extraordinary Session of the General Assembly to convene in Little Rock on Tuesday, May 26, 2015, at 3:00 p.m., and I do hereby specify that the General Assembly is convened in such Session to consider, and, if so advised, enact laws for the following purposes: 1. To provide for the payment of expenses and per diem of the House of Representatives and the Senate for this Extraordinary Session; 2. To declare the proposed project a qualified Amendment 82 project, authorize the execution of the Amendment 82 agreement in substantially the same form as presented to the General Assembly, and authorize the issuance of Amendment 82 bonds; 3. To amend Ark. The Arkansas Building Authority to the Department of Finance and Administration; and d. The Division of Land Surveys of the Arkansas Agriculture Department to the Arkansas Geographic Information Office; 5. To amend Arkansas law concerning the mental state required in Ark. Code Ann. 5-65- 103; 6. To amend Arkansas election laws to move the Preferential Primary and General Primary election dates to march, and the candidacy filing dates; 7. To amend Arkansas law concerning the time for the General Assembly to meet in fiscal session during the month of April and to change associated reporting dates accordingly; 8. To amend Arkansas law containing engrossment errors created during the 90 th General Assembly; 9. To honor Johnson County Sheriff's Office Auxiliary Deputy Sonny Smith, who served as a non-paid, volunteer officer; and 10. To confirm gubernatorial appointees. 5 Speaker Gillam addressed the 90th General Assembly. Representative Gossage moved that the House suspend, for the duration of this special session, House Rule 41 requiring bills to be on the desk for at least twenty-four (24) hours before final passage and requiring regular bills and resolutions to be on the calendar for two days. 41. A bill shall not be called for a third reading and final passage until a photocopied, printed copy, or electronic copy of same shall have been placed on every representative s desk for twenty-four (24) hours. The twenty-four (24) hour period begins when a bill is initially introduced and read across the desk. No regular bill or resolution may be brought up for a third reading and final passage on the Floor of the House until it has been on the calendar of the House for at least two (2) days. Representative Gossage moved that the House suspend, for the duration of this special session, House Rule 60 (a) - setting minimum lengths of time for notice of committee meetings. 60.(a) All committee and subcommittee meetings including but not limited to hearings at which public testimony is to be taken, (normally called public hearings ) shall be open to the public (Art. 5, Sec. 13) and shall be scheduled at least eighteen (18) hours in advance; agendas of bills, resolutions, and other proposals to be considered at such meetings shall be posted in a designated place at least eighteen (18) hours in advance; but in case of an emergency, a two-thirds (2/3) majority of the membership of the committee may bring bills up for consideration upon notice of not less than two (2) hours. 90 th General Assembly May 26, 2015-1 st Day's Proceedings
